ANNUAL CAWV SCHOLARSHIP GOLF OUTING JUNE 1 - MORNING FLIGHT ALMOST SOLD OUT

The deadline is approaching to register for the annual CAWV Scholarship Golf Outing which will be held Friday, June 1, at Berry Hills Country Club in Charleston. We are limited to 20 "Sixsomes" for both the 7:30 a.m. and 1:30 p.m. starting times. For morning golfers, a luncheon will be held immediately after play. For the afternoon golfers, dinner will be held immediately after play. Awards will be presented at the luncheon for the morning flight and at dinner for the afternoon flight. All proceeds from the golf outing benefit the CAWV Scholarship Foundation. Members can register by clicking here. Deadline to register is Friday, May 18.

ELECTION RESULTS FOR 2018 PRIMARY ELECTION

Voters cast their ballots across Tuesday in the 2018 Primary Election. Voter turnout statewide was 24 percent (up from 19 percent in the most recent non-presidential primary in 2014). Approximately 291,000 of West Virginia's 1.2 million registered voters cast ballots in Tuesday’s races. In the race for US Senate, Attorney General Patrick Morrisey won the GOP nomination with 35 percent of the vote, defeating Congressman Evan Jenkins (29 percent) and coal executive Don Blankenship (20 percent). Morrisey carried 32 of the state's 55 counties. Morrisey will now face incumbent Senator Joe Manchin in November. Manchin easily won the Democratic nomination, defeating Paula Swearengin by a margin of 70 percent to 30 percent.

In the race for the U.S. Congressional Third District (the seat being vacated by Congressman Evan Jenkins), state Delegate Carol Miller won the contested GOP race with 24 percent of the vote, defeating Delegate (19 percent), former GOP Party Chairman Conrad Lucas (18 percent), and Delegate (18 percent). Miller will face State Senator Richard Ojeda in November. Ojeda defeated Delegate Shirley Love in the Democratic Primary by a margin of 52 to 25 percent.

In the U.S. Congressional First District, WVU law professor Kendra Fershee defeated businessman Ralph Baxter by a margin of 47 to 38 percent to claim the Democratic nomination. Fershee will face incumbent Congressman David McKinley in November. McKinley was unopposed for the GOP nomination. Congressman Alex Mooney will face former Hillary Clinton staffer Talley Sergent in November for the U.S. Second Congressional District. Sergent defeated Aaron Scheinberg by a margin of 62 to 38 percent to win the Democratic nomination. Incumbent Mooney was unopposed for the GOP nomination.

The West Virginia state legislature will see many new faces in January 2019. Nineteen incumbent House Delegates (including current House Speaker Tim Armstead) did not seek re- election this year, due to legislative retirements or choosing to run for other offices. Three incumbent State Senators were defeated in the Primary Election. Delegate Bill Hamilton (Upshur County) defeated incumbent Senator Robert Karnes in the 11th Senatorial District by a margin of 61 to 39 percent. Hamilton will face Democrat Laura Finch in November. Incumbent Senator Mark Drennan, recently appointed to the Senate to replace long-time Senator Mike Hall, was defeated in his attempt to retain his Senate seat by newcomer in the 4th Senatorial District by a margin of 56 to 44 percent. Tarr will face the Democratic nominee, attorney Brian Prim, in November. Senator Lynne Arvon, a former House Delegate who was recently appointed to replace former Senator Jeff Mullins, lost her bid to retain her Senate seat and was defeated by in the 9th Senatorial District. Roberts will now face former Senator Bill Wooten in November, with Wooten winning the Democratic nomination.

Only two incumbent House Delegates seeking re-election were defeated in Tuesday’s Primary Election. Incumbent Delegate Phil Isner failed to win the Democratic nomination in the 43rd House District. Delegate Chanda Adkins lost her bid for the GOP nomination in the 31st House District. All other incumbent House members seeking re-election won their nomination.

WEST VIRGINIA HAS 8TH HIGHEST GDP GROWTH IN 2017

Recently released information from the U.S. Department of Commerce Bureau of Economic Analysis shows that in 2017, West Virginia was tied for the 8th highest GDP growth in the nation. West Virginia's GDP grew at a rate of 2.6% for the year, far outpacing the GDP growth of all five of West Virginia's border states. West Virginia also had the second highest GDP growth east of the Mississippi, tied with Massachusetts and following only Georgia (2.7%).

AGC WEIGHS IN WITH TREASURY DEPARTMENT ON PUBLIC PRIVATE PARTNERSHIPS

AGC joined industry partners this week in expressing concern to the Secretary of the Treasury on a provision in the recent tax reform law that may be interpreted as having the unintended consequence of creating a substantial disincentive for private investment in public infrastructure through the use of public-private partnerships (P3s). The letter highlights the fact that the interpretation of section 163(j) of the tax bill could cause substantially increased costs at all levels of government as they pursue P3 projects. Section 163(j) would cause the effective tax rate on P3s to skyrocket by restricting the P3 project company’s deductions for interest payments. AGC, along with industry partners, is asking Treasury to issue guidance to clarify the intent of section 163(j) and offered suggested guidance that is consistent with the tax bill and its legislative intents.

