Road Races Act 1982 ROAD RACES (RALLY IOM) ORDER 2013

Made: 9 September 2013 Coming into Operation: 12 September 2013

The Department of Infrastructure makes the following Order under sections 1 and 2 of the Road Races Act 1982.

1 Title This Order is the Road Races (Rally IOM) Order 2013.

2 Commencement This Order comes into operation on 12 September 2013.

3 Interpretation In this Order— “Clerk of the Course” includes, in the absence of the Clerk of the Course, any Deputy Clerk of the Course appointed by the promoter; “closure period” means any period during which an authorisation under article 4 is in force in relation to the race area or any part of the race area; “pedestrian” includes wheelchair users and any persons using another mobility aid other than a bicycle or motor vehicle; “prohibited area” means the areas listed in Schedule 2 that are not restricted areas; “promoter” means Rally Limited; “race area” means the roads specified in Schedule 1; “restricted area” means the areas and property areas listed in Schedule 2 that are indicated as being restricted; “senior police officer” means a member of the — (a) of the rank of sergeant or above; and (b) authorised by the Chief Constable to act as senior police officer for the purposes of this Order; c SD No.0306/2013 Page 3

“side road” means any part of a road that leads onto a race area; and “signage” includes any barrier, tape, sign, markings or structure which indicate restricted access to a race area, a side road or a prohibited or a restricted area.

4 Authorisation for use of race area for motor races (1) The promoter is authorised to use such parts of the roads listed in column 1 of the table in Schedule 1 for motor races on the days and times specified in column 2 of that table. (2) The Clerk of the Course may for any reason, cancel, suspend or annul such a race, or any part of a race. (3) If the Clerk of the Course cancels, suspends or annuls a race or part of a race under paragraph (2) he or she must notify the senior police officer. (4) The Clerk of the Course must suspend any racing if required to do so by the Department.

5 Suspension of right of way etc. Subject to articles 7 and 8, during any closure period in relation to any part of the race area, the right of way over it is suspended and accordingly, no traffic may enter or remain on it.

6 Regulation of traffic on side roads Subject to articles 7 and 8, during the closure period, a person must not enter or remain, or cause or permit any vehicle or animal to enter or remain on a side road that is marked with signage without the permission of a constable or marshal.

7 Exemptions from articles 5 and 6 (1) Articles 5 and 6 do not apply to the following persons— (a) the Clerk of the Course; (b) persons appointed by the promoter as officials for the purpose of the race in question and bearing an official badge, armlet or tabard issued by the promoter; (c) persons approved by the Clerk of the Course; (d) constables, fire officers and medical persons, highway maintenance and recovery persons; (e) persons lawfully taking part in the race in question and any person authorised by the promoter to assist those persons; and

(f) media representatives and photographers approved by the promoter and bearing an official badge, armlet or tabard issued by the promoter. (2) Articles 5 and 6 do not apply to the competing vehicles and any vehicle approved by the Clerk of the Course.

8 Temporary opening of the race area (1) This article has effect despite anything in articles 4 to 6. (2) If any race is temporarily postponed or suspended during a closure period, the senior police officer may, with the consent of the Clerk of the Course, authorise traffic, in accordance with the directions of a constable or marshal, to cross or proceed along such part of the race area, and at such times, as that officer may specify. (3) In any interval during the times specified for racing, the senior police officer may, with the consent of the Clerk of the Course, authorise pedestrians, in accordance with the directions of a constable or marshal to cross or proceed along the race area at such places, and at such times, as that officer may specify. (4) Nothing in paragraph (2) permits traffic to proceed in the reverse direction of the race, except with the express authorisation of the Clerk of the Course. (5) No person may, drive any vehicle or cause or permit any vehicle to be driven on any part of the race area, which is the subject of any authorisation under paragraph (2) or (3), otherwise than pursuant to that authorisation and in accordance with the directions of a constable or marshal.

9 Prohibited areas (1) No person or vehicle may, during a closure period, enter or remain on a prohibited area, except to go to the aid of a person or to prevent further danger or risk to the competitors or any other person. (2) The extent of the prohibited area must be clearly marked and indicated by signs bearing the words “Prohibited Area”.

10 Restricted areas (1) During a closure period no person or vehicle may enter or remain on a restricted area. (2) Paragraph (1) does not apply to— (a) race officials, marshals or police officers in the course of their duty; or

(b) photographers, television crew or other persons or vehicles approved by the Clerk of the Course. (3) The extent of the restricted area must be clearly marked and indicated by signs bearing the words “Restricted Area”.

