EXECUTIVE SUMMARY

GB Card & Partners has been commissioned by Hastingwood Developments Limited to undertake a Phase 1 Desk Study Report for a site located on Foster Street in Harlow, . The intention is to redevelop the site for residential use.

The site has been occupied by Foster Street Farm since the 1960’s/1970’s comprising a number of buildings including a large warehouse and smaller brick built outbuildings and sheds. During the GB Card & Partners 2014 walkover and the more recent walkover it was noted that the site and former farm buildings were being used by a scaffolding contractor. It was also noted that there was potentially fly-tipped material onsite and areas were being used for storage of old plant and barrels of unknown substances.

The underlying geology is likely to comprise superficial deposits of the Lowestoft Formation (‘Boulder Clay’); which overlies the London Clay Formation.

The site is considered to be of low to medium risk to identified receptors with regard to ground contamination. Further action is required to assess the risks to human health associated with contamination and outline specific remedial measures for the site, if required.

It is recommended that a Phase 2 ground investigation comprising a series of window sampler boreholes is undertaken to assess the potential for ground contamination associated with historic and current use of the site.

1. INTRODUCTION

GB Card & Partners (GBCP) has been commissioned by Hastingwood Developments Limited (‘the Client’) to undertake a Phase 1 Desk Study Report for a site located off Foster Street in Harlow, Essex. The intention is to redevelop the site for residential use.

The aim of the assessment is to understand the ground conditions and potential for contamination to be present beneath the site prior to its re-development. This report provides a preliminary conceptual site model and establishes the risks posed by potential contamination to future site users and the environment. Recommendations for site investigation requirements are provided.

This report has been prepared to support a planning application for the site ( Council planning reference: EPF/2516/14). The aim of this report is to discharge Condition 17 which is presented below.

‘No development shall take place until a Phase 1 Land Contamination investigation has been carried out. A protocol for the for the investigation shall be submitted to and approved by the Local Authority before commencement of the Phase 1 investigation. The completed Phase 1 report shall be submitted to and approved in writhing by the Local Planning Authority prior to the commencement of any necessary Phase 2 investigation. The report shall assess potential risks to present and proposed humans, property including buildings, crops, livestock, pets, woodland and service lines and pipes, adjoining land, groundwaters and surface waters, ecological systems, archaeological sites and ancient monuments and the investigation must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR11’, or any subsequent version or regulatory guidance.’

The report has been undertaken in general accordance with Environment Agency Contaminated Land Report (CLR)1 and R&D Publication 662.

3. SITE SETTING

3.1 Site location and description

The site is located to the north of Foster Street, Harlow, Essex (see Figure 1). The approximate National Grid Reference for the centre of the site is 548909, 209124.

A site walkover was undertaken by GBCP on the 27th February 2018. The site walkover record and photographs are presented in Appendix A. The site was formerly a farm and is currently occupied by wooden sheds, brick built storage areas, metal containers, fly-tipped material, old plant and a large metal framed warehouse. The warehouse is currently being used by a scaffolding contractor as a workshop. To the rear of the farm there is an above ground storage tank. Areas of compacted hardcore and concrete hardstanding are also present.

Immediately west of the site is an open field with a residential property located further west. The site is bounded to the east by residential properties and to the north and further west by open arable farmland. An electrical substation is present immediately south of the site facing on to Foster Street. Vehicular access is gained directly from Foster Street to the south.

3.2 Proposed development

The proposed development comprises low-rise residential properties with private gardens and associated infrastructure and soft landscaping. An extract of the proposed development plan is presented in Figure 2 below and the full drawing is presented in Appendix D.

3.3 Summary of site history

The historical development of the site was traced from Ordnance Survey map extracts dating back to 1874. A summary of the findings is presented below and selected historical map extracts are presented in Appendix B.

The earliest available map (1874 to 1875) shows the site to be largely undeveloped with the exception of large unnamed building (assumed to be residential) in the south-east of the site and a small structure in the south-west. The rest of the site comprises agricultural fields separated by hedgerows. The surrounding area is agricultural with occasional residential properties. A road runs along the southern boundary of the site (the same alignment as Foster Street).

