  • The Impeachment of a President
CHAPTER 4 The Politics of Removal: The Impeachment of a President Patrick Horst This contribution takes the current debate about an impeachment of President Donald J. Trump as an inducement to delve deeper into the question under which circumstances and conditions Congress decides to impeach a president—and when it prefers to evade or repudiate the legal and political demands to remove him from office. This tricky problem, an issue of constitutional (legal) principle and political expediency, will be dealt with in a longitudinal historical approach, comparing the philosophi- cal debate at the Constitutional Convention in Philadelphia with the most intriguing cases of impeachment debates in the 23 decades thereafter. Why did the House of Representatives impeach Andrew Johnson and Bill Clinton, and was willing to impeach Richard Nixon, whereas it tabled attempts to prosecute—among others—Andrew Jackson, John Tyler, Harry Truman, Ronald Reagan, George W. Bush and Barack Obama? And why was the Senate willing to convict Nixon but acquitted Johnson and P. PRESIDENTIAL IMPUNITY AND THE MUELLER REPORT Presidential Impunity and the Mueller Report: How the Department of Justice’s Failure to Subject the Special Counsel Regulations to Notice and Comment Undermined the Rule of Law by M. AKRAM FAIZER1 Abstract: Department of Justice (“DOJ”) Special Counsel, Robert S. Mueller, III’s two-volume, 448-page Report on the Investigation into Russian Inter- ference in the 2016 Presidential Election (“the Report”), did an outstanding job in evidencing that President Trump’s actions in office satisfied the fed- eral obstruction of justice standards. However, due to Mueller’s limited brief and his concern for maintaining the proper separation of powers, the Report, submitted confidentially to former Attorney General Barr as required by De- partment of Justice Regulations, abjured a determination as to Presidential criminality.

Examining opinion pieces from an array of influential media outlets through a lens of problem identification and blame direction, this project identifies four recent broad frames of the 2016 intervention. Blame is pointed either inwards at domestic actors or outwards at Russia, and the problem identified is either the intervention against Clinton or the suspicion of Trump afterwards. A survey experiment exposing respondents to vignettes based on these frames, however, shows no effects on stances towards the intervenor, Russia. These findings, while difficult to interpret, suggest that the significance of frames of electoral interventions may lie elsewhere.

The problem is in US politics… The other team lost. They are reluctant to acknowledge the mistake. It is easier to say, “We are not to blame, the Russians are to blame, they interfered in our election.” It reminds me of anti-Semitism: the Jews are to blame for everything. We know what such sentiments can lead to. They lead to nothing good. The thing to do is simply to work and think of how to get things right”.