CONSTRUCTION COSTS SURGE IN APRIL AS NEW TARIFFS AND OTHER TRADE MEASURES LEAD TO SIGNIFICANT INCREASES IN MATERIALS PRICES

The cost of goods used in construction jumped in April at the fastest year-over-year rate since 2011, with ongoing increases for a wide range of building materials, including many that are subject to proposed tariffs that could drive prices still higher and cause scarcities, according to an analysis by the Associated General Contractors of America of Labor Department data released this week. Association officials said that the new data indicates many firms are already being squeezed by higher materials prices that they are unable to pass along to their customers.

The producer price index for inputs to construction industries, goods—a measure of all materials used in construction projects including items consumed by contractors, such as diesel fuel— rose 1.0 percent in April alone and 6.4 percent over 12 months. The year-over-year increase was the steepest since 2011, the economist noted. Meanwhile, the producer price index for nonresidential construction—a measure of what contractors say they would charge to put up a mix of school, office, warehouse, industrial and health care buildings—increased 1.1 percent for the month and 4.2 percent year-over-year.

From April 2017 to April 2018, the producer price index jumped by 11.9 percent for aluminum mill shapes, 11.0 percent for lumber and plywood and 7.4 percent for steel mill products. The U.S. has been in a dispute with Canada over lumber imports, has imposed tariffs on several types of steel and has announced or recently imposed additional tariffs—not reflected in the April price index—on steel, aluminum and numerous Chinese construction products. Other construction inputs that rose sharply in price from April 2017 to April 2018 include diesel fuel, 41.6 percent; copper and brass mill shapes, 10.5 percent; gypsum products, 7.5 percent; ready- mix concrete, 6.9 percent; and truck transportation of freight, 6.0 percent.

Association officials said the Trump Administration's tariffs pose a real threat to the continued growth of the construction industry. As steel, aluminum, and wood prices continue to surge, contractors will be forced to charge more, potentially discouraging or delaying new infrastructure and development projects. NICHOLAS COUNTY SCHOOLS REBUILDING PLAN GETS OK

On Thursday, the state School Building Authority’s board approved the Nicholas County Board of Education’s new school rebuilding/consolidation plan. The plan would rebuild Richwood Middle and High onto an elementary school in Richwood and build a new consolidated school campus near Summersville. SBA Finance Director Garry Stewart said the vote is the last required approval of the proposed Nicholas projects from the SBA board, though he said SBA staff, like himself, will have to do administrative approvals in the future. The Nicholas public school system demolished the former buildings of Richwood Middle, Richwood High and Summersville Middle after they were damaged in the June 2016 flood with students being in temporary quarters since, and the Federal Emergency Management Agency is expected to provide at least 75 percent of funding for rebuilding.

OHIO COUNTY SCHOOL BOND GETS APPROVAL; RITCHIE COUNTY BOND PROPOSAL DOES NOT

For a second time, voters in Ritchie County have rejected a proposed school bond while a separate, larger proposal in Ohio County has been approved. Results from the West Virginia Secretary of State’s Office indicated 54 percent of Ritchie County voters in Tuesday’s primary voted against the $7.9 million proposal and nearly 46 percent supported it: 1,304 to 1,110. In Ohio County, more than 60 percent of voters, 4,888 to 3,154, cast ballots for a proposed $42 million bond that includes funding for safety and building improvements at 13 schools. More than half of the approved bond amount has been designated for Wheeling Park High School with plans for a renovated entrance and science labs along with additional space for music.

The state School Building Authority will be asked to provide $27 million in additional funding. As proposed, the Ritchie County bond would have funded a new elementary school in Ellenboro. Last September, a $9.9 million bond was proposed which included the consolidated elementary school project along with funding for renovations to Ritchie County Middle High School. In December, the SBA allocated $1.4 million for the middle and high school renovations in Ritchie County which included security upgrades to the school entrance, exterior door replacements and the relocation of administrative offices.

WORKING OUTDOORS IN WARM CLIMATES-PART I

With the hot summer months just around the corner the CAWV Safety Committee would like to remind members of the special hazards posed for outdoor workers who must protect themselves against heat, sun exposure and dehydration. Employers and employees should know the potential hazards in their workplaces and how to manage them.

Sun: Sunlight contains Ultraviolet (UV) radiation, which causes premature aging of the skin, wrinkles, cataracts and skin cancer. There are no safe UV rays or safe suntans. Be especially careful in the sun if you burn easily, spend a lot of time outdoors, or have any of the following physical features: numerous, irregular, or large moles; freckles; fair skin; or blond, red or light brown hair. Here’s how to block harmful rays:

● Cover up. Wear loose-fitting, long-sleeved shirts and long pants

● Use sunscreen with a sun protection factor (SPF) of at least 30.

