SW/10/0304 (2.1) Mr Bruce Bell

Change of use of two existing buildings from agricultural use to B1 (light industrial) and B8 (storage and distribution) for a temporary period for five years (retrospective). Vigo Farm, Lane, Lynsted, Nr .

The Development Control Manager reported that Lynsted and Kingsdown Parish Council had raised no objection to the application. Highway Services (KHS) acknowledged that local residents had concerns regarding the potential increase in traffic caused by the proposal, but as a larger scale of development had already been granted, KHS therefore raised no objection.

Mr Bell, the Agent, spoke in favour of the proposal.

Members supported the application but were disappointed that it had been retrospective.

RESOLVED That application SW/10/0304 be approved subject to conditions (1) to (8) in the report.

SW/10/0267 (2.2) Mr Rodney Ridout

Change of use of land from agricultural to keeping of horses and building of replacement stables and storage with pitched roof. R/o Skyline, 89 Chequers Road, Minster, Sheppey.

The Area Planning Officer explained that the deadline for representations was 3rd May 2010. He reported that the applicant had submitted a letter which explained changes that had been made to the building. These included the addition of roof lights to allow the roof space to be used for storage and allow for a fire escape. The building had been constructed to a high standard and was the same footprint as a previous approved application on the site in 2008. Amendments to the application included the addition of stable doors and the deletion of some windows and the addition of others.

Mrs Ridout, the Applicant, spoke in favour of the proposal.

Some Members raised concern that the building could be used as a residential dwelling. The Chairman advised that condition (6) in the report addressed this issue.

RESOLVED That application SW/10/0267 be delegated to Officers to approve subject to conditions (1) to (7) in the report, any fresh representations received before the 3rd

May 2010 deadline, and the inclusion of a condition requiring more details on the stable doors.

SW/10/0102 (2.3) Mr J Griffin

Residential scheme comprising thirty 1 bedroomed flats, twelve 2 bedroomed flats, six 3 bedroomed flats and associated landscaping and basement car park. 109-111 Staplehurst Road, Sittingbourne, Kent, ME10 2NW

A Ward Member reported that there was local concern regarding the proposal which included issues of over intensification, traffic problems and the height of the development. He further explained that residents were not opposed in principle to the application but concerns had been raised with the Traffic Management Scheme.

Members raised the following points: the amount of accommodation proposed was the same as a previously approved application on the site, and the arrangement of the development was cramped.

A Ward Member moved a site visit, but on being put to the vote, the motion was lost.

Mr Donald, the Applicant, spoke in favour of the proposal.

In response to questions, the Major Projects Officer explained that Code Level 4 of the Code for Sustainable Homes was a benchmark made up of a variety of different measures, required to be carried out by the developer on the development. He reported that Code 4 was a higher standard than the policies in the Local Plan required. He explained that most of the conditions in the report were typical of applications of this kind. He reported that condition (21) in the report addressed the issue of mud from the construction site getting on to local roads during construction to ensure they were kept clean while work was being carried out. He reported that the development was now more compact than in previous applications, and was a smaller footprint, but taller in height.

An amendment was proposed to defer the application to give Members the opportunity to visit the site and talk to local residents on an informal basis. The Chairman sought advice from the legal representative and rejected the amendment as it was the same proposal as the move to a site visit.

The KHS Officer explained that the proposal was similar to the previous application and he did not consider there would be increased heavy goods vehicle movement in the area.

Councillor Duncan Dewar-Whalley did not vote on this application.

RESOLVED That application SW/10/0102 be approved subject to conditions (1) to (25) in the report.

PART 4 SWALE BOROUGH COUNCIL’S OWN DEVELOPMENT; OBSERVATION ON COUNTY COUNCIL’S DEVELOPMENT; OBSERVATION OF DEVELOPMENT BY STATUTORY UNDERTAKERS AND BY GOVERNMENT DEPARTMENTS; AND RECOMMENDATIONS TO THE COUNTY COUNCIL ON “COUNTY MATTER” APPLICATIONS

SW/10/0333 (4.1) Governing Bodies of Westlands School Installation of 3 mobile classrooms at the Westlands School, Sittingbourne.

Members raised concern with the ever expanding number of mobile classrooms and requested that consideration be given to a new secondary school in north Swale.

RESOLVED That no objection be raised to application SW/10/0333 subject to conditions (1) to (2) in the report and that Kent County Council be advised of the above comments.

SW/10/0064 (4.2) Kent County Council C/o KCC Planning Applications Group

Redevelopment of site, involving demolition of existing buildings and erection of new school buildings and facilities for up to 970 pupils, including 2 storey family units and shared facilities building, sports pitches, car parking provision, new cycle storage, new boundary treatment, tree works and landscaping. Academy, West Site, Jefferson Road, .

The Major Projects Officer reported that further information had been provided on the potential noise implications, especially with regard to the re-location of access to the site from Marine Parade. He brought Members' attention to condition (2) in the report which sought to address this issue. He explained that two houses would need to be demolished.

The Major Project Officer confirmed there would be no student parking on the site and the Academy would also be used by the community.

A Ward Member welcomed the proposal, but raised concern with the proposed new access from Marine Parade. He suggested that traffic calming measures be put in place. The KHS Officer confirmed that there would be no parking outside the Academy and the access would have 'Keep Clear' signs.

An amendment was proposed requiring Conditions (9) and (13) to state 'removal', rather than 'minimise' dust and mud, and the inclusion of a suggested condition in respect of ensuring that the level of outdoor play space is not reduced.

RESOLVED That no objection be raised to application SW/10/0064 subject to Conditions (1) to (23) in the report and the inclusion of the above comments, and an additional condition in respect of play space provision.

The Area Planning Officer explained that the appeals had been dismissed against Enforcement Notices on homes where the planning condition, stating that the homes should not be occupied between 2nd January and 1st March, had been contravened. A decision needed to be taken on appropriate measures to take on 3rd January 2011, in case the issue of occupancy during this period arose again.

Discussion ensued on the options that could be implemented and Members offered their support to Officers.
