EXECUTIVE SESSION Chairperson The Board will meet in executive session under the following Oregon Revised Statutes: a. ORS 192.660(2)(d) to conduct deliberations with persons designated to carry on labor negotiations. b. ORS 192.660(2)(e) to conduct deliberations with persons designated to negotiate real property transactions. Representatives of the news media are allowed to attend executive sessions, except for those sessions held in regard to expulsions. All other audience members are excluded from executive sessions and are asked to exit the meeting area. Representatives of the news media are specifically directed not to report on any of the deliberations during executive sessions, except to state the general subject of the session as listed on the agenda. PUBLIC COMMENT: Agenda and Non-Agenda Items Chairperson The board wants to hear broad input from the community related to board business and decisions, while at the same time effectively conduct board business. Public comment will be accepted on agenda and non-agenda items in person, by call-in, or written submission. Each individual will be allowed up to three minutes, with an additional three minutes for translation to English, if needed. The link to sign up to give public comment opens when the agenda is posted and closes at 4 p.m. Monday. Please click here for directions and to sign up to comment. Signing up through the link is preferred for all forms of public comment (in-person, call-in, or written), but there will be a sign-up form in the board room for those who have not signed up through the link. In-person and call-in comment is heard on a first-come, first served basis. ADJOURNMENT Chairperson *Support Material Included SALEM-KEIZER PUBLIC SCHOOLS REPORTS 6.b August 10, 2021 PUBLIC COMMENT PROPOSAL FOR IN-PERSON BOARD MEETINGS Background/Discussion As the school board returns to in-person meetings, the board of directors is committed to hearing from the public during board meetings through the public comment process. On July 13, the school board heard a proposal on public comment for when the board returns to in-person meetings. On July 27, the board heard public comment on the proposal and discussed the proposal further. During this meeting, the board will discuss the proposal further and have an opportunity to hear any further public comment provided on the proposal. Recommendation/Board Action No action is required on this item. This item is before the board again to provide the public more opportunity to comment on the proposal. PUBLIC COMMENT PROPOSAL FOR IN-PERSON BOARD MEETINGS The board wants to hear broad input from the community related to board business and decisions, while at the same time effectively conduct board business. The board is committed to allowing enough time in decision-making for the public to provide comment to the greatest extent possible. The board is also committed to finding ways outside the public comment process to engage the community. Toward these goals, public comment procedures will be as follows: • Public comment will open when the agenda is posted on the Friday before a board meeting and will close at 4 p.m. on Monday. The district will make every effort to post the agenda by noon on Friday, but no later than 5 p.m. • Individuals may wait to sign up in the board room just prior to the meeting. These speakers follow those who signed up earlier using the link. • Speakers typically will be taken in order of sign-ups, though the board chair may use discretion in selecting speakers out of order to ensure (1) voice from different categories* or (2) to hear comment regarding agenda items for which it will be making decisions. • Options to provide comment include in-person, by call-in, by joining the virtual meeting live, or by providing written comment. • Comment will be accepted on agenda and non-agenda items. • The board will make every effort to hear from each person who signs up to comment, though the board chair can use discretion in the total time for comment based on the time needed to conduct board business on the agenda. • Each speaker may comment once per meeting and will be allowed three minutes to comment, with an additional three minutes allowed for interpretation into English. • Those who are calling in or are joining the virtual meeting live will be provided a phone number or link and brief instructions to use to call in or connect during the meeting. Callers and those joining virtually are taken in order of sign-up, not according to when they call in or access the meeting link. • Written comment is limited to 2,000 characters, which is about 250 words. • Written comment will be provided to the board in advance of the meeting. Written comment is very helpful as it gives the board an opportunity to contemplate the input ahead of time. • A summary of public comment is read during the board meeting. • Written comment and the summary will be posted on the website the next business day as supplemental material for the meeting. *Categories include the following: • Student • Parent • Individual Community Members (not part of a group) • Group/Organization – (name group) • District Staff • On behalf of SKEA • On behalf of ASKESP ACTION 7.a August 10, 2021 REAPPOINT PAUL DAKOPOLOS/REBEKAH JACOBSON AND/OF THE LAW FIRM GARRETT HEMANN ROBERTSON, P.C. AS LEGAL COUNSEL TO THE SCHOOL BOARD AND DISTRICT Background/Discussion The law firm of Garrett Hemann Robertson, P.C. (GHR) has been representing the school board and the district since 1986, and Paul Dakopolos of the same firm has been working with the district since the early 1990s. Other members of GHR also do work for the district in specific areas of the law or when Mr. Dakopolos is not available. Rebekah Jacobson also does substantial work for the district and acts as general counsel to the district when Mr. Dakopolos is not available. Board Governance Policy BG-10.2 requires the board to name an attorney for the district to provide professional legal counsel and advice to the superintendent, staff, and school board. The district has designated legal services as a class of contracts that are personal services contracts in Administrative Policy PUR-A001. This is consistent with ORS 279A.055(2). Personal services contracts are exempted from the Public Contracting Code pursuant to ORS 279A.025(2) and 279A.055. The contractual rates have not increased since 2018-19. The contractual rates for 2021-2022 will be increased as follows: Current rates will increase by $10 per hour: • $295 per hour for partners • $245 per hour for associates • $335 per hour for special cases The retainer increases by $1,500: • $6,000/month general services retainer It has been the practice of the school board to reappoint legal counsel at its first regular business meeting in July. Given the full agenda for the July business meeting, Mr. Dakopolos requested that this matter be considered at the August business meeting. Recommendation/Board Action Board leadership recommends the school board reappoint Paul Dakopolos/Rebekah Jacobson and/of the law firm Garrett Hemann Robertson, P.C. as legal counsel to the school board and district. LEGAL SERVICES CONTRACT THIS AGREEMENT made this 10th day of August, 2021, by and between the law firm of GARRETT HEMANN ROBERTSON P.C., 1011 Commercial Street NE, Salem, Oregon 97301, and SALEM-KEIZER SCHOOL DISTRICT 24J (hereinafter referred to as "District").
