MINUTES OF THE THIRTY EIGHTH MEETING

A. Confirmation of minutes of previous meeting: Minutes of the previous MHCC meetings dated 17.01.2018 (37th) were confirmed and the office was instructed to get the final copy of minutes signed by the Chairman.

B. The following proposals which were discussed previously were then considered:

Page 1 of 21 1. Case No. :665 / 2018 Sr. No.: 633 Grade- Precinct ‘Asia Publishing House – Ballard Pier Sub-Precinct’

Proposal: - Proposed structural repairs , addition / alterations and external façade modification to the existing building known as ‘Asia Publishing House’ situated on plot bearing C.S. No. 1111 of Fort Division, Calicut Street, Ballard Pier in ‘A’ Ward, Mumbai. Architect: - M/s Aspire Architects & Consultants. Ref: - i) Applications received on 09.11.2017, 19.12.2017 and 11.01.2018; ii) MHCC Meeting dated 20.12.2017.

The building u/r known as ‘Asia Publishing House’ situated on Calicut Street in ‘A’ Ward is not an individually listed structure but falls within Ballard Pier Sub-Precinct of Fort Precinct.

Scope of Work: - The scope of work as envisaged by applicant for conversion of building from office to commercial premises is as follows: • Structural repairs which includes replacement of damaged structural steel; • Replacement of flooring and internal plaster; • External waterproofing and plastering; • Removal of part Mezzanine floor; • Demolition of existing partition walls; • Demolition of entrance canopy; • Increase in height at ground floor entrance within existing approved FSI, • Modifications to the external façade.

Discussion of the Committee in its meeting held on 20.12.2017: - It was noted by the Committee that the proposal essentially comprises internal addition / alterations and façade modifications. The building is a RCC structure with no prominent heritage features. The Committee found the internal additions / alterations and repair works approvable from heritage point of view and the changes being proposed are within the existing building mass and height. Although situated at the periphery of Ballard Estate and Bazar-gate Sub- Precinct in a group of buildings with varying architectural styles, the Committee felt that as the facades are proposed for modification the dominant heritage character of the Precincts could be brought back. The Committee felt that the art-deco styled elevations comprising glass façade and GRC tile cladding ,as proposed by the architect would look out of place. The Committee, therefore, suggested the architect to revise the elevations as mentioned above.

Page 2 of 21 Decision of the Committee in today’s meeting: - The revised elelvations submitted by the applicant on 11.01.2018 were examined. It was noticed that the glass façade has now been restricted only at ground floor and stone finished surface is proposed for the rest of the façade at upper floor. Although the revised elevations do not exactly evoke the architectural language of original buildings in Ballard Pier Precinct, the glass component has been substantially reduced. The revised elevations were found to be approvable from heritage point of view. Subject to ensuring structural stability of the existing building and obtaining all other applicable permissions from concerned authorities / depts., the Committee decided to grant its NOC for the said proposal purely from heritage point of view.

C. The following new proposals / cases were also discussed:

1. Case No. :668 / 2018 Sr. No.: 67/84 & 68/85 Grade - Precinct

‘The Gabion & The Cresset' Proposal: - Proposed redevelopment of existing buildings known as ‘The Gabion’ and ‘The Cresset’ on plot bearing CTS No. C/546A & C546/V of Village - C at St. Alexious Road at Bandra (W), Mumbai in H/W Ward. Architect: - Yomesh Rao for M/s YMS Consultants Ltd. Ref: - CHE/28658/DP-DyMA dated 10.01.2018.

The site u/r situated St. Alexious Road at Bandra (W) comprises of two existing bungalows known as ‘The Gabion’ and ‘The Cresset’ which are separately included at Sr. No. 67/84 & 68/85 in proposed new heritage list of 2012.

Scope of Work: - The proposal contemplates redevelopment of the said two existing bungalows with construction of a new basement (2 levels) + stilt + 14 + 15 (part) storied building with total height of 57.95 m up to terrace floor level. The building comprises parking at lower basement, upper basement, stilt and first floor podium levels and residential units from 2nd to 15th floors.

Discussion of the Committee in today’s meeting: - The following provisions of DCR-67 for Grade III sites / structures were noted by the Committee: ‘reconstruction may be allowed when the building is structurally weak or unsafe or when it has been affected by accidental fire or any other calamity or if the reconstruction is required to consume the permissible FSI and no option other than reconstruction is available. However, unless absolutely essential, nothing should spoil or destroy any special feature or attributes for which it is placed in heritage list.’

Page 3 of 21 It was noted by the Committee that the 'Gabion' and 'Cresset' are twin bungalows and belonged to the same family. Both were built in an identical manner and are mirror images of each other. The bungalows are example of initial response to RCC technology; however, the final roof is constructed in wood. Bay windows, concrete jaalis and stained glass sun breakers are some of the features that dominate the front façade. After discussion, the Committee decided to visit the site for better understanding of present condition of the bungalows and impact of the envisaged proposal on the neighbourhood. Until such time, the decision of the Committee was deferred.

2. Case No. :670 / 2018 Sr. No.: 193/242 Grade - Precinct

Village Precinct' Proposal: - Proposed residential building on plot bearing C.T.S. No. 1102, 1102/1 to 1102/9 of Village Marol at Marol Bazar Road, (E) in K/E Ward, Mumbai. Architect: - Mrs. Sana (N. Malik) Shaikh for Dadamiya Associates. Ref: - Applications received on 15.01.2018 and 29.01.2018.

