1. Introduction

1.1 The protection of areas of open space within the urban and rural settlements of Newport is considered to be a key element in providing a healthy and sustainable environment. The Local Development Plan seeks to protect public open spaces from unacceptable development and retain them for use by the communities they serve.

1.2 The purpose of this background paper is to set out how the Environmental Spaces allocated in the Local Development Plan have been identified and the sources of information used. It provides a series of ward plans highlighting each site and the primary reason for its identification. These areas are allocated in the Local Development Plan – Revised Deposit as Environmental Spaces under Policy CE4.

1.3 A version of the Background Paper was published in April 2012 to support the Deposit Plan (April 2012). It has been updated to reflect changes in the status of land where known, and provide background evidence to the Revised Deposit (June 2013).

2 Policy Background

National Policy

One : One Planet – May 2009 2.1 This document sets out the Welsh Assembly’s vision of a sustainable Wales. Central to achieving this aim are 5 headline indicators: sustainable resource use, sustaining the environment, a sustainable economy, a sustainable society, and wellbeing. Commitment 219 states: “We will foster a sense of public ownership in relation to the countryside, urban green spaces and our coastline, recognising that many socially excluded groups do not currently enjoy their social, cultural and health benefits.”

People, Places, Futures: The Wales Spatial Plan 2008 update 2.2 The document sets out the Welsh Assembly Government’s policies and priorities in a spatial context. It recognises that our environment is fundamental to our quality of life and its protection, regeneration and enhancement is essential for its own sake, for health and wellbeing and for economic opportunities.

Planning Policy Wales Edition 5 – Nov 2012 – Chapter 11 Tourism, Sport & Recreation 2.3 The Assembly Government supports the development of sport and recreation, and the wide range of leisure pursuits which encourage physical activity. PPW notes that the Assembly Government’s long term strategy for an active, healthy and inclusive Wales is set out in Climbing Higher(Climbing Higher: The Welsh Assembly Government Strategy for Sport and Physical Activity – WAG 2005) . The Assembly Government’s main planning objectives are to promote:  a more sustainable pattern of development, creating and maintaining networks of facilities and open spaces in places well served by sustainable means of travel, in particular within urban areas;  social inclusion, improved health and well-being by ensuring that everyone, including children and young people, the elderly and those with disabilities, has access to the natural environment and to good quality, well-designed facilities and open space; and  the provision of innovative, user-friendly, accessible facilities to make our urban areas, and particularly town centres, more attractive places, where people will choose to live, to work and to visit.

2.4 Formal and informal open spaces, including parks with significant recreational or amenity value, should be protected from development, particularly in urban areas where they fulfil multiple purposes, not only enhancing the quality of life, but contributing to biodiversity, the conservation of nature and landscape, air quality and the protection of groundwater. Such open spaces also have a role in climate change, for example, by contributing to flood management and helping to reduce urban island effects.

2.5 All playing fields, whether owned by public, private or voluntary organisations, should be protected from development except where:  facilities can best be retained and enhanced through the redevelopment of a small part of the site;  alternative provision of equivalent benefit is made available; or  there is an excess of such provision in the area.

TAN 16: Sport, Recreation and Open Space (2009) 2.6 TAN 16 states that open space, particularly that with a significant amenity, nature conservation or recreational value should be protected. Local planning authorities should identify these areas in the development plan, and establish criteria against which sites should be assessed if development pressures arise (para 3.12).

2.7 Urban vacant and underused land should not be unnecessarily protected from development where the land is not of significant amenity, nature conservation or recreational value, as its development may reduce the need for development in less sustainable locations.

Local Policies

Corporate Sustainability Action Plan – 2009/12 2.8 The Sustainability Action Plan has been prepared in response to the Welsh Assembly Government’s, One Wales: One Planet. The Action Plan sets out the key actions the Council will take to try and achieve the main sustainability principles of One Wales: One Planet. One of the objectives of the Corporate Plan is “ will sustain an environment the whole city can take pride in and enjoy”. An action set out to achieve this goal is to “expand green spaces and forestry ensuring all communities have access”.

Single Integrated Plan – February 2013 2.9 The Newport Single Integrated Plan (SIP) is the defining statement of strategic planning intent for the next 3 years. It identifies key priorities for improving the City. Its vision is:

“Working together to create a proud and prosperous City with opportunities for all”

2.10 The SIP has six priority themes, which are:  Skills and Work  Economic Opportunity  Health and Wellbeing  Safe and Cohesive Communities  City Centre  Alcohol and Substance Misuse

2.11 The Plan has had regard to these priority themes and is well placed to help deliver them.

3 Identifying Environmental Spaces

3.1 There are many types of greenspaces in Newport including parks, public amenity spaces, woodlands, commons and village greens, wildlife corridors and playing fields. Rather than have separate allocations for each type of green space, it is considered more practical to have one Environmental Space classification, covering all types of greenspace. In some instances, the same area of greenspace could be used for different purposes by different people. Therefore defining each area for a specific function could be problematic where there are a number of uses that justify the protection of that area. It could also make the Proposals Map difficult to read where several types of open space designation overlay the same area.

3.2 The starting point for identifying potential Environmental Spaces was reviewing information relating to greenspaces in Newport. This involved identifying the following designations:

4 Identified Areas

4.1 Environmental Spaces are plotted as being worthy of retention and protection. The purpose of the designation is primarily to protect within urban areas greenspaces that might otherwise be vulnerable to development. For this reason, only greenspaces within or adjoining the settlement boundary have been designated as Environmental Spaces. Greenspaces situated outside the settlement boundary, and not adjoining the settlement boundary will be protected by the countryside designation.

4.2 The Environmental Spaces identified by the different designations listed in Table 1 have been plotted by ward and a table compiled to list each site and the designation(s) associated with it. This information is attached at Appendix 1. The identified Environmental Spaces will be incorporated into the Proposals Plan of the Local Development Plan.

4.3 The methodology used to identify Environmental Spaces has been designed to provide a consistent and transparent approach. While every effort has been taken to identify and plot as many sites as possible, it should be noted that the identified sites are not an exhaustive list of Environmental Spaces. There may be other greenspaces that are important to the local community or of environmental or recreational value that have not been identified.

4.4 A recent planning appeal has acknowledged this point in relation to the Environmental Spaces identified in the Newport Unitary Development Plan and noted that “it would be an unduly arduous task for the Council to compile a full list of all existing qualifying sites as part of the UDP process and it is not unreasonable to consider sites not defined on the Proposals Map on their individual merits” (App/G6935/A/10/2121304). This was also supported by Appeal Decision ref: App/G6935/A/10/2120127 where the Inspector determined that an amenity area provided as part of the original layout of a housing development fell within the ambit of policy CE33 (UDP) despite it seemingly not being so designated on the Proposals Map.

4.5 There are a number of Environmental Spaces located outside the settlement boundary and or on land where other designations apply. The Environmental Space allocation adds an additional layer of protection to such sites and does not replace them. All policy designations and associated policies will be considered in the determination of proposals that come forward on Environmental Spaces. For example, a proposal put forward on an Environmental Space, located in the countryside and Green Wedge will need to meet the Local Development Plan policies relating to all three designations, and any other policies of relevance to the use proposed.

5 Local Development Plan Policy

5.1 In order to protect the identified Environmental Spaces from development, it is proposed to include the following policy in the Local Development Plan.

CE4 Environmental Spaces and Corridors

IN AND ADJOINING THE URBAN AND VILLAGE AREAS, AND IN AREAS IDENTIFIED FOR COMPREHENSIVE DEVELOPMENT, SITES HAVING EXISTING IMPORTANCE FOR THEIR VISUAL QUALITIES, AS WILDLIFE HABITATS OR FOR RECREATIONAL OR AMENITY PURPOSES, WILL BE SAFEGUARDED AS “ENVIRONMENTAL SPACES AND CORRIDORS”. DEVELOPMENT IN THESE SPACES WILL BE PERMITTED ONLY WHERE: i) THE EXISTING OR POTENTIAL ENVIRONMENTAL QUALITIES OF THE SITE WILL BE IMPROVED OR COMPLEMENTED; ii) THERE IS NO ADVERSE IMPACT ON INTERNATIONAL, EUROPEAN, NATIONAL, REGIONAL OR LOCAL NATURE CONSERVATION INTEREST; iii) THERE IS NOT A LOSS, WITHOUT APPROPRIATE REPLACEMENT, OF A RECREATIONAL, OPEN SPACE, OR AMENITY RESOURCE FOR THE IMMEDIATE LOCALITY UNLESS IT CAN BE DEMONSTRATED THAT THERE IS AN EXCESS OF PROVISION OR FACILITIES CAN BE ENHANCED THROUGH DEVELOPMENT OF A SMALL PART OF THE SITE. PROPOSALS TO ENHANCE OR IMPROVE EXISTING ENVIRONMENTAL SPACE PROVISION WILL BE ENCOURAGED WHERE PRACTICABLE. ADDITIONAL PROVISION WILL BE SOUGHT IN AREAS WHERE A DEFICIT HAS BEEN IDENTIFIED 1.

4.1 Environmental Spaces and corridors form a valuable part of Newport’s green infrastructure provision. They provide a network of connected, accessible, multi-functional sites including parks, woodland, informal open spaces, amenity areas, footpaths and bridleways, hedgerows, commons and village greens, and nature reserves as well as linkages such as river corridors, wildlife corridors and the & Brecon Canal, that can bring about multiple social, health, economic and environmental benefits to the area. The sites are multi-functional in that apart from their ecological value they can be used for various purposes, for example, leisure activities and promoting tourism with associated benefits in terms of health and the economy.

4.2 Environmental Spaces are predominantly located within the settlement boundary, however, there are a number located outside the settlement boundary and/or on land with other designations. The Environmental Space allocation adds an additional layer of protection to such sites, it does not replace them. All policy designations and associated Policies relating to a site will be considered in the determination of proposals that come forward on Environmental Spaces. Proposals will also be considered against other relevant Policies of the Plan, including the GP Policies.

4.3 Where possible these spaces are defined on the Proposals Map. However, this should not be viewed as a definitive list as there may be other green

spaces that are important to the local community for the reasons set out above that have not been identified through the Local Development Plan process. Background Paper – Environmental Spaces sets out the process used to identify the Environmental Spaces.

4.4 A number of Environmental Spaces have also been identified as urban ‘quiet areas’ in the preparation of a Noise Action Plan. Such areas are protected against an increase in noise generated from development proposed on the site or nearby. Further details on the Noise Action Plan and quiet areas are set out in Chapter 13 of PPW and Policy GP7: Environmental Protection and Public Health.

4.5 One of the reasons for allocating many of the Environmental Spaces is their recreational value. Some sites will also therefore be protected under Policy CF1 – Protection of Playing Fields, Land and Buildings Used for Leisure, Sport, Recreation and Play. These sites can be viewed in the Council’s Assessment of Outdoor Play Space Provision.

4.6 To safeguard green infrastructure resources Environmental Spaces should be protected from severance as the value of isolated areas is much less in wildlife and amenity terms than if the areas are linked. Further information will be provided in Supplementary Planning Guidance – Wildlife and Development.

4.7 Through masterplanning processes incorporated within the Design and Access Statement, opportunities could exist to safeguard existing open features and to create new areas for amenity, nature conservation and recreation provision within key development sites. Opportunities may also arise to enhance existing provision, either through specific improvement schemes or through the redevelopment of neighbouring or nearby land. An Environmental Space master plan approach will be taken to the playing fields 2 following consultation with the local community.

4.8 The Natural Resources Wales (NRW) has developed a toolkit to help ensure everyone in Wales has access to natural greenspace. In accordance with NRW’s guidance, an assessment of accessible natural greenspace has been undertaken 3. This analysis together with the Assessment of Outdoor Play Space and other related documents, such as the Local Biodiversity Action Plan will be used to help inform decisions relating to opportunities to increase or enhance existing levels of provision. This could be achieved through design measures such as improved access points and link routes into an existing site or enhanced landscape and environmental improvements, such as tree planting. Additional provision will be sought on new development sites, where there are known deficiencies in an area.

4.9 Proposals for local food/plant production, in the form of community gardens, on Environmental Spaces will be supported provided that they link with other relevant Council Policies and that the proposal would enhance the social amenities and economic well being of the neighbourhood and will be used by nearby residents. Furthermore, in order to safeguard the continued value of

the land to the community, it will be important to work with the Council’s Streetscene Service Area in determining whether the natural and physical characteristics of the site are conducive to successful community gardening 4.
