Significantly, in a prior action before the Court of Appeals, counsel for both parties fully briefed the identical question presented in this case, rendering expedited review of this action particularly appropriate. See Hamilton v. Metro. Gov't of Nashville, No. M2016-00446-COA- R3CV, 2016 WL 6248026 (Tenn. Ct. App. Oct. 25, 2016).1 To enable prompt resolution of this case, counsels’ prior briefing in Hamilton is attached in a Notice of Filing Supplemental Papers for the Court’s review. To address the same question presented as applied to this case, however, the Petitioner respectfully states as follows: 1 In Hamilton, the Court of Appeals did not adjudicate the merits of the question presented, instead dismissing that case on standing grounds only. See 2016 WL 6248026, at *4 (Tenn. Ct. App. Oct. 25, 2016). I. FACTS On Friday, March 9, 2018, in a publicly noticed meeting, DCEC voted affirmatively in a split, party-line, 3-2 vote to hold an election to fill the vacancy for the office of Mayor on August 2, 2018 (the “Vacancy”). The Vacancy was created by the resignation of former Mayor Megan Barry. DCEC received legally required notice of the Vacancy by letter dated March 6, 2018 from the Metro Clerk.

Tennessee Supreme Court Rule 48(a)(1) Statement (i) Questions Presented for Review This case involves a pure question of law regarding a matter of unusual public importance: When the Metropolitan Government of Nashville and Davidson County— Tennessee’s capital city and most populous municipality—must hold an election to fill a vacancy in the office of Mayor. Even more significantly, this case seeks to determine -1- whether the citizens of Nashville are entitled to have their government faithfully adhere to the text of a Charter provision that they collectively enacted with overwhelming support by popular referendum. (ii) Statement of the Relevant Facts It is undisputed that in August of 2007, the Respondents placed a proposed amendment to the Metro Charter on the ballot for approval by popular referendum.1 In pertinent part, the Respondents summarized that proposed Charter amendment as follows: “This amendment would require that a special election be held to fill a vacancy in the office of mayor .

Me?” An Informational Guide to Becoming a School Board Member for Metro Nashville Public Schools Written and distributed for potential Metro Nashville Board of Education candidates in Davidson County General Elections which occur in even numbered years by: Nashville Public Education Foundation Introduction The nine members of the Metro Nashville School Board make critical policy decisions which guide the public schools in Metropolitan Nashville Davidson County, Tennessee. Members serve for four-year terms and may be reelected. Terms expire for four of the nine School Board members in 2006 and for five members in 2008.