The site u/r is situated within Marol Village Precinct which is included at Sr. No. 193/242 in proposed new heritage list of 2012.

Scope of Work: - It is informed by applicant that said proposal has been approved by E.E. (B.P.) WS – K Ward and I.O.D. has been issued on 24.11.2017. As per the IOD condition, NOC of the MHCC has been sought. The proposal contemplates redevelopment of existing site with construction of a new Ground + 4 storied structures residential building with height of 14.95 m up to terrace floor level. It is informed that except two existing structures on the north side, all other existing structures on site will be demolished.

Decision of the Committee in today’s meeting: - From submitted drawings, photographs and existing site condition it is observed by the Committee that the north part of site comprises of few low-rise structures and remaining part of site is vacant. It was also noted by the Committee that Marol Village Precinct, which was included as a draft Precinct in 2012, has sparse character of a heritage precinct in pockets and development or alterations have happened in most part of the precinct mainly on the periphery. The Committee therefore discussed the proposal only in terms of the elevational details. The Committee suggested some changes in the elevational treatment so as to be in harmony with the surrounding neighbourhood character. It was decided to grant the requisite NOC of the

Page 4 of 21 MHCC for the said redevelopment proposal subject to receipt of the revised elevations by the office.

3. Case No. :679 / 2018 Sr. No.: Grade: IIA

‘Deul Wadi, ’ Proposal: Proposed repairs / restoration of Hanuman Temple of Shri.Bhulingeshwar Dewalaya Trust, on plot bearing CTS No.917,917/1 to 20 Village Chembur, R.C.Marg, Chembur, Mumbai – 400 071. Applicant: B.K.Mhatre, Trustee, Shri.Bhulingeshwar Dewalaya Trust. Architect: Vaastu Vidhan Consultants Reference: CHE/030780/DP/Dy.M.A.(Heritage) Dtd.02.02.2018

The Deul Wadi complex at Chembur comprising 4 temples and its cartilage including the Deepmala is included in the Heritage List by the notification issued by the Govt. dtd. 5th December 2014. A Grade IIA has been assigned to the complex.

Scope of instant work: - It is informed that the complex has four temples namely Bhulingeshwar, Ram, Sitala Devi and Vitthal Rakhumai Mandir other subsidiary shrines of Hanuman, Someshwar and Ghatoba are located in these main shrines. The main temple is a single storied load bearing structure with a hipped roof with timber trusses, purlins and rafters. The Hanuman Mandir is a vaulted composite masonry structure centrally located between two major shrines and sharing a Sabha Mandap with them. This mandir is 1.6 mtr. X 1.95 mtr. from inside and has composite walls of random rubble and brick masonry. The shrine has a clear height of 3.6 mtrs. and the total height is 4.2 mtrs. The vault is constructed in bricks. The shrine has a pradakshina path around it with varying width of 0.97 mtr. to 1.59 mtrs.

It was proposed to repair and restore the said Hanuman Temple structure including the vault roof and facades. Existing polycarbonate sheet roofing was proposed to be replaced with mangalore tiled roof. A new façade with wooden framed glass panelled windows and wooden panelled central door was also proposed at west side in place of the existing wall thereon.

Decision of the Committee in today’s meeting: - The proposal was presented by the consulting architect Shri Rahul Chemburkar and Trustee of Shri. Bhulingeshwar Dewalaya Trust. It was noted by the Committee that repairs / restorations is proposed on the existing footprint and within the existing mass of the Hanuman Mandir structure. The Committee discussed various roof patterns and concluded that the roof as proposed would be aesthetically appropriate in this case. The Committee suggested exploring alternatives of

Page 5 of 21 stone for cladding the shrine externally which would be easy for maintenance. The Committee also suggested using plain / tinted glass instead of stained glass at rear façade. It was instructed to submit revised drawings incorporating the suggestions of the Committee before issuing the NOC for the proposal.

4. Case No. :676 / 2018 Sr. No.: 307 Grade: IIB

‘Jer Mahal’ Proposal: Proposed temporary supporting arrangement / need bas repairs of Jer Mahal, Sona Mahal, Dinshaw Mahal, Farm Mahal on C.T.S. No.104, J.S.S. Road, Metro Junction Bhuleshwar division, C Ward, Mumbai . Applicant: HCC ( Hindustan Construction Company. Architect: N.M. Consultant. Reference: Proposals for • Jer Mahal, u/no. CHE / 030282/ DYMADP(Heriatge) / dtd. 25.01.2018. • Farm Mahal, u/no. CHE / 030283/ DYMADP(Heriatge) / dtd. 25.01.2018. • Dinshaw Mahal, u/no.CHE/ 030284/DYMADP(Heriatge)/dtd. 25.01.2018. • Sona Mahal, u/no.CHE / 030285/ DYMADP(Heriatge) / dtd. 25.01.2018.

The ‘Jer Mahal,( including Sona Mahal, Dinshaw Mahal, Farm Mahal) which is located on corner plot of Dhobi Talav, M.G.Road. J.S.S. Road & Kalabadevi Road is listed at Sr.No.307 having Grade III as per sanctioned heritage list 1995 and proposed to be upgraded to Grade- II- B.

