APPLICATION FOR A NON ESTABLISHED MARKET LICENCE/CONSENT

Applicants should read the following notes before completing the form.

1. Documents to be produced:

• A completed application form with the appropriate fee • An endorsed passport sized photograph of the applicant • A copy of the certificate of insurance covering third party and public liability risks to the level of £5 million. • Disclosure and Barring Certificate. The event organiser must apply for a basic disclosure online via https://www.gov.uk/request-copy-criminal- record • Proof of Registration with Food Safety • Gas Safety Cetificate (if applicable) Every mobile catering unit needs to have a current gas safety certificate if it uses Liquid Petroleum Gas (LPG) on the vehicle. This verifies that the vehicle at the time of inspection complied with current gas safety legislation. The certificate should be renewed annually. If you have not got a current gas safety certificate you will need to obtain one. The mobile unit must be inspected by a gas engineer who is qualified in inspecting mobile catering units. To identify a suitable engineer refer to the Gas Safe website. https://www.gassaferegister.co.uk/

2. Disclosure & Barring Service disclosure

All applicants will be required to undergo Basic Disclosure. This needs to be dated within one calendar month on the date of application.

A licence/consent will not be granted until this process is completed.

Please note: spent convictions will not be taken into consideration when determining this application.

3. Renewal Applications

Any application for renewal should be made either by appointment or by post before the licence expiry date. Failure to renew before the expiry of your licence will result in you not being authorised to trade until such time as a new application has been made and a licence/consent granted and issued.

4. Payment of fees

Licence fees must be submitted with the application form. If payment is made by cheque, and the cheque is not honoured, the licence will be invalid with immediate effect. Cheques should be made payable to Durham County Council. Please note if your application is refused, the fee will be refunded minus a £45 administration charge.

APPENDIX A

What is street trading?

Street trading means selling, exposing or offering for sale any article in a street. The term ‘street’ includes any , footway, beach or other area to which the public have access without payment. Street trading activities may include hot and cold food vendors, vendors of non-food products who trade on static pitches or fixed locations from any vehicle, a stall, barrow, trailer, or any other moveable construction. The Council can issue ‘mobile’ consents to the owners of vehicles used as ice cream vans, mobile shops, sandwich vendors etc.

As the definition of “street” includes any land to which the public have access without payment, private land to which the public has free access may also be included. Street trading law and associated policy therefore can extend to events off the highway that are conducted on private premises.

1. CHESTER LE STREET AND SEDGEFIELD AREAS

You do not need to apply for a street trading consent/licence if you wish to trade in Chester Le Street and Sedgefield.

2. WEAR VALLEY AREA

There are three licensed pitches in the Wear Valley area, Collier Wood Lay-by, Westerton lay-by and Crook Market Place.

Vacant pitches will be advertised on Durham County Council’s website.

The following areas are consent streets for organised events only:

Bishop Auckland:

Part of Newgate Street (north end) between the Market Place and the junction with Durham Chare.

Part of North Bondgate from the junction with North Bondgate car park (and including the car park) to the junction of Wear Chare

The following areas are consent streets:

Bishop Auckland Market Place

The following areas are prohibited:

Bishop Auckland: Clayton Street, Finkle Street, Fore Bondgate, George Street, High Bondgate, Part of Newgate Street, Part of North Bondgate, Saddler Street.

Crook: Commercial Street, Church Street, Elliott Street, Hope Street, New Road, North Terrace, Queen Street, South Street.

The layby adjacent to the Council’s licensed layby at Collier Wood.

These prohibited street to include all forecourts, , footways or other areas adjacent to the prohibited streets for a distance of fifty metres, excepting designated licence streets.

To trade in all other areas within Wear Valley you do not need to apply for a street trading consent/licence.

3. TEESDALE AREA

A street trading consent is needed to trade in the following consent streets and consents will only be issued for trading at and during organised events that have been considered and supported by the County Council’s Safety Advisory Group:

Part of Marshall Street / Baliol Street / King Street / Flatts Road / Scar Top / Horsemarket & Market Place (including side road) / The Bank / Newgate / Galgate (including side roads) from its junction with John Street & Montalbo Road to its junction with Horsemarket & Flatts Road / Vere Road (from Flatts Road to Marwood Cottage) / Access road to Galgate Car Park

No other street designations exist in the Teesdale area outside Barnard Castle. You therefore do not need to apply for a street trading consent or licence to trade within any other part of the Teesdale area. Other authorisations and permissions may be necessary.

