1. NOTICE IS HEREBY GIVEN that the Council of the Borough of Merton, on 13 July 2021, made the above-mentioned Orders under sections 82, 83, 84 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, as amended, and all other enabling powers.

2. The general effect of the “Restricted Road” Order will be to revoke the (Restricted Road) (No. 1) Traffic Order 2016 and the London Borough of Merton (Restricted Road) (No. 1) Traffic Order 2019 and consolidate their provisions into one Order.

3. The general effect of the “Speed Limit” Order will be to revoke the Merton (20 MPH Limit) (No. 2) Traffic Order 2019 and the Merton (20 MPH Speed Limit) (No. 6) Traffic Order 2019 and consolidate their provisions into one Order.

4. A copy of the Orders, which will come into force on 16 July 2021, and other documents giving more detailed particulars of the Orders can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at Merton Link, Merton Civic Centre, London Road, , , SM4 5DX. The documents have also been made available for viewing at https://www.merton.gov.uk/streets-parking- transport/traffic-management/consultations .

5. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof, or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks from the date on which the Orders were made, make application for the purpose to the High Court.

The Council of the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, in exercise of powers conferred under sections 82, 83 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984(a) and as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985(b), and all other powers thereunto enabling hereby make the following Order:-

1. The Order shall come into force on 16 July 2021 and may be cited as the Merton (Restricted Road) (No. 1) Traffic Order 2021.

2. In this Order the expression “enactment” means any enactment, whether public, general or local and includes any Order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment and any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated re-enacted by or as having effect by virtue of any subsequent enactment.

3. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order:- (a) the lengths of highways in the London Borough of Merton specified in the Schedule to this Order shall be restricted road for the purposes of section 81 of the Road Traffic Regulation Act 1984; and (b) the London Borough of Merton (Restricted Road) (No. 1) Traffic Order 2016(c) and the London Borough of Merton (Restricted Road) (No. 1) Traffic Order 2019(d) are hereby revoked.

1. This Order may be cited as the Merton (20 MPH Speed Limit) (No. 1) Traffic Order 2021 and shall come into force on 16 July 2021.

2. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Orders specified in Schedule 1 to this Order shall be revoked.

3. No person shall cause or permit any vehicle to travel at a speed exceeding 20 miles per hour in any road or length of road specified in Schedule 2 to this Order.

4. Nothing in the Order shall apply:-

a) to anything done with the permission or at the direction of a police constable in uniform; or

b) to any person who causes any vehicle to proceed in accordance with any restriction or requirement indicated by traffic signs placed pursuant to Section 66 or Section 67 of the Road Traffic Regulation Act 1984; or

c) to any vehicle being used for police, fire brigade or ambulance purposes.
