1. Police Report PC Murdoch was deputising for WPC Kaiser-Ferris who was on a course and PC Howie who was on leave. He talked to the monthly report for October, a copy of which is attached at Appendix A.

He highlighted the new sergeant PS Kieran Dougal had started at having come from a CID background. In response to a question he stated that there had been 18 officers on duty for bonfire night but there had been no serious incidents in this part of the city. Patrols continue on golf course and Fairmilehead Park.

Monthly Crime Prevention Tip – Report any dark street lights to the Council.

1. Historic Environment Scotland Steven Robb, Deputy Head of Casework, Heritage Directorate introduced himself. He gave a slideshow presentation a copy of which is at Appendix C. He was unable to discuss active planning applications where HSE had commented i.e. Winton East.

Steven mentioned particular aspects of the procedures involved in listing buildings and also a useful website http://pastmap.org.uk/ which shows amongst other features listed buildings and conservation areas. He also mentioned the Spring Wellheads at which are listed and Comiston farmhouse which is not.

2. Minute Of Meeting Held On 3 October 2017 These were approved by the meeting.

Matters Arising: a) Pedestrian Crossing, Buckstone Terrace at Waterfield Road There was no progress the latest information being that the November installation date has slipped due to contract problems and that the earliest date for installation would now be March/April 2018. b) Boroughmuir High School This was on track to be occupied in January next year. There would be a transition and familiarisation period between the school opening and the February break. The Secretary informed the meeting that a report had gone to the Finance and Resources Committee that morning seeking approval to proceed with the sale of the existing building to CALA at a revised price of £11.7m. This was against the original offer of £14.525m but

Approval of the report was given. c) Buckstone Primary School The extension was on track to be finished in November and fitted out in December and should be open for the start of the new term. d) Braid Road Nothing further had heard on the proposals. e) Lothianburn Park and Ride The Secretary informed the meeting that he had responded to the request from the Council requesting views on the three questions raised in line with the discussion at the last meeting. A report was going to the Transport Committee in December. . 3. 4. Councillors’ Reports

Cllr Arthur distributed copies if his report:

Comiston Farmhouse – No news. Millar Homes/Winton – No news. New Pedestrian Crossing/Box Junction on Buckstone Terrace – This will go out to tender in January 2018 and will be installed March / April 2018., Existing Pedestrian Crossing on Buckstone Terrace (at Buckstone Gr) – This has been inspected and tested. Buckstone Crescent – I am working with people who live in Buckstone Crescent to bring the “abandoned” property there back in to use after over 20 years of neglect. It now appears that a bank is pursuing legal action with the aim of taking possession of the property – next due in court on 30th of November. Swanston Village – I have been working with residents with regard to the sale of Council poned land around Swanston Village. After a successful meeting between residents and Council Officers we now have the basis of an agreement in place – I am awaiting details being confirmed. East Camus Path – I am working with Council Officers here to install signage to highlight that pedestrians have priority on this path that connects Pentland Drive to Oxgangs Bank. Oxgangs Aldi – On track to open at the end of the month – I have a meeting next week with Council Officers and Jason Rust today to ensure the Broadway benefits from the added “footfall”. The focus of this is improved signage and local environmental improvements. 20mph Scheme – Scheduled for January/February no real issues have been raised. Boroughmuir High School – The new building will be ready to be occupied in January 2018. It has been agreed, at the request of the school’s parent council and the Head Teacher, that the five week period between the new term start in January and the February break will be used as a transition and familiarisation period for the school. When the school opens, more local households will be eligible for “free” to home school transport. Local Parking – Based on local feedback, I have asked for increased parking patrols around Buckstone Road and Buckstone shops.

In Council – Housing and adult social care are the biggest issues right now (and will be for some time). I’ve been trying to encourage local engagement in the budget consultation process and have been speaking to Council Officers about the Lothianburn park and Ride Proposal.