The HCC has appointed N.M. Consultants for carrying out the work of underground Metro- 3 project. The proposal u/r is basic temporary supporting arrangement / need bas repairs of repairs to start the pilling work construction of Metro Station and excavation for tunnel. Providing the M/s Pros and I section (ISMB) at various location where major structural deterioration is identified.

Decision of the Committee in today’s meeting: - It was noted by the Committee that the ‘Jer Mahal’,(including Sona Mahal, Dinshaw Mahal, Farm Mahal) is located on corner plot of Dhobi Talav, M.G.Road. J.S.S. Road & Kalabadevi Road. The ‘Jer Mahal’, Jer Mahal is landmark building at a major road intersection with a regular verandah façade and a rounded street corner that defines the edge of the Metro theatre junction. Its distinctive presence is further emphasized by the presence of large entrance gateways to the inner open space from the east and west sides. The HRC has recommended as Grade III in ‘C’ ward review report. Currently the repairs are taken under By MHADA repairs board.

Page 6 of 21 The Committee had no objection from heritage point of view for temporary supporting arrangement / need based repairs as preventive structural stability measures taking into account the pilling work to be started for Metro Line 3. However, the Committee suggested that structural stability of the heritage building should be properly ensured and temporary supports would be removed once the purpose is served. It was also advised by the Committee that safety of the pedestrians at the periphery of building should also be ensured. Subject to this and obtaining all other applicable permissions from concerned depts., the Committee decided to grant its NOC purely from heritage point of view for the said proposal.

5. Case No. :675 / 2018 Sr. No.: 310 Grade: III

‘Bhiwandiwala Terrace’ Proposal: Proposed temporary supporting arrangement / need bas repairs of Bhiwandiwala Terrace, A & B Block on C.T.S. No.1/411, Dhobi Talao, J.S.S. Road, Bhuleshwar division, C Ward, Mumbai. Applicant: HCC( Hindustan Construction Company. Architect: N.M. Consultant. Reference: Proposals for • A Block, u/no. CHE / 030286/ DYMADP(Heriatge) / dtd. 25.01.2018. • B Block, u/no. CHE / 030287/ DYMADP(Heriatge) / dtd. 25.01.2018.

The ‘Bhiwandiwala Terrace (A & B Block) which is located on, Jagannath Shankar Sheth Marg with Anjuman Atash Behram on the north side. is listed at Sr.No.310 having Grade III as per sanctioned heritage list 1995.

Scope of instant work: - The HCC has appointed N.M. Consultants for carrying out the work of underground Metro- 3 project. Decision of the Committee in today’s meeting: - it was noted by the Committee that the ‘Bhiwandiwala Terrace’ (A & B Block) is located on J.S.S. Road. The ‘Bhiwandiwala Terrace’ (A & B Block) building is ‘C’ shaped, with a central open court, consisting of 3 identical blocks. The buff stone clad building has an entrance is through a wide arch. The floors have rectangular full height rectangular openings overlooking balconies with cast iron railing. The internal openings are segmental arches with pediments above. The front façade is adorned with corbel bands, projecting mouldings, decorative brackets, floral motifs and friezes, rusticated columns with decorative capitals.

Page 7 of 21 The Committee had no objection from heritage point of view for temporary supporting arrangement / need based repairs as preventive structural stability measures. Subject to the suggestions given in the aforesaid earlier proposal ( no. 4) of the same consultant the Committee decided to grant its NOC purely from heritage point of view for the said proposal.

6. Case No. :671 / 2018 Sr. No.: 19/583 Grade- IIA

‘Sample Flat at Jambori Maidan’ Subject: - Proposed sample flat at Jambori Maidan, C.S.No.1539 and 1540, for the redevelopment project of B.D.D. Chawls at . Applicant: - Ex.Eng. MHADA Ref: - Letter dtd.17.01.2018

The Jambori Maidan u/r is a designated “Play Ground” and is included in the notified final Heritage List for G/South Ward under Grade IIA category.

Earlier Consideration: - Earlier by letter dtd.17.10.2017 the Ex.Eng. MHADA had requested for remarks of this office about the heritage status of Jambori Maidan and Ambedkar Maidan and also for their proposal for temporary construction of sample flat, site office etc. till the completion of redevelopment project of Worli’s B.D.D. Chawls. The office had than informed that the Ambedkar Maidan is not included in the Heritage List and therefore NOC from heritage point of view will not be required for any construction of sample flat etc. on that ground. However, as Jambori Maidan is in Heritage List, for any proposed work comprehensive proposal needs to be submitted for the NOC of Heritage Committee in addition to obtaining other applicable permissions.

Instant proposal & Scope of Work: - The MHADA has been appointed as the Nodal Agency and planning authority for the redevelopment of B.D.D. Chawls. The Jambori Maidan and Ambedkar Maidan, as mentioned above, are situated within the project area and it is now informed by the MHADA that they have found the Jambori Maidan suitable for construction of the sample flat. A sample flat, on a footprint of approximately 6 mtr. X 12 mtr. is proposed to be constructed at the North end of the maidan and is shown to be outside the existing useable space as a play ground.

