Subject: Request for appointment of an Arbitrator between the International Association of Machinists and Aerospace Workers and Air Canada

We are writing to request the immediate and urgent appointment of an Arbitrator pursuant to section 57(4) of the Canada Labour Code to assist in resolving approximately 130 grievances which are national in scope affecting the majority of our members working for Air Canada through the country. These issues are causing a direct financial hardship to our members and their families.

Despite our repeated efforts to get the company to agree on scheduling dates, Air Canada is refusing to agree upon scheduling Arbitrators and hearing dates to resolve these matters. The effect is frustration of the grievance-arbitration process, the collective bargaining agreement, and the labour relations between the parties and the Union’s Membership.

As many of the grievances are similar in nature, the grouping of the 130 grievances into silos would result in approximately 10 or 11 arbitration hearings.

The Air Canada Collective Agreement has named arbitrators as per a National Arbitrations Memorandum of Agreement signed November 16, 2017, who are familiar with the parties. We respectfully request that you appoint one or both of the named National Arbitrators agreed to by the parties (Ms. Corinn Bell and/or Ms. Christine Schmidt) to determine these matters. We are seeking hearings as quickly as possible, and we expect the hearing of these matters will take place via video-conference.
