Subject: Discrimination against LGBTI people in Hungary goes against the principles and rules of EU funding

On 15 June 2021, the Hungarian Parliament adopted a number of amendments which directly discriminate against LGBTI people. The amendments introduce a ban on teaching LGBTI education and literature and on LGBTI advertisements and other materials that the government considers to promote LGBTI rights. These amendments violate the principles set out in the Charter of Fundamental Rights of the (the Charter).

Under the rules for EU funding set out in the 2021‑2027 Common Provisions Regulation, which is set to be adopted on 24 June 2021, enabling conditions have to be met in order to receive cohesion policy funding. One of the criteria that Member States must fulfil is to set up effective mechanisms to ensure compliance with the Charter when managing funding programmes.

1. Does the Commission agree that the above‑mentioned amendments violate the Charter and will have an impact on the management of EU funds?

2. What is its view of the adoption of the amendments in relation to the aforementioned enabling condition on respect for fundamental rights?

3. Is the Commission going to refuse cohesion policy payments to Hungary as long as the amendments remain in force?
