Minutes of the 2nd PEC Meeting held on 18.09.2019 at AOE & AEA Office Premises, Chepauk, Chennai-5 The 2nd Parent Executive Committee meeting of AOE & AEA, TNPWD was held on 18.09.2019 at AOE & AEA Office Premises, Chepauk, Chennai-5 by 6.00 PM. The meeting was presided by Er.K.Prabakar, President, AOE. Er.K.Prabakar, President, AOE welcome all the PEC members for the meeting and briefly explained the agenda and requested all members to express their candid views on the agenda. Then he requested the Er.K.Murugan, General Secretary, AOE, to explain the subject agenda in detail to the members present. 1) VIIth Pay Commission – Discussion on the Supreme Court Case which was listed for final disposal on 25.09.2019 Mobilisation of Legal Fund. 2) Promotion & Court Cases in respect of 2007 batch Assistant Engineers. 3) Promotion panel of Assistant Executive Engineers and Executive Engineers. 4) Conducting General body meeting of AOE & AEA. 5) Poriyaalar Ramalingam Illam, Renovation work completed and Mobilisation of Building Fund for pending payment to the vendors. 6) Any other Subjects. Er.K.Murugan, General Secretary, AOE, explained the present stage of our pay scale case pending in the Supreme Court which was listed as Top of board for hearing on 25.09.2019. He explained that as per advice of our Advocate we are planning to engage 3 seniors for the above case and presented possible expenditure for the above case. He mentioned that we have addressed all the members and branches for collection of legal fund. In this case we are supported by Agricultural Engineering Department Engineers Association, Rural Development Department Engineers Association and Greater Chennai Corporation Engineers Association. He also explained that we will put all our efforts to win the case in our favour. Er.M.Dhanasekaran, General Secretary, AEA, explained about the present stage of court cases in respect of promotion of 2007 batch Assistant Engineers and the meeting conducted by the Engineer-in-Chief, WRD & Chief Engineer (General), PWD with our Association and TNEA in this regard. He also informed that we had categorically stated our Association stand with respect to Assistant Engineer to Assistant Executive Engineer panel. The General Secretary, AOE informed that inview of the “status quo” position in the court, the Executive Engineer panel could not be moved and explained the steps taken to solve the issue at the earliest. The General Secretary, AOE also informed that General body meeting of our Association will be hosted by the Cuddalore & Villupuram Branch. The venue and date will be intimated later. Er.P.N.S.Mahesh Babu, Resident Engineer, Poriyaalar Ramalingam Illam, informed that renovation work at Poriyaalar Ramalingam Illam is almost completed and final payments to the vendors are due to be paid. The General Secretary, AOE informed that Building Fund will be requested from individual members and branches so as to pay the dues to the vendors early. The issue of repayment of loan taken from ENGIBEF for renovation of PRI was discussed in detail and Resident Engineer informed that a minimum of Rs.50,000/- per month may be refunded to ENGIBEF. The amount may be increased according to the collection of PRI. It was decided to refund the ENGIBEF amount with interest. Er.D.Rajeshwar Babu, Treasurer, AOE & AEA informed that there is due for renewal of LIC policy of Thiru.R.Paramasivam, OA in our Association and requested for Approval. Er.K.Prabakar, President, AOE recalled the involvement & tireless work of Er.K.Karunanithi, Former President, AOE to our Association since his entering service as Assistant Engineer and requested all our members to participate in his farewell function on 01.10.2019. The Following resolutions were passed unanimously in the meeting: 1. Resolved to conduct our pay scale case pending in the Hon’ble Supreme court by engaging Senior Advocates and take every effort to win the case in our favour.
2. Resolved to pursue the Court cases in-respect of Promotion Panel (Assistant Engineer to Assistant Executive Engineer and Assistant Executive Engineer to Executive Engineer) and obtain early orders in this regard.
3. Resolved to conduct our General Body Meeting in the place and venue selected by the Cuddalore & Villupuram Branch.
4. Resolved to refund the temporary loan taken from ENGIBEF for renovation of Poriyaalar Ramalingam Illam, Rs.20,00,000/- (Rupees twenty lakhs only) with interest. The repayment will be a minimum of Rs.50,000/- (Rupees fifty thousand only) per month from the collection of PRI.
5. Resolved to renew the Annual LIC Policy of Thiru.R.Paramasivam, Rs.12,000/- (Rupees twelve thousand only) due for this year. Granting of such increments for PWD Engineers is being allowed since 1985 based on the G.O. cited in reference 3. Subsequently a letter from Government was issued viz. Lr.No.10577/D2/2012- 20/dt.19.03.2014, while soughting clarification specifically arised for granting increments to Er.Daniel Sagaya Raj of Boiler Department. In this clarification letter, it was Generally stated to dispense the advance increment system by citing the following reasons without analyzing the facts and existing Government Orders. Reasons cited in the Lr.No.10577/D2/2012-20/dt.19.03.14 to stop PG Increments: Sl. But after this order, the G.O.Ms. No.54, PWD, dt.11.01.1985 was issued to get Advance increments for PG qualification. This GO is still alive (refer RTI Lt.) 30 mf;Nlhgh; 2019 nghwpahsh; Based on the above facts the representation vide letter cited in ref.6 has been given by Engineer-in-Chief (B) & CE (G), PWD to reconsider the clarification issued on dt.19.03.2014. But, without considering the basic reason of clarification requested again and again, the Government issued Lr.No.12707/B2/2016-2, dt.26.09.2016 to deny the PG increment based on previous letter dt.19.03.2014. In this letter dt.26.09.2016, it is stated that the earlier representation by Engineer-in-Chief (B) & CE (G), PWD vide Lt.No.AEE/T1/AE/52831/05 dt.18.04.2012 and 18.07.2012 was analyzed and rejected. Here the fact that those representations were specifically arised for Er.Daniel Sagaya Raj of Boiler Department who hasn’t covered in G.O.Ms.No.54, PWD, dt.11.01.1985. So, the representation may be denied for him, but not for Engineers of PWD. So, at present because of the Letter dt.19.03.2014 and 26.09.2016 (cited in ref.6&8) the fellow Engineers of department are not being allowed to get PG increment which is rightfully eligible to them. Hence, based on the above said reasons and facts, we humbly request you to kindly re-consider the Letter issued on 19.03.2014 and 26.09.2016, to issue a order according to the existing GO’s and Pay Cell clarifications. It will be very helpful for the qualified Engineer to get increments for PG qualification without approaching the Judiciary. In this regard we wish to add the following points for your reference. 1. Two advance increment system was introduced and awarded for Engineers of PWD possessing PG qualification based on: a. G.O.Ms.No.531, Finance Department, dt.25.04.1963 b. G.O.Ms.No.825, P&AR Dept. dt.06.07.1977 c. G.O.Ms.No.1195, P&AR Dept. dt.27.10.1978 2. Advance increment system was changed to lumpsum grant vide G.O.Ms.No.843, P&AR Dept. dt.05.09.1983, consequently same was adopted in PWD by G.O.Ms.No.1470, PWD, dt.23.07.1984. 3. Then by G.O.Ms.No.1159, P&AR dt.21.11.1984 and followed by G.O.Ms.No.54, PWD, dt.11.01.1985. The advance increment scheme was again re-introduced. 4. Then P&AR issued amendment for G.O.Ms.No.1159 vide G.O.Ms.No.97, P&AR dt.05.07.2010 allowing PG increment system with certain conditions. 5. G.O.Ms.No.154, P&AR, Dept. dt.10/2010 was issued to dispense the scheme of increment for MBA qualification alone, not for Engineering / Medicine / Agriculture discipline. 6. G.O.Ms.No.54, PWD, dt.11.01.1985 and G.O.Ms.No.97, P&AR dt.05.07.2010 are in alive, so the PWD Engineers are entitled to get PG increments. 31 mf;Nlhgh; 2019 nghwpahsh; 7. The reason cited in Government Letter dt.19.03.2014 to stop PG increments is, “there is no rule provision for advance increment system based on G.O.Ms.No.234, Finance Department dt.01.06.2009 issued during Revised Pay rules 2009 with effect from 2006.” 8. But, in the clarification issued by pay cell against the G.O.Ms.No.234, dt.01.06.2009 vide its Letter nos. Lt.No.34124/Pay Cell/2009-1 dt.26.06.2009 and Lt.No.45113/Pay Cell/2009-1, dt.17.08.2009, where the PG increments are granted. 9. Besides all the above, the clarifications raised by the Engineer-in-Chief (B) & CE (G), PWD from the beginning is specifically meant for Er.Daniel Sagaya Raj of Boilers Department, which is nowhere connected to G.O.Ms.No.54, PWD, dt.11.01.1985. 10. But, the clarification issued by the Government Letter dt.19.03.2014 and 26.09.2016 without addressing the above facts discussed. 11. Moreover, while approaching the Court by individuals it is ordered to set aside the above said letters with a quote that “GO can’t be superseded by through a clarification letter” that too issued for not related to PWD. 12. Till a fresh GO issued by P&AR or PWD to dispense the PG increment system, the existing GO’s are holds good. Hence the Engineers of PWD are rightfully entitled to get PG increment. Ref: Letter No.100868/FR-1/90-1, P&AR (FR-I) Department, dated 03.12.1990 I am directed to invite attention to the reference cited, wherein instructions have been issued in respect of rectifying the anomaly of junior drawing more pay than senior. This instructions / format prescribed for rectifying the anamoly of junior drawing more pay than senior were issued long ago and after which many pay commission recommendations have been implemented by Finance department and Fundamental Rule provisions have also been amended accordingly. 2) Further, it has been noticed by this department that the particulars which are furnished by the Heads of Departments / Administrative Departments in Secretariat regarding the service details and pay drawn particulars are not sufficient to compare and justify the pay anomaly. The pay fixations made to the senior and junior are sometimes found erroneous on verification of the Service Books of the individuals. Moreover, the authenticated copy of seniority list is also not furnished by the Heads of Departments / Administrative Departments in Secretariat. In some cases, seniority numbers with reference to temporary promotions are furnished, which cannot be taken into account since temporary promotions shall not confer any rights on the individuals and they are not eligible for stepping up of pay on par with junior. In some cases, the pay drawn particulars furnished in the comparative statement are contrary to the entries made in the Service Book of both senior and Junior. Further, the Heads of Departments/ Administrative Departments, are not specifying the rule under which the pay anomaly was rectified and without quoting the relevant rules, the proceedings were issued by some Heads of Departments for stepping up the pay of the senior on par with that of junior. 3. Hence, it is considered that it is necessary to revise the previous instructions / format and to prescribe new format so as to verify the correctness of pay anomaly quickly and to clear the proposals without any delay. Accordingly, a new format is prescribed as annexed to this letter for rectification of pay anomaly of junior getting more pay. All the Heads of Departments / Administrative Departments of Secretariat concerned are requested to furnish all the particulars in the said format. They are also requested to examine the correctness of the pay fixed to the junior as well as senior up to date (including the stepping up of pay of the senior and junior, if any ordered earlier) and to certify to that effect as prescribed in Part-III of the above said new format and to enclose this format as an annexure to the proceedings / order issued by the Heads of Department / Government as the case may be, in all the cases where pay anomaly is rectified. 4.
