Message from Vice Premier Wu Yi January 3, 2006

The Council for the Promotion of International Trade: On the occasion of the CCPIT Working Conference, I would like to extend warm greetings to all CCPIT colleagues nationwide. In 2005, under the guidance of the Central Committee of the Communist Party of China (CPC) and the State Council, the CCPIT has followed closely the general picture of national diplomacy and the overall deployment of foreign economic and trade strategies, given full play to its features and strength, taken the initiative to serve the administration and businesses, and hence made tremendous achievements in foreign engagements, business promotion and institutional building. The year 2006 marks the commencement of the eleventh five-year plan. I hope the CCPIT will further digest and build on the conference spirit of the Fifth Plenary Session of the 16th CPC Central Committee and the Central Economic Work Conference, carefully follow and analyze the current sce- nario and tasks of foreign political relations, economic engagement and trade for China, combine scien- tific development concept with the reality, and give full play to the role of a trade promotion organiza- tion and chamber of commerce. I hope CCPIT will creatively carry out its work in all fronts to follow and serve the national needs of foreign relations and trade development, facilitate and promote Chinese businesses to “go global”, and make greater contribution to the implementation of the win-for-all open- ing strategy, and the further progress of our economy and society.

Wan Jifei Chairman

Mr. Wan Jifei was born in October 1948 in Dongping County, Shandong Province. He studied at the Department of political science and Administrative Management of the Peking University and graduated with a Master's degree in laws. He has a professional qualification of Senior Economist. Mr. Wan started working in January 1969, after which he worked successively as Deputy Secretary- general of the CPC Committee of Shunyi County, Municipality; Assistant Governor of Ningxia Hui Autonomous Region and concurrently Deputy Director General of Ningxia Foreign Trade and Economic Rela- tions Commission; Deputy Director General of the Commission of Foreign Trade and Economic Relations of Beijing Municipal Government. He served as Vice Minister of the Office for Special Economic Zones of the State Council in December 1995; Vice Minister of the Office for Restructuring the Economic Systems of the State Council in March 1998; Vice Chairman of China Council for the Promotion of International Trade (CCPIT) and China Chamber of International Commerce (CCOIC) in February 2000 respectively. In May 2003, he was appointed as Chairman of CCPIT and CCOIC and has been as such since then. Mr. Wan is concurrently Chairman of ICC China, Chairman of China International Economic and Trade Arbitration Commission, Chairman of China International Maritime Arbitration Commission, Member and Deputy Director of Organizing Committee of World Expo 2010 Shanghai, Executive Director of Executive Committee of World Expo 2010 Shanghai, Chairman of China Member Committee of the Pacific Basin Eco- nomic Council (PBEC), Chairman of China-ASEAN Business Council, Chairman of the China-Arab Joint Cham- ber of Commerce, Vice Chairman of China-Arab Friendship Association, Chinese Chairman of the Industrial Cooperation Sub-Committee of the China- Friendship, Peace and Development Committee, Chinese Chairman of US-China Business Dialogue, Executive Director of the China Overseas Exchange Association, Chairman of the China Association of Foreign Service Trades, Advisor to the Forth National Council of China International Friendship Cities Association, Honorary Chairman of the China Academy of Arbitration Law, Honorary Chairman of the Beijing Society of International Economy and Trade. He is also a Guest Professor at the Nankai University.

5 Zhang Zhou Vice Chairman

Mr. Zhang Zhou, Han nationality, was born in Xingtang County, Hebei Province in September 1954. He has twin master degrees in economic management and world economy, and holds the professional certificate of engineer. Mr. Zhang successively worked, from March 1971 to March 1978, in the Chemical Plant, Yecheng Road Maintenance Section and Agro-machinery Manufacturing and Maintenance Plant of Kashi region, Xinjiang. He then studied in the Agro-machinery Department of the Xinjiang Agricultural University, and graduated in March 1982 with a bachelor degree. Then he became an official with the Pasture Regulation Division of the Husbandry Department of Xinjiang government. He was the deputy head and then head of the Hutubi Bull Farm from August 1984 to November 1990, which was followed by the job as managing director of Xinjiang Animal Husbandry group. From December 1991 on, he became deputy chief executive, deputy Party secretary, and then Party secretary in the Bayingguoleng prefecture before ascending to the vice-chairmanship of the Xinjiang Uygur Autonomous Region in January 1998. He became, in June 2005, the Vice Chairman of the China Council for the Promotion of Interna- tional Trade and the China Chamber of International Commerce. Mr. Zhang is also Vice Chairman of the China International Economic and Trade Arbitration Commission, and Vice Chairman of the China International Maritime Arbitration Commission.

Zhang Wei Vice Chairman

Dr. Zhang Wei was born in July 1958 in Ju County, Shandong Province. He graduated from the College of Accounting, Shanghai Finance and Economic University, and the Law School of Yale University. He has a Doctor's degree in administration and has been entitled Professor. Starting to work in August 1975, he was sent to the countryside and later worked in a factory. From 1983, he successively served as Deputy Secretary General of the Student Federation of Shandong Province; Deputy Secretary-general of the Party Committee of Wenshang County in Shandong; Deputy Provincial Secretary-general of Shandong Youth League; Vice Chairman of Shandong Youth Federation and concur- rently Chairman of Junior Entrepreneurs' Association of Shandong Province. From 1991 onward, he suc- cessively served as Director of Agriculture Finance Division, Department of Finance and Taxation in Hainan Province; Deputy Director General of the Department and concurrently head of Xinghua Company; Deputy Director General of Hainan Provincial Bureau of Revenue. In January 1991, he was appointed as the Executive Deputy Director General of the Agriculture Taxation Bureau of the State Administration of Taxation. In June 1996, he was promoted to be Director General of the General Office of the State Administration of Taxation. In August 2003, he became Vice-Chairman of China Council for the Promotion of International Trade and China Chamber of International Commerce. Concurrently, he is Executive Director of the China Taxation Society, Director of China Finance Society, Executive Director of China Law Society (Law of Finance and Taxation),Vice President of Chinese Group of International Association for the Protection of Intellectual Property (AIPPI-China), and Panelist in the Doc- tor Steering Team of the Law School of Peking University. He focuses his study on macroeconomics, finance, taxation, investment and accounting, and authors a number of books and essays in the fields.

Gao Yan Vice Chairwoman

Mme. Gao Yan was born in November 1958. She graduated in 1982 from Renmin University of China. Mme. Gao started her career in March 1977. She worked successively as Deputy Director and later Director in the General Office of the Ministry of Foreign Trade. She became Deputy Director General of the General Office of the Ministry of Foreign Trade and Economic Cooperation in June 1995 and then Director General and Spokesperson of the Ministry in January 2001. She served as Director General of the General Office, Director General of the Information Office, and Spokesperson of the Ministry of Commerce in June 2003. She became Vice Chairwoman of the China Council for the Promotion of International Trade and the China Chamber of International Commerce in August 2003. Mme. Gao is concurrently Executive Director of China International Trade Society, Executive Direc- tor of Chinese Public Administration Society, Editor for China WTO-Entry Serials, Director of the 9th Execu- tive Commission of the All-China Women's Federation, Executive Deputy Director of Liaison Department and Member of Organizing Committee of World Expo 2010 Shanghai, Vice Chairwoman of the Chinese Workers’ Center for International Exchanges, Honorary Director of Standing Committee of China Special- ized Committee of Exhibition Organizations, Chinese Chairperson of the China- Business Council.

Yu Ping Vice Chairman

Mr. Yu Ping was born in June 1955 in Haiyang City, Shandong Province. He graduated from the English Department of the Guangzhou Institute of Foreign Languages and he got an EMBA degree in the Peking University. He later completed the advanced training program on International Trade in the Depart- ment of Finance and Trade of the Graduate school of the Chinese Academy of Social Sciences. Since September 2002, He is now a certified Senior Economist. Mr. Yu served the Ministry of Foreign Trade from June 1976. He later transferred to the Liaison Department (now the Department of International Relations) of the China Council for the Promotion of International Trade in February 1977. Mr. Yu studied Literature and English from October 1977 to July 1979 in Bayero University in . In CCPIT, Mr. Yu served successively as Deputy Director, Director of the Division of European Affairs, Deputy Director General and Director General of the Department of International Relations, the CCPIT US Chief Representative, Deputy Secretary General and concurrently Director General of the Personnel Department. In August 2003, Mr. Yu became Vice Chairman of CCPIT and CCOIC. Concurrently, he is Chief Delegate of ICC China, Chief Delegate of China to International Bureau of Exhibitions, Director of China- Friendship Association, and Director of Chinese People's Institute of Foreign Affairs, Vice Chairman of Council of China-Russia Friendship Association, Arbitrator of China Inter- national Economic and Trade Arbitration Commission.

China in 2005 stayed on the fast track of steady economic growth and made encouraging advances in building a harmonious society. The China Council for the Promotion of International Trade (CCPIT) made fresh records in various trade promotion fronts, by focusing on general deployment of foreign relations, trade and economic strategies of the Chinese government, implementing scientific development concept, delving into new phenomena of post-transition period of WTO entry, striving to better serve Chinese and foreign businesses, undertaking various forms of trade promotion and foreign communication, and basing development on innovation. I would like to, on behalf of the CCPIT and China Chamber of International Commerce (CCOIC), extend the hearty gratitude to Chinese and foreign friends who have rendered us long-term commitments and supports.

1.Conducting foreign engagements and business promotions by various means and ways following the general deployment of Chinese foreign relations and business strategies In 2005, the CCPIT received 107 visiting foreign delegations, including 30 missions led by foreign state leaders. It ar- ranged 22 audiences with Chinese state leaders, including meeting with foreign guests and participating in international conferences, and 267 other high-level meetings for foreign business delegations. It organized 70 outbound missions and signed 24 new cooperation agreements with counterpart organizations. It established two bilateral business councils and arranged over 60 business matchmaking meetings, seminars and project briefings. Organizing outbound and receiving incoming business delegations accompanying state leaders to highlight the implementation of “state leader diplomacy” In 2005, the CCPIT organized several China Business Delegations to accompany President Hu Jintao, Premier Wen Jiabao, Vice President Zeng Qinghong and other state leaders to , Spain, , , , , , , , , , , , , to participate in the APEC CEO Summit, the 2005 Asia- Africa Business Summit, and cosponsored with counterpart organizations on the first Canada China Business Forum, the first China-Spain Business Summit, the China-Portugal Entrepreneurs Forum, and other big-scale business networkings. The Council hosted 30 foreign business delegations accompanying their visiting senior state leaders and held presiden- tial speeches, business seminars and symposiums for these delegations. Holding a series of big bilateral or multilateral events, and fostering successional forums with unique feature, to forge key CCPIT platforms for overseas-related (including Hong Kong and Macao) event mechanisms Over the years, the CCPIT has actively collaborated with Chinese government agencies, local administrations and foreign counterparts to establish the big event mechanism, to provide stable high-level communication platforms for Chinese and

foreign businesses. In 2005, it held the second EU-China Business Summit, the China- Caribbean Business Conference, the Entrepreneurs’ Encounter of Cooperation between China and the Portuguese Speaking Countries 2005 , and the first China-Arab Business Conference, which were participated in by a large number of delegates from Chinese and foreign government agencies, businesses, research and news organizations, and had broad influence and sound effect. The CCPIT, at the support of the Chinese Ministry of Commerce and the govern- ment of Guangxi Zhuang Autonomous Region, held the Second China-ASEAN Business & Investment Summit, where it signed and released together with ASEAN national cham- bers of commerce the Nanning Joint Declaration, to accelerate the development of China- ASEAN Free Trade Area. It organized Chinese business people and chamber executives to South Korea to participate in the fourth China-Japan-Korea Business Forum cosponsored by the CCPIT and its counterparts in Japan and South Korea, where the Chinese participants expressed opinions and aspirations of the Chinese business community on the key issues of China- Japan-South Korea business engagement and cooperation. The CCPIT also held the China-South Pacific Islands Trade, Investment and Tourism Business Summit in Beijing. Business relations with countries without diplomatic ties have been further developed. The CCPIT hosted the del- egations from the Costa Rican Foreign Trade Corporation and the Chamber of Commerce, Industry, Agriculture of . It brought delegations to , Panama, and organized the Seventh Commercial Expo of the People's Republic of China in Panama, and the second Commercial China Expo in . It also received the special adviser group to the President. The CCPIT deepened business engagement with Hong Kong, Macao, and Taiwan. It held joint conference with Hong Kong and Macao Chambers of Commerce to explore the issues concerning triad business cooperation. It launched the Economic and Trade Coordination Committee for the Two Sides of the Straits (ETCOM) 2005 Session, and overhauled its leadership. It led delegations to Taiwan to participate in the Seminar on Across-the-Straits Import & Export Policies and Practices. It participated in the Taiwan fruit exhibitions in Beijing for times in the name of ETCOM. Expanding people-to-people business and foreign relations to capitalize on the international organization platforms The CCPIT maintained close cooperation with and actively participated in the events of the Pacific Basin Economic Council, the APEC Business Advisory Council (ABAC), the APEC Trade Promotion Working Group, the Asia-Europe Business Forum, and the Asian Trade Promotion Forum. It sponsored the second Meeting of 2005 ABAC.

