Introduction This Timber Legality Risk Assessment for Romania provides an analysis of the risk of sourcing timber from areas of illegal harvesting and transport. NEPCon has been working on risk assessments for timber legality, in partnership with a number of organisations, since 2007. In that time, NEPCon has developed timber risk assessments for more than 60 countries, illustrated in Figure 1. Figure 1. Countries for which NEPCon have developed a legality risk assessment for timber The risk assessments are developed in collaboration with local forest legality experts and use an assessment methodology jointly developed by FSC and NEPCon. Overview of Legality risks The key legality risks identified in this report relate to: Legal rights to harvest: There is a known risk to the sub-category 1.4 Harvesting permits: The risk related to harvesting permits originates in the issuing procedures and in the difficulty of controlling the decision system behind establishing the types of cuts, the drafting of volume estimation documents and the monitoring of the chain of custody through the wood tracking application. There is a risk of illegal logged volume introduced to the chain of custody due to ownership fragmentation, insufficient marking of property boundaries in the field and lack of administration contracts for every forest area. Timber harvesting activities: There is a known risk for Timber harvesting regulations (1.8), related to harvesting firms being authorised without their claims regarding equipment, machinery and sufficiently trained staff being verified. The procedure for authorisation is time consuming and delays the start of the forest harvesting process, which can prolong harvesting beyond the permitted period and force firms to resume the harvest in the next winter. For Protected sites and species (1.9) there is a risk of protected areas without a valid management plan. During the development of management plans for protected areas there is the risk of insufficient stakeholder consultation. There is a risk of illegal logging in protected areas. Regarding Environmental requirements (1.10), there is a risk of unconformities related to forest harvesting, referring to skidding trails, damage to remaining trees and water protection. Forest harvests without an environmental permit or ministerial decision were encountered. Health and safety (1.11) procedures are not properly implemented in the field, casual labour is a common phenomenon in Romania. This is related to the risk for Legal employment (1.12), the length of employment is very short in the forestry sector. Many employees prefer not to contract workers with employment contracts. Trade and transport: There is a known risk for Classification of species, quantities, qualities (1.16.), a risk of difference in the estimated volume of wood is identified, which can be transmitted throughout the chain of custody. Any underestimates in the diameter or heights measured in the field can be transmitted throughout the chain of custody, especially if the WOOD Tracking system is not applied properly. An identified risk for Trade and transport (1.17) is the weakness of the WOOD Tracking system. As there is no cross-checking between the volumes of assortments in the Volume Estimation Document and the volumes from the harvesting results, there is a certain risk that that firewood from a certain harvesting site is sold on the local market (with very short transportation distances and low risk of being identified by transport control) and be introduced

Only in Brazil have I seen anything like it." (overheard) Romania is justly proud of its forests and its age old tradition of forest management. We were fortunate to see woods which would be inaccessible without the organi- sation of the Romanian Forest Service, and to be guided by knowledgeable and enthusiastic foresters. We are particularly grateful to Florian Borlea. His invitation to Robert Tottenham, when they met at an international meeting of Presidents of Pro Silva, triggered the visit of Pro Silva Ireland to see Romanian forests and their close-to -nature management. The scale in time and space challenges the imagination. It took eight hours to walk through a natural beech forest. It was an inspiration to see how managed oakwoods (rotation 120 years) can regenerate naturally and provide continuous cover. Mixed woodland needs skilled management, and this must accommodate not only the timber industry but use of the forests by visiting sportsmen and gatherers of mushrooms as well as wildlife conservation, protection of water quality and recreation. And this integrated approach is shown to be profitable. No government funding is needed to support forestry in Romania. Above all we related the experience to Irish forestry and the tradition of hardwood and permanent cover which has been lost here. Only by seeing at first hand the tradition continued for many generations, as in Romania, can we begin to envisage how our own hardwood tradition can be regained.

The allowable cut is determined taking into account rotation length, average species composition, forest structure according to the site indices and the existing distribution of age classes. The actual present-day contribution of the forestry sector to the GDP show us that wood and other forest resources in Romania are still underused resources from the economical point of view. The primary wood processing sector is important but an important part of the primary and secondary timber industry has been operating in an environment of outdated technology. The main problem of the forest products industry in Romania nowadays is the poor knowledge of marketing and market information and little access to finance grants and loans. Also, the reliable and accurate information about the forest business sector is missing in the bussines environment. The fundamental objective of the present-day national forestry policy and strategy in Romania is the development of the forestry sector in order to increase the sector contribution to the improvement of the quality of life, based on the sustainable management of the forests.

During the inter-war period two types of compossessorates were most common in the Olt Land, between the Olt River and the Southern Carpathians: those of the former boyars and the ones owned by the former serfs. An analysis of the 1904 Austro-Hungarian Regulation on the organization and management of the commons, of the 1910 Romanian Forest Code that was implemented in Transylva- nia after 1918, and of the by-laws of compossessorates, derived from the aforementioned documents, unveils the concern of both legislators and members of compossessorates for the preservation, bal- anced exploitation and regeneration of the forest fund and their focus on sustainable management of forests. The compossessorates were disbanded upon the instauration of the communist regime in Romania and re-established after 1989. Nowadays, compossessorates in the Olt Land continue the local tradition of sustainably managing the forests and the pastures. Their activity in this regard can be improved. Collaboration of the communal schools and the university with the compossessorates, the use of the Internet to promote their image and the involvement of NGOs in their support would be effective in this respect.
