Liquor and Gaming Control Authority Response to Committee as at 7 September 2018 Printed on: 12/09/2018 @ 5:06 PM Question 1: In relation to the following question on notice: 3. The answers to questions on notice indicate that 215 venues have entertainment licence restrictions on them, and 74 have entertainment prohibited. Please list each venue and the entertainment licence. The answer that has been given only supplies the information requested from Table 44 in relation to one licence type (Liquor - on-premises licence) rather than what was requested, in relation to each licence type (Liquor - club licence, Liquor - hotel licence, Liquor - limited licence, Liquor - packaged liquor licence, Liquor - producer wholesaler licence, Liquor - small bar licence). Could the remaining information be supplied in the same format? Answer 1: Liquor & Gaming NSW has re-analysed licensing data as at 7 September 2018 and used refined search criteria that captured a broader range of entertainment restrictions. During this re-analysis, it was identified that some licences with older prohibitions and restrictions were inadvertently not picked up by the original search parameters. The response to the question on notice therefore requires correction as follows: As at 7 September 2018, there were 94 venues identified with entertainment prohibitions (on entertainment, live entertainment and/or live music); and 575 venues identified with entertainment restrictions (on the conduct of live entertainment/music, certain music genres, locations and times at which live entertainment or music must cease). A list of these venues by licence type is included in the table below. General noise limits that do not prohibit or directly restrict live entertainment or music from being provided, and similar requirements (e.g. relating to extra security, transportation & exit/entry from a venue where entertainment is provided) were typically not included. Some venues also had multiple entertainment-related conditions, so have been included once only to avoid double or triple-counting. Question 1A: Are the licence conditions referred to all the conditions, or simply the conditions on the liquor licence? That is, are there additional conditions that might be attached to the development approval by a local council or planning authority that relate to entertainment? Answer 1A: The conditions supplied to the Committee include those imposed on liquor licences. Conditions relating to entertainment may separately be imposed on a development consent by the relevant local consent authority. The main sequence is arranged in strict chronological sequence. A separate sequence lists the names of rival associations which formed at various intervals. The correct title of the respective associations is noted in the heading of each page, immediately under the year(s) of operation. Notes within the index have been kept to a minimum, but have been included when it was felt necessary to explain for example, the rise of a rival association or the reasons for a person's resignation/dismissal. In addition, the dates of elections for office bearers usually coincide with the financial year but occasionally follow the calendar year. Such changes typically follow a major upheaval of some kind and some explanation is warranted. I have also endeavoured to explain the reasons for any change in the association's name. Finally, as I imagine that this index will be used by family historians, I have tried to give certain background information. GEORGE SOURIS, MP Minister for Tourism, Major Events, Hospitality and Racing Explanatory note The object of this Regulation is to amend the Liquor Regulation 2008: (a) to specify the licensed premises in the Sydney CBD Entertainment precinct that are (or are not) high risk venues for the purposes of Division 4 of Part 6 of the Liquor Act 2007, and (b) to make it clear that tourist accommodation establishments, licensed restaurants and small bars in the Kings Cross and Sydney CBD Entertainment precincts will be subject to the new lock out and cease sales requirements if they are determined to be high risk venues by the Secretary of the Department of Trade and Investment, Regional Infrastructure and Services or if they are venues to which Schedule 4 to the Act relates (see the amendments made by Schedule 1 [1]–[3] and [5]–[7]). This Regulation is made under the Liquor Act 2007, including sections 116B (2) (b) and (3) and 159 (the general regulation-making power).