Innovating service mechanisms, and intensifying reforms to improve the efficiency and effectiveness of exhibitions The CCPIT in 2005 organized 37 overseas exhibitions on behalf of the People’s Republic of China, with a total of 31,500- sqm show space, where 1,938 Chinese exhibiting companies signed USD1.42 billion worth of contracts. These figures were all substantially up over the previous year. For exhibitions overseas, the CCPIT endeavored to adopt measures of partnership, commission, bidding, etcetera to organize the exhibitions. It actively recruited backbone and big-name Chinese businesses to participate in the exhibition, emphasized on intellectual property protection, and improved the quality of exhibits. It intensified promotions on the major big exhibitions in China, and capitalized on the platform of oversea exhibitions to lobby senior leaderships of the host countries, to explore the functions of oversea exhibitions from all perspectives. It organized the Chinese exhibition industry to actively implement the go global strategy, fostering Chinese exhibition brands in the international market. It launched, for instance, the China Fashion Fair in Japan, the China Trade Show for Machin- ery and Electronics in Kuala Lumpur, and the Asia Styles in Nuremberg of . The China International Exhibition Center (CIEC) in 2005 hosted 100 fairs and exhibitions, with a total exhibiting floor area of 1.41 million square meters. The China International Machine Tool Show staged here made record in exhibition scale. The Chinese self-developed printing show and stone fair are among the top exhibitions of their kinds in the world. Following a new mentality of openness, innovation and development to elaborate on the organization of the China Pavilion to the Expo 2005 Aichi, Japan The CCPIT elaborated on the China Pavilion at the Expo 2005 Aichi, following a new mentality of openness, innovation and development, and capitalizing on a broad spectrum of social resources. The varied attractions made the pavilion the most frequented national pavilion at the Expo. Vice Premier Wu Yi led the Chinese government delegation to the China Japan jointly held 21st Century Urban Development Forum, and the China Pavilion Day. Fourteen Chinese provinces and municipalities participated in the China Pavilion activity series. The Pavilion served an important platform for Chinese and Japanese culture communication, business cooperation, tourism promotion, and government-to-government and people-to-people engagement. It also promoted the Expo 2010 Shanghai, bridging the Shanghai and Achi expos. Efficiently handling the BIE related works and taking the offensive to prepare for Expo 2010 Shanghai The CCPIT worked to ensure smooth communication mechanism with the International Exhibitions Bureau (BIE) and parties concerned, effectively coordinated and handled the BIE-related businesses, promoted the notion of World Expo in China, and nurtured specialized professionals. It actively participated in the preparation for the Expo 2010 Shanghai, undertak- ing the daily communication and coordination of the organizing committee, and assisting the city of Shanghai in improving its registration report and presentation plans. Preparing for the new CIEC project Thanks to the support from the Chinese State leaders, government departments, and Beijing municipality, the prepara- tion for the new China International Exhibition Center program has made much headway, as it was officially ratified and was listed as one of the 60 key projects of Beijing city in 2005.

Steadily developing IP protection service The intellectual property (IP) service agencies under the CCPIT continued to receive booming new patent applications from foreign customers, and steadily growing new applications for trademark agent services. They continued to provide quality litigation agent services on IP infringement, patent and trade search, and stepped up cooperation and communication with overseas counterpart organizations. Enhancing business information, consultation, media and press services, to support Chinese businesses, espe- cially SMEs in their international competition and cooperation The CCPIT conducted in-depth researches and business information consultations on foreign markets, improved the CCPIT information network system, and capitalized on its publications, to provide information to businesses, especially the small and medium-sized enterprises (SMEs), in their bids to reach to global market. It delved into policies and regulations of various sectors of international business, participated in and represented Chinese voices at the regulation revision process of International Chamber of Commerce, such as documentary credits. The CCPIT held a series of specialized seminars, to help Chinese businesses to understand international practices, improve corporate governance, and better manage risks. Stepping up training services to develop human resources The CCPIT stepped up its training efforts on businesses and its sub-councils, capitalizing on and developing domestic and foreign training resources. It successfully hosted the second China African Chamber of Commerce Seminar entrusted by the Chinese Ministry of Commerce, the Management Training of Asia National Chambers of Commerce and Industry, and other seminars and workshops on international trade and investment. Assisting local opening ups, and promoting coordinated development of regional economies, to implement national economic development strategies To further implement the strategies of western development and Northeastern industrial rejuvenation, the CCPIT provided special facilitations and preferential treatments to the governments and business of these regions when they participated in the CCPIT organized exhibitions overseas, trade networkings, trainings and so on. It enhanced its commit- ment to and investment in the Investment & Trade Forum for Cooperation between East & West China, and the China International Fair for Investment & Trade. To assist the Northeastern China to expand opening-up, the CCPIT gave full play to the CCPIT established international advisory council on Northeast China, and provided a number of suggestions. It held the Dalian Peak Forum for Interaction between Port and Urban Economy, and cosponsored the Harbin fair, and the International Automobile Fair in Changchun. The year 2006 marks the commencement of the eleventh five year plan. The CCPIT will delve into the new phenomena and features of the current situation, implement the scientific development concept, follow the national diplomatic and foreign trade deployment, and give full play to the strength of a trade promotion organization. It is to accelerate the building of the China Chamber of International Commerce, actively conduct trade promotion and civil engagement by all means and ways, contribute to China’s opening-up, industrial restructuring and regionally coordinated economic development, and bring effective and efficient services to the Chinese and foreign businesses. 11 Healthy Development of Chinese National Economy in 2005

In 2005, various measures set by the central government aiming at enhancing and improving macro-control were carefully carried out. The national economy kept stable and fairly fast growth; the living standard of urban and rural population improved; China was opening wider to the outside world. However, the problems of irrational economic structure and extensive mode of economic growth are still prominent.

III. Industry and Construction In 2005, the total value-added of the industrial sector was 7,619.0 billion yuan, up by 11.4 percent over the previous year. The value-added of industrial enterprises above designated size was 6,642.5 billion yuan, up by 16.4 percent . The sales ratio of industrial enterprises was 98.1 percent, maintaining the same level as in 2004. In 2005, the total output of primary energy reached 2.06 billion tons of standard coal equivalent, up by 9.5 percent over the previous year. The electricity generated in the whole year was 2,474.7 billion kilowatt-hours, up by 12.3 percent. The output of coal was 2.19 billion tons, up by 9.9 percent. The output of crude oil reached 181 million tons, up by 2.8 percent. In 2005, among major raw material products, the output of crude steel stood at 352 million tons, up by 24.6 percent; that of rolled steel was 397 million tons, up by 24.1 percent. The output of cement was 1.06 billion tons, up by 10.0 percent. The production of 10 kinds of nonferrous metals went up by 13.2 percent. Output of major chemical products including sulfuric acid, soda ash, caustic soda, ethylene, etc. increased from 9.9 percent to 21.4 percent.

The Expo 2005 was hosted in Aichi, Japan from March 25 to September 25, 2005, with the theme of “Nature’s wisdom”. The world exposition featured presentations of 121 countries, 4 international organizations, and 9 Japa- nese corporate pavilions. It attracted a total of 22.05 million. CCPIT was authorized by the State Council to organize official Chinese participation. China Pavilion achieved great success by receiving 5.7 million visitors (accounting one fourth of the total), and therefore was honored pavil- ion with the largest number of visitors during the Expo. To pay special tribute to the presentation of China Pavilion, Dr. Shoichiro Toyoda, Chairman of Japan Asso- ciation for the 2005 World Exposition, wrote to Mme. Gao Yan, Commissioner General of China Section to the Expo, and Vice Chairperson of CCPIT, “With its appeal to visitors, the China Pavilion has greatly contributed to increasing the number of visitors at the EXPO 2005 Aichi, Japan and has raised the quality of the exhibition through the wonderful events it has held. We would like to congratulate you for your success and express our sincere gratitude for your efforts and contribution.” 1. Government Emphasis and local collaboration in the experiment of open organizing As China will be the host of the next registered world exposition in Shanghai 2010, participation in Expo 2005 Aichi has received great attention from the central government. Vice Premier Wu Yi had been briefed on the prepa- ration of China Pavilion twice. She has also headed a delegation to the China Day celebrations during the Expo. An Organizing Committee of China Pavilion was also established to give full play to the advantages of different depart- ments of CCPIT and local provinces and cities, which convened seven preparatory meetings, cooperating closely with 14 provinces and municipalities. Mr. Wan Jifei, Chairman of CCPIT, had chaired those meetings, listened to their work reports and gave on-site instructions. 14 local governments, including Beijing, Tianjin, Shanghai, Heilongjiang, Anhui, Guangxi, Hainan, Yunnan, Dalian, Qingdao, Hangzhou, Guangzhou and Suzhou, had set up special leading teams headed by chief officials to prepare for their presentation in China Pavilion. 13 Theme Weeks on specific province or city, plus the song and dance performance”Colorful Yunnan”, were staged during the Expo. China Pavilion had presented 5,120 cultural activities during the Expo. CCPIT had set up an open mechanism in the implementation of the entire preparation and presentation of China Pavilion. It made major reforms on the mode of preparation, as for the first time, inviting experts and profes- sionals from all walks of life to decide the designing, logo and construction contractor of China Pavilion, through public bidding. It was the first time that 14 provinces and cities were invited to participate in the presentation of China Pavilion, with fruitful results in boosting the economic and trade cooperation, cultural exchanges, and promo- tions of tourist attractions of those areas. And for the first time, market mechanism was introduced that CCPIT built up a platform as the Expo to help Chinese enterprises go to the world market. 2. A platform for Sino-Japan economic and cultural exchanges • Vice Premier Madame Wu Yi visited China Pavilion on May 19, 2005. Themed with “Nature, City, Harmony - Art of Life”, China Pavilion presented the Chinese understanding of • Performance during the National Day of Nature’s wisdom and the new way of life since China’s reform and opening to the outside world. China Pavilion was proud of its colorful cultural events, such as Sino-Japan Dual Meet for Weiqi Masters, Sino- Japan Soccer Match, Photo Show, Calligraphy & Painting Show, Ice Sculpture Show, Cuisines Show, folk arts and crafts, silk embroidery, tea ceremony, fashion show, and a series of cultural performances, like Musical Dance Fea- turing A Great China, Poetic Hangzhou, Concert of Tandun, the 12-Girl Band, Goddess of Mercy with A Thousand Arms, dance play Farewell to My Concubine, and other acrobatics, Peking opera, Kunqu opera, and Huangmei opera. All these events had attracted a large number of visitors during the Expo.

It also served as a senior platform for exchanges of foreign affairs and trade, which received 179 groups of foreign VIPs and VVIPs, such as His Majesty the Emperor, Empress, and royal family of Japan, Prime Ministers of Pakistan and , Vice Premier of , speakers of parliament, ministers, governors, mayors, chair- men of chambers of commerce, CEOs and presidents of world-class companies; and 119 Chinese delegations, includ- ing 78 ministers or governors. Participating provinces and cities had also been fruitful in business cooperation and promotion of their tourist attractions through China Pavilion. Five major trade talks were organized in Tokyo and Osaka, presenting 819 projects. And 676 matchmaking talks were held between Chinese and Japanese enterprises, reaching agreements on 175 projects. 91 tourism promotion campaigns took place. The colorful presentation and theme weeks had drawn the peoples of China and Japan closer to each other. On May 18, 2005, Mme. Wu Yi, Vice Premier of the State Council, received great applause from over 600 attend- ees from Japan and other countries, after expounding on China’s urban development on behalf of the government at the 21st Century Urban Development Forum, jointly sponsored by China and Japan. On May 19, the Chinese delegation, headed by Mme. Wu Yi, attended the China Day ceremony, which was well acclaimed thanks to its striking theme and abundant activities. The Japan Association for the 2005 World Exposition also highly re- marked that it was the most excellent event of all national pavilions. CCPIT established close partnership with both domestic and foreign media, giving wide coverage of the Expo and China Pavilion. More than one million printed matters and pamphlets were distributed during the Expo. Over 200 media carried more than 12,000 reports on the various events of China Pavilion, including People’s Daily, Xinhua News Agency, CCTV, China News Press, Phoenix TV (H.K.), major Chinese local media, NHK, Kyodo News Service, Asahi Shimbun, and Yomiuri Shimbun, of which over 80 reports by the News Channel of CCTV, and over 40 live broadcasts by Japan’s top five TV media. 3. A bridge to the Expo 2010 Shanghai CCPIT had always attached importance to promoting the Expo 2010 Shanghai while preparing China Pavilion. It launched a number of events before the opening of the Expo 2005, such as publicity campaigns for the Expo 2005 and China Pavilion, Appraisal of “Image ” of China Pavilion, and Theme Photo Contest, to increase the public awareness of expos and the Expo 2010. A Shanghai Desk was set up at the entrance of China Pavilion to promote the Expo 2010. And on behalf of the Chinese government, Mme. Wu Yi extended invitations to the Expo 2010 Shanghai to the world at the China Day ceremony, on which over 100 Chinese and foreign media carried live broadcasts, news reports or coverage, making it a hot topic during the Expo 2005. CCPIT assisted Chinese ministries concerned and Shanghai Municipal Government with over 30 visiting mis- sions to Expo 2005 Aichi, in order to exchange ideas with their counterpart departments in Japan Association for the 2005 World Exposition and learn from Japan’s organizational experiences. 17 CCPIT Hosted China-Caribbean Business Conference in Jamaica

To strengthen the China-Caribbean trade relations and highlight the business cooperation by the state visit of H.E. Zeng Qinghong, Vice President of China, CCPIT in cooperation with Jamaica Promo- tions Corporation (JAMPRO) hosted the China-Caribbean Business Conference at Kingston International Conference Centre in Kingston, Jamaica on February 3, 2005. Over 600 business and government del- egates from China and 13 Caribbean countries participated in the Conference. Mr. Wan Jifei, Chairman of CCPIT and Mrs. Patricia Francis, President of JAMPRO made welcoming remarks and introduced H.E. Jules Ajodhia, Vice President of , who delivered the keynote speech at the opening ceremony. Nearly 20 Ministers of China and Caribbean countries inaugurated the Conference. Chairman Wan applauded the achievements of the business cooperation between China and Car- ibbean countries in his opening remarks. He encouraged both Chinese and Caribbean business commu- nities to take the opportunities provided by the Conference and overcome the obstacles of distance to trigger a faster development of two-way investment and trade. Mr. Wan indicated the different business practices and different ways of thinking between Chinese and Caribbean business people will continue to have impact on the China-Caribbean trade. To minimize the negative influence, the trade promotion organizations and chambers of commerce should establish an efficient mechanism to facilitate the cross- sectoral business exchanges between China and Caribbean countries.

