Hughes, Ph.D., president. A well-known businessman and community figure even before his association with the San Diego football team, Klein was chairman of the board and president of National General Corporation, a firm which under his stewardship was one of the outstanding growth companies in California. Klein's background als o includes banking, publishing, insurance, and television and movie production in addition to his sports involvements. A native of New York, Klein moved to San Diego in 1979 from Los Angeles. In both communities, he is widely known as a strong supporter of the arts and has served the United Jewish Appeal and the American Red Cross. He was awarded the Medallion of Valor in 1969 by the Government of Israel. Klein also serves on the board of the City National Bank, Beverly Hills, and the Zenith National Insurance Corporation. Sanders, Dean of Graduate Studies Date ABSTRACT This thesis aims to provide historical context for the Sports Broadcasting Act of 1961 which allowed professional sports teams to collectively negotiate television contracts and equally share in the revenues. According to Immanuel Wallerstein, the state crafting legislation to allow an anticompetitive business practice is an example of a basic contradiction of capitalism being reconciled. Researching the development of the SBA unveils two historically significant narratives. The first is the fact that antitrust legislator Emanuel Celler crafted the act with the intent of providing the National Football League competition although the act unintentionally aided the formation of a professional football monopoly. The other is that the act legalized a collectivist business practice in a time of anticommunist fervor and was written by a legislator with well-documented anticommunist credentials.

INTRODUCTION Professional sports leagues were established to privately govern the major sports in the United States.' The individual team franchises in- volved in each major sport have combined to establish these entities to direct the financial success of their particular sport.2 To obtain a franchise in a professional league, the individual owners must contractu- ally agree to be controlled by the constitution and by-laws of that league.3 The cooperation required under these league rules is often rec- ognized as an important factor in bringing about the financial success of professional sports leagues.' At Balboa Stadium 1965 Chuck Gunderson A merica met the Beatles on Sunday, February 9, 1964, as a record television audience in 73 million homes tuned into the Ed Sullivan Show to see four longhaired British pop singers make their United States debut. The band’s performance would remain etched in the memories of young people along with visions of man first walking on the moon and the gyrations of Elvis Presley. This is evident by the Beatles’ continued popularity four decades after their much- publicized split in 1970.
