1. The petitioner/appellant Thiru. K. Devendran, is present for today’s enquiry. The Public Authority is absent.

2. The petitioner/appellant has sent a petition under Section 6 (1) of the RTI Act, on 16-02-2015 to the Public Information Officer, O/o the Tahsildar, Madhavaram Taluk Office, asking for information on two items i.e, soft copy or Xerox copy of typed ‘A’ 2 register copy of Madhavaram Village as per Old Survey Nos and the Xerox copy of Madhavaram Village Field Map drawing (FMB) of the old survey Nos. 1087, 1088, 1089, 1090, 1091, 1092, 1093, 1094, 1095, 1096, 1097. As the required information has not been furnished within the stipulated time, the petitioner has sent a first appeal under Section 19(1) dt.30-03-2015 to the Appellate Authority adding other 8 survey Nos.874, 872, 403, 947, 990, 995, 991, 990. On 10-04-2015, the Public Information Officer by his letter No. e.f.v©.091/2015/m1 ehŸ 10/04/2015, has furnished the item-wise information to the petitioner. In that letter, the Public Information Officer has stated that for item No.1, he is not able to furnish the information sought for by the petitioner since the petitioner has failed to furnish the survey numbers for which he has sought for ‘A’ register copy. At the same time, he has furnished the FMB copy for the survey Nos.1091, 1092, 1093 of Madhavaram Village. Aggrieved, the petitioner/appellant has sent a second appeal dt.25/05/2015 under Section 19(3) to this Commission for providing the soft copy or Xerox copy of the information sought for by him, which is taken up for today’s enquiry.

3. For today’s enquiry, summons are issued to the Public Information Officer cum Headquarters Deputy Tahsildar, Madhavaram Taluk, Madhavaram, Chennai and the petitioner Mr. K. Devendiran. As already mentioned, the petitioner Mr. K.Devendiran is present but the Public Information Officer is absent for today’s enquiry.

4. During the course of enquiry, the petitioner has stated that he did not receive any information for item No.1 and he received only information partly for item No.2. A perusal of the reply of the Public Information Officer dt.10-04-2015 would show that the information to the first item is totally denied and for the second item information pertaining to survey nos.1087 to 1090 and 1094 to 1097 are also denied by the Public Information Officer. Those information are readily available in the records of office of the Public Information Officer. Under these circumstances, this Commission passes the following orders :-

(1) The Public Information Officer is directed to furnish the information asked for by the petitioner in item No.1 in his RTI petition dt.16-02-2015 in full and for item No.2, the Public Information Officer is directed to furnish the information 3

pertaining to the survey Nos.1087 to 1090 and 1094 to 1097 to the petitioner free of cost within 30 days from the date of receipt of this order by registered post with acknowledgement due. The Public Information Officer is also directed to send a compliance report to this Commission within 15 days from the date of compliance of this order.

(2) The Public Information Officer is directed to show cause as to why action under Section 20 (1) & (2) should not be recommended for against him for his absence for today’s enquiry before this Commission within 15 days from the date of receipt of this order.
