Introduction 1. Submitting Parties The Daphne Caruana Galizia Foundation welcomes the Human Rights Committee’s (HRC) request for information regarding human rights issues concerning the ‘State Party’ of Malta. The Daphne Caruana Galizia Foundation is a ​non-profit, independent and non-governmental organisation registered in Malta and was established by the family of the investigative journalist, Daphne Caruana Galizia, who was assassinated in a car bomb attack in Malta on 16th October 2017. 2. The Foundation’s mission is accordingly; ensuring the public interest of full justice for Daphne’s assasination; supporting efforts to protect investigative journalists; ending impunity for the murder of journalists; ensuring the guardianship of Daphne’s work; promoting a culture of public interest litigation; supporting independent, non-partisan media.1 In doing so, we advocate for the complete fulfilment of the core values of international human rights laws, including but not limited to, the International Covenant of Civil and Political Rights (ICCPR) to which Malta is a state party. 3. Our submission will focus specially on the failures to implement Article 2, Article 14, Article 17 and Article 19 of the ICCPR in Malta. The Foundation hopes that our assessment of these issues will contribute towards the Human Right Committee’s evaluation of Malta’s adherence to their obligations under international law. Her murder was a cruel and stark reminder of how tenuous the free flow of information can be when democratic systems falter. We added Daphne to the sad and long list of journalists whose work Forbidden Stories is committed to continuing. For five months, we coordinated a historic collaboration of 45 journalists from 18 news organizations, aimed at keeping Daphne Caruana Galizia’s stories alive. Her investigations, as a result of this, ended up on the front pages of the world’s most widely-read newspapers. Seventy-four million people heard about the Daphne Project worldwide. Although her killers had hoped to silence her stories, the stories ended up having an echo way further than Malta. The president is the head of state, appointed by a resolution of the unicameral parliament for a term of five years. The parliament appointed George Vella president for a five-year term beginning April 4. The president names as prime minister the leader of the party that wins a majority of seats in parliamentary elections. Early parliamentary elections held in 2017 were considered free and fair. On December 1, Prime Minister Joseph Muscat announced he will resign the Labor Party (PL) party leadership following the election of a new leader on January 12, 2020. He also said that he will resign as prime minister in the days that followed the leadership election to make way for a new premier. The PL intends to complete its five-year mandate, which began in 2017. The national police maintain internal security. The armed forces are responsible for external security but also have some domestic security responsibilities. Both report to the Ministry of Home Affairs and National Security. Civilian authorities maintained effective control over the national police, the intelligence services, and the armed forces, and the government has effective mechanisms to investigate and punish abuse. It has asked difficult questions to witness and forced the only form of proper examination of the circumstances in which Daphne Caruana Galizia was assassinated and the causes of the crime, how it was allowed to happen and the failings of the State in dealing properly with the matter after the fact. In our submissions, we will attempt to address the Inquiry’s substantive terms of reference. 1. We show how Joseph Muscat and people within his circle enjoyed and continue to enjoy impunity in spite of mounting evidence that should have led to proper investigations and prosecution for crimes under existing law. We cite examples such as events connected with John Dalli’s return from Brussels, the Pilatus affair, the Panama Papers and others. We argue that this level of impunity coupled with police failure to act appropriately after a string of car bombings allowed the perpetrators of their crime to believe they would not be caught. 2. We show how Joseph Muscat and his circle led a campaign to dehumanise Daphne Caruana Galizia, frustrating her right to privacy, family and property, ultimately denying her the right to her very life. 3. We list the failures of the State to mitigate the risks to Daphne Caruana Galizia’s life, including the effect of her isolation as a result of slander and vilification on political party media.

    Rapporteur on the assassination of Daphne Caruana Galizia reacts to the resignation of Maltese Prime Minister Joseph Muscat Pieter Omtzigt (the Netherlands, EPP/CD), rapporteur on ‘the assassination of Daphne Caruana Galizia and the rule of law in Malta and beyond: ensuring that the whole truth emerges’, today issued the following statement. “After the astonishing events of the past two weeks, and especially the last 24 hours, now is the time to take stock and to look to the future. These have been the main developments in the criminal investigation and the related political context: - In December 2017, Vince Muscat and the two Degiorgio brothers were arrested and charged with the murder of Daphne Caruana Galizia in October 2017. In July 2019, they were indicted. - Muscat is reported to have provided evidence against the Degiorgio brothers and the alleged middleman, Melvin Theuma, detailing how the murder plot had been planned and carried out. Muscat’s request for a pardon in return for this testimony was refused. - On 14 November 2019, Theuma was arrested for money-laundering. Theuma then provided evidence against wealthy businessman Yorgen Fenech, detailing how he had commissioned and paid for the murder. - Fenech is reportedly the owner of a secret off-shore company expected to make large payments to secret offshore companies owned by Keith Schembri, Prime Minister Muscat’s chief of staff, and Konrad Mizzi, a government minister. Daphne had reported on most of the details of this scheme, which allegedly relates to corruption in major government contracts. - On 19 November, Prime Minister Muscat promised Theuma a conditional pardon.

The recent confession of Mr. Vincent Muscat shed further light on the criminal act of the murder of Daphne Caruana Galizia, while also showing that many questions around other individuals possibly implicated remain unanswered. The revelations make clear that the Maltese government must still consider the fight against organised crime, corruption and the intimidation of journalists as an utmost priority. I am particularly concerned over the possible involvement of public officials in the Daphne Caruana Galizia case. Allegations that former Economy Minister Chris Cardona could have been involved in a plot to kill a journalist and that MP and former parliamentary secretary Rosianne Cutajar could have accepted cash from Yorgen Fenech, the man accused of masterminding the assassination, are alarming. In light of this, bearing in mind DRFMG does not want to interfere with ongoing court proceedings, we would request the Maltese government to give our DRFMG a comprehensive update on the latest state of affairs in the case of the murder of Daphne Caruana Galizia.
