Permit Descriptions

CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act.

Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency.

Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Flood Hazard Area Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required.

General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products.

NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4)

Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq.

Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands.

Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems.

Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State.

Coastal Wetlands: A permit authorizing disturbances to Mapped Tidal Wetlands under the Wetlands Act of 1970, N.J.S.A. 13:9A”

General Information The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Flood Hazard Area (FHA) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA).

In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover.

Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public.

Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved.

DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

WATERSHED PROPERTY REVIEW BOARD NOTICE OF REQUEST FOR JURISDICTIONAL DETERMINATION

The Watershed Property Review Board is charged with granting or denying exemptions to the Watershed Protection and Moratorium Act, P.L. 1988, c.163, as amended by P.L. 1990, c.19. The Act requires that all municipalities, municipal utility authorities and utilities obtain an exemption from the Board prior to the conveyance of any land utilized for the purpose of the protection of a public water supply. The Board only has jurisdiction over land utilized for the purpose of the protection of a public water supply.

Manalapan Lake is located Monroe Twp. II-A within the northern most portion of Thompson Park. This manmade NJ0127795 Bureau of Nonpoint recreational lake is approximately 60 years old, sedimentation has reduced water Middlesex County Pollution Control depth and fostered growth of vegetation such that it has protruded above the Ground Water surface of the lake. 120,000 cubic yards (cf3) of sediments were proposed to be (609) 633-7021 dredged from the lake to deepen the lake, retard vegetative growth and restore the lake’s recreational value and aesthetic quality. This represents the first time Manalapan Lake has been dredged. Chemical analysis of leachate quality from the sediments to be dredged from Manalapan Lake showed elevated concentrations of mercury (Hg). The sediments to be dredged from Manalapan Lake were emplaced within an upland confined disposal facility (CDF) located in an abandoned borrow pit in the approximate center of Thompson Park. The proposed upland CDF will cover approximately four acres and extend 20 feet in height.

Hydrogeologic simulations provided by the County of Middlesex indicated that the ground water plume from the proposed upland CDF is not expected to contravene New Jersey Ground Water Quality Standards (GWQS) for Hg in downgradient receptors (northern and southern tributaries of Manalapan Brook).

In order to test the validity of the prediction of the model, ground water quality will be assessed for Hg. Four ground water monitoring wells (MWs) will be used to assess ground water quality with one MW located at a point hydraulically upgradient from the upland CDF and three MWs located at points hydraulically downgradient from the upland CDF. Ground water samples shall be collected from each MW on a semi-annual basis. A ground water constituent standard (GWCS) for Hg of 1.25 ug/l has been established for this permit. Griffin Pipe Products 1100 W Front Street Kevin Ball Delaware River The above named applicant has applied for a New Jersey Pollutant Discharge Co. Elimination System (NJPDES) renewal permit to the New Jersey Department of Florence Twp. Bureau of Nonpoint Environmental Protection (NJDEP), Bureau Nonpoint Pollution Control. A NJ0005096 Pollution Control 02040201090030 location map of the facility is included. The applicant is involved with the Burlington County manufacturing of ductile iron pipe, which is primarily used for municipal water (609) 633-7021 supply purposes under the Standard Industrial Classification (SIC) 3321. Currently, the facility is offline, however, source materials are still present on the property and are in direct exposure to stormwater, which necessitates the need for coverage under an individual stormwater permit at this time. This permit may be reopened for further modification to include additional BMPs/monitoring requirements if the facility resumes operation. The proposed permit regulates stormwater discharges to Zone 2 of the Delaware River.

Lummus Technology 1515 Broad Street Kerri Standwoski FW2-NT(C2) The above named applicant has applied for a New Jersey Pollutant Discharge Elimination System (NJPDES) permit renewal to the New Jersey Department of NJ0052078 Bloomfield Town Bureau of Nonpoint Environmental Protection (NJDEP), Bureau Nonpoint Pollution Control. The Pollution Control 02030103150010 applicant provides Engineering Design Services under the Standard Industrial Essex County Classification (SIC) 8711 and is also involved with Engineering Research and (609) 633-7021 Development under SIC 8731. The existing permit regulates stormwater discharges to the Third River, classified as FW2-NT(C2). Four Seasons at Rte. 206 - Old Chester Mike Pigliacelli This is a renewal permit action for Four Seasons at Chester. The facility is an Chester Gladstone Rd. II-A existing residential development consisting of 120 condominium units and 7 Bureau of Nonpoint single family homes. NJ0071013 Chester Twp. Pollution Control Sanitary wastewater generated from the homes is discharged to ground water via Ground Water Morris County (609) 633-7021 an on-site treatment system and 6 (six) underground disposal beds. The treatment plant provides equalization, nitrification, denitrification, membrane filtration and UV disinfection, and the treated wastewater meets GWQS at the discharge point for required parameters except fecal coliform. Three (3) hydraulically downgradient monitoring wells ensure compliance for fecal coliform, and the facility has a maximum daily flow limit of 29,100 GPD.