Decision of the Committee in today’s meeting: - It was noted by the Committee that the site u/r being a listed play ground the provisions of Grade II-A, which allow for internal changes and additional floor in some cases, may not be directly applicable. It was informed by the applicant that the proposed sample flat is at the periphery of the maidan outside the useable boundary and will be of temporary nature till the completion of redevelopment

Page 8 of 21 project. However, the Dy.Chief Eng.(D.P.) pointed out that the site u/r being a designated R.G., no construction activity would be allowed within this area as per DCR. Also, the Committee was concerned that although of temporary nature, the construction would be retained for a longer period till completion of the project and eventually more temporary structures may be added. Considering all, and as the general DCR may not allow such construction on a Play Ground, the Committee decided not to grant its NOC for the said construction of sample flat at Jambori Maidan and advised applicant to explore other alternative location for the purpose.

7. Case No. :623 / 2018 Sr. No.: 631 Grade - I

‘Bandra Railway Station’ Proposal: - Regarding issuance of NOC / remarks for the beautification of Bandra Railway Station area in H/W ward. Applicant: - Asstt. Commissioner, H/W ward. Ref: - i) Application dtd. 27.09.2017 & dtd.30.01.2018. ii) MHCC Meeting dated 13.10.2017; iii) CHE / 018086 / DP/ DyMA(Heritage) dtd. 22.11.2017.

The site u/r is situated in ‘H/W’ Ward, adjoining the ‘Bandra Railway Station’ on west side. The station is listed at Sr. No. 631 of the Heritage List, as a Grade I Heritage Site.

Previous consideration by MHCC: - Earlier the proposal of beautification of Bandra Railway Station area in H/W ward was received from Asstt. Commissioner, H/W ward. The scope of work as could be seen from the submission contemplated to explore the possibility of removal of bottlenecks to reduce the traffic congestion at Bandra Station.

The applicant through their consultant M/s. Design Architects has also carried out basic study of traffic flow & done basic planning which proposes the following: • Dedicated additional lane for Autos to direct vehicular traffic in proper channel & footpath for pedestrians. • Dedicated lane for BEST Buses to avoid vehicular crossing etc. • Pedestrian friendly footpaths from station entrance towards Auto stand / Bus Stops. • Innovated Auto stand shelters & Bus Stop Shelters. • Construction and Beautification of traffic island at the station area. • Installation of street furniture including zebra crossing / lanes marking etc.

The said matter was considered by the MHCC on 13.10.2017.The Committee noted that the scope of work mainly envisages exploring the possibility of removal of bottlenecks to reduce the traffic congestion at Bandra Station area and also some beautification work like

Page 9 of 21 street furniture, shelters, traffic island at the station area. As only schematic site plan was submitted, the Committee suggested furnishing detailed drawings with specifications and the same can be conveyed to the applicant.

Decision of the Committee in today’s meeting – The proposal was presented by the officials from concerned Ward office. It was explained that it is proposed to beautify the station front by providing pedestrian friendly footpaths, dedicated lanes for autos / buses, auto / bus shelters, construction of traffic island and installation of street furniture. It was informed that the existing road is proposed to be widened on the opposite side of Bandra Station (W) to de-clutter the traffic. The Committee after consideration gave its in-principle approval for the said beautification works with following suggestions: • It was informed by the applicant that north – south traffic on Gurunanak marg will be cut off and diverted from the station on either side. The Committee was apprehensive about this arrangement and felt it may add to traffic woes at the site. It was advised to get remarks from traffic dept. regarding traffic flow and overall layout; • It was advised by the Committee to provide bus shelters only on the opposite side of road (area under widening) so that the view of the Bandra Station which is a Grade I structure is not obstructed from the road. The Committee also suggested that modern materials such as glass and steel may also be considered for design of bus shelters. In addition, the Committee suggested exploring possibility of constructing under pass (below Gurunanak Road) from station to the bus shelters to facilitate smooth pedestrian as well as traffic movement. • It was suggested by the Committee not to construct any structures / shelters in front of station, except the landscaping, which may mar the view of the Bandra Station. • The design of railings was also discussed. It was suggested by Committee to use a subtle low height design preferably bollards with chains.

The authorities accepted the suggestion and assured that the details of the same will be worked out and submitted separately to the Committee in due course. Subject to taking cognizance of aforesaid suggestions and submitting the details / drawings separately in due course for vetting, the Committee decided to grant its NOC for the said beautification work at Bandra station.

8. Case No. :593 / 2018 Sr. No.: Nil Grade - Nil ‘Proposed Bollards / barricades at Worli Sea-face’

Page 10 of 21 Applicant: - Dy.Ch.Eng.(Traffic) Ref: - No.DyChE/844/MC/Traffic dtd.22.01.2018.

The MHCC after considering the proposal to erect bollards / barricades at Marine Drive for preventing terror attacks such as vehicle ramming into the crowds, had deliberated in its meeting held on 08.08.2017 and 07.09.2017 and given its views with a suggestion that the matter may be referred to the Home Dept. for a comprehensive view on the matter.

The concerned dept. (Traffic) has informed that accordingly a D.O. letter by Hon’ble M.C. was forwarded to Home Dept. which has replied by their letter dtd.14.11.2017 stating that it is essential to install barricades on Marine Drive Promenade as the threat from terrorists ramming vehicle into crowd has of late increased. The M.C., MCGM has been requested to have a meeting with the Commissioner of Police, Mumbai and devise a plan of putting barricades in such a manner which is both preventive and aesthetically appealing.

