Tamil Nadu Inland Fisheries Lease & Licence Rules, 1972 (G.O.Ms.No.1749, Agriculture, 21st June 1972)

In exercise of the powers conferred by section 6 of the Indian Fisheries Act, 1897 (Central Act 4 of 1897) and in supersession of the rules published with the late Development Noitification No.138, Dated the 16th April 1929, published at pages 746-748 of part 1 of the Fort St.George Gazette, dated the 23rd April 1929, as subsequently amended, and with the Agriculture Department Notification, dated the 14th March 1955, published at page 133 of the Rules Supplement to part 1 of the Fort St.George Gazette, dated the 27th April 1955, and with the late Development Department Notification, dated the 14th November 1950, published at the pages 491-492 of the Rules Supplement to part 1 of the Fort St.George Gazette, dated the 5th December 1950, as subsequently amended, the Governer if Tamil Nadu hereby makes the Tamil Nadu Inland Fisheries Lease and Licence Rules, the same having been previously published for general information as required by sub-section (6) of the said Act.

RULES

1. Short title: These rules may be called the Tamil Nadu Inland Fisheries Lease and Licence Rules, 1972. 2. Prohibition of fishing without lease or licence in waters under control of Fisheries Department: No person shall take any fish from the waters specified in Annexure-1 except under a lease or licence granted by the Government or by such authority as may be authorized by them in the form and in accordance with the conditions specidied in the appendix to Annexure-1 of these rules which may be suitably modified or amended from time to time as required. Provided that this rule shall not apply to the fishing operation of the Fisheries Department conducted under the Orders of an Officer not bellow the rank of Assistant Director of Fisheries. “24. Revision by Government: The Government shall have the right to revise orders of the authority in Rule 2”. (G.O.Ms.No. 1062, F&F Department, dated 02.12.75) 3. Prohibition of fishing without a lease in other Government tanks: No person shall take any fish from any of the waters specified in Annexure II except under and in accordance with the condition of lease granted by the Government or by the local body in whom the water vests. 4. Penalty: Whoever commits a breach of rule 2 or 3 shall be punishable with the which may extend to one hundred rupee and when the breach is a continuing breach. With a further fine which may extend to ten rupees for every day, after the date of first conviction, during which the breach is proved to have been persisted in. 5. Forfeiture: A Magistrate may, on the conviction of any person for the breach of these rules, Order the seizure. Forfeiture and removal of the fixed engines erected or used or nets used in contravention of these rules and also, Order the forfeiture of any fish taken by means of any such fixed engine or net.

ANNEXURE - I

List of Waters Reffered to the Rule 2

A. Rivers, Channels and connected Waters 1. The Cauvery and coleroon rivers including the branches of the Cauvery and the irrigation channels of the Cauvery & Coleroon rivers in the Districts of Salem, Dharmapuri, Coimabatore, , Tiruchirappalli, Thanjavur and South Arcot the tributaries of the Cauvery in the districts of Salem Coimabatore and Periyar the Mettur reservoir in salem district and the Bhavanisagar reservoir in Periyar Districtes together with the rivers emptying into them and the surplus courses issuing from these reservoirs. 2. (a) The Amaravathi river and Amaravathi reservoir and all the streams emptying into the river and reservoir and the surplus courses and channels issuing from that reservoir and river in Coimbatore and Tiruchirapalli Districts.

(b) The Koneri and Chinnar rivers and Chinnar project in Tiruchirappalli District.

3 (A) The Krishnagiri Resevoir in Dharmapuri District and Sathanur Reservoir in North Arcot District with all rivers and streams emptying into the reservoirs, the Markanda Nadhi, Chinnar, Vaniar, Pambar, Aliyar, Ponniyar and all rivers and channels connected with and issuing from the reservoirs and rivers Malattar and Gadilam in Salem, North Arcot and South Arcot Districts.

(B) The Gomukhi and Manimuktha Nadhi Reservoirs and al their tributaries and channels in south arcot district.

4. North rajan and vadavar irrigation channels and other branches mentioned below relating to the lower coleroon system of south arcot district:-

a) Veeranam tank and all its connected irrigation channels.

b) Coleroon left Rajan Vaikal from head to Eyyalur.

c) Coleroon from komaratchi to tail end

d) Coleroon from Eyyalur to Komaratchi e) Vadavar channel from head to 22.4km stone and all its connected irrigation channels.

f) Khan sahib’s cnal public works department limits from viranatham block to Municipal limits upto the muthiah pillai surplus.

28. A. The Vaigai reservoir with all the rivers and streams emptying into and the periyar, suruli and varahanadhi and and all their tributaries and channels taking off at the anicuts and regulator in and ramanathpuram districts.

28.B. The manjalar reservoir, sathiyar odai, reservoirs and their tributaries and channels in .

29. Streams numbered 1 to 14 and 16 to 24 in survey nos. 2052, 2059, 2059-2, 2060-6 and 2063 of the manjalar district.

30. The in the chingleput district together with all the streams emptying into that reservoir from the north arcot and chingleput districts and kortallayar river below the poondi reservoir upto 201 meters below the vallur anicut and the supply channels taking off at the kesavaram and tamaraipakkam anicuts.

31. The 91.44 metres both above and below the karattur anicut and its head sluices.

32. The section of the adayar river lying within the limits of the madras district commencing from a line drawn fro survey nos.246 to 247 of the western boundary of the S.no. 3886 to the in the east.

33. The adayar back waters, occupied by the fish farm called fish bay adyar.

34. “Covelong backwaters” – Waterspread connected with the Buckingham canal north of tiruporur at 41.8 kms and south of sholinghanallr at 20.9 kms with covelong bridge in the centre extending over a length of 19.2 kms.

