Pla/65/09/18 Minutes RESOLVED that the public minutes Pla/50/08/18 to Pla/63/08/18 of the meeting of this Committee held on 13 September 2018 be confirmed and signed by the Chairman as a correct record of those proceedings. Pla/66/09/18 Declarations of Interest No declarations of interest were made at this meeting. Pla/67/09/18 Planning Issues RESOLVED that the attached lists of the Deputy Director Technical Services: a) Applications determined under office delegated powers for the month of August 2018 (attached as Appendix 1 to these minutes) b) Reasons for refusal on delegated decisions for the month of August 2018 (attached as Appendix 2 to these minutes) be noted. 1 Pla/68/09/18 Planning Issues - Applications for Debate (Green Papers) Members were advised of the applications requiring a decision by Members as detailed in a report of the Deputy Director Technical Services. RESOLVED that: 1. the following applications for planning permissions ("those applications") are determined as indicated hereunder; 2. those applications which are approved be approved under the Town and Country Planning Act, 1990, subject to any detailed conditions set out in the Report, to any conditions set out below and to any conditions as to time stipulated under Sections 91 and 92 of the Act; 3. those applications which are refused be refused for the reasons set out in the report and/or any reasons set out below; 4. those applications which the Deputy Chief Executive is given delegated powers to approve under the Town and Country Planning Act, 1990, be approved by him subject to any detailed conditions set out in the Report, to any conditions as to time stipulated under Sections 91 and 92 of the Act, to the receipt of satisfactory replies. Pla/69/09/18 Planning Application No. 18/0586, Erection of 18 dwellings and associated infrasturcture The Senior Planning Officer gave an update on the response which had been received by the Education Authority after the preparation of the agenda. The Senior Planning Officer read out a response which had been received after the deadline for the Parish Council, in accordance with their wishes. Councillor Lynch arrived at 9.38am. The Committee received a presentation from Mr J Woodward in objection to the application. The Committee received a presentation from Councillor E Martin, from Hesket Parish Council, in objection to the application. The Committee received a presentation from Mr Blue, an agent, in support of the application. Proposed by Councillor Thompson Seconded by Councillor Sealby And RESOLVED that delegated power be given to the Deputy Director Technical Services to GRANT planning permission subject to a Section106 Agreement being entered into to the absolute satisfaction of the Deputy Chief Executive and the Deputy Director Technical Services requiring the provision of; 2 4 dwellings at 40% below market value subject to a price cap, one of said dwellings being a bungalow and fully accessible, suitable for older people; A developer contribution for highway improvement works of £6258.29; A footpath to link the site to the existing footpath network. and the Council’s reasonable costs being paid in relation to that Section 106 Agreement and subject to the following conditions: 1. The development permitted shall be begun either before the expiration of three years from the date of this permission. Reason: In order to comply with the provisions of the Town and Country Planning Act 1990. 2. Reason: To ensure a satisfactory development and to avoid any ambiguity as to what constitutes the permission. Pre-commencement conditions 3. Prior to the commencement of any development, a surface water drainage scheme, based on the hierarchy of drainage options in the National Planning Guidance Practice Guidance with evidence of an assessment of the site conditions (inclusive of how the scheme shall be managed after completion) shall be submitted to and approved in writing by the Local Planning Authority. The surface water drainage scheme must be in accordance with the non-statutory technical standards for Sustainable Drainage Systems (March 2015) or any subsequent replacement national standard. The drainage scheme submitted for approval shall also be in accordance with the principles set out in the Flood Risk Assessment & Drainage Strategy dated 25 May 2018 proposing surface water discharging to the ground via infiltration techniques. Once approved the development shall be completed, maintained and managed in accordance with the approved details. Reason: To safeguard against flooding to surrounding sites. It is necessary for the condition to be on the basis that 'No development shall commence until' as compliance with the requirements of the condition at a later time could result in unacceptable harm contrary to the policies of the Development Plan. 4. No development shall commence until a construction surface water management plan has been agreed in writing with the Local Planning Authority. Once approved, those details shall be implemented fully for the duration of the hereby approved development. Reason: To safeguard against flooding to surrounding sites. It is necessary for the condition to be on the basis that 'No development shall commence until' as compliance with the requirements of the condition at a later time could result in unacceptable harm contrary to the policies of the Development Plan. 5. Prior to the commencement of the development clear arrangements must be detailed for ongoing maintenance of the drainage system over the lifetime of the development. The drainage system must be designed for ease of maintenance. These details shall be submitted for written approval by the Local Planning Authority. Once approved, these details shall be adhered to at all times. Reason: To ensure flood risk is not increased within the site or elsewhere. It is necessary for the condition to be on the basis that 'No development shall commence until' as compliance with the requirements of the condition at a later time could result in unacceptable harm contrary to the policies of the Development Plan. 4 6. Prior to the commencement of the development details of the longitudinal/cross sections of the carriageway, footways, footpaths, cycleways and all other required infrastructure shall be submitted to the Local Planning Authority for written approval. The details shall be in accordance with the standards contained with the current Cumbria Design Guide and be designed, constructed and lit to a standard suitable for adoption. Once approved these details shall be constructed and implemented as per the approved plans and before the development is complete. Reason: To ensure a minimum standard of construction and in the interests of highway safety. It is necessary for the condition to be on the basis that 'No development shall commence until' as compliance with the requirements of the condition at a later time could result in unacceptable harm contrary to the policies of the Development Plan. 7. Prior to the commencement of the development, details of any works associated with vehicular crossings over the footway, including the lowering of kerbs shall be submitted to the Local Planning Authority for written approval.