The Dy.Ch.Eng.(Traffic) by a note dtd.22.01.2018 has now forwarded a proposal to provide similar barricades at Khan Abdul Gaffar Khan Road along the Worli Sea face for the remarks of MHCC. Earlier a report was submitted by the Dy.Ch.Eng. (Traffic) on 27.09.2017 for the approval of AMC (ES) and M.C. in the said matter. The views expressed by the MHCC while considering the proposal to barricade Marine Drive where quoted in the report and it was mentioned that this is a sensitive issue and a huge expenditure will be incurred with specific type of bollards to sustain impact of heavy vehicles and also beautify the respective area in this case the Worli Promenade. It was then proposed to call a joint meeting of concerned officials to discuss the issue. The AMC (ES) had then pointed out that the MHCC has not agreed to provide bollards and had instructed to check proceedings of Heritage Committee and then put up.

Decision of the Committee in today’s meeting: - Although the Worli Sea Face along Khan Abdul Gaffar Khan Road is not a listed Heritage site, in view of the application received, the Committee considered the instant proposal for providing barricades to prevent vehicle ramming on Worli Sea-face in G/S Ward and decided to offer its remarks from urban planning point of view. The remarks of Traffic Dept. put up to AMC (ES) and Hon’ble M.C. were noted by the Committee wherein it is stated that site visit was carried out by Traffic Dept. and it was observed that height of Worli promenade from carriage way is above 500mm and hence it was felt that ramming of vehicles on Worli promenade will not be possible as kerb stones are fixed in stepping manner with three steps. The Committee, considering the fact that Worli promenade is at a substantial height from carriage way, was in agreement with the view of Traffic Dept. and expressed that it is desirable to keep the

Page 11 of 21 promenade open and installation of barricades / bollards may be avoided for the reasons stated above.

9. Case No. :677 / 2018 Sr. No.: 370 Grade III ‘125, Cumballa Hill (Contractor's residence)' Proposal: -Proposed addition / alterations, restoration, change of user, structural consolidation and interior works at existing building known as Contractor’s residence on plot bearing C.S. No. 565 in ‘D’ Ward, 125, Kemps Corner, August Kranti Marg, Mumbai. Architect: - Abha Narain Lambah Associates. Owner: - Mottibai & Nowroji Contractor Charities. Ref: - Che/30935/DP-DyMA dated 01.02.2018.

The building u/r known as ‘Contractor’s Residence’ located at 125, Kemps Corner, August Kranti Marg ‘D’ Ward is listed at Sr. No. 370 as a Grade III structure in the heritage list.

Scope of Work: - The existing building known as ‘Contractor’s Residence’ is a ground + 3 storied structure built in Neo-Classical style of architecture. The scope of proposed addition / alterations, restoration, structural consolidation and interior works is as following: Internal: • Addition of machine room-less internal lift; • Restoration of delaminated plaster and paint due to leakages; • Restoration of deteriorated false ceiling; • Restoration of architectural details; • Repairs / restoration of damaged / broken stone steps; • Addressing insensitive painting and colour palette with sympathetic shades and type of paint for interior; • Cleaning of existing mosaic flooring and restoring damaged flooring; • Replacing existing flooring with travertine, epoxy and engineered wooden floor in all floors; • Repairs and restoration of original openings, windows and doors as per original design, opening up blocked windows and doors; • Restoration and provision of new timber boarding; • Waterproofing of flat terraces and mangalore tiled roof; • Timber repairs to joists and framing members of slab; • Stainless steel splice repairs to timber joists; • Structural steel works in case of failure of trusses, consolidation of structural members;

External: • Repairs / restoration of entrance gate and railing along the periphery of building; • Replacement of entrance paving and provision of drain gutter; • Rainwater down take pipes to be painted in colour similar to external façade; • Cleaning of stone façade using water misting technique; • Removal of ficus and other vegetation growth on external façade; • Lime pointing to replace cement pointing; • Poulticing of decorative details; • Dutchman repairs to the deteriorated stringer courses missing details; • Plastic repairs to deteriorated details; • Removal of ad-hoc additions along façade; • Structural strengthening of balcony; • Restoration of incongruous chajja to original design, removing incongruous grills; • Restoration of missing details in architectural elements; • Lead flashing for gutters and valleys; • Restoration / repairs to roof and eaves board, cleaning / replacing mangalore tiles; • Removal and up gradation of telephone wiring criss-crossing; • Relocation of water tanks; • Provision for illumination of building; • Provision of landscaping, paving and street furniture; • Provision of sensitive signage.

Decision of the Committee in today’s meeting: - The proposal was explained by the representative of consulting architect. It was explained that the proposal contemplates change of use from residential to office use and accordingly the internal alterations are proposed along with comprehensive restoration of building u/r. The Committee, after consideration, found the proposed scope of works, methodology and material specifications approvable from heritage point of view. However, the Committee advised architect maintaining original window design / pattern instead of flat panelled windows as proposed. It was also suggested by the Committee to submit details of the proposed signages. Subject to incorporating the aforesaid suggestion in drawings, the Committee decided to grant its NOC purely from heritage point of view for the said proposal.

