CALL TO ORDER: Mayor Kartak called the Snohomish City Council Workshop to order at 5:00 p.m., Tuesday, February 16, 2021. COUNCILMEMBERS/MAYOR PRESENT STAFF PRESENT Larry Countryman Debbie Burton, Finance Director Steve Dana Emily Guildner, City Attorney’s Office Judith Kuleta Rebekah Park, HR Manager/City Clerk Tom Merrill Glen Pickus, Planning Director Felix Neals Steve Schuller, City Administrator and Donna Ray Utility General Manager Linda Redmon Brandi Whitson, Deputy City Clerk John Kartak, Mayor NOTE: Due to the COVID-19 declared federal, state and local emergency, and pursuant to Governor Inslee's Proclamations 20-05 and 20-28, the Snohomish City Council held its meeting via remote participation. 2. PRESENTATION: Council Do’s and Don’ts Mayor Kartak welcomed and introduced Ann Bennett, Executive Director, Washington Cities Insurance Authority (WCIA). Ms. Bennett provided an introduction of WCIA as the City’s insurance authority, and basics on what they handle for the City. She then provided a slide show outlining key points for Councilmembers to be cognizant of in avoiding liability: Immunity for legislative activities (such as adopting budgets, ordinances, etc.). Understand the difference between quasi-judicial and legislative roles in land use issues. Personnel issues are part of the Executive’s role to oversee, such as hiring/firing, and harassment/discrimination issues. Negligent misrepresentation (don’t make promises or assurances). Defamation and untruths. Refer Public Works issues to staff. Retain confidentiality of Executive Session discussions and materials. Use of social media and other written forms of communication, use of personal equipment, and OPMA rules. 3. ADJOURN at 5:58 p.m. APPROVED this 2nd day of March, 2021. Snohomish City Council Meeting Minutes February 16, 2021 1. CALL TO ORDER: Mayor Kartak called the Snohomish City Council regular meeting to order at 6:00 p.m., Tuesday, February 16, 2021. INTRODUCTORY REMARKS BY MAYOR JOHN T. KARTAK. Mayor Kartak provided a statement regarding the necessity to conduct the remote meeting due to the Covid-19 pandemic. 3. APPROVE AGENDA contents and order. MOTION by Redmon, second by Countryman to approve the agenda as presented. Motion passed unanimously (7-0). 4. APPROVE MINUTES of the January 26, 2021 workshop, and the February 2, 2021 workshop and regular meeting. MOTION by Merrill, second by Neals to approve the minutes. Motion passed unanimously (7-0). 5. PRESENTATIONS a. Proclamation for Pam Schilaty, Chamber of Commerce President. Mayor Kartak presented a Proclamation recognizing February 16, 2021 as Pam Schilaty Day, in recognition of her dedication to the City of Snohomish as president of the Chamber of Commerce, from which she is retiring. b. Snohomish School District Update - Dr. Kent Kultgen, Superintendent. Dr. Kultgen reported on the School District’s activities to open schools for in-person learning. The District is considering staggering attendances, while continuing to providing remote learning. Sports programs will also be allowed to re-start this month. School district staff have received vaccinations, and have partnered with the University of Washington for a first-of-its-kind study of how safe schools are and whether children can transmit the virus to adults. The District plans to continue its inclusivity training that was delayed due to the City Council Meeting March 2, 2021 6 AGENDA ITEM 4. pandemic, and develop student mental health and learning acclimation measures. c. Youth Council Update. Youth Council members Allison Naumann and Colby VerHoeven presented an update on Youth Council activities in 2020. These included assisting the community through the COVID pandemic, and educating the public about the importance of voting. Mr. VerHoeven requested Council consider passing a resolution in support of ranked-choice voting. 6. CITIZEN COMMENTS. Mayor Kartak welcomed the citizens to the meeting and discussed the procedures for providing citizen comment. Citizen Comments: Jesse Podoll (in writing) commented on the lights at Pilchuck Park. Michael Caldwell (in writing), Penelope Gunterman, Jeanne Andrews, and Milt Grover all commented on pedestrian safety on Terrace Avenue. Ron Anderson, Dana Harker, Melody Clemans, John Lorenz and Debby Lippicott all commented on traffic safety issues through the residential areas of Avenue D. City Comments: Closed 7. PUBLIC HEARING: Renew Comcast Franchise Agreement. a. Announce purpose and open public hearing: Mayor Kartak opened the public hearing, indicating tonight was to hear public testimony regarding a non-exclusive franchise agreement with Comcast, to allow them to use public rights-of-way for cable system purposes. b. Staff presentation: Mr. Pickus provided details of renewing Comcast’s franchise agreement, covered by draft Ordinance 2412. The franchise would be for five years, and cover service standards per SMC 5.08.130, as well as franchise fees, insurance requirements, and programming categories. c. Council’s questions of staff: Councilmember Ray questioned ownership and maintenance of the poles. Mr. Pickus indicated the City did not own the poles. Mr. Vincent Buys, a representative with Comcast, indicated Comcast did not own the poles, either. Rather, their cables were typically underground or on poles owned by other utilities, such as PUD. Councilmember Merrill asked for clarification on the code language regarding franchises.