H.E. Jules Ajodhia Vice President of Suriname revealed the features and advantages of the Caribbean market in his keynote speech and expressed the strong desire of Surinam to improve its trade relations with China. He emphasized that governments of Caribbean countries will keep coherent policies to support the China-Caribbean business cooperation, which helps Chinese companies shape long-term business strategy on the Caribbean market. Vice President Ajodhia believed Chinese companies will have a better under- standing of the Caribbean market at the Conference and China-Caribbean business cooperation conse- quently will witness a win-win situation with more exchanges generated by the Conference. The Conference featured by two parallel sessions of “how to trade with China” and “the investment climate of Caribbean countries” was interactive and practical to participants. Based on their own experi- ence and concrete case studies, speakers from Chinese and Caribbean business communities led the discus- sion about the best practice and the existing problems of China-Caribbean cooperation. Participants reached the consensus that the momentum of the China-Caribbean trade relations is enjoyable. However, there are lots of jobs to be done to ensure a stable and continuous development of the bilateral trade, which requires more business exchanges to enhance mutual understanding of Chinese and Caribbean markets, a close working mechanism among bilateral chambers and industrial associations to facilitate bilateral trade and investment, better systems of finance, transportation and insurance, etc.. • On February 3, 2005, witnessed by H.E. Among them, 3 agreements defined the cooperation between CCPIT and its counterparting organizations in Jamaica, Bar- bados and Surinam while another signed by China National Complete Plant Imp. & Exp. Co. promised the construction of a modern cricket court in Kingston Jamaica. CCPIT Chairman Mr. Wan Jifei was awarded Grand Golden Medal of the Republic of Austria

On April 20, 2005, Mr. Wolfgang Schuessel, Austrian Prime Minister who was pay- ing a working visit to China, awarded the Grand Golden Medal of the Republic of Austria to Mr. Wan Jifei, CCPIT Chairman, at the Medal-awarding ceremony held at the Austrian Embassy in Beijing. Austria is a nation with Medal System and the Grand Golden Medal is the highest honor awarded to the presidents of foreign chambers of commerce or the figures with extraordinary international influence in economic activity. In 2005, with recommendation by Austrian Federal Chamber of Commerce and strong support from the Ministry of Economy of Austria, the President of Austria signed the official letter in a decision to award Mr. Wan Jifei the Grand Golden Medal for his special contribution to the development of Sino- Austrian economic and trade relations and the business cooperation between the compa- nies of the two countries. 19 The First Business Conference of China-Arab Cooperation Forum

The First Business Conference of China-Arab Cooperation Forum was held ceremoniously in Beijing Hotel from April 12 to 13, 2005. Around 1000 attendees including officials from China and Arab countries, leaders of trade promotion organizations, entrepreneurs and journalists sitted in the conference. The conference was hosted by China Council for the Promotion of International Trade and supported by Minis- try of Foreign Affairs of China and Ministry of Commerce of China. The conference was a grand meeting aimed at promoting China-Arab business relations within the frame of China-Arab Cooperation Forum which was initiated one year ago, and was strongly supported by Chinese and Arab government. The subject of the conference was "Enhancing mutual understanding, expanding cooperation".

Mr. Jia Qinglin, Chairman of The Chinese People’s Political Consultative Conference, was present at the confer- ence and made the keynote speech "Deepen China-Arab Cooperation and Create a Prosperous Future". Mr. Amr Musa, Secretary General of The League of Arab States, sent his ardent remarks to the conference. Mr. Li zhaoxing, Foreign Minister, Mr. Bo Xilai, Minister of Commerce, Mr. Wan Jifei, Chairman of CCPIT and Dr. Khalid Rajeh Sheikh, Minister of Trade and Industry of , Mr. Mazen Sinnoqrot, Minister of Economy of Palestine, Mr. Al-Zubair Ahmed Al-Hassan, State Minister of Economy and Finance of , and Mr.Saleh Abdulla S.Al-Bouanin, Head of the Mission of Embassies of Arab States in China and of , also sitted in the senior conference and delivered speeches. During the conference, around 600 companies from China and Arab countries held business talks in the field of Electronics/Machineries, Energy, Finance, Light Industry, Construction, Agriculture, Tourism, Chemicals, Telecommunication, Textile and Automobile, etc., and a number of contracts summed U.S.$ 470 million in total was signed. The success of the conference brought about tremendous influence in Arab countries. According to feedback from Chinese embassies in Arab countries, before the conference, Arab countries con- sidered China-Arab Cooperation Forum merely a political gesture in the mass, but the success of the conference made them realize that the forum will provide brand new channels and opportunities for China-Arab business cooperation. After the conference, many Arab countries put forward their application to be the host country of next Business Conference of China-Arab Cooperation Forum. At present, and have respectively got the qualification of hosting the Second and Fourth Business Conference of China-Arab Cooperation Forum. In addition, the conference was held in correspondence with China's national development strategy, and made breakthrough to the tradition of previous international business meetings that only state-owned large and medium size enterprises were involved. On the foundation of making plenty of market reasearch, the conference focused on the muslim resident regions in the north-west and developed coastal regions in the south-east, encouraged many qualified and reputed private enterprises to attend and seek opportunities for trade and investment. The U.S.-China International Partner Network

On July 11, 2005, Mr. Wan Jifei, Chairman of CCPIT signed a Memorandum of Understanding with Mr. Timothy Houser, Acting Under Secretary of U.S. Department of Commerce and officially launched the U.S.- China International Partner Network Project. The Project with a wide coverage of 14 major business cities in China is designed to facilitate the U.S. export to China. In recent years, the trade imbalance has been a hot issue within the U.S.-China business relations. Though the Chinese government and the Chinese business community strongly encouraged the import from the , China’s trade surplus with the States keeps growing and triggers uneasiness in the States. A long-term research conducted by CCPIT observes that the business cooperation between Chinese provinces and the U.S. witness a huge imbalance, though the overall U.S.-China business cooperation in- creases rapidly. It is the lack of direct communication that causes the less cooperation between Chinese local companies and the U.S. businesses. Except a few transnational companies, most U.S. businesses are not aware of the economic features and business demands of Chinese provinces. This factor restrains the U.S. export to China to a large extent. To restore the trade balance and overcome the above difficulties, trade experts on both sides made efforts to design a low-cost project promoting U.S. businesses’ understanding of Chinese local markets and setting up indoor business meetings with U.S. exporters for Chinese local companies. The negotiation and preparation between CCPIT and the U.S. Department of Commerce gave the birth to the U.S.-China Interna- tional Partner Network. The wide-ranging cooperation established under the MOU provides for: * Sharing and jointly preparing targeted Chinese market research and trade lead information, * Establishing high quality business matchmaking services for U.S. exporters in 14 major business cen- ters across China,

On July 15, 2005 US-China Business Mediation Congress spon- sored by China Council for the Promotion of International Trade (CCPIT) and International Institute for Conflict Prevention and Resolution(CPR) was held at the Great Wall Sheraton Hotel, Beijing. Well-known digni- taries participated in the Congress such as Mr. Zhang Huaixi, Vice-Chair- man of China People’s Political Consultative Conference(CPPCC), Mr. Graig Allen, Minister-Counselor of Commercial Affairs at US Embassy in China and officials from Legal Affairs Committee of National People’s Congress, Office of the Committee for Handling Proposals of CPPCC Na- tional Committee, Legislative Affairs Office of State Council, Supreme People’s Court, Ministry of Justice, Ministry of Commerce, National Coun- cil for Social Security Fund, All China Attorney at Laws’ Association and U.S.-China Business Council. As the leader of sponsors, President Tom Stipanowich of CPR Institute and Chairman Wan Jifei of CCPIT delivered the welcome addresses for the Congress.

As the trade trend between China and US enterprises is booming, trade disputes are also expanding in a swift way, which incurring the attention of China and US governments, and even the whole world. As a way of disputes settlement parallel to litigation and arbitration, commercial mediation is in a fast track of development as it bears the features of independency, equity, flexibility, high efficiency, expediency and with no harm to business relation- ship among the parties involved, so as to provide a new channel to solve the disputes arising from the businesses of China and US. Guided by the theme” To Promote Commercial Mediation so as to Con- stitute a Harmonized Society”, the Congress attracted an audience of 150 business people from well-known enterprises, attorneys and economical and legal scholars. In the Congress, the participants made vigorous and profound discussions on the theories and practices of the commercial mediation, on the difference and similarities between the two countries mediation procedures and on the advantages of US-China Business Mediation Center. Participants agreed that he Congress promoted the understanding among the participants on the features and details of commercial mediation, built up the acceptance of the judicial officials on commercial mediation and benefited in a long run, the legislation works of mediation law drafting. • Press interview with US-China Business Mediation Center was established on January 2004 by Mediation Center of CCPIT and CPR institute, American participants. which as a nonprofit coalition of famous law firms and top 500 companies around the world, is among the most influential propellants engaging in the commercial mediation. Since the establishment of US-China Business Mediation Center, it con- stantly provides excellent services to the settlement of disputes between Chinese and American enterprises. Besides the US-China Business Mediation Center, Mediation Center of CCPIT has entered into cooperation agreements with counterparts from South Korea, Canada and to establish joint mediation centers. There are specific mediation rules and mediator panels for the joint mediation centers, in line with the specific bilateral business customs, legal specifications and cultural background taken into consideration, and in this way these joint centers are winning the cutting-edge advantages in disputes settlement. The US-China Commercial Congress is a key joint promotion project after the establishment of US-China Business Media- tion Center as well as an important international conference focusing on Chinese commercial mediation. In the Congress, the efficient, practical atmosphere and principles of serving the enterprises and society won wide praises from the participants.

Asia Styles — The first overseas brand show owned by Chinese

Asia Styles, Trade Fair for Consumer Goods, Gifts and Houseware, was held at the Nuremberg Exhibition Centre On Aug. 29-31, 2005. About 270 exhibitors from mainland China, India, Pakistan, , , the , Germany, and Taiwan Province presented their high-quality products, and 247 exhibitors were from mainland China. The exhibition area is 6,800 sqm. During the 3-day opening of the exhibition, 2,724 trade visitors from Germany and other European countries visited the show, and the trade volume surpassed 10 million Euros. The organizer, CCPIT (China Council for the Promotion of International Trade), was staging this interna- tional trade fair for the first time in close cooperation with Nuremberg Global Fairs, Trade Development Bureau of Ministry of Commerce of the People’s Republic of China, China Great Wall International Exhibition Co., Ltd., China Chamber of Commerce for Import and Export of Light Industrial Products & Arts-Crafts, China Foreign Trade Guangzhou Exhibition Corp., China National Arts & Crafts Import and Export Corporation, GENERTEC International Advertising and Exhibition Co., Ltd., Fujian Huiyuan International Commerce & Exhibition Co., Ltd., and CIEC Overseas Exhibition Co., Ltd. This was a significant event in the field of exhibition of China. With China’s acceding to the WTO, the products from China have become more and more competitive and the companies from China have become more and more active in exploring the world market. An impor- tant way for China’s enterprises , especially for the SMEs to explore the world market, is to participate in the influential international exhibitions. In order to provide a stable and effective platform of trade for the enter- prises from China, Asia and Europe, CCPIT joined hands with China’s exhibition industry and carried out the strategy of “going global”. This was the first time for China to cooperate with European exhibition organizers to create its own brand of professional trade exhibition. After one year’s preparation, the new trade fair of Asia Styles, was successfully held in Nuremberg.