35. Pullambadi canal within Trichirapalli district. 36. Pulicat backwaters – waterspread adjoining the sea in and around pulicat and lying within the chengalpattu district boundary of tamilnadu and the connected Buckingham canal.

37. Srimoolaperi reservoir in tirunelveli district.

The Srimoolaperi reservoir and its direct and indirect tributaries and channels branching off from the river in tirunelveli district and the branches of the irrigation channels and the surplus course issuing from the reservoir.

38. Uppar reservoir in Dharapuram taluk with all the rivers and streams and channels emptying into the reservoir and the surplus courses and channels issuing from that the reservoirs in periyar district.

39. Sholayar reservoir in pollachiu taluk with all the rivers and streams emptying into the reservoir and the surplus courses and channels issuing from that reservoir in periyar district (upto a distance of 2400 metres below sholayar dam).

40. Pillavakkal project in ramanathapuram district formed by the periyar and kovilar reservoirs and their indirect tributaries and channels branching from kovilar river in taluk of ramanathapuram district. 41. Ponnaniyar reservoir in trichirappalli district with the following rivers and channels emptying into that reservoir namely ponnaniyar river, kural kuthuvar, ediyar perumal kodumppu, thirukkumalai kodumppu kallanai kodumppu and kanniyakumari kodumppu and 1.6 km of the river streatch below the ponnaniyar reservoir.

42. Upper-Aliyar reservoir in periyar district with the connected streams and channels emptying into and issuing from this reservoir (upto a distance of 2400 metres below upper aliyar reservoir)

43. Marudhanadhi reservoir in Madurai district with marudhanathi river and channels emptying into and issuing from this reservoir 1.6 km above the dam and 1.6 km below the head sluices of the dam.

44. Chinnar reservoir in thenkanikottai taluk of dharmapuri district with chinnar river and channels emptying into and issuing from this reservoir 1.6 km above the dam and 1.6 km below the head sluices of the dam.

45. Perumal tank (Eri) in south arcot district with the velar river and connected channels emptying into and issuing from this tank 1.6 km above the tank and 1.6 km below the head sluices of the dam.

46. Gadana reservoir in tirunelveli district with the karunaiyar river and channels emptying into and iissuing from this reservoir 1.6 km above the dam and 1.6 km below the head sluices of the dam.

CONDITIONS

I. All types of fishing except with the use of rod, reel and line by sporting anglers are prohibited within the following limits_____ (i) The Mettur Reservoir from the Hogainakkal falls in the North to a distance of six kilometres upto Karnamalai. (ii) The Cauvery River from its junction with the supply channel at Mettur to its confiuence with the surplus channel at Nattamangalam.

II. The following fees shall be levied for the grant of licences______(i) Fees for one coracle with two fishermen with all types of tackle, Rs.125 (Rupees One Hundred and Twenty Five only) per annum.

Explanation: (1) (i)____ Members of Fishermen Co-operative Societies shall be allowed to pay the fees of Rs.125 ( Rupees One Hundred and twenty five only) in two instalments narnely Rs. 75 (Rupees Seventy five only) as the first instalment and Rs. 50 (Rupees Fifty only) as the second instalment on or before the 1st October of the financial year for which the licence is issued. (ii) Fee for one fishermen to ply one shore net (wall net of 200 metres long without the use of a coracle) Rs. 35 (Rupees Thirty five only) per annum. (iii) Fee for fishing with one country rod and line for one fishermen 75 paise (paise Seventy five only) per mensem or Rs. 5 (Rupees Five only) per annum. (iv) Fee for fishing with rod reel and live fly: spoon or live bait for sport:____ (a) Rs.1 (Rupee one only) per day or Rs.10 (Rupees ten only) per mensem and per angler for the area mentioned in item (i) under condition l above. (b) Rs.2 (Rupees two only) per day or Rs. 20 (Rupees Twenty only) per month per angler for the area mentioned in item (ii) under condition l above.

2. 121/2 percent rebate on annual licence fees and 61/4 percent rebate on half yearly licence fees are allowed for sporting anglers. (G.O. Ms. No. 547, Forests and Fisheries, dated: 13th may 1981)

III. Every coracle licenced for fishing shall bear on its four sides a distinguishable mark in bold white figures. The marking will be done and renewed as and when necessary by the Fisheries Department free of charge. IV The licensee shall not ply his coracle of fish within 200 metres of the Dam, Masonry, works, jetty, etc., nor shall unload his catches near such works after fishing.

V. The licensee shall sell his entire catches to the Fisheries Department or to persons authorised by the Department at prices fixed by the Director of Fisheries, Madras. The Department reserves the right to refuse the purchase of a part or the entire catches of a licensee, and shall permit the licensee to dispose his catches.

V(a). In addition to the licence fee the licensee shall also agree for the payment of an amount of 50 paise ( paise fifty only) per kilogram of fish caught by him in consideration of the grant of the right to fish and shall also execute an agreement agreeing to make such payment to the Fisheries Department or to the persons authorised by that Department.

V(a) (i) In addition to licence fee, the licensee shall also agree for payment of additional amount at the following graded rates namely:----

(i) For grade I Fishes 50 paise per kilogram (ii) For grade II Fishes 40 paise per kilogram (iii) For grade III fishes 35 paise per kilogram

2. The payment of the additional amount under this condition is applicable only to fishermen who have obtained coracle licence on payment of Rs.125 per annum.

3. The licensee shall also execute an agreement agreeing to make the payment, the graded rates to the Fisheries Department or to any person authorised by that Department. (G. O. Ms. No. 869, Forests & