In the context of the election for the 38th , MERCAZ USA has petitioned the American Zionist Movement (AZM) Tribunal for relief arising out of the allegations against ERETZ HAKODESH. ERETZ HAKODESH has denied the Complaint of MERCAZ and filed a Counterclaim against MERCAZ.

The World Zionist Organization (WZO) is an institution premised on the fundamental principles of , as defined in the WZO Constitution. The Jerusalem Program is the official platform of the WZO and the global Zionist movement. All proposed slate candidates and voters, to be eligible to vote in the Zionist Congress election, must expressly agree to the statement that: “I declare that I accept the Jerusalem Program”, which reads as follows:

“Zionism, the national liberation movement of the Jewish people, brought about the establishment of the State of , and views a Jewish, Zionist, democratic and secure State of Israel to be the expression of the common responsibility of the Jewish people for its continuity and future. The foundations of Zionism are:

1. The unity of the Jewish people, its bond to its historic homeland Eretz Yisrael, and the centrality of the State of Israel and Jerusalem, its capital, in the life of the nation. 2. to Israel from all countries and the effective integration of all immigrants into Israeli society. 3. Strengthening Israel as a Jewish, Zionist and democratic state and shaping it as an exemplary society with a unique moral and spiritual character, marked by mutual respect for the multi-faceted Jewish people, rooted in the vision of the prophets, striving for peace and contributing to the betterment of the world. 4. Ensuring the future and the distinctiveness of the Jewish people by furthering Jewish, Hebrew, and Zionist education, fostering spiritual and cultural values and teaching Hebrew as the national language. 5. Nurturing mutual Jewish responsibility, defending the rights of Jews as individuals and as a nation, representing the national Zionist interests of the Jewish people, and struggling against all manifestations of anti-Semitism. 6. Settling the country as an expression of practical Zionism.”

DECISION OF THE TRIBUNAL:

After reviewing all the materials submitted by the parties and hearing oral argument on June 24, 2020, the Tribunal decided, by a vote of 9-0 as follows:

1. Because of statements made during and after the campaign by its presumptive spokespersons or advocates, ERETZ HAKODESH reaffirmed in these proceedings its commitment to all aspects of The Jerusalem Program. ERETZ HAKODESH is directed to publicize this reaffirmation of its commitment to The Jerusalem Program, including the full text, on the homepage of its website, as well as in an individual notification to all listed on its slate of delegate candidates This publication is to be implemented within thirty days following the issuance of this ruling, and copies of the notices shall be provided to the AZM Tribunal. 2. Recognizing that the work of the AZM and the WZO is enhanced by our pursuing Derech Eretz (common decency) in our engagement with each other, despite differences of opinion, MERCAZ and ERETZ HAKODESH are strongly urged henceforth to desist from engaging in demeaning and denigrating rhetoric toward each other. 3. Both the complaint of MERCAZ and counterclaim of ERETZ HAKODESH are denied.