This time we adopted a new model for exhibition. The Chinese consortium and Nuremberg Global Fairs brought their advantages into full play and carried out influential promotion within and outside China. The Chinese consortium was respon- sible for promotion and recruiting exhibitors in China. They held several promotion meetings in , Fujian, Beijing, Guangzhou and etc. and also carried out promotion activities at the famous exhibitions in China, like the Chinese Export Commodities Fair, East China Fair, and etc. With its abundant experience, Nuremberg Global Fairs took on the job of promotion and visitor-invitation outside China. At different stages of the preparation for the exhibition, Nuremberg Global Fairs sent invitations to 8,000 importers and wholesalers in Germany and its neighboring countries by mail. In addition, Nuremberg Global Fairs also contiguously published ads in over 30 professional magazines of house ware and gifts. The trade and exhibition circle of Germany think highly of the first session of Asia Styles. This exhibition also receives supports from the Nuremberg municipal government. At the opening day, Dr. Ulrich Maly, the Lord Mayor of the City of Nuremberg and other officials visited the exhibition, participated in the party for opening and delivered ebullient message of greeting. Several panel discussions focusing on “Sourcing Asia” was organized during the exhibition. The representatives from the famous chain stores, supermarkets, emporiums and local commercial associations in Germany participated in it and dis- cussed the experience of trading with Asia companies. The press media in Germany and Europe paid much attention Asia Styles. During the preparation period, they reported Asia Styles several times. On the opening day, over 20 press media in Germany participated in the exhibition press release. Several media such as the German channel-1, Bavarian TV station, Bavarian broadcasting station and German western TV station, actively reported this exhibition during the gold time in the news programs. Professional media and websites of other European countries also focused on this exhibition. Asia Styles paid attention to the protection of intellectual property rights. Chinese consortium asked all exhibitors to strictly eradicate products with piracy. During the exhibition, there were many statements of protecting the intellectual prop- erty rights, and all exhibitors and visitors may also get instruction from the information desk about how to solve the dissension caused by intellectual property rights. Due to the careful work, there was no dissension about intellectual property rights in this exhibition. On Jul. 4-6, 2006, Asia Styles 2006- the 2nd Trade Fair for Consumer Goods, Gifts and Houseware, will be held in Nuremberg. In 2005, CCPIT have successfully implemented two foreign-aid training programs: China-Africa Chamber of Commerce & Industry Seminar II from Aug. 31st to Sep. 13th; and Training Program for Chambers of Commerce & Industry of Asian Countries from Nov. 28th to Dec. 12th. Different from China-Africa Chamber of Commerce & Industry Seminar I, which aimed at French speaking countries in Africa, seminar II aimed at English speaking African countries. The delegates were high-ranking officials of chambers of commerce & industry and government departments from , , , , , Equatorial , , , , , Sudan, and . Training Program for Chambers of Commerce & Industry of Asian Countries had delegates from Philippine, , Mongolia, Pakistan, Burma, Sri lanka, Nepal, Indonesia, , , Azerbaijan, , , , and . By implementing three foreign-aid training programs, CCPIT have trained 86 high ranking officials of chambers of commerce & industry and government departments from 30 African coun- tries and 15 Asian countries. During the delegation staying in Zhejiang, CCPIT Zhejiang Sub-Council signed memorandums of cooperation with Nepal Chamber of Commerce & Industry, Nepal-China Trade Council, Chambers of Commerce and Industry of Yerevan, Union of Manufacturers and Businessmen of Armenia, looking forward the promotion of bilateral economic and trade relationship. The Ministry of Commerce, the commercial sectors of Chinese embassies in African and Asian countries, China-Africa Cooperation Forum Follow Up Commission have offered great help to the seminars. There was also efficient collaboration between CCPIT and her Guangzhou Sub-Council, Zhuhai Sub-Council, Panyu Branch, Zhejiang Sub-Council, and Ningbo Sub-Council. The seminars not only helped the chambers of commerce & industry and government depart- ments of these Asian and African countries learn more about China, but also helped Chinese enterprises, commercial associations and chambers of commerce & industry founding cooperation relations with them. The seminars have also enhanced the importance of CCPIT in China’s economic and trade coop- eration with African and Asian countries. The delegates and Chinese government departments and enterprises have given high remarks on the seminars, as CCPIT had built a cooperation platform. Second EU-China Business Summit

On September 5th 2005, EU-China Business Summit, which was co-hosted by MOFCOM, EU Commission, UK Trade and Investment and China Council for the Promotion of International Trade, was held at the Great Hall of the People. The theme of this summit is “harmonized development and sharing prosperity”. Chi- nese Premier Wen Jiabao, UK Prime Minister Tony Blair, EU Commission President Jose Barroso, Minister of Commerce Bo Xilai EU Trade Commissioner Peter • EU Trade Commissioner Peter Mandelson Mandelson and over 600 guests participated in this summit. Chairman Wan Jifei of CCPIT chaired the plenary session of the summit, in which Premier Wen Jiabao delivered a keynote speech. He pointed out, after 30 years of diplomatic ties of EU-China relation, it had withstood all kinds of test and now was at its most dynamic and fruitful stage. Comprehensive strategic partner- ship relationship between EU and China is a wise choice made by both parties. It is n ot only in the interest of EU and China, but also conducive to world peace, stability and development. UK Prime Minister Tony Blair also stressed in his speech that China’s devel- opment is neither a challenge nor a threat, but an opportunity to the EU. EU Commission President Barroso highly praised the contribution of China to world economy through its reform and opening up. EU is willing to seek means to solve the current bilateral economic problems with a practical manner. This business summit is the highest-profile and largest-scale business event between China and EU since the first one held in Hague. Over 600 business people including 37 CEO from Fortune 500 Companies took part in the panel discussion after the plenary session. As an integral part of this business summit, it is the first time that CCPIT, together with CBI, UNICE and EUCCC, issued a business declaration on the busi- ness community’s behalf. 25 Publication of the CIETAC 2005 Rules

In an effort to meet the requirement of the users of the arbitration service in the new economic environment, the China International Economic and Trade Arbitration Commission (CIETAC) revised its rules in time and promulgated Rules of Arbitration of 2005 version (2005 Rules). The main characteristics of the 2005 Rules can be concluded as the following aspects: in the current legal framework, respect the autonomy of the parties’ will as much as possible to adapt to the needs of the situation; fully borrow ideas from the advanced international and domestic practices and improve the procedural rules in order to ensure the flexibility and efficiency of the arbitral proceedings; strengthen the administrative power of arbitral tribunal on the basis of respect for party autonomy; strengthen the administrative power of the arbitration commission on the quality of the arbitral award on the condition of respect for the independence of the arbitral tribunal ; develop specific business sector arbitration and profession in order to satisfy the diverse needs of the market subjects on dispute resolution. 1.Amendments regarding the structure of the CIETAC Rules The subtitle for each article and serial number for each paragraph had been added to ensure its convenient use in the 2005 Rules. While still maintaining the stable framework of the 2000 Rules, chapters and provisions were integrated to make them more systematic and logical; furthermore, an index had been created at the front of the text for clear and easy reference.

2.Provision regarding arbitration in a specific business sector or profession is incorporated The 2005 Rules set up regulations related for establishing a business center according to the current development; meanwhile, Article 4, “scope of application”, stipulates clearly that parties may agree to refer their disputes to arbitration for a specific business sector or profession in their contract, and the parties should also designate arbitrators from the arbitrators’ panel of the specific business sector or profession.

3.Simplify the formulation of jurisdiction It is necessary to simply the Article 3, 4 and 5 in the 2000 Rules that are regarding the formulation of jurisdiction. Since the Arbitration Law of PRC has already stipulated the list of non-arbitrable disputes and the list may be in conflict with the applicable law chosen by the parties, the 2005 Rules deleted the enumeration of the non-arbitrable disputes.

4.Further reflect the principle of party autonomy Article 4(2) of the 2005 Rules incorporated “where the parties agree on the application of other arbitration rules, or any modifi- cation of these Rules, the parties’ agreement shall prevail except where such agreement is inoperative or in conflict with a mandatory provision of the law of the place of arbitration “, which reflects the arbitration commission’s full respect to the parties’ free will. The excluding provision is used to make sure that parties’ agreement is operative and not in conflict with the mandatory provision of the law of the place of arbitration.

5.Clarify the written form of the arbitration agreement and the separability doctrine 2005 Rules, which introduced the corresponding provision in the Contract Law of PRC and borrowed ideas from the international practice, clearly stipulates that “an arbitration agreement is in writing if it is contained in a tangible form of a document such as a contract, letter, telegram, telex, facsimile, EDI, or Email. An arbitration agreement shall be deemed to exist where its existence is asserted by one party and not denied by the other during the exchange of the Request for Arbitration and the Statement of Defense.”

6.Improvement of the mechanism of the determination of the validity of the arbitration agreement and jurisdiction According to the Arbitration Law of PRC, Article 6 of the 2005 Rules still stipulates “the CIETAC shall have the power to determine the existence and validity of an arbitration agreement and its jurisdiction over an arbitration case. “. In order to deal with discrepancy between the decision rendered by the CIETAC and the conclusion reached by an arbitral tribunal through substantive hearing, the 2005 Rules simultaneously stipulates: “Where the CIETAC is satisfied by prima facie evidence that an arbitration agreement providing for arbitration by the CIETAC exists, it may make a decision based on such evidence that it has jurisdiction over the arbitration case, and the arbitration shall proceed. Such a decision shall not prevent the CIETAC from making a new decision on jurisdiction based on facts and/ or evidence found by the arbitral tribunal during the arbitration proceedings that are inconsistent with the prima facie evidence”. Meanwhile, considering the real needs, the 2005 Rules also stipulates, “the CIETAC may, if necessary, delegate such power to the arbitral tribunal”.

7.Shorten the time limit and accelerate arbitral procedure Due to the comparation with the time period regulated in other arbitration rules, the requirements of the parties and the consid- eration of the real practicability, the 2005 Rules had shortened the time limit for cases involving foreign elements, domestic and summary procedures to 6 months, 4 months and 3 months respectively. Also, there is no longer any difference in period issue between

examining the case on the basis of documents and the normal hearing of summary procedure. Meanwhile, the time limits for submitting a statement of defense, counterclaim and issuing notice of oral hearing had also been shortened correspondingly.

8.Expand the scope of party’s choice of arbitrators and respect the will of parties’ choice 2005 Rules stipulates, under some certain circumstances, namely the parties agreed in the contract and theagreement and the appointment has been confirmed by the Chairman of the CIETAC, parties may appoint arbitrators from outside of the CIETAC’s Panel. The limitation of a designated panel is not rigidly enforced provided that the appointed arbitrators have the qualifications; so the parties’intentions are respected as much as possible. 2005 Rules stipulates the appointment procedure of the presiding arbitrator, which may also apply to the appointment of sole arbitrator. The parties are entitled to enjoy more right of appointment of presiding arbitrator on the condition of no delay of the arbitral procedure, which makes the appointment more open and impartial.

9.Perfect the mechanism of the supervision of arbitrators and safeguard parties’ legal rights and interests 2005 Rules stipulates that in the event that an arbitrator is prevented de jure or de facto from fulfilling his/her functions or he/she fails to fulfill his/her functions in accordance with the requirements of these Rules or within the time period specified in these Rules, the Chairman of the CIETAC shall have the power to decide whether the arbitrator shall be replaced. This provision indicates that the Chairman of the CIETAC shall have the power to decide the replacement of an arbitrator under those certain circumstances; furthermore it strengthens the supervision of arbitrators without prejudice to the parties’ right of appointment and makes sure the arbitral proce- dures carry on efficiently. It embodied the characteristics and advantages of institutional arbitration. Referring to international practice, 2005 Rules authorizes the truncated tribunal to continue the arbitration and make decisions, rulings, or the award under the strictly restricted conditions. This provision intends to avoid the delay of an arbitration procedure caused by arbitrators’ personal reasons, and to protect the parties’ legal rights and interests. 2005 Rules stipulate that minority opinions or dissenting opinions in the tribunal shall be docketed into the file and may be attached to the award, but it clearly stipulates that those opinions shall not form a part of the award. This procedure can be used as a tool of supervision and restriction on arbitrators to make the tribunal more open and improve the quality of the arbitral award.

10.Clearly differentiate the place of arbitration and place of hearing 2005 Rules stipulates the place of arbitration and the place of hearing respectively. The division between the place of arbitration and hearing is in line with the practice of commercial arbitration, especially international commercial arbitration. The aforesaid provi- sion simultaneously stipulates that the parties have the right to choose the place of hearing and seat subject to the applicable laws.

11.Reform the method of hearing and enhance the flexibility and efficiency of the procedure Article 29 of the 2005 Rules stipulates the way of the hearing and clearly stipulates that the parties are entitled to make an agreement on the method of oral hearing. If there is no such agreement, the tribunal shall have power to decide the appropriate method of the hearing. This provision emphasizes the principle of respecting the autonomy of the parties’ will, while still giving the tribunal the power to decide arbitration procedure and oral hearing procedure. At the same time, it imposes restrictions on exercising the arbitral tribunal’s power, namely the arbitral tribunal must afford reasonable opportunities to all parties for presentations and debates. This provision shows that an inquisitorial or adversarial approach may be agreed upon by the parties or adopted by tribunal as the ways of oral hearing. The inquisitorial and adversarial approaches are adopted during examination, which is meant to cater to the different needs of parties with various legal culture backgrounds.

12.Development on combination of conciliation with arbitration Article 40 of the 2005 Rules is named “combination of conciliation with arbitration”, and it stipulates and highly commends the combination of conciliation with arbitration, which is one of CIETAC’s distinctive features. Building upon the 2000 Rules, this provision provides that where the parties have reached a settlement agreement by themselves through negotiation or conciliation without involving the CIETAC, either party may request the CIETAC to constitute an arbitral tribunal to render an arbitral award in accordance with the terms of the settlement agreement. This stipulation improves the method of dispute settlement combined with arbitration and conciliation.