Councillor Doggart gave a verbal report reporting on sports pitch provision; quality of road repairs – slurry on top of weeds in east Camus; winter treatment for path between Mounthooly and Buckstone Circle; loss of banking facilities in and and community looking at [ossible solution.

In the absence of Cllr Rust the Secretary circulated his report: 1. I have been in contact with the Localities Manager and Chief Executive following Council communications re Neighbourhood Partnerships. It would seem that due to the delays and confusion around the new locality set-up, NPs are to continue for the time-being. This raises a number of questions which will hopefully be dealt with at the next meeting and I am keen that our Community Councils are kept fully in the loop. 2. I had a meeting this morning with Council Officers and Cllr. Arthur in relation to Oxgangs Broadway and future investment. A meeting will now be arranged with local businesses and then budgets permitting, items will be taken forward. I also took the opportunity to again raise the issue of the lack of lighting on the path between Oxgangs Library and the Aldi development. This is being followed up by officers. 3. I seconded a motion at Council congratulating Heriot Watt University on being named the inaugural International University of the Year 2018. 4. I seconded a further motion welcoming the City of Edinburgh Council webcast will be provided with subtitles to improve accessibility for Deaf and hard of hearing people. 5. I have had further discussions with council officers regarding the abandoned property at Buckstone Crescent. 6. I have had discussions with Hockey Club and officers in respect of availability of facilities etc. 7. I met recently with the Chairman of in respect of potential festival sponsorship, but also took the opportunity to highlight issues with local bus services.

Councillor Melanie Main introduced herself to the meeting. She was the Green councillor for Morningside and since the local election boundary changes a very small part (Fox Springs area) of the community council area fell within the Morningside ward.

She commented on parking east of Comiston Road; travel plans update for South Morningside Primary; review of Boroughmuir build and the forthcoming budget proposals. 5. Pentlands Neighbourhood Partnership/South West Locality The Secretary reported that the Locality situation was still not clear. He read over an e-mail from Cllr Donald Wilson, Chair of the Culture and Communities forwarded by Cllr Rust: “There continues to be confusion in some quarters regarding the status of Neighbourhood Partnerships . As Convener of the Culture and Communities Committee which has the over sight of this area I would like to reiterate again that Neighbourhood Partnerships remain in operation until new governance structures are in place. I would ask therefore that Locality Managers inform me of the dates of the next meetings which should be taking place in each area over the next couple of months so that this can be logged centrally.”

6. Planning and Environment Colin Anderson distributed copies of the planning report which can be found at Appendix B. He highlighted the following – 1 Winton East; 5 – Comiston farmhouse; 6 – Morrisons; 8 training; 10 – second court case; 17 Myreside and 20 Concert hall.

He also said that he had had a meeting with Donald McLeod of Turret Developments regarding the very initial proposals for the old pumphouse. These proposals were to divide the property into 3 flats with gardens. In the weekly list that had been issued that day there was notification of a PAN in respect of the existing Sick Children’s site.

Roger West representing he Friends of Fairmilehead Park gave an update. He thanked the Council and the Parks Officer for their assistance with getting a path laid. There had been a bulb planting event with very enthusiastic pupils from Pentland Primary. Some parents had set off fireworks but they had cleared up any rubbish after them.

7. Transport Complaints were raised about the state of the roads, particularly the main traffic routes, and the apparent inefficiency of the patching that was being undertaken in Swanston Road as opposed to just scarping the surface and laying a new top surface.

He also drew attention to the Council Budget consultation which had opened that day. Leaflets were also available in libraries.

A member of the public updated the meeting on her efforts to make contact with Firrhill High Schhol regarding encouraging the pupils to cycle. She had ascertained the Active School Co-ordinators details and would be contacting her.

Another attendee asked if the landscaping intentions as detailed in the planning permission in respect of the Scottish Water site had been fulfilled. The planning representative would follow this up.

