AGRICULTURE DEPARTMENT Tamil Nadu Inland Fisheries Lease & Licence Rules, 1972 (G.O.Ms.No.1749, Agriculture, 21st June 1972) (Published in Supplement to part V of Tamil Nadu Government Gazette, Dated 19th July (Issue No. 28-A) S.R.O. No. A-610 of 1972 In exercise of the powers conferred by section 6 of the Indian Fisheries Act, 1897 (Central Act 4 of 1897) and in supersession of the rules published with the late Development Noitification No.138, Dated the 16th April 1929, published at pages 746-748 of part 1 of the Fort St.George Gazette, dated the 23rd April 1929, as subsequently amended, and with the Agriculture Department Notification, dated the 14th March 1955, published at page 133 of the Rules Supplement to part 1 of the Fort St.George Gazette, dated the 27th April 1955, and with the late Development Department Notification, dated the 14th November 1950, published at the pages 491-492 of the Rules Supplement to part 1 of the Fort St.George Gazette, dated the 5th December 1950, as subsequently amended, the Governer if Tamil Nadu hereby makes the Tamil Nadu Inland Fisheries Lease and Licence Rules, the same having been previously published for general information as required by sub-section (6) of the said Act. RULES 1. Short title: These rules may be called the Tamil Nadu Inland Fisheries Lease and Licence Rules, 1972. 2. Prohibition of fishing without lease or licence in waters under control of Fisheries Department: No person shall take any fish from the waters specified in Annexure-1 except under a lease or licence granted by the Government or by such authority as may be authorized by them in the form and in accordance with the conditions specidied in the appendix to Annexure-1 of these rules which may be suitably modified or amended from time to time as required. Provided that this rule shall not apply to the fishing operation of the Fisheries Department conducted under the Orders of an Officer not bellow the rank of Assistant Director of Fisheries. “24. Revision by Government: The Government shall have the right to revise orders of the authority in Rule 2”. (G.O.Ms.No. 1062, F&F Department, dated 02.12.75) 3. Prohibition of fishing without a lease in other Government tanks: No person shall take any fish from any of the waters specified in Annexure II except under and in accordance with the condition of lease granted by the Government or by the local body in whom the water vests. 4. Penalty: Whoever commits a breach of rule 2 or 3 shall be punishable with the which may extend to one hundred rupee and when the breach is a continuing breach. With a further fine which may extend to ten rupees for every day, after the date of first conviction, during which the breach is proved to have been persisted in. 5. Forfeiture: A Magistrate may, on the conviction of any person for the breach of these rules, Order the seizure. Forfeiture and removal of the fixed engines erected or used or nets used in contravention of these rules and also, Order the forfeiture of any fish taken by means of any such fixed engine or net. ANNEXURE - I List of Waters Reffered to the Rule 2 A. Rivers, Channels and connected Waters 1. The Cauvery and coleroon rivers including the branches of the Cauvery and the irrigation channels of the Cauvery & Coleroon rivers in the Districts of Salem, Dharmapuri, Coimabatore, Periyar, Tiruchirappalli, Thanjavur and South Arcot the tributaries of the Cauvery in the districts of Salem Coimabatore and Periyar the Mettur reservoir in salem district and the Bhavanisagar reservoir in Periyar Districtes together with the rivers emptying into them and the surplus courses issuing from these reservoirs. (a) The Amaravathi river and Amaravathi reservoir and all the streams emptying into the river and reservoir and the surplus courses and channels issuing from that reservoir and river in Coimbatore and Tiruchirapalli Districts. (b) The Koneri and Chinnar rivers and Chinnar project in Tiruchirappalli District. © Aliyar Reservoir and connected streams and channels, pillur reservoir and connected streams, Thirumoorthy reservoir and connected channels and streams. 3 (A) The Krishnagiri Resevoir in Dharmapuri District and Sathanur Reservoir in North Arcot District with all rivers and streams emptying into the reservoirs, the Markanda Nadhi, Chinnar, Vaniar, Pambar, Aliyar, Ponniyar and all rivers and channels connected with and issuing from the reservoirs and rivers Malattar and Gadilam in Salem, North Arcot and South Arcot Districts. (B) The Gomukhi and Manimuktha Nadhi Reservoirs and al their tributaries and channels in south arcot district. 