Conclusion 2005 Rules demonstrates the new developments in the field of international commercial arbitration and simultaneously consid- ers the specific situation of arbitration mechanism in China. The arbitral tribunal is endowed with more administrative power on the proceedings on the premise of respect for the party autonomy. Simultaneously, the new Rules put further emphasis on the obligation of the arbitrators to act diligently and impartially. 2005 Rules will provide new opportunity to the Chinese arbitration career. The 2nd China-ASEAN Business & Investment Summit (“Summit” as an abbreviation) was convened on October 19 and 20, 2005 in Nanning, Guangxi. The Summit is co-organized by the Ministry of Commerce of China, China Council for the Promotion of International Trade (CCPIT) and the People’s Government of Guangxi Zhuang Autonomous Region. With the theme of “China and ASEAN Countries: Market Opening and Exploring”, the Summit comprised three parts: Keynote Speeches by State leaders, Senior Officials’ Forum and Business Leaders’ Forum. More than 1500 participants from China, ASEAN and other countries attended the Summit. ’s Prime Minister Soe Win, Lao’s Vice President Mr. Choummaly Sayasone and Thailand’s Deputy Prime Minister Dr. Somkid Jatusripitak delivered keynote speeches in the opening ceremony. CCPIT Tower Foundation Stone Laying Ceremony

CCPIT Tower Foundation Stone Laying Ceremony was held in Xizhimen building site on Oct. 28th, 2005. The attendees included Mr. Wan Jifei, Chairman of China Council for the Promotion of International Trade, Mr. Zhang Zhou, Vice Chairman, Mr. Ma Yue, Chairman of the Board of China Patent Agency (Hong Kong) Limited Co., Mr. Ding Zhongze, former General Manager, leaders of the relative departments of CCPIT, former CCPIT leaders and represen- tatives from China State Construction Engineering Corporation. Chairman Wan cut the ribbon and delivered an encourag- ing speech during the ceremony. He extended congratulations to the Foundation Stone Laying Ceremony of CCPIT Tower. Meantime, he requested that all related departments shall work together, make concerted efforts, emphasize manage- ment and strictly abide regulations, so as to complete the project on schedule and with high quality. The floor space of CCPIT Tower covers over 30,000 Square meters, with 16 storey the ground and 3 storey underground. Co-organized by CCPIT and CEOE of Spain, 1st China-Spain Business Summit was held in Madrid Congress Palace on November 15th 2005. Visiting Chinese President Hu Jingtao and Spanish King Juan Carlos I attended the summit opening ceremony. Over 1000 government officials and business representatives from both China and Spain also attended the summit. President Hu Jingtao made a keynote speech at the opening ceremony of the business summit. He highly praised the friendship and goodwill exchanges by two countries in all sectors and pointed out, Sino-Spain economic and technological cooperation has only pushed forward the two country’s economic and social advancement, but also brought tangible benefits for the two peoples. Bilateral relations has laid a good foundation for the further economic and technological development, he said and he hoped that with the support of the two governments, business people from two countries could push that develop- ment a new level.

President Hu went on to introduce the achievements made by China in the past 27 years since China embarked on its opening-up and reform, its development goal and tremendous business opportunities that will come along with the west development strategy, revitalization of the northeast, 2008 Beijing Olympic Games and 2010 Shanghai Expo. Under the approval of the State Council of China, China Council for the Promotion of International Trade (CCPIT), National Office of Rectification & Standardization of Market Economic Order, and Finance, Credit and International Business (FCIB) co-hosted the Second China International Credit & Risk Management Conference in Shanghai on December 7-9, 2005. With the theme of Strengthening International Exchange and Fostering Credit, China, the conference attracted more than 400 professionals and delegates, of which about 100 were from the U. S.A., Europe and Southeast Asia, etc. The conference, managed by the Economic Information Department of CCPIT, received energetic support and concern from the Chinese government. The Forum consists of Plenary and Consecutive Sessions. On the Plenary Sessions, industry VIPs home and abroad made speeches on the topics of Economic Globalization, Regionalization and Development of Exhibition Industry, China’s Economy and the Devel- opment of Exhibition Industry and International Cooperation and Sustainable Development of Exhibition Industry. The Annual Report on China’s Convention and Exhibition Industry 2005 was officially released by Ms. Gao Yan, Vice Chairwoman of CCPIT. The report reviews new characteristics and major problems that China exhibition industry features and encounters during its move-on in 2005. Valuable suggestions are put forward for the growing of the industry in the report. On the Special Plenary Session, Ms. Gao Yan, Vice Chairwoman of CCPIT and Mr. Zhao Huitian, Director General of the Exhibition Department, CCPIT signed The Joint Declaration for Protection of Intel- lectual Property Rights at Exhibitions with IAEM on behalf of CCPIT. The two parties expressed common concern on the issue and agreed to make effort to promote the IPR protection in exhibition industry. Under the proposal of CCPIT, 945 Chinese companies of the industry cosigned The Joint Operation Declaration for Protection of Intellectual Property Rights in China’s Convention and Exhibition Industry to ensure the healthy development of the industry. On the 9 Concurrent Sessions, the delegates made communication and discussion on the topics of common interest, such as Show Organizers’ Sub-contracting Strategy, Enhancing Quality and Profitability and the Internationalization and Protectionism in Exhibition Industry, etc. The 7th China International Exposition and Conference (InterExpo 2006), as part of the 2nd CEFCO, was undertaken by China Association for Exhibition Centers. With over 130 participation companies and a total size of 6,000 square meters, the InterExpo hit a historical record in terms of size and quality. Recognized as a networking platform for exhibition industry in China and abroad, CEFCO has estab- lished itself as an annual EVENT, which plays an effective role in the process of China exhibition industry progressing itself in a legal, market-oriented, professional and international way. 33 The Construction of The The New China International Exhibition Center (NCIEC) is the rebuilding project of The China International Exhibition Center on different site. The new New China International site is located in Airport Industrial Zone, Shun Yi, Beijing, which neighbors Beijing international airport in the east and Wenyu River Ecological Corridor in the Exhibition Center Southwest. The project has been greatly supported by the national and Beijing government and listed as one of the 60 key projects of Beijing and the con- struction projects related to Beijing 2008 Olympic Games.

Introduction of the Project The NCIEC project was formally approved by the State on January 17, 2005. The total planned area of NCIEC is 155.5 hectares with the total aboveground construc- tion area of 660,000 square meters among which the aboveground construction area of exhi- bition halls and related facilities is 400,000 square meters including 200,000 square meters exhibiting space of 16 separate, single-level, column-free and spacious exhibition halls. The aboveground construction area of comprehensive and related facilities is 260,000 square meters including one comprehensive shopping mall equipped with shopping, fitness, food & beverage as well as entertainment facilities, hotels and office buildings equipped with convention center, business center, seminar rooms and news release center and etc. The NCIEC will become the largest and most functional exhibition center in Beijing after its completion. The NCIEC project will be divided into two phases. The aboveground construction area of the first phase of NCIEC is 355,000 square meters, among which the aboveground construc- tion area of exhibition halls and related facilities is 200,000 square meters and the aboveground construction area of hotels, office building and shopping center is 155,000 square meters. The planned investment of first phase is 2.9 billion RMB. The exhibiting space will reach 100,000 square meters (8 exhibition halls) after the completion of the first phase of NCIEC. • Overall Plan of NCIEC

Introduction of the Construction Company of the Project Due to the onerousness of the NCIEC project, China Council for the Promotion of Interna- tional Trade (CCPIT) has reorganized China Exhibition Investment & Development Co., Ltd (CEID) which is responsible for the preparation of the project, and increased the registered capital to 500 million RMB. The reorganized CEID has improved corporate management structure, readjusted the board of directors, board of supervisors and managers group and stipulated such regulations as”Rules of Business Discussion of Board of Directors”, “Working Rules of CEID” and etc.

Construction Progress of the Project The working focus of NCIEC project after its start in 2005 is to do the preparations for the construction of the project. After signing “The Land Development Agreement” and “Compensation & Relocation Agree- ment for Land Requisition” and paying the related fees, CEID has acquired the construction land and started the cleaning and removing job. Up to now, it has basically met the overall construction requirements of “3 throughs and 1 evenness”. On December 28, 2005, the foundation laying ceremony of NCIEC was held on the construction site. Mr. Wan Jifei, Chairman of CCPIT, Mr. Lu Hao, Deputy Major of Beijing and etc attended the ceremony.

Prospects of the Project The NCIEC project has fully absorbed the construction experience of domestic and overseas exhibition centers and opinions of experts and customers in the fields of city planning, transportation, economy and architecture. It is economic, practical, safe and comfortable, and will keep the world top-level for a considerable long period of time after its completion. The layout of NCIEC is tailor-made for the exhibition industry. Every single hall can be separated or merged for different sized exhibitions. It is convenient to hold large scale exhibitions. Centering on Chinese government’s strategy of furthering opening-up, addressing trade imbalance, solving trade disputes and realizing win-for-all, the Department of International Relations of CCPIT (hereinafter referred to as the Department) has made tremendous and efficient efforts in 2005 to develop new and effective businesses, and thus won the applaud from both international and domestic political and business communities. In the year, the Department had received 124 visiting foreign delegations with a total guest number of 4,089, including 30 missions led by foreign state leaders. It organized 70 outbound groups and signed 24 bilateral cooperation agreements. The department arranged 22 audiences with Chinese state leaders, where they either met foreign guests or participated in international conferences, and 267 other high- level meetings for foreign business delegations. It arranged over 60 matchmaking meetings, seminars and project briefings, and established 2 bilateral business councils.

Concentrating strength on major events to build platform of mutual benefit In 2005, the department has successfully organized a dozen of regional forums and international conferences, which were of profound and far-reaching influences. China-Caribbean Business Conference was organized by CCPIT and Jamaica Promotions Corporation in Kingston. The first China-Arab Business Conference of China-Arab Cooperation Forum had some 1,000 government and business delegates from China and Arabian countries, and held a heated discussion on the means and ways of China-Arab coop- eration that would benefit both. The second Meeting of 2005 ABAC was successfully launched at the request of APEC members and the Chinese Foreign Affairs Ministry. The Second China-ASEAN Business & Investment Summit launched by CCPIT in collaboration with the Chinese Ministry of Commerce and the government of Guangxi Zhuang Autonomous Region to implement Premier Wen Jiabao’s proposal, accel- erated China-ASEAN engagement and the development of China-ASEAN Free Trade Area. Emphasizing work on the United States and promoting across-the- board foreign business engagements The United States is China’s largest trade partner. Bilateral trade reached 162.9 billion USD in 2005, a year-on-year increase of 30.4%. Trade disputes, however, grew with the volume. CCPIT thus put more efforts on America-related work to remove barriers and achieve win-win. Early in 2005, CCPIT Vice Chairman Zhang Wei led a trade delegation to the National Manufacturing Week in Chicago, and signed cooperation agreement with Fortworth Chamber of Commerce. US-China Busi- ness Dialogue 2005 was held in May. In July, CCPIT and U.S. Department of Commerce signed a MOU to launch International Partner Network. In September Chairman Wan Jifei headed a business mission to Utah and Florida. And Vice Chairman Yu Ping led a business mission to South Carolina, California and several other states. These efforts effectively facilitated Chinese government effort in improving U.S.-China relations. CCPIT work on neighboring countries has taken a new look. Vice Chairman Zhang Wei headed a business delegation to the United Arab Emirates. CCPIT organized 8 Chinese business delegations to 2005 Aichi Expo. Vice Chairman Zhang Zhou headed a business mission to the Forth China-Japan- Korea Business Forum and the 8th World Chinese Entrepreneurs Convention, and expressed opinions and aspirations of the Chinese business community on the establishment of China-Japan-South- Korea Free Trade Zone. A CCPIT working delegation visited the Democratic People’s Republic of Korea. Thanks to the well-targeted preparation of these visits, economic relations with neighboring nations were intensified. Cooperation with EU countries has been further expanded. Chairman Wan Jife led a business mission to Iceland and participated in the 10th anniversary ceremony of Iceland-China Trade Council, to further the bilateral business relations. CCPIT also hosted visiting delegations accompanying heads of State from Belgium, Iceland, Croatia and introduced China’s opening policy and investment environment, setting in sound momentum for the across-the-board cooperation for Chinese and European enterprises. Business communication between mainland and Taiwan, Hong Kong and Macao has been further promoted. Vice Chairperson Gao Yan participated in the Seminar on Across-the-Straits Im- port& Export Policies and Practices. The department organized Chinese business delegations to Inter- national Conference on Foreign Investment in Timor-Leste and training program provided by the Hong Kong based Chinese General Chamber of Commerce. It also launched Economic and Trade Coordination Committee for the Two Sides of the Straits (ETCOM) 2005 Session. The Department also focused on cooperation with the Caribbean countries, including coun- tries without diplomatic ties with China. The exhibition industry received unprecedented attention from the Chinese government in 2005, with marked achievements, shown by rapid development of professional associations and training, emerging regional cooperation, and the further accelerated process of legalization, marketization, industrialization and internationalization. After a careful study of the state policies for foreign affairs and foreign trade, and the status quo of China’s overseas exhibitions, CCPIT has made positive efforts in implementing its Outline of Reform and Development. It develops new ideas for organizing exhibitions and stresses innovation of service, brands and system, making due contribution to the sustainable development of China’s exhibition industry.

Review on 2005 1. Transforming way of exhibition organization , innovating on service, and forging brands In 2005, CCPIT began reforming its work on exhibitions by adopting the “Two-way exchange” in show organizing, and fulfilled the goal of “Cooperation, Win-win and Development”. It organized participation in 37 overseas exhibitions in 23 countries, with a total of 31,500-sqm show space, 1, 917 booths, and 1,938 exhibiting companies who received 53,400 clients and concluded USD1.42 billion contracts. All the index numbers increased substantially over the previous year. CCPIT has made a series of bold endeavors in exhibition organizing by studying the trends of the industry both domestic and abroad, such as partnership, public bidding, and entrustment for the implementation of some projects. These new measures raised the efficiency of funds, enhanced the presentation and trading effects. It succeeded in cooperating with other Chinese organizers to establish several self-owned events overseas, such as “Asia Styles” in Nuremburg, Germany, “China Trade Show for Machinery and Electronics” in Malaysia, and “China Fashion Fair” in Japan, putting its advantage of network into full play. Competitive mechanism was introduced to improve the quality of exhibition service, particu- larly for the presentation of China Pavilion to the Expo 2005 Aichi, Japan. CCPIT took an open attitude in tapping the potentials of the Expo to serve the economic and social development of local provinces and cities. It also launched surveys at grass-root level to find their demand and provide quality service for enterprises. In addition, it organized “China Trade Show” in Panama and , furthering the publicity and promoting the mutual understanding and friendship between China and those countries having no diplomatic relations with us.