Page 13 of 21 10. Case No. :673 / 2018 Sr. No.: 113 Grade :- IIA ‘Preventive Maintenance Work- J. N. Petit Institute’ Subject: - Preventive Maintance Work to be carried out in J. N. Petit Institute, Fort, Mumbai. Architect: - Vikas Dilawari. Ref: - i) CHE/ 030137 /DP/DyMA(Heritage)dtd.23.01.2018; ii) Earlier NOC dtd.20.04.2013 & Completion NOC dtd.26.06.2015.

Scope of work: - It was informed by the Conservation Architect by letter dtd. 23.01.2018 that they intend to carry out basic external and internal preventive maintenance of the J. N. Petit Institute bldg. u/r with a request to put up the said matter before MHCC for information. The building was repaired in 2014 and has also won the UNESCO Asia Pacific Award of Distinction in the year 2015. The building is in fair condition and the works that are identified are majorly periodic maintenance related. The applicant has stated that the work shall include cleaning of the soiled external ashlar masonry walls (due to moss and algae) and re-painting/touch up of all the plastered surfaces and teakwood members. The broken finial on the north side façade top will be carefully fixed in place. The redundant fixtures like AC stands, non functional electrical cables etc will be removed and electrical cables will be organized. Internally, minor cracks in the RCC columns and beams and loose cover in small patches will be attended. Complete lime wash will be done to the entire main staircase shaft and painting touch up will be done in localized areas on first, mezzanine and second floor.

Decision of the Committee in today’s meeting: – It was noted by the Committee that the scope of work as envisaged by applicant is only to carry out basic external and internal preventive maintenance of the said building. The Committee found the proposed scope of work approvable and decided to grant its NOC purely from heritage point of view.

11. Case No. :674 / 2018 Sr. No.: 134 Esplanade Sub Precinct ‘Preventive Maintenance Work- Esplanade House ’ Subject: - Preventive Maintance Work to be carried out in in Esplanade House on C.S. No.73 of Fort Division, Mumbai. Architect: - S.P.RAO, For POONAGER BILIMORIA & CO., Reference: - i) CHE/ 030138/DP/DyMA(Heritage) dtd.23.01.2018. ii) Earlier NOC of the MHCC dtd.11.05.2000 & Completion NOC dtd.28.08.2015. The property under reference known as Esplanade House comprises of 2 buildings, the main block facing the road and the annex on rear side. The original main building was

Page 14 of 21 Gr+two upper storied separate ground + 1 annex block with tiled roof, built in 1885 abutting H. Somani Marg, located opposite Bombay Gymkhana and individually listed at Sr.No.134 of the existing heritage list under Grade-IIA category.

Scope of work: - It was informed by the Conservation Architect by letter dtd.23.01.2018 that they intend to carry out basic external and internal(in common area) preventive maintenance of the Esplanade House bldg. u/r with a request to put up the said matter before MHCC for information. The building was last repaired in 2013 and has also won the UNESCO Asia Pasific Award (Honourable mention) in the year 2014 and is otherwise in a fair condition requiring periodic maintenance and membrane waterproofing. The applicant has stated that the work shall include cleaning of the soiled external Porbundar stone surfaces (due to moss and algae), painting of the plastered areas (top floor added in 1938), teakwood and CI members. The flat terraces will be treated with membrane waterproofing which will be led over the existing china mosaic waterproofing and the basement will be re waterproofed. Mangalore tiled roof over the North and South balconies will be redone. The site surrounding i.e. the existing landscape will be enhanced and external lighting will be done if so desired by the clients. Lightening arrestor is proposed for the main building.

Internally, the common areas like the porch, staircase lobby will be repainted and toilets on the first floor will be refurbished.

Decision of the Committee in today’s meeting: – It was noted by the Committee that the scope of work as envisaged by applicant is only to carry out basic external and internal preventive maintenance of the said building. The Committee found the proposed scope of work approvable and decided to grant its NOC purely from heritage point of view.

D. The following additional items were considered with permission of chair:

1. Case No. :669 / 2018 Sr. No.: 49/41 Grade II-A

‘Commissariat Building’ Proposal: - Proposed comprehensive repairs and restoration of the external façade, roof repairs and internal structural repair works at building known as ‘Commissariat building’, No. 231 bearing C.S. no. 762 of Fort Division, D. N. Road in ‘A’ Ward, Mumbai. Architect: - M/s F. S. Lokhandwala. Ref: - Applications dated 16.01.2018 and 03.02.2018;

The building u/r is included at Sr. No. 49/41 as a Grade II-A structure in the proposed heritage list of 2012 and also falls within Bazzargate Sub-precinct of Fort Precinct.

Page 15 of 21 Scope of Work: - It was informed by the architect that the comprehensive repairs / restoration of the building u/r is planned in two phases, tenantable repairs (part A) and structural repairs (part B).

The proposal for part A was considered by the Committee in its meeting dated 17.01.2018 for the following scope of work: • Repairs to existing Mangalore tiled roof – The existing Trafford pattern AC sheet of the entire roof will be replaced by T&G boarding with tar-felt layer topped by Mangalore tiles or corrugated G.I. sheets or combination of two. Existing AC sheet valley gutter will be replaced with new GI/MS gutter and new CI down-take pipes; • Removal of extensive vegetation growth on external façade using biocide / weedicide; • Cleaning of façade by removing paint from Porbunder stone surface on the north and west façade. If the paint is found to be rigid and removal is not possible, the façade will be painted; • Carpentry works including new teakwood bison board chajjas over fifth floor windows, replacement aluminium windows installed in past with new TW windows matching original ones, provision of 8” TW drip mould on all windows protect teak wood sections, repairs and repainting of damaged existing TW windows; The Committee had found the proposed scope of work approvable from heritage point of view and had decided to grant its NOC for the said work.

