A. SCOPE OF SERVICES

1. General. CONTRACTOR shall furnish all labor, tools, equipment, materials, supplies, supervision, and all other items to satisfactorily maintain, in a clean and sanitary condition, the common and described areas in the Hale Iako Building within the NELHA Research Campus. This building is dedicated to tenant and STATE offices, meeting and collaboration areas. All trash, wastepaper and other rubbish shall be removed from the facilities by the CONTRACTOR after each cleaning and deposited in the proper outside receptacle.

A Notice to Proceed (“NTP”) shall be issued by the STATE Officer in Charge (“OIC”) to indicate the date that services shall commence. No services shall be provided prior to the date indicted on the NTP.

The STATE shall furnish tissue, hand towels, toilet seat covers, napkin disposal bags, hand soap, deodorants, and trash can liners. However, the CONTRACTOR shall be responsible for replenishing these supplies in the proper receptacles or fixtures as required. The CONTRACTOR shall contact the Officer-in-Charge (OIC) to obtain and store supplies provided by STATE in the janitor’s and other designated storage areas. The CONTRACTOR shall furnish all other cleaning supplies and equipment such as ladders, brooms, mops, buckets, rags, vacuum cleaners, sponges, brushes, dusters, disinfectants, cleaners, wax remover, floor wax, table surface wax and so forth.

The CONTRACTOR shall perform all services in a safe and efficient manner. The CONTRACTOR shall employ the best industry practices to provide services as specified herein. The CONTRACTOR shall further assure that the performance of work specified herein shall be in complete compliance with any applicable rules and regulations of all federal, state, and local governmental agencies.

The CONTRACTOR shall be solely responsible for the satisfactory completion, as determined by the STATE OIC, of all work performed in accordance with the specifications herein.

2. Specific Services to be Performed.

a. CONTRACTOR shall perform the following services daily: 1) Clean and disinfect toilets, urinals and sink basins. 2) Clean restroom mirrors. 3) Replenish all restroom supplies. 4) Sweep and wet mop restrooms . 5) Sweep and wet mop , hallways, entry and interior stairway. 6) Clean and wipe down tables in collaboration area 7) Vacuum entry mats/rugs. 8) Clean drinking fountain. 9) Clean sink and countertop in kitchen. 10) Empty all trash containers in service area, including kitchen. Trash shall be removed from the building and deposited in proper outside receptacle (dumpster) as designated by the Officer-in-Charge.

b. CONTRACTOR shall vacuum the carpets and wipe down the table tops in Conference Room 208, Training Room 119 and all small carpet areas in the collaboration and meeting lanai areas each Tuesday and Friday, except when a State Holiday falls on one of those dates, in which case said work shall be performed on the respective preceding working day.

c. CONTRACTOR shall perform the following services on a monthly basis: 1) Clean , and partitions of the restrooms and . 2) Sweep, mop and wax the hallways, lobby, collaboration area, upstairs meeting lanai and all common areas on the first and second floors. 3) Outside Lanai and : Sweep, wash (scrub off bird feces) and mop wood and stair treads. Wipe down handrails and guardrails. 4) Metal Stairs in Rear of Building: Sweep, wash (scrub off bird feces) and mop stair treads. Wipe down handrails and guardrails. 5) Clean entry doors, and door/ frames (inside and outside) in common and collaboration areas. 6) Wipe down and polish (remove rust) all interior and exterior door. hardware – handles, push-bars, kick-plates, automatic closers, hinges.

7) Wipe down, vacuum upholstery and wax wood surfaces of all in the meeting lanai, collaboration and common areas (approximately 6 seating areas). 8) Sweep and hose down concrete surfaces of all first-floor entry areas. d. CONTRACTOR shall perform the following services on a quarterly (every 3 months) basis: 1) Wash all outside building windows and window frames on first and second floors of building.

2) Clean interior and exterior light fixtures

3) Wash windows and frames of Room 203 (interior, collaboration side only).

4) Wash and wipe bird droppings off all outside blue painted metal . e. The following services shall be performed two (2) times during each term of the Agreement, the third week in February and the first week in August: 1) Strip and floor wax hallways, lobby, collaboration area, upstairs meeting lanai and all common areas on the first and second floors. 2) Machine scrub and steam clean restroom floors and scrub restroom tiles. 3) Clean all and lobby walls.

4) Clean fans in collaboration area.

f. The following services shall be performed two (2) times during each term of the Agreement, the first week in February and the third week in August: 1) Clean interior surfaces of all doors and windows in the common areas on the first floor, at the end of the hallway on the second floor and in the Conference Room 208 and inside the Training Room 119.

B. TIMING OF PERFORMANCE OF SERVICES Services to be performed as listed in the Scope of Services sections 2a through 2c shall be carried out Monday through Friday between the hours of 5:00PM HST and 12:00AM HST. Services to be performed as listed in the Scope of Services sections 2d through 2f may be carried out any time Monday through Sunday, provided the CONTRACTOR coordinates the timing and approval of the services with the STATE OIC.

C. WORKERS COMPENSATION The CONTRACTOR shall, in accordance with Sections 396-12 to 396-129 Hawaii Revised Statutes inclusive, procure and keep in force during the term of this Agreement adequate workers compensation insurance for all of its employees who will be engaged in work on the premises under this Agreement, and in case any part of this Agreement is sublet, the

CONTRACTOR shall require his subcontractor to maintain such insurance for all the subcontractor’s employees who will be so engaged, unless the latter’s employees are protected by the CONTRACTOR’s insurance. The CONTRACTOR shall submit to the STATE a “Certificate of Insurance” evidencing workers compensation insurance prior to commencing work under this Agreement.

D. INSURANCE The CONTRACTOR shall procure and keep in force during the term of this Agreement comprehensive general liability insurance with one combined single limit of liability of at least ONE MILLION DOLLARS ($1,000,000) for ANY OCCURENCE. The CONTRACTOR shall submit to NELHA a Certificate of Insurance evidencing general liability insurance prior to commencing work under this Agreement. Each insurance policy required shall contain the following clauses:

i. “This insurance shall not be cancelled, limited in scope of coverage or not renewed until after 30 days written notice has been given to the State of Hawaii, Natural Energy Laboratory of Hawaii Authority, Fiscal Department, 73-4460 Queen Kaahumanu Hwy, #101, Kailua Kona, Hawaii, 96740-2637.”

ii. "The State of Hawaii and the Natural Energy Laboratory of Hawaii Authority are added as additional insured’s with respect to operations performed for the State of Hawaii."

iii. "It is agreed that any insurance maintained by the State of Hawaii will apply in excess of, and not contribute with, insurance provided by this policy."

Each insurance policy shall be written by insurance companies licensed to do business in the State or meet Sections 431:8-301, Hawaii Revised Statues, if utilizing an insurance company not licensed by the State of Hawaii.

The CONTRACTOR agrees to deposit with the STATE, on or before the beginning of work, certificate(s) of insurance necessary to satisfy the STATE that the insurance provisions of this Agreement have been complied with and to keep such insurance in effect and the certificate(s) therefore on deposit with the STATE during the entire term of this Agreement. Upon request by the STATE, the CONTRACTOR shall furnish a copy of the policy or policies.