Between 2004 and 2005, 145 show organizers went to participate in 950 events overseas under the approval of CCPIT. And 1,076 applica- tions by organizers had been submitted to the Council by the end of 2005, 983 were countersigned and approved by CCPIT and the Ministry of Commerce. CCPIT also granted approval for 89 events held by its regional and industrial sub-councils in China for 2005 and 119 applications for 2006.

CCPIT strengthened its examination of problematic points in show organizing, as well as su- pervision and administration of large events. It also carried out on-the-spot investigations and examinations to solve problems in time. CCPIT drafted the new Rules for the Examination and Administration of Organizing Trade Shows Overseas (currently in the process of approval), which introduced joint enforcement to enhance supervision and administration. The new Rules will be of great importance to the standard market development for overseas trade shows, and is considered a major step in China’s legislation on the exhibition industry.

3. Broadening fields of service and strengthening international co- operation In order to meet the demand of China’s growing exhibition industry and to complete its scope of services, CCPIT has set up a new division for domestic exhibitions in its Exhibition Department. The domestic exhibition division aims at full use of the two kinds of resources and markets, both domestic and foreign, and seeks new ways to extend public service. Its role in boosting development of domestic exhibitions will be further displayed in the near future. In early 2006, CCPIT co-organized the 2nd China Expo Forum for International Cooperation (CEFCO 2006), a top event for the country’s exhibition industry, with UFI (Global Association of Exhibition Industry), IAEM (International Association for Exhibition Management), and SISO (Society of Independent Show Organizers). In addition, it edited and published the Annual Report on China’s Exhibition Industry 2005, Fairs & Exhibitions in China 2006, and Exhibition Periodical. CEM (Certified Exhibition Managers) training program has also been successfully held. All these efforts have pro- vided the industry with more practical information and service, contributing to its development to- ward legalization, marketization, industrialization and internationalization. China’s exhibition industry has made remarkable progress in the past year. However, there are still many drawbacks with regards to issues including standardization, competitiveness and opening of the industry. More work shall be done to deepen the reform, strengthen international cooperation, perfect related laws and regulations, promote self-discipline, and launch theoretical study and per- sonnel training, so as to upgrade the overall competitiveness.

Nowadays, China’s exhibition industry as a rising industry has assisted faciliating the development of Chinese rel- evant industries , the optimization of collocation of resources and the internalization of enterprises through varieties of exhibition activities. In 2005, the China International Exhibition Center Group Corporation (CIEC) has played a significant role in boosting the national economy and has achieved great social and economic benefits through improved services, customer satisfaction and innovative management in organizing domestic exhibitions, referring to the international routines and optimized man- agement models. Last year, CIEC hosted 121 exhibitions at its complex venue covering an area of 1.50 million square meters ,including 21 exhibitions as organizer or co-organizer with its business partners. Among those held by CIEC, CIMT hit the high record in terms of scale and number of exhibitors and visitors, boasting an exhibition area of 72,000 square meters. China Print and Stonetech have both gained their reputation internationally, while those like Auto Mechanika, Fenestration, ILOPE, FW & WM, have become popu- lar trade fairs in the relevant industrial sectors. Others exhibitions in Beijing, Xiamen, Guangzhou, Shenzhen and Shanghai were also successfully organized by CIEC’s sub-companies in Shenzhen and Shanghai.

Meanwhile, CIEC provided high-quality exhibition services, completing 270,000 square meters of special tailor-made designed booths. CIEC also achieved developments in the exhibition related industries such as commercials and advertisement, fair transportation, commerce and trade, hotel operation as well as office lease for better exhibition services. CIEC has now improved its ticket and audience registration services by introducing a brand- new electronic system. This system can be used with high flexibility and mobility and the two func- tions can be operated separately and can be easily installed in other places outside the CIEC’s venue. The information technology applications in the exhibition business have effected positively on both exhibition management and organization. In the area of show operation and exhibition company management, CIEC has created a model that applies to the Chinese situations by improving its services, facilitating exhibition operation, setting up norms and regulations, which has provided an excellent environment for holding exhibi- tions and its clients. With the support from the relevant departments, The first-phase of the construction had ac- complished its foundation laying by the end of 2005 and will start its operation in 2007 with 100, 000 covered and 50,000 open square meters of exhibit space. For the year 2006, the Media and Press Center shall focus on reformation, improving quality of its news papers and periodicals, enriching volume of news and information, adding columns to reflect local economic and trade trend, completion of distribution of press station, strengthen guidance on business, inspecting daily business and procedure management, establishing monthly report system and planning for several impressive business activities so as to promote the distribution of newspapers and collection of advertisement. The Center will continue to promote local economic and trade activities to widen the channel for attracting more business and investment. In 2005, China Patent Agent (H. K.) Ltd. (CPA) reached a new high in the number of patent applications it prosecuted after it took the lead in the industry in China the previous year, and succeeded in keeping the momentum of growth of its overall business volume: Under the leadership of the CCPIT, CPA smoothly changed its leadership, and appointed its new General Manager and more assistants to the General Manager. Besides, it reinforced its management with a group of newly promoted young managerial members, thus laying a solid foundation for its long-term and steady development. Quality and efficiency are key to its business success. Therefore, CPA adopted, in the year, a variety of mea- sures to have heightened the sense of responsibility of all the workers in its patent agency operation, increased the accuracy of their work performance, and enhanced internal inspection and checking with an aim to reduce the rate of errors. The Agency continued to adjust the workflow of its patent agency operation, and improved the efficiency in the internal circulation of the corporate files. It also re-formed the duty posts for its staff members to ensure the quality of prosecution of all cases of applications. Besides, it made strict rules on making prompt replies to all incoming correspondence from its clients, which resulted in less complaint from them for delay response. On top of all these, it adapted, in a timely manner, the internal computer system to the new RMB-based schedule of rates formulated by the All-China Patent Agents Association in response to the adoption of a flexible exchange rate for RMB in July 2005.

To increase its influence in East China, particularly in the delta region of the Yangtze River, where lies the most potential for its business expansion, CPA established a new office in Shanghai in the year. Also, it stepped up its efforts to make market investigation and collect, in a timely fashion, marked information, to enhance the operation coordination and centralized management between the Hong Kong-based Headquarters and the three offices in Beijing, Shenzhen and Shanghai, so that it could work out expedient and practical coping strategy regarding, and solution to, any circumstances that should arise, and make speedy response to the market and to the clients. CPA attached importance to stabilize its contingent of professionals by adopting the guiding principle of “taking people as the essential priority”, and working for their career, emotional and material satisfaction, with policy tilting in favor of the key professionals, in particular, of those who have advanced academic qualification, are more professionally capable, and work at the fore-front of the routine operation. In this year, CPA employed 56 patent attorneys, patent engineers, translators, and other office workers in Hong Kong, Beijing and Shenzhen, which alleviated the shortage of personnel, and made the Agency better prepared for the sustainable develop- ment in the future. CPA also paid attention to the in-service training for its employees. In the year, it sent 36 patent attorneys and engineers to receive short training courses abroad, and 97 at home. 21 who passed the national qualification exami- nation for patent attorney attended the pre-post training. Besides, all the managers working in the Beijing Office were trained at the National School of Administration; 15 employees working at the Headquarters in Hong Kong took the MA program in law in their spare time, and 50% of them were conferred the MA degree. The Agency invited 18 examiners from the State Intellectual Property Office to give lectures in Hong Kong on four occasions. Wang Zhongfu, Commissioner of the State Administration for Industry and Commerce, Tian Lipu, Commis- sioner of the SIPO, and He Hua, Vice-Commissioner, personally inspected the Beijing Office and the General Office in Hong Kong in the year. In 2005, CPA worked as law agents in a variety of complicated cases of dispute involving the rights and interests of holders of patent, trademark and copyright. These cases covered extensive subject matters and wide geographic regions, and were highly technically related. In the case of invalidation of Pfizer’s patent for the inven- tion of “Viagra”, the plaintiff appealed to the Beijing Higher People’s Court out of dissatisfaction with the ruling of first instance. The lawsuit instituted by the Japanese Sel Co., Ltd. for keeping the validity of its invention patent right remained pending for lack of proper equipment for testing and appraising the alleged infringing products. In the cases involving such world famous brands as Citizen and YSL, we began to work with the enforcement departments to make investigation in Lhasa, Tibet, and Urumqi, Xinjiang. The design of a British company’s famous utensils was involved in a copyright dispute. Last year, we dealt with more cases of dispute than the last year arising from unfair

competition involving joint ventures and enterprises invested solely by foreign businesses. To promote the orderly development of the intellectual property system in China, CPA attached importance to, and conscientiously dealt with, requests for consultation made by the Governmental departments, and took an active part in the research on the formulation of the National State Intellectual Property Strategy, and in the work on the revision of the Patent Law and the Patent Agency Regulations. 2005 was the year in which we participated in the most events held by the organizations in the IP industry at the national level. CPA dispatched its employees to have attended more than 20 symposiums and seminars held by the organizations, such as the All-China Agents Association, the Intellectual Property Society, and the China Trade- mark Association. Besides, we also participated in the World SME Expo and the Hong Kong Licensing Show orga- nized by the Hong Kong Trade Development Council (TDC), the Shenzhen Chinese and Foreign Trademark Expo 2005 held by the China Trademark Association, and the Hong Kong Industry Exhibition held in Shanghai. In addition, we were invited by the Chinese Manufacturers’ Association of Hong Kong to provide free legal service as its patent agency legal consultant to the meeting it held. In addition, CPA was highly praised by the All-China Agents Associa- tion for sponsoring its practice training program for patent attorneys from the western regions of China in 2005. In 2005, we received 150 groups of over 300 official visitors, and dispatched 12 groups of 40 people to have attended the meetings held by the international IP organizations, such as the INTA, LES, AIPPI, AIPLA and FICPI. At these events, we expanded our corporate influence in the IP community, and, as well, visited our old clients and made new friends before, during and after these meetings. In the year, CPA was chosen again by the world re- nowned IP journal, Managing Intellectual Property, as one of the top three patent agencies in China.

Working in the spirit of realism and pragmatism, CPA will focus its attention on and do a good job in the following work in the year of 2006: 1. For us, the most valuable corporate assets are people, and adoption of the HR strategy and workforce construction are now urgent tasks facing us. The management should know the employees’ potential, bring their talents into full play, and constantly bring forth well-qualified employees. We should also cultivate young and middle-aged managerial staff members, and do a good job in position- ing and training the personnel to ensure CPA’s long-term, steady development; 3. In 2005, under the correct leadership and with the continuous support of China Counsel for the Promotion of Inter- national Trade, people in CCPIT Patent and Trademark Office consolidated their ideas and conducted industrious work in further developing patent, trademark prosecution and intellectual property legal services. Over the past year, our office’s portfolio of patent and trademark prosecution concerning foreign business kept good momentum of stable and rapid development over the same period in 2004. The annual patent application cases reached more than 14,000, up to eight percent over the previous year and the annual trademark cases reached more than 30,000, up to nine percent over the previous year. The intellectual property in China has been developed vigorously but a number of great challenges have been emerged as well. As one of the first intellectual property offices dealing with foreign related business, we have been sticking to the tenet of “Client First and Best Quality” in the environment where both opportunities and challenges exist. In 2005, we continued to provide efficient and qualified services for our clients at home and abroad in protecting their intellectual property rights. In order to enhance the competitiveness of the firm, to improve the professional capacity and to strengthen the in service training and academic exchange, we established a work committee in major divisions to cultivate leading professionals. It has met the requirement of increasing volume of business and personnel, additionally, it guarantee sustainable develop- ment and democratic management of the firm. In the meantime, an internal website was kicked off last year to provide a platform for people to share information and opinions which will ultimately build up a harmonious working environment. People within the office can communicate in this website about their work, study and even hobbies. The unceasing development of the firm relies on the key element of attracting, recruiting and cultivating professional personnel. In 2005, we recruited 35 new staff for different positions after strict examinations and screening. In 2005, we successfully held the annual meeting of LES China and AIPPI China respectively which play a full and important role in promoting the exchange between our counterparts on the international and domestic level. In order to further carry out the strategy of rejuvenating the country through science and education as well as the strategy of intellectual property, we continued to participate in the nationwide special campaign for intellectual prop- erty rights protection in 2005, collaborating with relevant governmental organizations. By treating patent right, trade- mark right and copyright protection as the focal points and taking the Customs, all kinds of exhibitions, small commod- ity markets and printing products as the important links, our people went to places where the fake trademarks and infringed copyrights are readily available. They carried out investigation, evidence collecting and cracking down of infringed intellectual property cases which have achieved remarkable results. As an efficient legal system, intellectual property rights enhance the independent innovation. The aim of found- ing an innovation-type country is a long-term and important topic facing the intellectual property research and devel- opment in China. In 2006, we will unite together as one and work enthusiastically to realize this aim by fully displaying the role of intellectual property system in promoting the innovation capacity. (By Wang Shen)

