STATE OF MAINE Commission Meeting 09/30/2020 COMMISSION ON GOVERNMENTAL ETHICS Agenda Item #5 AND ELECTION PRACTICES 135 STATE HOUSE STATION AUGUSTA, MAINE 04333-0135 To: Commission From: Michael Dunn, Esq., Political Committee Registrar Date: September 22, 2020 Re: Complaint against Public Opinion Research On September 15, 2020, the Commission received a complaint from the Lincoln County Democratic Committee (the “LCDC”) alleging that unknown persons acting under the name of Public Opinion Research have engaged in a “push poll” to influence the general election for State Senate, District #13. ETH 1-8. Voters have received phone calls from live callers asking questions that are likely designed to influence their vote and text messages linking to an online survey conducted through the SurveyMonkey.com containing similar questions. According to the LCDC, the organizers of the telephone campaign have violated three disclosure requirements in Maine Election Law: • the callers have not provided any “disclaimer statement” identifying who paid for the calls, • the calls do not meet special disclosure requirements applicable to push polls in Maine, and • no independent expenditure report has been filed relating to the calls, text messages, and online survey. The LCDC requests that the Commission initiate an investigation into these activities. The Commission staff has been unable to make contact with Public Opinion Research as part of our preliminary investigation. We cannot find an online presence for a polling or political consulting firm with that name. A “push poll” is a paid influence campaign conducted in the guise of a telephone survey. The telephone calls are designed to “push” the listener away from one candidate and towards another candidate. -

We are grateful for the passage of the CARES Act and the assistance it will provide, but in its current form, we are concerned that the funding Maine will receive cannot be used to address the massive losses in state revenue we expect to incur due to the coronavirus. Current guidance requires that approximately $1.25 billion of the funding Maine is expected to receive must be used for expenditures that: (1) are necessary expenditures incurred due to the public health emergency with respect to COVID–19; (2) were not accounted for in the budget most recently approved as of March 27, 2020 for the State or government; and (3) were incurred during the period that begins on March 1, 2020, and ends on December 30, 2020. These significant restrictions, and an inability to specifically use these funds to offset revenue shortfalls, will seriously inhibit Maine’s ability to respond to this crisis. More flexible federal funding will help us continue to provide vital services, prevent further shutdown of key sectors of the state economy and hasten recovery once social distancing measures are relaxed. -

President Biden’s ambitious $1.9 trillion American Rescue Plan will go a long way towards alleviating the significant financial strain COVID-19 has placed on our states, counties, cities, and schools, and the pocketbooks of working families. Working people have been on the frontlines of this pandemic for nearly a year and have continued to do their jobs during this difficult time. Dedicated public servants are still leaving their homes to ensure Americans continue to receive the essential services they rely upon: teachers and education workers are doing their best to provide quality education and keep their students safe, janitors are still keeping parks and public buildings clean, while healthcare providers are continuing to care for the sick. Meanwhile, it has been ten months since Congress passed the CARES Act Coronavirus Relief Fund to support these frontline workers and the essential services they provide. Without significant economic assistance from the federal government, many of these currently-middle class working families are at risk of falling into poverty through no fault of their own. It is a painful irony that while many have rightly called these essential workers heroes, our country has failed to truly respect them with a promise to protect them and pay them throughout the crisis. -

COVID- 19 is not only rampaging through our healthcare system, it is ravaging our economic security as well. It is with this in mind, that we ask you to propose a federal waiver within the Unemployment Insurance Benefits program to allow sole proprietors to collect benefits while the state and the nation are reeling from the insecurity accompanying the Coronavirus pandemic. Small businesses in Maine pay into state unemployment insurance and federal unemployment insurance pools for their employees. These same small business owners do not always count themselves as employees, rather they earn their salaries through the company’s profit. This means at times, they do not take home any salary at all. -

Barton (1935-2006) Chief Barton served the community of Gray for over three decades as a member of the Gray Fire and Rescue Department. In 1959, he joined Gray Fire-Rescue at the age of 23. Jon was later promoted to an offi cer position and was named Chief of the Department in 1987. He was past president of the Maine Fire Chiefs Association, the Cumberland County Fire Chiefs Association, the Coastal Mutual Aid Chiefs Association and the New England Association of Fire Chiefs. Maine Legislature 2 STATE HOUSE STATION AUGUSTA, MAINE 04333-0002 January 18, 2021 Commissioner Michael Sauschuck Department of Public Safety 45 Commerce Drive, Suite 1 104 State House Station Augusta, Maine 04333 Dear Commissioner Sauschuck, As elected representatives, we are extremely concerned about recent posts and comments made by Maine Bureau of Capitol Police Chief Russell Gauvin on social media. Chief Gauvin expressed support for conspiracy theories that led to the violent insurrection against the government at the U.S. Capitol on January 6, 2021 and the death of two police officers. His words portray an inability to neutrally provide for the safety of every member of the Legislature. At this historic juncture in which there are viable, coordinated threats against lawmakers, we find Chief Gauvin’s comments reprehensible, and his apology utterly insufficient. We believe Police Chief Gauvin should be immediately placed on administrative leave while a full and transparent investigation takes place, and next steps are determined. Those who commit to public service are held to a higher standard for public comments. The words of Police Chief Gauvin made in recent months and reported over several years have diminished our trust in his ability to serve in his current role. Many of us may never feel safe at the Maine State House facility again so long as Chief Gauvin is in charge of security or a member of the Capitol Police. OPEN ViewPDF.io State legislative seats that changed party control, 2018 PRIMARY ELECTIONS FEDERAL ELECTIONS STATE ELECTIONS LOCAL ELECTIONS VOTER INFORMATION On November 6, 2018, 6,073 seats were up for election across 87 of the nation's 99 state legislative chambers. As a result of the elections, control of 508 seats was flipped from one party to another. 2018 State Democrats gained a net 308 seats in the 2018 elections, Republicans lost a net 294 seats, and third legislative elections party and independent candidates lost a net 14 seats. At least one flip occurred in every state except Louisiana, Mississippi, New Jersey, and Virginia, which did not hold state legislative elections in 2018. « 2017 2019 » New Hampshire had 77 seats flip, the most of any state. Sixty-seven of those seats flipped from Republicans to Democrats, seven from Democrats to Republicans, two from third party legislators to Republicans, and one from a third party legislator to a Democrat. Maine followed with 26 flips, including 16 Republican seats to Democrats, two Democratic seats to Republicans, three Republican seats to third party candidates, and five third party seats to Democrats. The only other state with more than 20 flips was Pennsylvania, with 19 Republican seats flipping to Democrats and three Democratic seats flipping to Republicans. Six state legislative chambers flipped control in 2018, including both chambers of the New Hampshire General Court, the state senates of Colorado, Maine, and New York, and the Minnesota House of Representatives.