Residuals generated at this facility are managed off-site at an approved residuals management operation. Bristol-Myers Squibb 311 Pennington-Rocky Hill John Gray This is a major modification action to an existing NJPDES-DGW permit. Rd II-A Bristol-Myers Squibb maintains infiltration/percolation lagoons that receives NJ0101575 Bureau of Nonpoint treated rinse water from research and development facilities, sanitary Hopewell Twp. Pollution Control wastewater, blowdown water, construction dewatering, and some stormwater Ground Water runoff. This major modification adds an additional monitoring well, and Mercer County (609) 633-7021 changes the effluent limit for arsenic to "Report Only." Bayway Refinery 1400 Park Ave John Gray This is a renewal action for an existing NJPDES-DGW permit. Bayway II-A Refinery treats process water and stormwater at an onsite wastewater treatment NJ0105104 Linden City Bureau of Nonpoint plant prior to discharge. The discharge to ground water may occur through lined Pollution Control stormwater rentention impoundments located on-site. Ground Water Union County (609) 633-7021 The Orchards at 24 State Highway 34 Keith Howell The Orchards at Colts Neck Shopping Center has applied for a renewal NJPDES Colts Neck Shopping II-A DGW permit. This facility consists of commercial retail shop(s), medical Center Colts Neck Twp. Bureau of Nonpoint office(s), food service(s) and dry cleaning. The retail portion of this center will Pollution Control consist of 28,346 square feet. The office portion will consist of 10,975 square NJ0109029 Monmouth County feet. The combined square footage is 39,321 square feet. (28,346 + 10,975 = (609) 633-7021 39,321 square feet) Ground Water The facility is designed to discharge 5,222 gallons per day (gpd) of sanitary wastewater which will be treated and discharged to a on-site subsurface disposal system.

All residuals generated at this facility will be managed off-site at an approved residuals management operation.

The Department is granting a reduction in the number of parameters that must be reported on the annual residuals “production” WCR at monitoring location SL1A, pursuant to N.J.A.C. 7:14C-1.13(c). The new annual residuals WCR with reduced reporting parameters will replace the existing annual residuals WCR beginning the calendar year that the permit becomes effective.

After the completion of the NJ0145831 Hillsborough Twp. Bureau of Nonpoint proposed site improvements, the wastewater generating areas of the site will Pollution Control consist of a new orientation center, five (5) cottages (existing), and an auxiliary Ground Water Somerset County restroom facility. This individual DGW permit action replaces the current T-1 (609) 633-7021 general permit the facility that regulates the existing septic fields serving the cottages.

Sanitary wastewater from the facility will discharge to an on-site constructed wetlands treatment system. The system components will include lined treatment cells, a sand filter, a trickling filter, and an equalization tank. The treated effluent will then be discharged to ground water using a drip irrigation system located south of the Farm Barn area of the facility. The design daily volume of wastewater generated by visitors, residents, and employees will be 16,000 gallons per day (gpd). Through the use of equalization, the design flow to the treatment system will be 12,000 gpd. The average daily flow will be approximately 10,000 gpd, with lows of 2,000 gpd expected. Sanitary wastewater is NJ0134627 Tewksbury Twp. Bureau of Nonpoint discharged to a Wastewater Treatment and Recycling System (WTRS) that Pollution Control discharges to subsurface disposal beds. Potable water softener backwash and Ground Water Hunterdon County boiler blow down water to the WTRS represents an additional discharge of 121 (609) 633-7021 gpd. This permit action authorizes an increased loading rate to the disposal bed from 1 gpd/sq ft. to 2 gpd/sq.ft. The design flow of the WTRS is 8,221 gpd. The disposal field is comprised of two beds of laterals with a total of 3,825 square feet of disposal area. The discharge of wastewater to the onsite disposal field is limited to a flow volume of 7,500 gpd. The facility is an office complex that includes bathrooms. Sanitary waste generated by the facility is treated by the onsite WTRS. A portion of the wastewater is recycled back to the office complex to use in restrooms for non-potable toilet flushing. Any other portions of wastewater are discharged to a subsurface disposal field located onsite.

Sludge generated at this facility is removed from the bioreactor on a periodic basis and managed at an approved residuals management site. The Department is granting a reduction in the number of parameters that must be reported on the annual residuals “production” Waste Characterization Report (WCR) at monitoring location SL1A, pursuant to N.J.A.C. 7:14C-1.13(c). The implementation of this change to the residuals “production” WCR is based upon the effective date of the permit renewal and will be activated at the beginning of the corresponding calendar year.

Notice is hereby given that the New Jersey Department of Environmental Protection (NJDEP), Bureau of Watershed Regulation, has received the following Highlands Applicability and Water Quality Management Plan Consistency Determination application(s) requesting the issuance of determinations in accordance with N.J.S.A. 13:20-1 et seq. Each application is described in the accompanying table.

All applications, prior to submittal for public notice, have been deemed administratively complete in accordance with N.J.A.C. 7:38-11.2(c)3 and the following agencies/persons have been notified by the applicant in accordance with the requirements under N.J.A.C. 7:38-9.2(b).