4. North rajan and vadavar irrigation channels and other branches mentioned below relating to the lower coleroon system of south arcot district:- a) Veeranam tank and all its connected irrigation channels. b) Coleroon left Rajan Vaikal from head to Eyyalur. c) Coleroon from komaratchi to tail end d) Coleroon from Eyyalur to Komaratchi e) Vadavar channel from head to 22.4km stone and all its connected irrigation channels. f) Khan sahib’s cnal public works department limits from viranatham block to Chidambaram Municipal limits upto the muthiah pillai surplus. g) Khan sahib’s canal drainage public works department limits from muthian pillai surplus to sivapuri raod culvert. h) Khan sahib’s canal public works limits from Chidambaram southern railway bridge to portonovo lock. i) Khan sahib’s canal municipal limits from muthian pillai surplus to Chidambaram railway bridge including thillaiamman odai. j) Cavarapet channel k) Ponneri tank and channel l) Pasunathamodai public works department limits. m) Pasunatham odai municipal limits n) Sivakamisundaripuram drainage. o) Khan sahib’s canal from puliangudi adjuct to the junction of Manvaikal. p) Tholudir project q) Vidur reservoir, varahanadhi, thondiar and their tributaries and vidur main channel in the left flank of vidur reservoir. 5. The velar river in sout arcot district. 6. New coleroon from rendathupirivuto sea in south arcot district. 7. Virudahchalam anicut and head sluice in south arcot district. 8.Pelandurai anicut and head sluice in south arcot district. 9. Main channel taking off from eastern side of the willington reservoir in south arcot district. 10. Supply channel to willington reservoir in south arcot district. 11. Willington reservoir in south arcot district. 12. Ellis choultry anicut in south arcot district. 13. New alngal channel in south arcot district. 14. margathapuram channel in south arcot district. 15. The hope lake above the papanasam upper dam, the diversion weir of the lower dam and the river thambarabarani both above the hope lake and below the diversion weir up to the junction with the sea together with all the streams flowing into the river, river including the manimuthar reservoir and all channels fed by the river system lying within the tirunelveli district as detailed below: i) Nathiyunni channel taking off from nathiyunni anicut. ii) Kannadian channel taking off from the kanadian anicut. iii) Kodagar channel taking off from the ariyaneyagipuram anicut. iv) Palayam channel taking off from the Palayur anicut. v) Tirunelveli channel taking off from the suthamalai anicut. vi) Murudur melakkal taking off from marudur anicut. vii) marudur keelakarai taking off from the marudur anicut. viii) Srivaikuntam north main channel taking off from the srivaikuntam anicut. ix) Arthoorankal taking off from kadayan odai head sluice of kadamba. x) Kuttamudakkaippodai lying north of kayalpattinam village. xi) Manimuthar channel taking off from manimuthar dam. xii) Perungal channel taking off from perungal sluices of manimuthar dam. xiii) Thayar dam channel taking off from odai sluice of the left bank of Manimuthar dam. xiv) The Srimoolaperi reservoir, which has been formed by damming the four streams, namely konivalleri, kuluratti, valukkamthori and sommantheri and its direct and indirect tributes and channels branching off from the river in tirunelveli district and srimoolaperi reservoir branches including the branches of irrigation channel and the surplus courses issuing from the reservoir. The Vaigai reservoir with all the rivers and streams emptying into and the periyar, suruli and varahanadhi and vaigai river and all their tributaries and channels taking off at the anicuts and regulator in Madurai and ramanathpuram districts. 28.B. The manjalar reservoir, sathiyar odai, reservoirs and their tributaries and channels in Madurai district. 29. Streams numbered 1 to 14 and 16 to 24 in survey nos. 2052, 2059, 2059-2, 2060-6 and 2063 of the manjalar district. 30. The poondi reservoir in the chingleput district together with all the streams emptying into that reservoir from the north arcot and chingleput districts and kortallayar river below the poondi reservoir upto 201 meters below the vallur anicut and the supply channels taking off at the kesavaram and tamaraipakkam anicuts.
