ORDER: WHEREAS,in the Notificationissued with the S.O. first read above, by invokingsub-rule (3) of the rule 120 of the TamilNadu Panchayats (Elections) Rules,1995, the Commissiondirected that all the contestingcandidates in the electionslisted therein shall lodge a true copy of their electionexpenses kept by them or by their respectiveelection agent under sub-rule(1) of rule 120 of the said Rulesin the format prescribedtherefor under sub-rule (2) of the rule 120 of the said Ruleswith the officersmentioned therein, within thirty days from the date of declarationof the resultof the elections; 2. WHEREAS,in the Notificationissued with the S.O.second read above, this Commissionprescribed a format for the said purposeby invokingsub-rule (2) of the rule L20 of the saidRules; 3. WHEREAS,this Commissionconducted Ordinary Elections to the Rural LocalBodies during October 2011; 4. WHEREAS,the DistrictElection Officer/District Collector, Dindigul, in the letter third read above reportedthat 748 candidatescontested in the said OrdinaryElections for variousoffices failedto lodgecopies of their accountof electionexpenses as directedby this Commission; 5. WHEREAS,based on the report of the said District Election Officer/DistrictCollector, a show causenotice was issued in the referencefourth readabove to eachof the contestedcandidate who failedto lodgea true copyof the accountof electionexpenses in the OrdinaryElections held during the month of October,20L1, through the DistrictElection Officer/District Collector, calling for explanationwithin 20 daysof the receiptof the said Notice/as to why action shouldnot be taken againsthim/her as per sub-section(4) of section37 of the TamilNadu Panchayats Act, 7994(Tamil Nadu Act 21 of 1994); 6. WHEREAS,on receipt of show cause notices 22 candidateshave submittedtheir accountdirectly to the Commissionand the same have been forwardedto District ElectionOfficer in the referencesixth cited and requested to sendhis remarksalong with the reportsof othercandidates. 7. WHEREAS,the said District ElectionOfficer/District Collector, in his letter ninth read above, has now reportedthat out of the said 748 contested candidates,four candidateshave expired, t2! contested candidateshave submitted their explanation along with the accounts and 623 contested candidates,have neithersubmitted their explanationsnor lodgedthe accountof electionexpenses in spiteof the showcause notices issued to them; and 8. WHEREAS,in view of the said report of the District Election Officer/DistrictCollector, the Tamil Nadu State ElectionCommission is satisfied that 623 candidateslisted in column(3) of the Tablebelow against the contested electionmentioned in the correspondingentry in column(2) thereof,have failed to lodgean accountof electionexpenses as requiredby or under the said Act and haveno justificationfor the failure. 9. The Ministry of Housing & Urban Affairs has approved and released funds for implementing urban infrastructure projects in Tamil Nadu under its various schemes, viz., Atal Mission for Rejuvenation and Urban Transformation (AMRUT), Smart Cities Mission (SCM), Page 1 of 2 Heritage City Development and Augmentation Yojana (HRIDAY), Swacchh Bharat Mission – Urban [SBM (U)], Urban Infrastructure Development in Satellite Towns around Seven Mega Cities (UIDSST), Urban Transport (UT), Pradhan Mantri Awas Yojana-Urban [PMAY (U)] and Jawaharlal Nehru National Urban Renewal Mission (JnNURM). Under AMRUT, the Ministry of Housing & Urban Affairs does not approve projects for individual cities but accords approval to the State Annual Action Plans (SAAPs) only. Selection, approval and implementation of individual projects is done by State Government. Further, the Ministry of Housing & Urban Affairs does not release central share of funds city-wise, but funds are released State-wise.