4. EASINGTON AREA

The following streets bounded by and contained within the former district of Easington Council area are designated as “LICENSED STREETS”

CRIMDON: Crimdon Park

HASWELL: The Cattle Market

PETERLEE: The Broad Close/Surtees Road Car Park/Yoden Way Town Centre/The Chare

WINGATE: Constitutional Club Car Park

SEAHAM: Former garage site at South Terrace

This means you require a Street Trading Licence to trade from these areas.

The following streets bounded by and contained within the former district of Easington Council area are designated as “PROHIBITED STREETS”

GENERAL: Trunk Road A19/Road (A1018)

BLACKHALL: Middle Street (A1086)

CRIMDON: Coast Road (A1086)/Crimdon Terrace (A1086)/Crimdon Park approach road

EASINGTON VILLAGE: Road (B1432)/Seaside Lane/Rosemary Lane/Hall Walk/Low Row/South Side/Thorpe Road (B1432).

EASINGTON COLLIERY: Seaside Lane/Station Road

HASWELL: Salters Lane (B1280)/Front Street/George Street/Chapel Street/North View/ North Road

HASWELL PLOUGH: Road (B1283)/Durham Lane/Front Street

HORDEN: Sunderland Road (A1086)/Coast Road (A1086)/Blackhills Road, Northumberland Avenue/Dene Street/Third Street/Cotsford Lane/Alder Road

SHOTTON: Salters Lane (B1280)/Potto Street/Friar Street/Station Road/Front Street, Bridge Road/Carlyle Crescent.

SOUTH HETTON: Road (A182)/Front Street/Wingate Road.

WHEATLEY HILL: Church Street/Front Street/Alexander Terrace/Granville Terrace, Thornley Road (B1279)/Wingate Lane (A181).

A PROHIBITED STREET is hereby declared and decreed to include all forecourts, roads, footways or other areas adjacent to the prohibited streets referred to above for a distance of fifty metres except where it encroaches on a Licensed Street.

All other streets bounded by and contained within the former district of Easington Council area are designated as “CONSENT STREETS”

This means you require a Street Trading Consent to trade.

5. DURHAM AREA

The following streets are designated as Prohibited Streets which means Street Trading will not be permitted in these areas:

Alnwick Road (part) / Canterbury Road (part) / Carrhouse Drive (part) / Cheveley Park Shopping Centre / Crossgate / Durham Road, Esh Winning (part) / Framwellgate Waterside (part) / Front Street, Framwellgate Moor (part) / Gort Place / High Street North, Langley Moor (part) / High Street South, Langley Moor (part) / Milburngate Link Road / Neville Street / New Elvet / North Road / Old Elvet /

Owengate / Part of the A690 between Ramside and Rainton Gate / Part of the A167 between Oakmede and Burn Hall / Pity Me (part of the northern bypass, part of A167, part of Potterhouse Lane and part of Front Street) / Priory Road (part) / Rothbury Road (part) / Saddler Street / Silver Street / South Street (part)

All other streets are designated as Consent Streets which means you need a Street Trading Consent to trade.

Durham City Centre including Elvet Bridge / Framwellgate Bridge / Market Place / Freemans Place

These are designated as consent streets but please refer to Page 11, Section 9.0 General Presumptions for further information.

6. DERWENTSIDE AREA

All streets within the Former District of Derwentside are consent streets which means you need a Street Trading Consent to trade.

The streets set out below are designated as Prohibited Streets, which means Street Trading will not be permitted in these areas:

Consett Town Centre Medomsley Road from the junction of Stanley Street to Sherburn Terrace, Sherburn Terrace from the junction of Tyne Street to Front Street, Station Road from the junction of Seymour Street to Medomsley Road, Front Street, Queen Street, Middle Street, Wesley Street, Mason Street, Raglan Street, Victoria Street, Victoria Road, Newmarket Street, Gibson Street, John Street, Church Street, Nile Street, Albert Road, Taylor Street from the junction of Front Street to Seymour Street, Knitsley Lane from the Junction of Front Street to Palmerston Street, Nelson Street.

Lanchester Village Front Street

The prohibited streets set out above are prohibited at all times except for the Sunday of every week they are class as consent streets, only between the hours of 6am and 6pm.

APPENDIX B – APPLICATION FEES

PLEASE NOTE THAT IF YOUR APPLICATION IS REFUSED THE LICENSING AUTHORITY WILL RETAIN £45.00 ADMINISTRATION FEE.