Subsequently by letter dated 03.02.2018 it was informed by the architect that Part B of the works for structural repairs was now proposed with following scope of work:

External :

• Recasting of flat slab if terrace as new RCC slab and waterproofing of terrace and lift shaft with china mosaic. Recasting of slabs over toilet block with additional two columns, relocating water tanks over the toilet block. • Stitching to vertical cracks in the brick wall on fifth floor or reconstructed as the case may be. RCC / encased concrete lintel of the fifth floor will be repaired / strnghtened with micro concrete after adding stirrups. Complete sand faced re-plastering of fifth floor. Ground floor of the east (rear) façade will be plastered matching the existing rusticated masonry on the North and West side. • Rough kadappa stone will be provided over existing corbels with waterproofing layer above ensuring no further growth of vegetation takes place. Missing cornices of the east side will be remade wherever missing matching the original existing cornices on the North and West side.

Page 16 of 21 • Additional openings made above the window on the East façade will be sealed.

Internal: - • The jack arch slabs wherever deteriorated, will be reconstructed appropriately; • Encased columns will be opened up and strengthened wherever required. Columns in poor condition will be jacketed and re-casted. Encased / corroded lintels will be repaired using micro-concrete and re-encased if required. All steel members will be treated with anti rust. • Loose RCC slab cover patches observed over staircase shaft top slab will be repaired in polymer modified mortor. • The slab of the arcade with loose plaster patches will be re-plastered after treating the steel members. All unauthorized lofts will be dismantled to reduce the load on building; • All plywood partitions will be dismantled while teak wood partitions will be retained. • Interventions done in past to structural system like addition of water tanks directly suspended from jack arch slab will be eliminated. • Replacing the existing sintex water tanks covered with AC sheets at the ground floor chowk with an underground water tank. Entire chowk will be re-plastered. • Entire plumbing of toilets to be redone and toilets will be refurbished. • Entire internal re-plastering and painting will be done. The entire flooring will be done in Bharat Heritage flooring at all level.

Decision of the Committee in today’s meeting: - The proposal was presented by the consulting architect in today’s meeting. The Committee considered comprehensive proposal including Part ‘A’ and part ‘B’ as mentioned earlier. The scope of proposed work, methodology of repairs and material specifications were found to be approvable from heritage point of view by the Committee. The following suggestions were given by the Committee: • that, all existing signages should be streamlined and the proposal for signages should be submitted separately for consideration of the Committee. • that, as far as possible existing AC units haphazardly placed on front facades of building should be relocated / shifted to appropriate location, • that, structural stability of the building u/r should be ensured during course of work. Subject to above and obtaining all other applicable permissions from concerned depts., the Committee decided to grant its NOC purely from heritage point of view for the said proposal. The authenticity of the floors, lofts etc. to be examined and confirmed by concerned dept.

‘Petit Bandra Municipal School/ Committed Communities Development Trust’

Proposal: - Proposed temporary porta cabins for shifting of existing OPD at K.B.Bhabha Hospital, on plot/ property, bearing CTS No.1086 of Village Bandra – F (F.P.No.37-38 of Bandra TPS – II) Located at R.K.Patkar Marg, Bandra (West) in H/W Ward, Mumbai. Applicant: - Municipal Architect I/c Reference: - CHE/MA/649/I Dtd.02.02.2018.

The property u/r is situated at R.K.Patkar Marg (Waterfield Road) in Bandra (W) opposite Bhabha Hospital. The property has been included in the published draft Heritage List under Grade – IIB category. Although the entire plot has been marked under the listing only one building in the complex in the south west corner, known as Petit School, is considered as the only listed building in the said property.

Scope of work: - It is informed that as per SRDP 1991 the plot u/r is reserved for ‘Extension to Hospital’ and as per RDDP 2034 the plot is reserved for multiple reservations i.e ‘Multipurpose Housing for working women’ + ‘Care Centre’. The structure u/r is in dilapidated condition and it is not in use but being used to store metal and other scrap material from surrounding Municipal Offices. A small canteen for the staff of Bhabha Hospital is being operated in one corner of the said structure and the other side has a small shed being used by a social organization.

Permission of the MHCC has been sought for demolition of the said structure to facilitate construction of temporary porta cabins. It is mentioned by the applicant that other than this plot there is no other space in Bhabha Hospital Compound or around where approximately 17 nos. of porta cabins as per the requirement of user can be accommodated to temporarily run the extremely crowded OPD until the extension work of Bhabha Hospital Complex is completed. MHCC is requested to grant permission for the same in larger public interest.