The 1886 mapping shows a series of ponds and ditches along the boundary or in close proximity to the site.

There are no significant changes on site until the 1960’s except extensions to the large building in the south west of the site and additional outbuildings in the southern portion of the site. By the 1960’s a new configuration of buildings is present with a large rectangular building present in the previously undeveloped northern portion of the site. On the 1974 map the site is labelled as Foster Street Farm. An electricity substation is located along the western boundary. Further minor changes to the layout occurred during the late 1970’s and 1980’s.

3.4 Ground and groundwater conditions

3.4.1 Ground conditions

The geological map3 for the region identifies the site to be underlain by the superficial deposits of the Lowestoft Formation; which overlies the London Clay Formation. The Lowestoft Formation generally comprises chalky cohesive till, together with outwash sands and gravels, silts and clays. The till is characterised by its chalk and flint content. Previously the Lowestoft Formation was sometimes referred to as Lowestoft Boulder Clay or Lowestoft Till. The London Clay Formation is typically 40-80m thick in the area of the site. At depth, the London Clay is underlain by the Lambeth Group, the Thanet Sand Formation and the Upper Chalk.

Based upon the former land-use and GBCP’s previous experience on the site a limited thickness of Made Ground is anticipated to mantle the site.

3.4.2 Groundwater conditions

The Environment Agency (EA) classifies the Lowestoft Formation as a Secondary Aquifer (undifferentiated). This means that it has previously been designated as both a minor and non-aquifer in different locations due to the variable hydrogeological properties. The London Clay Formation is classified as Unproductive Strata indicating a low permeability deposit which has negligible significance for water supply or river base flow. The site does not lie within a Groundwater Source Protection Zone.

3.4.3 Surface water conditions and flood risk

A surface water body has been identified on site in the north-west corner of the site. This appears to be one of several unnamed small ponds, streams, drains and ditches identified either on site or in the immediate surrounding area.

Information available on the gov.uk website4 indicates that the site is within a Flood Zone 1 which equates to a low risk of flooding (land having a less than 1 in 1,000 annual probability of river or sea flooding).

3.5 Summary of environmental records

An environmental disclosure report was obtained as part of the Envirocheck® report for the site. A summary of the findings of the report is provided below with the full report presented in Appendix C.

Discharge Consents and Abstractions

There are four recorded discharge consents within 250m of the site (two of which are for the same domestic property). Three of these are revoked; the only current discharge consent listed is located 224m south west of the site and is for domestic sewage discharges (final/treated effluent). There are a further two within 250m and 500m of the site (one of which is revoked).

There are no groundwater/surface water abstractions within 500m of the site (the closest is located 1220m south-east of the site and is for agriculture/irrigation).

Pollution Controls and Incidents

There are five recorded pollution incidents to controlled waters within 500m of the site. The nearest incident was in 1998 and involved a spillage of oils at 110m south-east of the site. The incident was a Category 2 – Significant Incident. The other incidents within 500m were all Category 3 - Minor Incidents.

There are three records of Local Authority Pollution Prevention and Control permits within 500m of the site, all attributed to the same address and all revoked. They all were attributed to C J Pryor Limited (plant hire) and related to quarry processes and waste oil burners located 212m south-west of the site.

Waste Treatment and Disposal Sites

There are no Historical Landfill Sites or Local Authority Recorded Landfill Sites within 500m of the site.

There is a single Licensed Waste Management Facility listed within 500m of the site. This relates to Pryor Mourik Limited (mobile plant) located 160m south- west of the site.

Radon

The site lies in an area where less than 1% of the homes are above the radon action level and as such no radon protection measures will be required.

Trade Directory Entries

The closest active Contemporary Trade Directory Entries is located 56m south of the site and relates to joinery manufacturers (Branson Leisure). There are a further four active entries within 500m of the site which relate to garden machinery, waste disposal, pest/vermin control and garage services.

3.6 Epping Forest District Council

As part of the GBCP 2014 Phase 1 Desk Study5, which is publicly available on the planning portal6, Epping Forest District Council were contacted to obtain any records that were relevant to the site. The Environmental Health Officer highlighted the historic usage of the site and the potential for Made Ground/infilled ground.

3.7 Bomb damage records

According to the information available on the Bombsite® website7 the site is not situated in an area affected by bomb damage. No further assessment is considered necessary in this regard.

4. RISK ASSESSMENT

4.1 National policy

Historical contamination of land may present harm to human health and the environment. Current UK legislation stipulates that the risk associated with any potential land contamination is assessed and remediated, if necessary. Under the Town and Country Planning Act 1990 (as amended), potential land contamination is a "material planning consideration" together with the National Planning Policy Framework (March 2012) which means that a planning authority must consider contamination when they prepare development plans or consider individual applications for planning permission. It is the responsibility of the developer to carry out the remediation where it is required and satisfy the Local Authority that the remediation has been carried out as agreed.

Additionally, Part 2A of the Environmental Protection Act 1990 requires that a significant source-pathway-receptor linkage exists to determine a site as contaminated land. This means that there has to be a contaminant present, a receptor that could be harmed by this contaminant, and a pathway linking the two. Part 2A deals with the contamination risk from a site in its current use, however the planning system requires that the proposed use is considered. Where remediation is carried out under the planning system, it should be ensured that the site is in such a condition that it would still not meet the definition of contaminated land under Part 2A.

4.2 Conceptual site model

A preliminary Conceptual Site Model (CSM) has been developed for the site (in the context of the proposed development) in accordance with CLR111 to assess the significance of potential pollutant linkages. The CSM is described as follows.

4.2.1 Contamination sources

Potential sources of contamination from the site have been identified and are detailed below:

• Made Ground – Made Ground is likely to be present at the site based upon the previous land-use. Where Made Ground is present, elevated contaminant concentrations may be present. Typical contaminants that can be associated with Made Ground/fill materials include heavy metals

and asbestos. Based on the site’s history, hydrocarbon contamination may also be present with the soils. Made Ground may also be a source of soil gas particularly if the organic content is high.

• Substances stored on site and former farm usage - Small barrels and drums and occasional fly tipped material were/are present across the site and this could represent a source of contamination. The sites former use as a farm may present a source of some agricultural pollutants and fuel storage.

• Former buildings – There may be asbestos containing materials (ACMs) contained within the building structures. A pre-demolition asbestos survey may be required.

• Electrical Substation - there may be localised polychlorinated biphenyl (PCB) contamination associated with the electrical substation.

4.2.2 Contamination pathways

Potential pathways by which contamination may migrate are:

• Vertical and lateral migration of contaminants through permeable soils, ducts and service trenches. It is noted that the soils are expected to be of limited permeability based on published geology but that permeable bands may be present based on previous experience.

• Ingestion or dermal contact with contaminants that may be at or near the surface, particularly in proposed private garden areas, or that are exposed during earthworks.

• Inhalation of airborne particles, ground gases and/or vapours which may be present at the site.

• Leaching and run-off to surface water receptors.

• Root uptake by plants in private gardens, ingestion of affected plants would be a pathway. In areas of open landscaping, root uptake could adversely affect vegetative growth.

4.2.3 Sensitive receptors

Potential sensitive receptors in the vicinity of the site are considered as follows:

• Future site users – The site will be used for residential purposes.

• Construction workers – Workers may come into contact with underlying soils during the earthworks.

• Neighbours/public – The surrounding land use is a mixture of open space and residential use. These neighbouring sites could be receptors during earthworks.

• Buildings and services – Including buried structures such as water supply pipes and buried concrete.

• Ground and surface water – Surface water receptors (in particular on- site ditches and drains) could be a receptor. There may also be more permeable bands of glacial gravels present within the soils.

4.3 Risk assessment

The above conceptualisation of the source, pathway, receptor contaminant linkage model provides information to allow the following qualitative risk assessment to be made in accordance with the requirements of CLR 111.

In order to assess the risk posed by the various source, pathway and receptor linkages that may exist, the following risk rating terminology has been adopted to describe the risks identified at the site and is based on the site prioritisation and categorisation rating system set out in CLR Report No. 68.

• High Risk: Contaminants are very likely to represent an unacceptable risk to receptors. The site is probably not suitable for its proposed use.

• Medium Risk: Contaminants are likely to represent an unacceptable risk to identified receptors. The site is probably not suitable for its proposed use. Action is required in the medium term.

• Low Risk: Contaminants may be present but unlikely to result in an unacceptable risk to identified receptors. The site is probably suitable for its proposed use. Action is unlikely to be needed whilst the site remains in its current use.

• Negligible Risk: If contamination sources are present they are considered to be minor in nature and extent. The site is suitable for its proposed end use. No further action is required.

A preliminary assessment of the risks posed by the identified pollutant linkages is provided in Table 1 below:

5. CONCLUSIONS & RECOMMENDATIONS

5.1 Conclusions

Historically, the site has been occupied by Foster Street Farm since the 1960’s/1970’s comprising a number of buildings including a large warehouse and smaller brick built outbuildings and sheds. During the GBCP 2014 walkover and the more recent walkover it was noted that the site and former farm buildings were being used by a scaffolding contractor. It was also noted that there was potentially fly tipped material onsite and areas were being used for storage of old plant and barrels of unknown substances.

The site is considered to be of low to medium risk to residential end-users with regard to ground contamination. Given the potential for Made Ground to be present associated with the previous land-use and development, further action is required to assess the risks to residential users associated with contamination and outline specific remedial measures for the site, if required.

5.2 Recommendations

A Phase 2 ground investigation should be undertaken at the site to assess potential ground contamination and refine the preliminary risk assessment presented within this report.

Shallow exploratory and sampling holes should be excavated using a window sampler rig (or equivalent) which will allow good site coverage. Typically, depths of 3m to 5m below ground level can be achieved using this equipment. It is recommended between up to 8 window sampler boreholes are drilled to provide adequate coverage, to include chemical testing of shallow soils and installation of monitoring standpipes in selected boreholes. A single gas/groundwater monitoring round will be undertaken although the risk from ground gas at the site is considered to be low.

The scope of further investigation and assessment should be agreed with the Local Authority before proceeding with the next phase of investigation. However, we note the current turnaround times at Epping Forest District Council may not permit this.

Given the relative age of the buildings and observations made during the walkover, a refurbishment/demolition survey should be completed in relation to

the potential presence of asbestos in accordance with the requirements of HSG 2649.

Weather conditions Cold but dry. Some light snow present over during visit: ground.

Observations: The site was the location of the former Foster Street Farm and still resembles an old farm yard. The historic gated entrance for vehicular access off Foster Street was shut at the time of the site walkover. It appeared that this entrance is no longer in use. Vehicular access is gained from Foster Street to the west of the site.

The site is occupied by a large warehouse, currently used by scaffolding contractor. The land surrounding the warehouse is predominantly hardcore and some areas of hardstanding. A number of other typical farm buildings were present on the site in various states of repair.

There appears to be several areas used for storing waste and old plant. However, no signs of hazardous waste or chemicals present.

In previous walkover there appeared to be a raised office with steps leading to it which is no longer present.

A hardcore track is present to the west of the warehouse, with locked gated access at the northern end. A grassed access is present on eastern side of warehouse.

An electrical sub-station is located between the vehicular access and the historic farm entrance.

Two ditches were noted during the walkover, one adjacent to the northern boundary and one entering the site between the sub-station and historic vehicular access.

Due to the amount of soft landscaping and hardcore located around the site, there should not be any problems with access for any site investigation works.

The Environment Act 1995 has made site sensitivity a key issue, as the legislation pays as much attention to the pathways by which contamination could spread, and to the vulnerable targets of contamination, as it does the potential sources of contamination. For this reason, Landmark's Site Sensitivity maps and Datasheet(s) place great emphasis on statutory data provided by the Environment Agency/Natural Resources Wales and the Scottish Environment Protection Agency; it also incorporates data from Natural England (and the Scottish and Welsh equivalents) and Local Authorities; and highlights hydrogeological features required by environmental and geotechnical consultants. It does not include any information concerning past uses of land. The datasheet is produced by querying the Landmark database to a distance defined by the client from a site boundary provided by the client. In the attached datasheet the National Grid References (NGRs) are rounded to the nearest 10m in accordance with Landmark's agreements with a number of Data Suppliers.