● Wear a hat. A wide brim hat, not a baseball cap, works best because it protects the neck, ears, eyes, forehead, nose and scalp.

● Wear UV-absorbent sunglasses (eye protection). Sunglasses should block 99 to 100 percent of UVA and UVB radiation.

● Limit exposure. UV rays are most intense between 10 a.m. and 4 p.m.

Heat: The combination of heat and humidity can be a serious health threat during the summer months. If you work outside, you may be at increased risk of heat-related illnesses. So, take precautions. Here’s how:

● Drink small amounts of water frequently and eat smaller meals before work activity

● Wear light-colored, loose fitting, breathable clothing-cotton is good

● Take frequent short breaks in cool shade

● Avoid caffeine and alcohol or large amounts of sugar

SENATE COMMITTEE RELEASES BIPARTISAN WATER INFRASTRUCTURE BILL

This week Congress took an important step in keeping its promise to authorize a water resources development bill (WRDA) entitled America’s Water Infrastructure Act of 2018. While not a spending bill, WRDA authorizes billions in funding for U.S. Army Corps of Engineers Civil Works projects, including navigation (dredging, locks), flood control (levees), hydropower (dams), recreation (parks), and water supply. This bill would authorize about $2.4 billion of new federal spending on six projects involving disaster recovery. Additionally, the bill includes several provisions impacting drinking water and wastewater infrastructure. AGC applauds Congress for returning to a regular two-year authorization of WRDA and is advocating for reform.

Notable highlights from bill include:

• Five Year Plan – Requires the Corps of Engineers to provide Congress with a work plan and four-year projected budget on an annual basis

• P3 Pilot Program – Extends the authorizations of the non-federal implementation pilot programs at $50 million for both 2020 and 2021

• Authorized Projects – The Senate authorized fewer projects than in recent WRDA bills. While the reason for this is unclear, it is expected that the House will authorize more projects

• Reauthorizes the Water Infrastructure Finance and Innovation Act (WIFIA)

• Language establishing a water infrastructure workforce development program

• A sense of Congress that the State Revolving Funds should continue receiving robust federal support

Disappointingly, the Senate bill does not include the AGC-supported Securing Required Funding for Water Infrastructure NOW (SRF-WIN) Act, which would authorize additional funding for WIFIA and allow for these funds to be accessed by State Revolving Funds for drinking and wastewater. Nor does it include AGC’s recommendations that would have streamlined duplicative environmental reviews before the Corps of Engineers can initiate a water infrastructure project. CAWV HOLDS SECOND FORUM ON UPCOMING HIGHWAY PROGRAM

The CAWV and West Virginia Division of Highways held the second highway construction forum for all CAWV contractors, subcontractors, engineers, material suppliers, equipment dealers and all other interested members on Friday, May 4, at 8:30 a.m. at Embassy Suites in Charleston. CAWV members joined WVDOH officials to discuss how the division will design, bid and award hundreds of projects for 2018. Transportation Secretary Tom Smith, his leadership team, district engineers and others outlined the WVDOH’s proposals to get the projects designed and constructed. Officials updated CAWV members on the West Virginia Jobs Act revisions; contractor registration through the state tax department; WV Turnpike construction, bonding and tolling; federal highway funding; and the 2018 state highway construction program. CAWV members also had an opportunity to ask questions and to provide comments to officials.

Speakers for the event included WVDOT Secretary Tom Smith, WV Division of Labor Commissioner Mitch Woodrum, Byrd White of the WV Tax Department, WV Parkways Authority General Manager Greg Barr, Federal Highway Administration Division Administrator Edward Stephen, WV Minority Business Association President Elliot Hicks, as well as WV Division of Highways officials including Chief State Highway Engineer Aaron Gillispie, Deputy State Highway Engineer - Construction and Development Todd Rumbaugh, General Counsel Jonathan Storage and EEO and Human Resource Director Drema Smith.

WV PARKWAYS TO HOST FOUR PUBLIC MEETINGS REGARDING PROPOSED TOLL RATE CHANGES AND ISSUANCE OF TOLL REVENUE BONDS

The West Virginia Parkways Authority will be hosting a series of four informational public meetings to discuss proposed toll rate changes and the issuance of toll revenue bonds. The meetings will consist of six informational stations discussing various aspects of the proposal, an overview by the Parkways General Manager, and time for oral comments. Allow submission of and accept written comments, oral comments, and exhibits by attendees. Attendees may present their information by oral presentation or by written presentation or by written comments.

The purpose of the meetings is to:

• Provide notice of and information to members of the public about the needs, reasons, and justifications for the proposed change in toll rates and the proposed issuance of toll revenue bonds.
