Studying Law at NUI Galway Is More Than Attending Lectures. There Is a Whole Range Of School of Law at NUI Galway 2017-2018 Undergraduate Degrees www.nuigalway.ie/law Contact Details: T: + 353 91 49 2752 E: [email protected] www.nuigalway.ie/law www.facebook.com/schooloflaw www.twitter.com/NUIGLaw or @NUIGLaw WELCOME TO THE SCHOOL OF LAW AT NUI GALWAY Welcome Students choose to study law at university for many reasons. Some wish to pursue a professional career as a solicitor or barrister, others wish to keep options open by getting a valuable grounding in law or law and other disciplines. The broad range of options available to undergraduate students at our School provide a secure path to traditional law careers as well as other possibilities such as journalism, banking, human rights, accountancy, tax consultancy, lecturing and employment in the civil service and non-governmental organisations. These options are explained in greater detail in this brochure and I encourage you to contact us directly if we can be of assistance in further explaining or clarifying information regarding our three main undergraduate programmes: Bachelor of Civil Law, B.Corp.Law or our B.A. (Law). Employability is at the heart of our teaching mission. With that in mind we have developed an innovative and original programme of Clinical Legal Education through which students gain invaluable work experience and develop practical legal skills. Our graduates enjoy success at the highest levels in Ireland and abroad and we are immensely proud of their achievements as a testament to the solid legal education that they received at NUI Galway. Our curriculum features opportunities for problem-based learning, translation of knowledge into action, and the development of skills critical to engaged, effective and enlightened lawyers. Information about our curriculum can be found at http://www.mcgill.ca/law/future. The BCL/JD program is a full-time first level professional law degree. • Bachelor of Civil Law
Course Information Sheet for entry in 2016-17 Bachelor of Civil Law About the course The Bachelor of Civil Law (BCL) is a world-renowned taught graduate course in law, designed to serve outstanding law students from common law backgrounds. The academic standard is significantly higher than that required in a first law degree, and only those with outstanding first law degrees are admitted. You will choose four courses from a list of around 40 different options, including a dissertation option. All options are taught by a combination of seminars and tutorials apart from the dissertation option, which involves one-to-one sessions with an assigned supervisor. Seminars are normally led by a senior member of academic staff but are typically interactive in nature, and you will be expected to participate in the discussions arising from the material covered. Tutorials involve an intensive discussion between a tutor and two or three students, providing an opportunity for you to present your ideas and discuss your work with leading academics. Typically, seminars will introduce you to a particular area of study and familiarise you with general concepts and ideas which will then be investigated in greater depth in the tutorials. For most tutorials you will be expected to write an essay, which typically will be marked and returned to you at the next tutorial. Outside of the seminars and tutorials, you will be expected to read extensively in order to acquire the necessary knowledge to engage with course material at an appropriate level. All course options are examined by timed examinations at the end of the course - with the exception of the Jurisprudence and Political Theory option, which is examined by assessed essay, and the dissertation option.

www.theblackletter.co.uk!1 www.theblackletter.co.ukNeil Egan-Ronayne www.theblackletter.co.ukDecember 2015 Property Law Implied Easements Gerry has been in possession of a registered fee simple estate or ‘freehold’ estate since September 1990. Barton (Construction) Ltd were the registered owners of the unadopted service road that runs along the rear of Gerry’s property up until March 2015 whereupon Barton (Construction) Ltd sold the road to Hyde Ltd as part of a land package. Hyde Ltd has since established a business operation that uses the service road for access. As part of that process they have also erected a lockable gate across the public highway end of the road that is only accessible by using keys held by their employees. Gerry has for a continuous period used the service road in order to park his car and by assumption it is understood that Gerry does not park on the service road itself rather he uses it only as a means of access. When considering Gerry’s position in relation to his denial of access to the service road it would be prudent to refer to the common law position on easements.1 For an easement to be legally considered there are a number of criteria first established in Re Ellenborough Park2 which when met permit such a justification: I. A dominant tenement3 and a servient tenement burdened by the easement must be shown to exist. II. The easement must benefit the dominant tenement. III. The dominant and servient tenements must fall under different ownership.4 IV.