11 Publicity for cancellation etc If the senior police officer is notified of the cancellation of the race or a part of the race under article 4, he or she must take such measures (if any) as he or she considers appropriate to inform the public of the effect of it.

12 Notification of end of closure (1) At the end of each closure for which an authorisation under article 4 is in force— (a) the Clerk of the Course; or (b) senior police officer, after consulting the Clerk of the Course, must arrange for one or more motor vehicles, marked in accordance with paragraph (2), to travel the race area. (2) As respects any part of the race area, a closure period will be treated as completed for the purposes of this Order when an official motor vehicle, displaying in a prominent position, a notice with the words “Roads Open” has passed along that part of the race area. (3) Any official motor vehicle referred to in paragraphs (1) and (2) above, displaying the words “Roads Open” must not exceed a speed of 90 mph whilst driving on closed roads.

13 Erection of signage (1) The Clerk of the Course must ensure that barriers, diversion signs and closure signs are erected and maintained on all side roads immediately before, or as soon as possible after, the beginning of every closure period, and in any event before the relevant part of the race area is used for a race. (2) The Clerk of the Course must ensure that all signs required by paragraph (1) are plainly visible to approaching traffic. (3) The Clerk of the Course must ensure that all prohibited and restricted areas are adequately marked and delineated. (4) The barriers and signage referred to in paragraph (1) must consist of— (a) structures and signage approved by the Department; or (b) if the Department so directs for any particular location, a banner stating “Road Closed” in red letters on a white background, and suspended from a rope or structure.

(5) The closure signs referred to in paragraph (1) must be of the size, colour and type shown in diagram 7010.1 (warning, informatory and regulatory) in schedule 12 of the Traffic Signs Regulations and General Directions 2002. (6) The Clerk of the Course must ensure that the barriers, diversion signs and closure signs referred to in paragraph (1) are removed at the end of every closure period.

14 Insurance The promoter must secure insurances and indemnities against death, injury or damage to persons or damage to property arising out of the conduct of the races or arrangements incidental to them of at least thirty million pounds (£30,000,000).

PROHIBITED AND RESTRICTED AREAS

(Articles 9 & 10)

In this Schedule the areas should be assumed to be PROHIBITED unless stated otherwise.

Douglas Promenade – Stage 4 1. The most northern section of the sunken gardens on Loch Promenade 2. The garden area and traffic island opposite the Sefton Hotel and Gaiety Theatre enclosed by the Harris Promenade.

Switchback – Stages 12 and 24 1. Entire triangular parcel of land at the junction of the East Lhergydhoo Road and the Switchback.

Ballaugh, Cronk and Killane – Stages 9 and 26 1. The triangular parcel of land bounded by the junction of the A10 Ballaugh to Jurby Coast Road and the Ballaugh Loop Road. 2. Killane – the triangular parcel of land bounded by the A10 Ballaugh to Ramsey Coast Road and the C28 Killane Road, Ballaugh.

The Braaid Crossroads – Stages 8 and 19 1. The grass area on the northeast corner of the junction bounded by the A24 Douglas to Foxdale Road and the A26 Braaid to Glen Vine Road. 2. The grassed area from the bus shelter on the southeast corner of the junction and bounded by the A24 Douglas to Foxdale Road and the A26 Braaid to St Marks Road.

Castletown – Stages 16 and 17 1. Bridge Street— that section of the car park fronting the harbour from the junction with Thirtle Bridge to the first set of chains. 2. The car park at the junction of Farrants Way and Queen Street, Castletown— three car parking spaces adjacent to the entrance and exit together with sections of the entrance and exit.

Sign Post Corner to Glencrutchery Road – Stage 27 1. The first 50 yards past Signpost Corner on the left side of the road to a depth of 5 metres from the road edge. 2. RESTRICTED — Glencrutchery Road, Douglas—the Playing Fields, the area from the rear edge of the pavement to the bottom of the bank, running the entire length from Dukes Avenue up to the boundary of Oakleigh House, Glencrutchery Road, Douglas. c SD No.0306/2013 Page 15

EXPLANATORY NOTE (This note is not part of the Order)

This Order closes various roads in the Island between Thursday 12 September and Saturday 14 September 2013 whilst Rally Isle of Man takes place and makes supplemental provision with respect to such closures.