APPENDIX B

FAIRMILEHEAD COMMUNITY COUNCIL

Planning Report – Tuesday 7 November 2017

A. FAIRMILEHEAD CC - LIVE

1. Miller Homes, Land to the East of Winton Gardens, Edinburgh Reference: - 15/02778/PAN and 17/00108/FUL Miller Homes lodged the planning application in January 2017. The proposals indicate a development of 86 units, being a mixture of 2, 3 and 4 bedroom houses. Full details are on the Planning Portal. The deadline for comments to the Council was Friday 17 February 2017. 112 comments by way of objection have been logged on the Planning Portal, with no comments in support. The FCC Letter of Objection was submitted on 27 February 2017 and can be viewed on the Planning Portal. Miller Homes recently lodged an additional Historic Impact Statement to address issues raised by Historic Environment Scotland (HES). HES responded maintaining their original concerns about the application. Miller Homes have been in discussion with the Council’s Transport Department regarding a more detailed Transport Assessment. Once that is completed, it is understood the Report to the DMC can be finalised. The Planning Officer advised me yesterday that “We are aiming for DM committee of 13 December 2017, subject to Transport matters.”

2. Construction of 6 single storey driving bays and golf academy in grounds of existing driving range and golf course at Swanston Golf Club, 111 Swanston Road Reference: - 17/04606/FUL This application by Swanston Golf Club was lodged last month. The site is on the left hand side of the road going up to Swanston Golf Club after one crosses the bridge over the City By-pass. The existing access off Swanston Road will be used. The deadline for submitting comments is 11 November 2017.

B. FAIRMILEHEAD CC - PENDING 3. Erection of single storey Nursery Building, removal of 2 trees and proposed tree planting at Cranley Nursey, 226 Braid Road Reference:- 17/01518/FUL The triangular area of ground at the corner of Braid Road and Buckstone Terrace was sold last year. This application is for permission to build an extension to the existing Cranley Nursery on that ground. No update.

4. Proposed mountain bike trails and other activities at the former Lothianburn Golf Course – Swanston Farms Limited Reference:- 15/00169/PAN Nothing has been heard about this application for several months.

C. FAIRMILEHEAD CC – COMPLETED 5. Demolition of existing buildings, erection of 37 flats, formation of new site entrance and parking area, landscaping works and all other associated works - Comiston Farmhouse, 83 Pentland View Reference:- 16/ 02397/FUL Scottish Government Appeals Division:- PPA-230-2205 Planning permission was refused by the DMC at its meeting on 19 April 2017, on the grounds the proposals were contrary to the LDP Policies DES1 and HOU4. On 3 July 2017 the developer lodged an appeal with dpea. On 6 October 2017 the Reporter issued his decision letter following a site inspection the previous month. In dismissing the appeal the Reporter said ”…. I find the proposal would not comply with the objectives of the relevant design policies of the development plan. In my judgment, the proposal would appear unduly dominant and prominent within its local context, would have an unacceptable impact on the amenities of immediately adjoining properties and result in the loss of an important tree. I consider that the proposal would have an excessive density and find that the concerns of the

council and many local residents that the proposal amounts to over-development to be well founded.” On 11 August 2017 the Council made a Tree Preservation Order (TPO) No. 187 in respect of 5 trees - 3 lime and 2 cedar – within the site, on the grounds these trees “contribute to the attractiveness and character of the locality”. The Order took effect on 11 August 2017. The deadline for making objections and representations was 11 September 2017.

6. Construct an extension to the existing Wm Morrison supermarket to accommodate a customer café and associated kitchen at 30 New Swanston Reference:- 17/02103/FUL Permission for this extension was granted as a Fast Track Decision on 7 July 2017 and work is well underway. At the September meeting, a question was asked about the disabled parking spaces adjacent to where the customer café is being built. I have been in touch with the Agent for Morrisons about this matter and await a further response from him.

