Change may come in Court selections The way Kansas chooses Supreme Court justices may be one of the first things to come up when the Legislature meets next month. Big vote totals against two justices show how the public feels about the high court. Hard as it is to lose an election where you run unopposed, the justices came close. In this instant case, people upset by the court’s voiding a death penalty in a heinous Wichita murder case ran a campaign promoting a “no” vote. It wasn’t much, but both men came close to losing their seats. In most years, hardly anyone votes against appellate judges up for “retention,” but this year, a lot of voters were unhappy. This unrest has been growing for several years as the high court has taken upon itself to rewrite the laws and redefine the state Constitution. Of course, how you feel about a court decision depends a lot on the outcome you wanted, not on any objective standard. But under the Kansas Constitution, a bare majority of voters can oust any judge for any reason they like. An Unfortunate Indiscretion There are all kinds of subtle touches a declarer can employ to try to attain his goal. Take this case where West led the ace and another diamond against six hearts, South winning the second dia- mond with the queen. South’s only problem was to avoid a trump loser. But when declarer cashed the ace and West’s ten appeared, he decided to give himself an extra chance by crossing to dummy with a spade in or- der to lead a second round of trumps toward his hand. He fully intended to play the king if East followed low, but he thought he might tempt East into an indiscretion if the trumps were actually divided 4-1. Sure enough, when East saw South taking pains to lead the second round of trumps from dummy, he became convinced that declarer would finesse the eight. So East put up the nine in an effort to assure himself of an eventual trump trick -- a slip for which declarer proceeded to make him pay Jim Borgman & Jerry Scott dearly. • After West showed out on the king, South crossed to dummy with a spade, ruffed a spade, led a club to the king and ruffed another spade. These two ruffs reduced South’s trump holding to the Q-8, while East had the J-5. Declarer then returned to dummy with a club and led his spade winners. Whether East ruffed or not, South was sure to finish with 12 tricks. East should not have gotten himself into this predicament, but he did.