Decision of the Committee in todays’ meeting: - It was noted by the Committee that the structure u/r and the adjoining Petit School structure form the major part of the complex and are the only visible structures from the Waterfield Road side. These two structures separated by an internal road, are similar in terms of scale and design character. However, the Petit School structure is relatively maintained well whereas the structure u/r proposed for demolition appears to be in a state of disrepair. The Committee was of opinion that although the structure proposed for demolition is not considered as the listed structure, considering that it part of the complex and complements

Page 18 of 21 the listed structure of Petit School, the possibility of repairing and reusing the existing structure for the purpose of running the OPD temporarily could be explored so that the visual quality of the structure is improved while maintaining the scale and character of the heritage site.

E. The following case was discussed and remarks were recorded as under:

Sub: - Letter from Shri. Amol Jadhav, State Secretary, BJP Yuva Morcha dtd. 01.01.2018 forwarding therewith a representation by Shri. DarshanSingh Thakur on some issues related to alleged demolition of building no.21-25, Bhuleshwar Road, ‘C’ ward, Mumbai. Ref: - 1) MHCC NOC u/no. CHE / 5798 /DPC dtd. 6..6.2016. 2) Letter forwarded to BP Dept.u/no.CHE/ 27616/ DP/DyMA (Heritage) dtd.22.01.2018.

The office is in receipt of copy of the letter dtd. 01.01.2018 from Shri. Amol Jadhav, State Secretary, BJP Yuva Morcha, addressed to Dy.Ch.Eng.(BP) City forwarding therewith the representation of Shri. Darshansingh Thakur on the issue of alleged demolition of a Temple building no.21-25 known as ‘Narmadeshwar Temple’ on plot bearing C.S.No.2367 near Bhuleshwar Devalaya Complex.

A letter u/no.CHE/ 27616/ DP/DyMA (Heritage) dtd.22.01.2018 has been forwarded by the office as an interim action, to the Exec. Eng. (BP) City requesting to examine the matter and take appropriate action.

The matter was placed before the Committee and it was prime-facie observed from the events mentioned by Shri. Darshansingh Thakur in his representation that it is primarily an issue between Landlord and tenants and the applicant (tenant) has requested to get their first floor property restored and to ensure that their ground floor shop remain intact. The following was also noted:

• The entry named as ‘Bhuleshwar Devalaya Complex’ is included at Sr. No.292 of the heritage list having Grade II-B (proposed to be upgraded to Grade II-A) category, in the published heritage list of 31.07.2012. • This MHCC had received a proposal contemplating repairs to temple building no.21- 26, Bhuleshwar Road, ‘C’ ward, plot bearing C.S.No.2367, Bhuleshwar, Mumbai on 05.04.2016. The D.P. remarks submitted by the applicant mentioned the said plot bearing ‘C.S. NO.2367’ as part of the ‘Bhuleshwar Devalaya Complex’ entry. The proposal was considered by the MHCC in its meeting dtd.10.05.2016 and NOC of

Page 19 of 21 MHCC was given u/no.CHE/5798/dpc DTD 06.06.2016. It was advised that all the existing features of the temple should be properly restored and repaired as may be needed during the course of repairs. The NOC was granted subject to the overall approvability of proposal being further examined and got confirmed by the Building proposal Dept. • The applicant Shri. Darshansingh Thakur had earlier submitted a complaint letter dtd. 23Rd March 2017 about alleged demolition of Narmadeshwar Mandir and restriction imposed on him by landlord to enter the Temple building. The office had forwarded the complaint on 7th April 2017 to Asstt.Comm. ‘C’ Ward to examine and take necessary action as per the provision of regulations and policies in force. • It is alleged by the applicant now that the proposal for repair of the property on plot bearing C.S.No.2367 is as per the plan sanctioned by the Building Proposal Department but, in his opinion, the submitted plans by the architect were incorrect. The office had then forwarded a letter on 26.12.2017 to Exec. Eng. (BP) City requesting to ascertain the authenticity of submitted plan. • It was noted by the Committee from the MMRHCS Data cards for Sr.No. 292 u/r that that although the plan shown in the data card did not include plot bearing C.S. No. 2367 (where the Narmadeshwar Temple u/r is situated) the C.S. No. was mentioned in the card and therehow it was reflected in the D.P. Remarks. • The Heritage Review Committee (HRC) after reviewing the Heritage list for ‘C’ ward has recommended that the entry at Sr. No. 292 under the name ‘‘Bhuleshwar Devalaya Complex’’ be retained and upgraded in the heritage list from Grade II B category to Grade II A category. The boundary / extent of the said heritage site has also been delineated. The delineated boundary for ‘‘Bhuleshwar Devalaya Complex’’ heritage site does not include the Narmadeshwar Temple plot bearing C.S. No. 2367. Hence, The proposal on said C.S.No.2367 is outside the ‘Bhuleshwar Devalaya Complex’ site. • The said report of the HRC in respect of ‘C ‘ward heritage has been accepted by the Municipal Commissioner and the delineation plan has been forwarded on 05/01/2018 to the State Govt. by the HRC. The MHCC therefore concluded that the said Narmadeshwar Temple site cannot be considered as a heritage site in light of the findings of HRC. • As the Committee had earlier given its no objection for repairs and restoration of the temple and adjoining structure the concerned depts of MCGM may process the proposal accordingly. Although the MHCC may not have any jurisdiction in the matter the Committee was generally of the opinion that from the point of view of

Page 20 of 21 cityscape it is desirable that the sanctity of the Narmadeshwar Temple is ensured by concerned authorities / owners.

The meeting then concluded with a vote of thanks to the chair.