In 2005, the CCPIT department for foreign-related legal services made pioneering efforts and adopted a realistic and pragmatic approach in conscientiously implementing its tenet of “offering services primarily targeted at domestic enterprises and oriented towards the international business community”, achieved notable results in all endeavors. 1. Providing high-efficiency and high-quality legal services for domestic and foreign indus- trial and commercial enterprises In 2005, the CCPIT system of organizations issued 1,300,000 Certificates of Origin with a year-on-year growth rate of 30%, including 1,000,000 E visas, which account for 80% of the total number of visas issued; legalized 170,000 commercial documents, up by 28% year on year; issued 140,000 International Commercial Certificates, up by 33% year on year; and obtained£¨on behalf of their clients, consular legalization for 100,000 documents, up by 25% year on year. The CCPIT system of organizations issued 1451 ATA Carnets, up by 27.5% year on year; 2411 electronic letters of record-keeping for import carnets, up by 6% year on year; 319 documents for claim on the strength of import carnets, up by 61% year on year; and 89 documents for claim on the strength of export carnets, up by 58% year on year. Substantive steps were taken to promote mediation and 380 cases of commercial disputes were handled. The quality of case handling in respect of average adjustment and legal consultancy has been constantly improved, and opinions for revising draft laws or regulations were offered. 2. Creating a brand name of legal services A good service image in respect of certification and legalization has been fostered by increasing our contacts with enterprises, acquainting ourselves with the demand of enterprises and making services promotion better focused and more effective. In publicizing and promoting the ATA service, we have adopted the method of “combining work at se- lected spots with that of the whole area”. On the basis of extensive publicity and promotion, some representative industries, enterprises and meetings have been consciously selected as focus areas for such work. The Conciliation Center has been vigorously promoting commercial mediation among enterprises. The implementation of the idea of “consolidating the foundation while improving case handling” has resulted in the increase of cases accepted for mediation. With respect to legal consultancy, we have focused our attention on services promotion, visiting enterprises, distributing questionnaires and conducting voluntary consultancy, thus building a good image of CCPIT legal services. The Office for Average Adjust- ment has established good business relations with its clients by participating in such activities as meetings of the Interna- tional Association of European Average Adjusters, annual meeting of the CCS (China Classification Society) Classification Committee and meetings of the China Insurance Regulatory Commission, and substantive breakthrough has been made in the publicity of particular average adjustment services and coastal transportation services. • Scene of US-China Commercial Media- tion Congress. In 2005, with the opening of a new Portal Site (lad.ccpit.org) on the Internet, the program to promote IT application • The China-US Mediation Seminar was in the legal services offered by the Legal Department was launched in an all-round way. The upgrading of the data held in New York on Oct 18, 2005 exchange platform as well as the CCPIT end system and enterprises end system in the e-visa system has raised the Net Access rating among users, the automatic identification ability of the system and the visa-issuing efficiency: The CA digital Certificate has been introduced into the e-visa system; and the system for obtaining consular legalization on behalf of applicants has been upgraded. A new ATA website has been commissioned with a new function of “on-line application”, the data coupling in the ATA subsystem of the Electronic Port has greatly enhanced the work efficiency, displaying to the public a brand-name image of legal services offered by the CCPIT system of organizations. 3. Building a broad international platform Strengthening international exchanges and cooperation and actively participating in international competition are becoming a special feature of the foreign-related legal services offered by the CCPIT and an important platform for pushing forward the legal services work. Firstly, we have adhered to the practice of “going out”. The CCPIT Delegation for a Tour Study of Certification and Legalization, the CCPIT Delegation for the Study of ATA Service, the CCPIT Delegation on a Commercial Mediation Mission to the USA successively visited the United States, , Sweden, and New Zealand, meeting their colleagues and discussing, from the perspective of the two sides, questions related to certification and legalization, ATA Carnet system, commercial mediation and legal consultancy with a view to promoting international exchanges and cooperation. Secondly, we have paid adequate attention to the work of “inviting in”. Delegations from the ATA Carnet Department of the U.S. Chamber of Commerce, the Dallas municipal governments (U.S.A.), the Garvey Schubert & Barer (U.S.A.), the Chicago-Kent College of Law (U.S.A.), the Russian industrial and commercial communities, the World Customs Organization, the Davis & Company LLP (Canada) and our counterpart institutions in Britain, Italy and Austria were invited to visit China and their visits turned out to be successful, laying a sound foundation for the further enhancement of the bilateral cooperation. Thirdly, jointly sponsoring meetings. In cooperation with the CPR International Institute for Conflict Prevention & Resolution (USA), the China-US Commercial Mediation Congress focused on the theme of “Promote Commercial Media- tion to Build a Harmonious Society” was held in Beijing with over 150 representatives of renowned Chinese and American enterprises as well as economic, trade and legal experts participating in the meeting, which is of great significance to the

promotion of commercial mediation and the enhancement of Sino-US cooperation in the field of commercial mediation. Fourthly, taking an active part in international trainings and exchanges. During the year, scores of people were sent by the Legal Depart- ment to participate in all sorts of international trainings and exchanges such as international annual business meetings, academic exchange meetings and special training sessions, including a short-term sturdy of ATA Carnet service arranged by the DIHK, the 2005 ICC Annual Business Meeting on ATA, the Mainland-Hong Kong and Mainland-Macao Annual Meetings, the Cross-Strait Economic and Trade Coordination Meeting, the General Meeting of the International Association of European Average Adjusters, etc. 4. Gradually reinforcing the concerted efforts of the CCPIT system of organizations to render legal services Energetic efforts were made to conduct investigations to gain a complete picture of the legal services rendered by the CCPIT system of organizations and identify the key issues, hot issues and thorny issues facing the legal services development within the CCPIT system of organizations so as to give timely guidance in light of the actual situation. After conducting special investigations in some CCPIT regional branches, concentrated efforts were made to seek solutions to problems existing in various areas of legal services including certification and legalization, ATA, commercial mediation and legal consultancy. More training sessions were conducted for personnel within the CCPIT system of organizations to raise their professional skill in legal services. Within the CCPIT system of organizations, special training on the Regulations on Place of Origin of Imported and Exported Goods, training for staff engaged in certification and legalization and ATA training were conducted. While sponsoring training sessions, the Legal Department also advised its branches on how to conduct legal services training. The management system has been further improved to ensure the sound development of legal services. To gear our certification and legalization work to the new requirements resulting from the implementation of the Regulations of the People’s Republic of China on Place of Origin of Imported and Exported Goods and the Regulations on the Substantially Changed Standards in the Non-Preferential Rules of Origin, our working procedure was modified in time and arrangements were made for the whole system of organizations to study and grasp the new regulations. In view of the forthcoming implementation of a number of new rules and regulations, including the Rules for the Issuance of ATA Carnets, before the end of the year, the Practical Guide to the Issuance of ATA Carnets and the Supplemen- tary Regulations to the CCPIT Provisional Regulations Governing ATA Carnets were issued in time to all our visa agencies. New Media- tion Rules and Rules and Regulations for Mediators were published. New progress was made in expanding authorized legal services. During the year, 4 agencies were authorized to issue visas on behalf of the CCPIT. The concerted efforts of the whole system of organizations have been further reinforced. In response to the new situation facing the textile trade after the abolishment of the textile quota regime, the Conciliation Center and the Textile Trade Association jointly set up a special- ized committee for textiles under the Conciliation Center, which will play an important role in settling textile trade disputes. 5. The main tasks for foreign-related legal services in 2006 (1) Certification and legalization: closely follow the readjustment of the state policies on import and export and carefully study the change of the international market so as to enhance our ability to act promptly in response to changes, seize opportunities for development and endeavor to look for new areas for legal services growth while improving the existing services; strengthen the guidance over certification and legalization and set the goal for the building of a system management system so as to promote the legal services development; continue to popularize and implement the on-line certification and legalization project; strive to complete, as soon as possible, the CA verification and legaliza- tion within the CCPIT system of organizations and achieve the target that 20% of enterprises will use the CA Certificates issued by the CCPIT. (2) Work related to ATA: try by every possible means to break the “bottleneck” which restricts the development of the services and resolve, as soon as possible, the problem of counter guarantee in the Carnet insurance system; enhance the sense of urgency to popularize electronic filing of the ATA Carnet within the CCPIT system and take effective measures to get prepared for offering relevant services during the 2008 Olympic Games; promote the application of network technology in the work related to ATA and expand the scale of the services; strive to improve the environment for the implementation of the Carnet system. (3) Mediation: keep abreast with the mediation legislation process and fully air our views and suggestions on legislation; focus our work on case handling as a mediation network covering the whole system has been built; promote the development of international exchanges and cooperation in a pragmatic way, and put the stress of our service promotion on Sino-US, Sino-Italian and Sino-British joint ventures according to the framework of international cooperation in commercial mediation which has taken shape. (4) Legal consultancy: as a representative of the business community and a legal spokesman for the CCPIT system of organizations, actively participate in the state legislation process with a high sense of responsibility and fully transmit suggestions on legislation from the business community to the authorities concerned; vigorously expand the areas of foreign-related legal services, strive to offer high-quality legal services to enterprises and work for good economic returns and social effects, serving as a bridge for the vast number of enterprises in handling foreign-related legal affairs. (5) Average adjustment: on the basis of improving the professional skill and standardizing the case-handling procedure, energetically integrate insurance, transportation, shipping and other resources to demonstrate the unique status and advantage of the CCPIT in respect of average adjustment; make redoubled efforts for market promotion targeted at enterprises such as shipping companies and insurance compa- nies and create a good climate for the service development; continue to handle well particular average adjustment and adjustment related to domestic coastal transportation and increase the volume of case-handling; energetically push the establishment of an adjustment center and strive for an early start of the services for adjustment and assessment of property loss in the course of land transportation. In the new year, the Legal Department with higher morale will work in a creative spirit and exert concerted efforts to open up new areas of services and make new and splendid progress in foreign-related legal services. China International Economic and Trade Arbitration Commission (CIETAC) and China Maritime Arbitration Commis- sion (CMAC) are permanent international commercial arbitration institutions set up separately in 1956 and 1959 by CCPIT in accordance with the decision of the former government administration council of the central people’s government, which independently and impartially resolves, by means of arbitration, contractual or non-contractual, economic and trade disputes and disputes arising from maritime affairs.

CIETAC was formerly called the Foreign Trade Arbitration Commission as established. To meet the needs of the continuing development of China’s economic and trade relations with foreign countries after the adoption of the reform and opening-up policy, the Foreign Trade Arbitration Commission was changed to the Foreign Economic and Trade Arbitra- tion Commission in 1980 and then renamed the China International Economic and Trade Arbitration Commission in 1988, and also named as the Court of Arbitration of China Chamber of International Commerce as from Oct.1st , 2000. CIETAC has its headquarters in Beijing. The Shenzhen Sub- Commission and Shanghai Sub-Commission were estab- lished respectively in 1989 and 1990 in view of expansion of arbitration activities. The Shenzhen Sub- Commission was renamed South China Sub- Commission on June 18th, 2004. CMAC also set up Shanghai Sub- Commission on January 7th, 2003. The Beijing Headquarters of CIETAC and CMAC and their Sub-Commissions are one institution. They maintain the same Panel of Arbitrators and use the same Arbitration Rules and they share the same arbitration jurisdiction. CIETAC also set up the Domain Name Disputes Resolution Center of China International Economic and Trade Arbitration Commis- sion in 2000, and also named as the Online Dispute Resolution Center of China International Economic and Trade Arbitra- tion Commission since July, 2005, in order to resolve disputes arising from Domain Names and e-commerce by means of online arbitration. After fifty years of unremitting efforts to improve its service, CIETAC enjoys a wide reputation both domestically and internationally for its independence, impartiality, efficiency and expeditiousness in handling cases, earns a common trust of Chinese and foreign case parties, and has become one of the major commercial arbitration institutions in the world. Since 1990, it has grown rapidly to the first place in the world in terms of caseload. There are parties from 45 countries and regions other than China involved in CIETAC arbitration cases. CIETAC awards are accepted as fair and impartial both at home and abroad and are recognized and enforced in more than 140 countries and regions in accordance with Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention). The enforce- ment rate of CIETAC awards in Hong Kong is more than 99%. In 2005, the commercial and maritime arbitration services made further achievements. In this year, CIETAC took cognizance of 979 cases and concluded 958 cases. Under the heave market competitions, all the members of CIETAC cooperated in good faith, and strictly control the quality of arbitration awards. The number of case admission and conclusion in this year are both over the highest records, and the total subject matter of cases exceeds RMB 10 billion Yuan the second time. The impartiality of arbitration awards earns common recognition. Meanwhile, the Domain Name Dispute Resolution center took cognizance of 145 Domain Name and Keyword cases and concluded 122, which is the highest record till now. In the past year, CIETAC fulfilled the re-employment of arbitrators, and the number of arbitrators has reached 1025 at present, with 228 of them being foreigners. To improve the quality of arbitration and the awards, CIETAC strengthened the management and training to the arbitrators and secretaries and offices around the country. Also, CIETAC vigorously push forward the arbitration for specific business sectors. The current Arbitration Rules (Arbitration Rules 2005) were revised and come into force on Oct.1st, 2005. Arbitration Rules 2005 fully embodied the Party Autonomy Principle and the procedures are agile, effective and practical, and thus praised as” a modern set of arbitration rules with material break- throughs and conformed with international customs “ by related experts. The use of Arbitration Rules 2005 is a new promise of services by CIETAC for domestic and foreign parties with years of preparation, which spreads great influence to

