Notice concerning countervailing measures on imports of stainless bars originating in

By its judgment of 19 September 2001 in case T-58/99, Ltd, Isibars Ltd, Ferro Alloys Corporation Ltd and Viraj Impoexpo Ltd v Council of the European Union, the Court of First Instance of the European Communities (CFI) annulled Council Regulation (EC) No 2450/98 of 13 November 1998 (1) imposing a definitive countervailing duty on imports of stainless steel bars originating in India and collecting definitively the provisional duty, in so far as it concerns imports into the European Community of stainless steel bars manufactured by:

— Mukand Ltd, established in Mumbai,

— Isibars Ltd, established in Mumbai,

— Ferro Alloys Corporation Ltd, established in , and

— Viraj Impoexpo Ltd, established in Mumbai.

As no appeal was lodged before the Court of Justice of the European Communities, the judgment of 19 September 2001 is definitive.

Consequently, the definitive countervailing duties paid and the provisional duties definitively collected pursuant to Regulation (EC) No 2450/98 on imports into the European Community of stainless steel bars falling within CN codes 7222 20 11, 7222 20 21, 7222 20 31 and 7222 20 81 manufactured by the abovementioned companies (under additional TARIC codes 8403, 8402, 8400, 8410) should be reimbursed. The reimbursement must be requested from national customs authorities in accordance with applicable national customs legislation.

As a consequence of the judgment of 19 September 2001, Mukand Ltd (Mumbai), Isibars Ltd (Mumbai), Ferro Alloys Corporation Ltd (Nagpur) and Viraj Impoexpo Ltd (Mumbai) are no longer subject to the countervailing measures imposed by Regulation (EC) No 2450/98 of 13 November 1998.

Explanatory notes adopted in accordance with the procedure defined in Article 10(1) of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), as last amended by Regulation (EC) No 2433/2001 of 6 December 2001 (2).