D. CONSULTATIONS, GUIDANCE AND OTHER NEWS – EDINBURGH

7. Community Engagement in Planning On 17 August the Planning Committee requested a report be submitted on proposals for expanding community engagement in the planning system. This was to include the involvement of children and young people, hard to reach groups and the use of technology. A report setting out the scope for this was before the Planning Committee on 12 October 2017. This highlighted the variety of ways for people to get involved in planning, e.g. community representation, planning applications, Place standard, Edinburgh City Vision, Planning Aid for Scotland and RTPI ambassadors. Opportunities exist to do more to improve engagement and to deliver more meaningful involvement in the planning process. That report set out a number of areas for further exploration which will inform options going forward, e.g. define what is meant by community, hard to reach groups, consider the role of the Place standard, review examples of PANs to identify examples of good practice. A further report will be submitted to the Planning Committee in due course.

8. Training for Community Councillors A training session for Community Councillors was held on 31 October. One of the subjects covered was Listed Buildings and Conservation Areas. The following are some points of interest from the presentation:- there are 4,829 entries listed for Edinburgh made up as follows - 922 Category A; 2,666 Category B; and 1,241 Category C listed buildings (there may be a number of individual listed buildings in one Category entry); 30,000 individual buildings in total; 25 % of all planning applications are for Listed Building Consent for which no fee is payable by the applicant; and 23 % of the households in Edinburgh live within a Conservation Area. Interestingly the Council do not communicate with community councils on either applications for listed building consent or enforcement action.

9. Housing Land Audit and Delivery Programme 2017 A report on this subject was before the Planning Committee on 12 October. The Housing Land Audit and Delivery Programme (LHADP) is a monitoring tool used to assess the performance of Strategic Development Plan (SDP) housing land policies and targets. The HLADP records the amount of land available for house building, identifies any constraints affecting development and assesses the adequacy of the land supply against the supply target and housing land requirement set by the SDP. Scottish Planning Policy (SPP) requires local authorities to maintain a 5 year supply of effective housing land at all times to ensure that the housing land requirement is met. As at 31 March 2017, there was sufficient land free of planning constraints and available for development for 23,329 houses. In addition to this, there was land for a further 7,954 houses on sites where there is currently a constraint preventing development. The housing supply target for Edinburgh is 18,384 for the period 2016 to 2026. Adding in a 10% “generosity” margin to help ensure the target will be met, the housing land requirement is therefore 20,222. The number of new houses completed has more than doubled over the past 4 years from 1,191 in 2012/13 to 2,457 in 2016/17. However steps need to be taken to increase the delivery rate. The report refers to

actions identified last year to help here and how these have been progressed. In addition the report sets out a number of new actions proposed by the Council.

10. Recent Court Cases There have been 2 important court decisions in relation to planning law:- In the first of these, a petition for Judicial Review of a planning decision made by the Council was dismissed – Reference (2017) CSOH 135. This related to the mixed use development comprising hotel (225 beds), restaurant, café, retail and commercial uses and alterations to India Buildings, 11-15 Victoria Street and 18-20 Cowgate – Reference:- 15/04445/FUL. Planning permission was granted by the Council on 17 November 2016. There was considerable community opposition to this (“SAVE Edinburgh Central Library - Let there be Light and Land”), the focus being the possible effect of the development on the now A listed Central Library and other adjacent listed buildings. In dismissing the petition, Lady Wyse said none of the 3 grounds of challenge have been made out and no errors in the decision- making process have been established, and that the approach taken by the Council cannot be regarded as irrational or perverse. She also said that “it was well established that judicial review does not give an open opportunity to look at the merits of a decision as it is only the legality of a decision that can be challenged”.

In the second case, the Supreme Court rejected an appeal by Aberdeen City and Shire strategic development planning authority against the Court of Session decision to quash its adoption of statutory supplementary guidance implementing its Strategic Transport Fund. Important legal issues in planning law were considered by the Court and will likely result in changes to the Section 75 contributions regime. The crux of the issue was the argument by the developer that the contribution under Section 75 it was required to pay to the Fund, was disproportionate to the infrastructure demands created by its development.

