He got a reply on 20- 6-2009, wherein he was given part information and he was told that the rest of the information will have to be collected from the Taluk Office, Alangulam and Ambasamudram, by the PIO, District Survey Office, Tiruneveli. On 3-3-2009, he appealed and he was told the same reply on 26-3-2009. He also appealed to the two Taluk Offices on 2-4-2009 to whom the original PIO has marked the letters asking them to supply the information, but didnot get any reply from them and appealed on 12-5-2009 to the District Registrar again and he got a reply in X.K. 2609/09 dated 23-3-2009 in which some replies were given, but answers according to him for question No.9,10,11,12 and 13 have not been given. Whereupon, he came on a complaint to the Commission on 27-7-2009, received on 3-8-2009, resulting in today's enquiry. These facts were averred to by him at the enquiry and the public authority also confirmed the same and stated that his complaint of queries 1 to 6 have not been given a reply is not correct as he has given a reply in their letter. However, the reply is that they donot have the records and stated that according to their records, 1874 survey settlement details asked for are not available in the District. They have only 1906 and beyond survey records and the 1906 records does not show of the existence of any 1874 records. As the petitioner states that he has obtained 1874 records details from the Tamil Nadu Archives in an earlier RTI petition and hence avers that these records exist at the Archives. The PIO, Alangulam, also stated that he had given information asked for in reply to another RTI petition on 14-10-2009 and in that reply and the detailed records given therein covers all the points asked for, but the petitioner states that the specific details asked for in question No.7,8 and in sub divisions of that field asked in question No.9,10,11,12 and 13 have not been given to him. Regarding query No.15,16,17 and 18 original records are supposed to be at the parent Taluk Office of Ambasamudram from which Alangulam was bifurcated and that PIO is not present today, having sent a telegram stating that he is busy with the flood relief work. The Commission, therefore, rules that the Collector, Tirunelveli District should (a) direct the PIO, District Survey Office, Tirunelveli, to obtain the records asked for in query No.1,2,3 from the Archives and supply them to the petitioner within four weeks; (b) to ensure that the PIO, Alangulam Taluk, specifically send again the details with regard to query No.7,8,9,10,11,12 and 13 as asked for; (c) direct the PIO, Ambasamudram Taluk Office, to supply the information for query No.15,16,17 and 18; (d) direct the PIOs concerned to supply the information asked for in the petitioner's petition dated 1-6-2009 in Case No.18241/Enquiry/2009; (e) send a completion certificate to the Commission within four weeks of this order. (f) The information must be supplied free of cost and any payment made by the petitioner must be refunded to him under Section 7(6) and his acknowledgement filed before the Commission.
