Rasmea Odeh: The Case of an Indomitable Woman Downloaded from http://online.ucpress.edu/jps/article-pdf/46/4/62/142082/jps_2017_46_4_62.pdf by Oregon State University, [email protected] on 08 March 2021 NEHAD KHADER In this profile of Rasmea Odeh, JPS examines the case of a Palestinian woman who has been incarcerated in both Israel and the United States. After a decade of confinement in Israel, Odeh was freed in a prisoner exchange in 1979. Following deportation from the occupied Palestinian territories, she became a noted social justice and women’s rights organizer, first in Lebanon and Jordan, and later in the U.S., where she built the now over 800-strong Arab Women’s Committee of Chicago. In April 2017, Odeh accepted a plea bargain that would lead to her deportation from the United States after a years-long legal battle to overturn a devastating conviction on charges of immigration fraud. Observers, legal experts, and supporters consider the case to “reek of political payback,” in the words of longtime Palestine solidarity activist, author, and academic Angela Davis. Odeh’s generosity of spirit, biting wit, and easy smile did not desert her throughout the years that she fought her case. To know Odeh is to be reminded that the work of organizing for social justice is about the collective rather than the individual, and that engagement, relationship building, and trust are the foundations of such work. A strong woman is caring and tough, practical and spiritual, revolutionary and flexible. You are all of these. You are all powerful and you hold up half of the sky. -

And thank you, Chairman Nadler, for stating in your November 27 letter that this Committee “will likely examine the causes of racial and religious violence.”2 For the past 25 years, I have served as president of the oldest pro-Israel organization in the country, the non-partisan Zionist Organization of America (the ZOA). A key ZOA mission is protecting American Jews and others from antisemitism and violence. As a child of Holocaust survivors, I’ve personally felt the horrors of unbridled antisemitism. I was born in a displaced persons camp in Germany, and grew up without the loving presence of most of my grandparents, aunts, uncles and cousins, whom the Nazis murdered. Ms. Odeh’s submissions in support of reconsideration are substantial and, we submit, would surely sustain her burden of proof, if reconsidered: • This Court has already found that Ms. Odeh poses no risk of danger to persons or the community. • While the Court found that Ms. Odeh failed to sustain her burden of proof that she presents no risk of flight because she has no family in Chicago, Ms. Odeh has shown, in her reconsideration papers, that she has close family in Chicago, including two nephews, with whom she has lived and helped to raise. • Additionally, Ms. Odeh has shown exceptionally strong and credible non-family ties to her home community of Chicago – ties far stronger than most U.S.-born Americans are able to show: o She rejected a plea offer that would have guaranteed no term of imprisonment, because it would have required her to leave Chicago and the United States to avoid the risk of deportation. -

Drain RASMIEH ODEH, Defendant MOTION TO DISMISS INDICTMENT AND BRIEF IN SUPPORT NOW COMES the defendant Rasmea Odeh, by her undersigned counsel and respectfully requests that this Court dismiss the above-entitled indictment as it is the product of an illegal investigation into the First Amendment activities of the Arab-American Action Network (AAAN) and intended to suppress the work of the defendant in support of the Arab community of Chicago.' In support of this request the defendant states the following: 1. In January of 2010, the FBI and office of the United States Attorney for the Northern District of Illinois were involved in the investigation of the AAAN ' When present counsel appeared before the prior judge on May 25, 2014, to replace appointed counsel, who had filed no pre-trial motions and expected to plead the defendant, new counsel was told that the time to file pre-trial motions had passed. Your undersigned objected arguing that new counsel should have the opportunity to file pre- trial motions since prior counsel had not done so. Judge Borman nonetheless refused to allow new counsel to file pre-trial motions. Since your Honor has now been assigned to replace Judge Borman, and since due process and fundamental fairness should allow the defendant to file pre-trial motions, the defendant submits this motion.