E. DEVELOPMENTS – EDINBURGH and

11. Calderstones , demolition of existing dwellinghouse, erection of hotel, formation of access roads and associated works – Midlothian Council Reference:- 15/00113/PPP No update. The application for planning permission in principle was granted on 26 August 2015.

12. Development of affordable housing (between 70 to 90 units) with associated roads, parking infrastructure and landscaping at Site 72 metres south of 4A Oxgangs Green Reference:- 17/04444/PAN This pre-application notice was registered with the Council on 26 September 2017. There will be a consultation event in Oxgangs Library in the second half of November – details have still to be confirmed. (This previous application for a proposed residential development of 89 units of affordable housing with associated roads, infrastructure and landscaping, at site 72 metres south of 4A Oxgangs Green under references: - 16/04446/PAN and 16/06134/FUL was withdrawn by the applicant on 4 September 2017.)

13. Remove metal fencing, re-point wellheads and replace stones where missing, bricked-up doorways to be rendered, step access to be covered with metal grille at Site 72 metres South of 4A Oxgangs Green Reference:- 17/02621/LBC This is an application for Listed Building Consent for part of the Site mentioned in No. 10. There are 2 Wellheads, both B Listed and which date from the late 17th Century. These are part of Edinburgh’s first piped water supply. The 2 Wellheads are surrounded by metal fencing and disguised by overgrowth. It is proposed to repoint the stonework and replace missing stones. The overgrowth will be cleared and the ground properly maintained going forward as part of the development mentioned above. A decision on this is awaited but will be affected by the new application in No. 10 above.

14. Application for planning permission in principle for Land 1000 metres NW, SW and W of Hermiston Junction M8, Road – proposed residential development, local centre,

community facilities (including primary school), green network ( “Phase 1 of the Garden District”) by Murray Estates. Reference: - 15/04318/PPP Scottish Government Appeals Division Reference: - NOD-EDB-002 *Case Update 24 October 2017* Inquiry and hearing sessions in this case were held 22-24 May and 12 October 2017. It is anticipated that a report will be forwarded to Ministers during January 2018, following receipt of the parties’ closing submissions. Scientific Advice for Agricultural Services (SASA) have withdrawn their objection to this application. The developer has agreed to substantial woodland planting and enhanced boundary treatments to lessen the impact of the development on SASA’s operations. In addition, they have agreed to contribute £150,000 towards the cost of the relevant mitigation measures and also give a piece of nearby ground free of charge to SASA. This would be secured by the completion and registration of a planning obligation.

15. Former Royal High School Building at 5-7 Regent Road, Edinburgh (Hotel Development) References:- 15/03989/FUL and 15/03990/LBC Scottish Government Appeals Division References:- PPA-230-2178 and LBA-230-2076 www.dpea.scotland.gov.uk References: - 16/04537/PAN; 17/00587/LBC: 17/00588/FUL (amended applications) The developers lodged the amended applications for planning permission in February 2017. In their Report Planning Officials recommended that the amended applications be refused. A hearing was held by the DMC on 31 August and after a 6 hour session the applications were unanimously refused. The developer has already indicated they will appeal the refusals to Scottish Ministers.

16. Residential development, up to a maximum of 1400 units, and ancillary commercial (Class 1 retail and Class 2 financial and professional) including landscaping, access and services and all other ancillary development at site 100 metres north east of 19 Road, Edinburgh Reference:- 16/04738/PPP Scottish Government Appeals Division: - PPA-230-2207 As mentioned previously, this is site HSG19 in the recently adopted LDP. It represents one of the largest housing allocations in the LDP and a significant westward expansion of the city, on land which formerly comprised Green Belt. The value of the overall development is estimated at £280m. Planning Officials recommended that the application be refused and this was agreed by the DMC on 19 April 2017. As expected, on 18 July 2017 the applicants lodged an appeal with dpea against this refusal. 2 Reporters have been appointed and a public hearing will be held between 24 and 26 January 2018.