arbitration societies around the world. CIETAC held this good opportunity to enhance the propaganda and extension of arbitration service and introduce the new developments of CIETAC to foreign enterprises, chambers and law offices. Now, CIETAC Arbitration Rules 2005 has been translated into Korean, Portuguese, Spanish and French. Meanwhile, CIETAC further enlarged external communication and friendly cooperation, which include hosting the visits of related institutions from USA, England, Italy and German, representing at international arbitration conferences such as “Institutional Arbitration in Asia”, and co-hosting arbitration seminar with the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) in Sweden. In 2005, CMAC took cognizance of 46 cases and concluded 40 cases. This caseload is more the number of 36 in 2004 and is a highest record in the history. CMAC also fulfilled the re-employment of arbitrators at the end of 2004, and the number of arbitrators has reached 187 at present, with 36 of them being foreigners, Taiwan and HongKong people. The year 2006 is the first year since the establishment of 16th commission, to strengthen the supervision and training to the arbitrators, CMAC further perfected several rules and regulations, and set up Regulations for the Training of Arbitrators. CMAC also hosted training classes for new arbitrators and Maritime Arbitration Salon in Shanghai and Beijing to deliver speeches and discussions around problems come out of the arbitration procedures, such as evidences, effect of “All other conditions as per C/P”, and so on. The secretariat of CMAC periodically held internal meetings to enhance the study of Regulations for Secretaries and the service spirit. CMAC also made a series of propaganda and survey efforts in the fields of shipping, logistics, ports, maritime and fishing through hosting and attending proseminars and training classes, and media including internet, newspapers and magazines. Besides, CMAC made efforts to contact and communicate with governmental departments in charge and related judicial departments and promoted the Supreme Court of PRC to make out the Notice Concerning Appointing Shanghai Maritime Court to Exercise Jurisdiction over Judicial Review to Maritime Arbitration related with Shanghai Sub-commission of CMAC on May 27th, 2005, which appointed Shanghai maritime court to exercise jurisdiction over cases concerning the effect of maritime arbitration agreement or application to withdrawal maritime arbitration awards related with Shanghai Sub-commission of CMAC. This notification of Supreme Court provided legal basis for Shanghai Maritime Court to exercise jurisdiction over judicial review to maritime arbitration cases. CMAC also took measures to strengthen the management to CMAC offices, cancelled the traditional way to provide administration out- lays and introduced the new distribution mechanism, which linked the bonus to work effects and brought material progress to the work of offices. In the new year, CIETAC will continuously and strictly control the problem of quality and ensure the quality of awards, and make a good effort in the extension, propaganda, survey of arbitration and the publication of related magazines, and continuously strengthen external cooperation and communication and positively join into the circulation of interna- tional commercial arbitration to step forward the CIETAC goal of modernization and internationalization. CMAC will continuously control the good quality and speed of cases administration and establish a public praise for the arbitration services. CMAC shall also make more efforts in the propaganda of maritime arbitration with Beijing Headquarter as the center, to introduce standard arbitration clauses of CMAC in land-carriage and aviation besides shipping, which will lead the work of CMAC to be based on traditional maritime arbitration, and with three centers of “logistics, fishing and maritime”. In 2005, CCPIT have implemented 30 training projects, including six overseas trainings projects with Talents Training 103 trainees; and 24 domestic projects, more than 2200 trainees. As a department of making plans and administrating training work, Department of CCPIT Sub-Council and Membership Affairs is in charge of domestic and overseas training projects, carrying out agreements signed with foreign institutions, under- taking important projects assigned by CCPIT’s leadership. Under the general frame of CCPIT talents training, other departments have also carried out some training projects.

The Achievement of CCPIT Domestic and Overseas Trainings IPMA-CP was the first qualification certificate training project introduced to the whole CCPIT system by CCPIT and the State Administration of Foreign Experts Affairs (SAFEA), from the U.S. International Per- sonnel Management Association. After taking the training course and the examination, 18 persons from CCPIT member enterprises have gained IPMA-CP Certificate, becoming senior professionals on HR management. CCPIT invited three experts from AFAQ-AFNOR to give lectures at “HACCP and Foodstuff Related E.U. Legislation” and “Training Program and the 3rd HACCP Seminar” held in Beijing and Hunan Province. To meet the demands of the foodstuff producing enterprises in Hunan Province, CCPIT have ar- ranged the three experts visiting these enterprises, giving guidance immediately on how to insure the quality and improve the technology. By the end of 2005, CCPIT have trained 500 persons from enterprises and quality supervision institutions of foodstuff industry, providing more than 20 enterprises from five provinces with technical expertise. Sponsored by Department of Sub-Council and Membership Affairs, Personnel Department, Foreign Affairs Office, Overseas Office in the U.S., CCPIT have held “U.S. Visa/Business Seminar” in Beijing and Shanghai, with officials and experts from U.S. Department of State, Immigration and Naturalization Service and World Trade Center giving lectures. Department of Sub-Council and Membership Affairs have also held “Seminar on What Chinese Companies Need to Know about Expanding Overseas” in Beijing and Shanghai. Other projects were: “the 8th Training Projects for the leadership of CCPIT Sub-councils and Branches”, “CEM-CHINA Training” by Exhibition Department, “Audit Training” by Asset Supervision Department, “In- tellectual Property Right Protection Training” by Patent and Trademark Law Office, and etc. To Implement the overseas training plans, Personnel Department have held “Patent and Trademark

Law Theory and Practice Training” in the U.S., “Human Resource Management and Practice Training” in Germany; Department of Sub-Council and Membership Affairs have carried out “Investment and Trade Training” in the U.S., “International Marketing and Negotiating Training” in France, “MSE Internationalization Training” in Japan. In 2005, CCPIT successfully organized “China-Africa Chamber of Commerce & Industry Seminar II” and “Train- ing Program for Chambers of Commerce & Industry of Asian Countries”. Up to now, CCPIT have trained 86 high ranking officials of chambers of commerce & industry and government departments from 30 African countries and 15 Asian countries.

Combining Resource, Creating Famous Brand After years of endeavor, CCPIT’s talents training have been developed a lot. Aiming at cultivating the project to be famous-branded training projects, Department of CCPIT Sub-Council and Membership Affairs have held “CCPIT System Training Work Meeting” twice in 2004 and 2005, discussing with sub-councils and branches about coopera- tion on some domestic and overseas training projects; searched the requirements and the development direction of CCPIT system training work through questionnaires; held “The 1st CCPIT System Training Achievements Exhibition”, with good training projects classified by “Creating New Brand”, “Specialized Subject” and “Integrative Managing”. All these actions were the fundamental work for rightly deploying CCPIT training resources and creating new brands. Department of CCPIT Sub-Council and Membership Affairs have made the best use of CCPIT’s international reputation and resource, cooperating with domestic and foreign institutions to develop and introduce new training programs: signed an agreement with International Trade Center (ITC) of U.N., defined that CCPIT would be EMD projects China National Center; signed an agreement with Research Center for Professional Managers (RCPM), established Administrative Committee of Professional Manager of International Trade (PMIT) Training Projects, be- gan to promote the project in China; Organized a work group to Hong Kong and Macau, visiting Hong Kong General Chamber of Commerce, Macau Trade and Investment Promotion Institute, and Macau Fair & Trade Association, for continuing “Enterprise Management Seminar for Chinese Companies”, which have been held for six time and be- come a brand training projects; attended EMD projects Meeting for Asia-Pacific Region held in Thailand, organized a work group to to visit ITC, discussing about introducing EMD project to China; cooperated with Ubi- France, who provided French experts and sustentation fund, on HACCP training project; signed cooperation agree- ment with Singapore Asprecise Business School.

Looking Ahead, We Have a Long Way to Go In 2006, CCPIT is going to implement 39 training projects, including 13 overseas projects, training 300 persons, and 26 domestic projects, training 2500 persons. In the new year, the Administrative Committee of Professional Manager of International Trade (PMIT), Training Management Office and Evaluation Management Office are running. CCPIT will focus on cultivating famous-branded training programs, that is, to promote the Training and Certificating Program of PMIT; introduce EMD from Interna- tional Trade Center; keep on undertaking IPMA-CP training, CEM-CHINA training, HACCP project, and U.S. Visa/ Business Seminar. CCPIT is applying for holding China-Africa Chamber of Commerce and Industry Seminar III and • The Third HACCP and EU’s Regulations Training was held in Changsha on Jun. Training Program for Chambers of Commerce and Industry of Latin America and Caribbean Sea Region. 20th, 2005 CCPIT is going to intensify harmonizing service, holding the 3rd CCPIT System Training Work Meeting, and the 2nd Training Achievements Exhibition, promoting the cooperation among CCPIT and her sub-councils and branches on training projects and establishing cooperation regulation. For carrying out agreements signed with foreign institutions, CCPIT will organize training delegations and research groups to the U.S., Europe, and other countries. Human Resource Management and Foreign Affair Service

In order to facilitate the ongoing reform and development and expanding foreign affair service, in the year of 2005 our Council attached great importance to the further reform of human resource system, enhanced the management of foreign affairs and service, valued human resource as the most important resource, and built up a favorable environment for professionals with various abilities. The reasonable deployment and ceaseless optimization of human resource has not only guaranteed the fulfillment of every missions of our Council, but also laid a favorable groundwork for sustainable development of trade promotion. The further implementation of The Outline of the Implementation for the Construction of Human Resource. The mechanism for human resource training, employing, inspiring and safeguarding has been built up and optimized. And the mechanism of competing for posts has been put into practice actively and steadily. As a result, the number and percentage of leaders who got their jobs by this way has been increased step by step. The percentage and number of exchanging, rotating officials and those delegated to lower organizations has been increased while the officials’ ability and style of work has been improved. The adjustment of organizations and the construction of leaders In the past year the configuration of leaders of 13 organizations has been enriched and adjusted. As a result, the composition of age, knowledge and specialty of leaders has been improved notably. Meanwhile the asset management mechanism of our Council has been much more perfect. The registration procedure of Asset Management Center has been completed. The reconfiguration of Asset Man- agement Commission has taken effect. The internal structure and personnel number in the Department of Exhibition has been adjusted. And Beijing China Exhibition Investment and Development Co., Ltd has been founded. Personnel recruitment /employment With the principle of openness, equality, competition and choosing the best, nearly 500 candidates participated in written examinations on specialty of Chinese, English, Japanese, law, intellec- tual asset, finance and accounting. Altogether 77 professionals were recruited /employed in the past year. Great attention has been paid to the recruitment of knowledged professionals from the society. A number of high-level professionals have been recruited and human resource composition has been optimized.

Review of Year 2005 Completed CCOIC registration and conducted researches in area of international chamber of commerce China Chamber of International Commerce finished its long delayed registration procedure, re-orientated its business scope and received its business license and relevant certificates in August 2005. Before the newly registered CCOIC starts its business, we did extensive research work beforehead. Such business inves- tigations include research of several business organizations, including several sub-councils in the Yangtze River Delta, China Chamber of Commerce of Metals, Minerals and Chemical Importers and Exporters (CCCMC), Shanghai Chamber of Interna- tional Commerce and few relevant foreign chambers of commerce. We tried to understand the real situation and problems during their business operation and hope such endeavors could be helpful in our business re-engineering. Such research work resulted in a series of business reports covering the area of operating procedures, finance, services etc. Based on the preliminary researches, several business proposals focusing on CCOIC business functions, financial management, membership fees restructuring, logo design, foreign chambers of commerce participation and corporate member liaison base etc were sketched out. Provided professional services and updated the membership database The year 2005 witnessed 28 new corporate members. Most of the new members are SMEs and from the sector of manufacturing and services. The CCPIT membership composition continues to be optimized. To help the corporate members develop in the global business context, we invited government officials and specialists from international law firms and organized seminars on topics of international duties, legal affairs, accounting, investment and risk-management in Beijing and Shanghai. In this year, we improved our data-mining and research work based on our membership database. For example, we have established a “Go Global” SME Database, which included over 200 Chinese companies invested and doing business abroad. We hope to better understand the status-quo of these enterprises and provide personalized services according to their needs. Besides, we also did on-site researches on companies in Dongguan city and Zhejiang province. Promoted understanding, strengthened guidance, and carried out construction of CCPIT system regulations In 2005 we carried out investigation for the basic information of sub-councils and clarified the status of our sub-councils. According to the results we updated “The information for CCPIT Sub-council leaders”, “ The address book of CCPIT Sub- council”. We also carried out training courses for sub-councils officials. The CCPIT department authorities discussed frequent problems and gave suggestions to the trainees in the training courses. We trained more than 180 sub-council officials and key business representatives. These courses were welcomed by sub-councils and branches. We also strengthened the inspection and guidance on the sub-councils. At the beginning of 2005 we held National Trade Promotion Working Conference. In the conference we reviewed the work of the whole system for 2004 commended excellent sub-councils and made some demands in the future work. In July we held National Working Conference for Sub- councils and Membership Affairs in Qinghai Province. In this conference, CCPIT President Mr. Wan Jifei put forward the goal to transform the system into a Combined Fleet in trade promotion services. He also addressed that we should strengthen the construction of our system and the development of talent team. This competition was the first recreational activity held nationwide in the CCPIT history for more than 50 years. It enriched the cultural life of the system and enhanced the cohesion of the whole system.

Objectives in 2006 2006 is the first year of 11th five year plan. Our economic and social development is in the best stage during the reform and opening up period. The department of sub-council and membership affairs will seize this opportunity and continue to implement the CCPIT Reform and Development Outline. We will strive to improve our work and make progress in the first year of 11th five year plan. Strengthen system construction, integrate system resources 1. Strengthen system planning and network construction. On the basis of research and extensive consultation, we will sketch out the 2006-2010 CCPIT Development Plan for the whole system. This plan should be under the guidance of scientific development view and in accordance with 11th five year plan. This plan will focus on extensive participation in international economic cooperation and strengthen our trade promoting undertakings. We will hold 2006 National Trade Promotion Working Conference, sum up the work of 2005 and arrange the work of 2006. We will also organize system resources integration session, national working conferences for sub-councils and member- ship affairs and 9th training courses for the leaders of sub-councils and branches. We will strengthen the investigation and research for the sub-councils and branches especially those non-active sub-councils and branches. On the basis of previous work we will check up the economic and trade activities under the name of CCPIT and participate with classification. We will hold experience exchange meeting for the organizers of important economic and trade activities to improve the organiz- ing level of these activities.
