LEGAL FRAMEWORK The documentation is based on the specific laws regarding the health and safety issues or collateral regulations, which are prevalent. These are: - The Environmental Protection Law, no.137/1995, republished on 17 February 2000, Ministry of Water, Forest and Environmental Protection (MAPPM). The environmental protection Law represents the basic law for the environmental protection in Romania being based on the principles and strategic elements that lead to the sustainable development of the society. These principles and strategic elements are the following: - Principle of careful decision making - Principle of anticipation of ecological risks and damages - Principle of preservation of the biodiversity and the specific ecosystems within the natural bio-geographic frame; - Principle of the paying pollutant - Prioritize the removal of the pollutants, which directly put at serious risk the people’s health - Development of the national environmental monitoring system - Maintenance, improvement of the environmental quality and reconstruction of the damaged areas - Development of the framework for the involvement of the non-governmental organizations and the population in the process of the preparation and application of the decisions - Development of an international co-operation in order to ensure the environmental quality; - Ordinance no. 860 of MAPPM for the approval of the Procedure of the Environmental Impact Assessment and the issue of the environmental agreement. - Ordinance no. 863 of MAPPM for the approval of the methodological guides, which apply to the stages of the framework of the environmental impact assessment. 5 - Emergency Ordinance no. 91 of 20 June 2002 for the modification and completion of the Environmental Protection Law no.137/1995, published in the Official Gazette, Part I, no. 465 of 28 June 2002. Regulation regarding the Waste Material Disposal Emergency Ordinance regarding the waste material disposal, no. 78/22 June 2000, Official; Gazette no. 283/2000. Regulation regarding the water Quality Protection A standard regarding the provision of the pollutants loading limits of the wastewater discharged into the natural receptors NTPA-001, Romanian HG no. 188/2002. A standard regarding the conditions for the wastewater discharge into the city sewage or directly into the water cleaning plant, NTPA-002/2002, Romanian HG no.188/2002. Surface water – categories and quality technical conditions, Standard 4706 – 88. The law of drinking water quality – Low no. 458/2002. Ordinance 756 for the approval of the regulation regarding the assessment of the environmental pollution. Regulation regarding the Protection of the Air Quality Ordinance no. 462/1993 of the Ministry of Waters, Forests and Environmental protection for the approval of the technical conditions regarding the air quality and methodological norms to determine the air pollutants emission generated by the stationary sources. Air in the protected areas – quality conditions, STAS 12574-87. It applies to the atmospheric air and determines the maximum admissible concentration of pollutants around the protected areas. The maximum admissible limits are 6 determined and complied with so that the unprotected population is safe from negative impact of the pollutants. STAS 12574-87 shall provide the following: - Values of the maximum admissible limits of the air pollutants in the protected areas, which shall not be exceeded for a number of 29 substances. - Maximum admissible quantity for substances with synergetic effect, which occur simultaneously in the air; - Maximum admissible quantity for sedimentary particles; - Standards regarding the sample taking and analysis methods. MAPPM Ordinance no.592 of 25.06.2002 for the approval of the Normative regarding the determination of the maximum values and the criteria and assessment methods for the sulfur dioxide, nitrogen dioxide, particles in suspension, lead, benzene, carbon monoxide and nitrogen in the atmosphere. Ordinance no. 536/1997 for the approval of the norms of hygiene and recommendations regarding the environment for the population. Regulation regarding the Soil Quality Protection MAPPM ordinance no. 756 of 3 November 1997 for the approval of regulation regarding the environmental impact assessment: - it determines the maximum admissible limits and the intervention limits for the concentration of soil pollutants. 7 2. PROJECT DESCRIPTION 3.1. Project Title Construction of Targu Mures East By-Pass. Phase: Feasibility Study 3.2. Location Targu Mures is situated in the center of Transylvania in wonderful geographical surroundings. The city is crossed by the river Mures and surrounded by hills covered with forests (beech trees and oak trees). The deviation road in the east of Targu Mures makes the connection between DN13 (E60) km 165+175 and DN15 km 83+900 in the north of Targu Mures, at about 4 km distance from the city, passing around Targu Mures and Sangiorgiu de Mures. Targu Mures is crossed by national roads and by county roads in the direction North- South, DN13, DN15, DJ152 and in the direction East-North, DN15, DJ135. 3.3. Achievement and Operation of Scheme The period of execution proposed for the by-pass is 24 months (2 years). The operation time and the schedule are unlimited. 3.4. Investment opportunity Targu Mures is crossed by national roads and by county roads in the direction North- South, DN13, DN15, DJ152 and in the direction East-North, DN15, DJ135. In order to avoid the crossing through the city in the direction South-North from DN 13 to DN 15 towards Reghin the construction of a new diversion road is necessary and this will make the connection between the two roads through the East of the city. In the East-West direction for the connection between DN 15 – DN 13 the deviation road has the feasibility study finished. The construction of this by-pass will lead to: - Increase of traffic capacity by the improvement of traffic flow; - Elimination of municipality traffic jams; 8 - Development of a comfort plan for the road users; - Increase of traffic safety; - Reduction of accident number; - Improvement of municipality environment reducing air and noise pollutants 3.5. Project Description The by-pass route starts from DN 13 from km 165+175, crosses a passageway that has been left available, free of existent constructions or designs. Then the route follows the area of the major riverbanks of the valleys Poclos and Saivari, which are crossed through two bridges. There has to be mentioned that this area is partly situated inside the city of Targu Mures and is unsuitable for constructions. The route crosses the county road to Livezeni (DJ135) through a viaduct having a length of 30 m at a distance of 3,185 km at a level of 335.20; crosses Terebici hill at a distance of 6.220 km and at a level of 451.73; crosses the village road to Cotus (DC20) at a distance of 9.722 km and a level of 356.24. In this area, the designed route crosses the valleys: Poclos, Saivari, Hosuba and Tofalau through four bridges. The return of the route to the national road DN15 is made by a roundabout placed at km 83+900. All the crossings will be made according to the norm C173-79 introducing acceleration and deceleration lanes. The minimum radius of curvature is 215 m. All circular curves are connected to the axis through clothoids. 9 4. EXISTING SITUATION 4.1. Water 4.1.1. Surface Water The route follows the area of the major riverbanks of the valleys Poclos, Saivari, Hosuba and Tofalau through four bridges. At the present, on the riverbanks of the above mentioned valleys there are no pollutants. 4.1.2. Underground water The underground waters in the construction area, do not exceed the maximum admissible limits stipulated by STAS 1342/91 “Drinking Water” and “Law 458/2002” regarding the Quality of Drinking Water”.
