November 12, 2020 Email: [email protected] The Honourable Filomena Tassi Minister of Labour House of Commons Ottawa, Ontario K1A 0A6 Dear Minister Tassi: Subject: Request for appointment of an Arbitrator between the International Association of Machinists and Aerospace Workers and Air Canada We are writing to request the immediate and urgent appointment of an Arbitrator pursuant to section 57(4) of the Canada Labour Code to assist in resolving approximately 130 grievances which are national in scope affecting the majority of our members working for Air Canada through the country. These issues are causing a direct financial hardship to our members and their families. Despite our repeated efforts to get the company to agree on scheduling dates, Air Canada is refusing to agree upon scheduling Arbitrators and hearing dates to resolve these matters. The effect is frustration of the grievance-arbitration process, the collective bargaining agreement, and the labour relations between the parties and the Union’s Membership. As many of the grievances are similar in nature, the grouping of the 130 grievances into silos would result in approximately 10 or 11 arbitration hearings. The Air Canada Collective Agreement has named arbitrators as per a National Arbitrations Memorandum of Agreement signed November 16, 2017, who are familiar with the parties. We respectfully request that you appoint one or both of the named National Arbitrators agreed to by the parties (Ms. Corinn Bell and/or Ms. Christine Schmidt) to determine these matters. We are seeking hearings as quickly as possible, and we expect the hearing of these matters will take place via video-conference. Canada’s fertilizer industry is doing everything possible to ensure farmers receive essential fertilizer products in time for spring seeding in April and May, while protecting employees and the public from COVID-19. We know that the situation remains fluid and rapidly changing, but as the government implements new policies it must acknowledge that fertilizer is essential to continued global food security. Like many industries who rely on Canada’s infrastructure system to deliver products, we have felt the impact from recent disruptions. However, we have done well in recovering and generally have normal supplies of fertilizer moving throughout the country. This movement must continue, allowing farmers to position product for spring seeding and ensure additional quantities are available for replenishment throughout the entire planting season. The Canadian supply chain is resilient and can manage through these challenges. However, our industry would be concerned about any restrictive measures that may have unintended consequences on rail, port, and truck service, or imports and operations at agri-retail. Your government must ensure that the Canadian border remains open to the movement of critical goods, like fertilizer, in order for farmers to receive their product and meet their spring seeding requirements. In addition, clarity for agricultural businesses on the Temporary Foreign Worker program will allow industry to appropriately manage its labour force and ensure continued operations.

It is no secret that the COVID-19 pandemic has had an impact on all sectors of activity. Nurses, orderlies, cashiers and a few other trades were rightly thanked in a number of ways. However, I feel it is more than time to thank the truck drivers for the discreet but fundamental work they have done for the Canadian community. At the height of the crisis, the daily lives of these workers were not always easy. Who has not heard about the washrooms that were not available for truck drivers who spend long hours in the cab of their vehicles? Or the restaurants that no longer provided access to the counter to order a hot meal? And let's not forget the closure of hundreds of rest areas across North America that deprived many truck drivers of a deserved shower after long hours of work. Truck drivers have ensured that the supply chain is working without interruption. They continued to make deliveries bravely, without asking for anything in return. Store shelves were filled by them. Hospitals were stocked with medical supplies because a truck driver took to the road that day, despite the risks. Access to quality and affordable food was one of the challenges truck drivers faced during the pandemic. Increases of up to 50% have been seen in some parts of North America which has created a serious financial impact for tens of thousands of truck drivers.

April 17, 2020 Right Honourable Justin Trudeau Prime Minister Office of the Prime Minister 80 Wellington Street Ottawa, ON K1A 0A2 Re: Mobilizing Home Health Care During COVID-19 Dear Prime Minister Trudeau, First of all, thank you for continued efforts to support us and all of those working tirelessly to support the health of Canadians during this pandemic. We are writing you as our sector grapples with the challenges we face today as well as looking ahead to the future waves of infection over the next 12–18 months. There are significant health human resource challenges impacting the sector and it is our recommendation that the federal government, through provinces and territories, invest to better support health home care workers. Frail elderly and individuals with chronic disease, those at greater risk of acquiring COVID-19, hospitals and long-term care facilities are high risk settings to receive care. Throughout this crisis, home health care has continued to be an essential service for older adults living with frailty, people with complex, chronic disabling conditions, and individuals at the end of life. The Canadian Home Care Association (CHCA) appreciates the federal government considering a temporary top up to the salaries of low-income workers. However, we feel strongly that the following elements need to be implemented in order to achieve maximum benefits to retain essential unregulated home health care workers: The top up program must be designed as an employer subsidy that includes unregulated home health care workers providing essential services during COVID-19. The program should incent employers to offer full time work - 37.5 hrs / week @$23.50 / hr (i.e.

The Honourable Filomena Tassi Minister of Labour 140 Promenade du Portage Gatineau, Quebec, K1A 0J9 Subject: Port of Montreal – Longshore Workers Strike Dear Minister, We are writing to raise our concern with the possibility of a renewed labour disruption at the Port of Montreal and the detrimental economic effect it will have on the port and indeed the country. As you may recall, in August of 2020 labour action in the Port of Montreal effectively closed the port for 3 weeks. The parties – CUPE Local 375 & the Maritime Employers Association – agreed to a “truce” to provide time to negotiate a contract to replace the previous agreement, which had expired in 2018. That truce is scheduled to end on March 21. This means that a strike or lockout could start as early as March 24. At present there is little sign of progress, or even of negotiations between the parties, despite the efforts of the Labour Canada mediators. The hope is that the parties will be able to come to an agreement before March 21. However, if this does not happen, the result should not, and cannot, be a total cessation of service at the Port of Montreal. The shut down of an essential element of the Canadian supply chain is not an acceptable consequence of a failed labour negotiation. We recognize the right of workers to collective bargaining but that right does not extend to holding Canadian shippers’ hostage and hurting the Canadian economy as a whole. FMA does not have a position on the issues in dispute at the Port.
