Dear Chamber Members, 2010 was a challenging year for the American Chamber of Commerce (Chamber) and our Members as Ukraine’s new leader- ship struggled to effectively address issues within an economy which was dealing with the fallout of the global financial crisis. The Chamber and its Executive team reacted to these changes by quickly adapting to the new reality and provided access, informa- tion, and high level engagement on behalf of our Members to key decision makers, who have the responsibility to develop and manage the process of implementing comprehensive economic reform which is desperately needed to ensure that Ukraine is able to successfully compete in the global market place and attract the much needed domestic and foreign investment. Throughout 2010, the Chamber focused on the strategic priority set by the Board of Directors of increasing Ukraine’s com- petitiveness through the Chamber’s “Partnership for Successfully Competing in the Global Economy”. That initiative sets forth a clear and concise regulatory and legislative reform agenda created in conjunction with the business, expert, NGO and donor community designed to help Ukraine mitigate the negative impact of the financial crisis and position it appropriately to take advantage of global growth trends. This work product was well received by the new political elite and many of the ideas and concepts are reflected in President Yanukovych’s ambitious Economic Reform Agenda that the Chamber is busy helping to execute. A prime example of that high level engagement and the subsequent results was the passage of a comprehensive Tax Code in December of 2009 with substantial input from the business community under the Chamber’s umbrella. The Chamber also focused on strengthening our Policy Team and our Committees and further tapping into the Chamber’s long-stand- ing relationships with key decision makers in order to work on those issues that are of major concern to our Membership. In the same vein, the Chamber further developed numerous segmented Networking events, allowing our Membership to have access to the wealth of experience and opportunities that their fellow Members of the Chamber also bring to the table. The Chamber has focused in further developing a well-rounded offering of benefits and services by being proactive, innovative, and customer-service-oriented. This uncertainty has raised the importance of the role that the American Chamber of Commerce in Ukraine plays as a “Key to your Success” and a focal point for increasing the competitiveness of the country. The Chamber, as a representative of the business community, continues to proactively utilize different advocacy venues to lobby for positive changes in the business environment in Ukraine. On September 1st, 2010 the President Viktor Yanukovych issued Decree #892 “On the Council of Local and Foreign In- vestors” reorganizing the Foreign Investors Advisory Council (FIAC) and establishing a new advisory body to the President that will engage strategic local and foreign investors into the process of decision mak- ing assisting in the reform process, developing of the economy of Ukraine and enhancement of the coun- try’s integration into European and global economic systems. The Chamber’s proposals regarding the Council’s reorganization were taken into account by the President of Ukraine helping to create an effective platform for the business community to engage in a high level policy dialog with the President of Ukraine.

On July 8th, 2010 the Law #6525 “On Collection and Accounting of Unified Social Contribution” was adopted by the Parliament. Such decision was taken with 250 confirming votes out of 425 present. The Draft Law envisages consolidation of the func- tions, similar to functions of all funds of compulsory state social insurance in one body — Pension Fund of Ukraine, i.e.: registration of the payers of insurance payments; development and management of the State Register of Social Insurance; maintenance of the unified reporting; control over the completeness and timely charging of the unified social contribution. Moreover, it is suggested to implement the payment of the unified social contribution for compulsory state social insurance (from January 1st, 2011) and its division by the State Treasury to centralized ac- counts of the social insurance funds.

In December 2010 the Tax Code of Ukraine #7101-1 with amendments incorporated by the President of Ukraine has been adopted by Verkhovna Rada and subsequently signed into law.

The American Chamber of Commerce’s business community was actively involved into the process of preparing and adoption of the Tax Code, advocating for economically rational well grounded wording of the Tax Code which we will all have to live with for years to come.
