Another 46% (1,290 units) was between the built and the planned route of the fence. Only 18% was west of the built fence. At least 10% (282 housing units) of the construction was illegal according to the Israeli laws applied in the Occupied Territories (regardless of the illegality of all settlements according to the international law). Out of those, 234 units (8% of the total construction) were in illegal outposts. The vast majority of the new construction, 91% (2,544 housing units), was for permanent structures, while that the remainder 9% were new housing units in the shape of mobile homes both in outposts and in settlements. 68 new public buildings (such as schools, synagogues etc.) started to be built, alongside 69 structures for industry or agriculture.     Since the beginning of the second intifada, in September 2000, Israel has imposed restrictions on the movement of Palestinians in the West Bank that are unprecedented in scope and duration. As a result, Palestinian freedom of movement, which was limited in any event, has turned from a fundamental human right to a privilege that Israel grants or withholds as it deems fit. The restrictions have made traveling from one section to another an exceptional occurrence, subject to various conditions and a showing of justification for the journey. Almost every trip in the West Bank entails a great loss of time, much uncertainty, friction with soldiers, and often substantial additional expense. The restrictions on movement that Israel has imposed on Palestinians in the West Bank have split the West Bank into six major geographical units: North, Central, South, the Jordan Valley and northern Dead Sea, the enclaves resulting from the Separation Barrier, and East Jerusalem. In addition to the restrictions on movement from area to area, Israel also severely restricts movement within each area by splitting them up into subsections, and by controlling and limiting movement between them. This geographic division of the West Bank greatly affects every aspect of Palestinian life. The 1992 Basic Law: Human Dignity and Liberty describes the country as a “Jewish and democratic state.” The 2018 Basic Law: Israel – The Nation State of the Jewish People law determines, according to the government, that “the Land of Israel is the historical homeland of the Jewish people; the State of Israel is the nation state of the Jewish People, in which it realizes its natural, cultural, religious and historical right to self-determination; and exercising the right to national self- determination in the State of Israel is unique to the Jewish People.” In June, authorities charged Zion Cohen for carrying out attacks on May 17 on religious institutions in Petah Tikva, Ashdod, Tel Aviv, and Kfar Saba. According to his indictment, Cohen sought to stop religious institutions from providing services to secular individuals, thereby furthering his goal of separating religion and the state. The Israeli government neither planned nor approved of the outpost and the Ministry of Finance did not transfer funds to it. Nonetheless, the outpost contains dozens of mobile homes, intensive construction of permanent homes, an access road (passing through private Palestinian land), utility poles, and a water and sewage system - all illegal and under demolition orders. If all of this activity is illegal, how is a new settlement being established in the heart of the West Bank, against the government's position and in contravention of democratic decisions? The present report attempts to answer this question. This report exposes the fraudulent system set up by a handful of settlers enabling a small and organized group to create facts on the ground and impose its vision upon the State of Israel.

Israeli Prime Minister Ehud Olmert and Palestinian Authority (PA) President Mahmud Abbas reached a “Joint Understanding,” in which they agreed to launch continuous bilateral negotiations in an effort to conclude a peace treaty by the end of 2008 and to simultaneously implement the moribund 2003 Performance-Based Road Map to a Permanent Two-State Solution to the Israeli-Palestinian Conflict. Both leaders are operating under significant domestic political constraints and they continue to disagree on many issues. Thus, their negotiations will be challenging. Background In early 2007, Secretary of State Condoleezza Rice was said to have promised moderate Arab regimes that the United States would become more engaged in the Israeli- Arab peace process in exchange for their support for countering increasing Iranian influence in the Middle East.1 The Secretary made eight trips to the region during the year, initially to work with Israeli Prime Minister Ehud Olmert and Palestinian Authority (PA) President Mahmud Abbas on developing a “political horizon” that would lead to a resumption of the long-stalled Performance-Based Road Map to a Permanent Two-State Solution to the Israeli-Palestinian Conflict, issued by the international Quartet (the United States, European Union, United Nations, and Russia) on April 30, 2003.2 Each side maintains that the other has not fulfilled its obligations under the three-phase Road Map; independent observers agree that neither has done so.