17. Erection of two spectator stands, disabled viewing platform, television gantry, hospitality marquee, retail marquee, food and drink units, toilet facilities, and associated works/infrastructure. George Watsons College Grandstand, Myreside Reference: - 17/04240/FUL Last year Edinburgh Rugby were granted a temporary planning permission – 16/04715/FUL - to use Myreside for a 12 month period for their home games in 2017. This application now seeks permission to use Myreside on a permanent basis. An Addendum to the Transport Assessment was recently lodged.

18. Erection of 11 temporary nesthouses and a temporary community hub building which incorporates kitchen, dining and lounge facilities in support of nesthouses, together with associated landscaping at land 120 metres south of 20 West Shore Road Reference: - 17/02839/FUL October’s report mentioned this proposal (“Social Bite Village”) to provide a temporary community of modular housing for up to 20 homeless people with the aim of supporting these people into permanent housing and employment. At the DMC meeting on 20 September on a division the application was continued for a site visit and for further public consultation. The site inspection took place on 28 September. The application will be before the DMC on 8 November with a recommendation from the Planning Officer that it be granted subject to conditions.

19. Erection of student accommodation with associated development, including landscaping and access works (as amended) at 22 Haymarket Yards Reference: - 16/04400/FUL October’s report mentioned this application for student accommodation on former railway land at Haymarket. A 7 storey building is proposed with 91 beds (originally 104). A separate new building within the site will have 60 cycle spaces. The application came before the DMC on 27 September when it was continued for a site visit and further information on (i) student accommodation both consented and completed within the data zone and (ii) the 3 apartments that had not complied with daylighting criteria. The site inspection took place on 2 November. The application will be before the DMC on 8 November with a recommendation from the Planning Officer that it be granted subject to conditions.

20. Demolition of rear office block and associated works and erection of music and performing arts venue (Class 11) and associated uses at 35-36 St Andrew Square Reference: - 17/04757/PAN This pre-application notification relates to the proposed new music and performing arts venue (1,000 capacity) immediately behind Dundas House. This would be the new home of the Scottish Chamber Orchestra. This has been featured in the local press. The venue would be used extensively during the Edinburgh International Festival. It would involve the demolition of a 1960s office block to the rear of the RBS Branch. The RBS Branch would continue to operate as at present. It appears this is being funded to some extent by the Dunard Fund but significant fundraising, grants etc. would be required. The overall cost was stated in the Press to be £45m. A consultation event is being held in the RBS Branch on 7 November between 3 pm and 7.30 pm.

21. Erection of new 6 storey building, comprising 11 flats and a small commercial space on the ground floor – abuts existing tenement gable – at 7 Canaan Lane Reference:- 17/00184/FUL Scottish Government Appeals Division:- PPA-230-2211 September’s report mentioned this application to replace the former public toilets on Canaan Lane with a new 6 storey building. This was refused by the DMC on 2 August on the grounds it was contrary to LDP policies DES1, DES4 and DES5. The applicant lodged an appeal against the refusal with dpea on 31 August. An accompanied site inspection was held by the Reporter on 23 October and a decision is awaited.

22. Demolition of existing garage and re-development for 37 units, access, parking, associated infrastructure and landscaping (as amended) at 116 Colinton Road Reference:- 16/04062/FUL Scottish Government Appeals Division:- PPA-230-2212 September’s report mentioned this application to redevelop the site until recently occupied by Western Motors. The application attracted a lot of local objection, with 69 representations being lodged, including one from Community Council. Planning Officials recommended approval. A hearing was held on 2 August 2017 following which the DMC refused the application. The applicant lodged an appeal against the refusal with dpea on 31 August. In his appeal submission the developer has claimed the Council acted unreasonably and contrary to the policy requirements in the LDP in refusing the application and also acted contrary to the Edinburgh Design Guide and Affordable Housing Guidance. As a result the developer intends to pursue costs from the Council to reflect the additional expenses incurred on professional work associated with the appeal. The Reporter carried out an unaccompanied site inspection on 17 October and a decision is now awaited.
