To us, the Promax BDA Station Summit AwardS show recognizes the most inspiring creative. Through the Promax BDA Station Summit Award we honor and celebrate our most innovative peers. So we asked ourselves...What if the Award is an Idol? If the Award is an Idol, then it has to be personified with a back story. There has to be a legend surrounding how this Idol came to be. We distilled the meaning of the trophy to it’s purist form... And to us the trophy is the physical representation of the creative process; the AWARD SHOW DESIGN PARTNER process that starts with that one spark that inspires more ideas and moves us forward with a focus that cuts through the cloud to define the direction. It transforms to an energizing obsession we all feel marketing creativity when that concept is solidified and we begin to create. That momentum pushes us forward to a clear path and the light at the end of the tunnel, when we’re finessing the final touches and finally... the reality. The moment arrives, when that small evolving thought that has been brewing in our heads comes to full fruition, ready to share with the world. For me, the process is just as important as the final product. Through the process I feel alive and energized. But this time around, Nexstar is pointing the finger at the other side of the negotiating table. It has suedDirecTV in a NY federal court, claiming breach of contract. At issue is an “unlaunched station fee” that it says DirecTV agreed to pay for not being required to immediately launch Nexstar station WHAG (aka WDVM). The Hagerstown, MD, station lost its affiliation with NBC on July 1, 2016. “DirecTV now erroneously claims that its obligation to pay the unlaunched station fee depends on the station retaining its network affiliation. Nothing in the contract supports DirecTV’s wishful thinking,” Nexstar told the court. “Indeed, the contract plainly places the risk on DirecTV that the station might lose its network affiliation during the contract’s term.” Reached for comment, an AT&T spokesperson said, “While we hope to resolve this with Nexstar, we dispute their claims and plan to respond.” WHAG made retrans waves earlier this year, with Antietam Broadband losing it on Jan 1 (it remains off the provider’s lineup). DISH and Verizon Fios carry the channel, which offers local news for the area. Comcast carries the station in-market, but stopped carrying it out-of-market in March.

In support thereof, Dr. McMorries would respectfully show unto the Court as follows: I. Summary of the Action: 1. The Texas Medical Board is about to do exactly what the Texas Legislature has prohibited. The Texas Legislature stated that “the [Texas Medical] [B]oard may not consider or act on a complaint involving care provided more than seven years before the date on which the complaint is received ….” TEXAS OCCUPATIONS CODE § 154.051(d) (emphasis added). Despite that law, and despite initially following that law, the Board now stands on the cusp of instigating a contested case with the State Office of Administrative Hearings over complaints involving care provided in the 1980’s, more than three decades ago. The Board does so based on a Board rule that twists the Texas Legislature’s words to the point of outright defiance of the Legislature’s intent.
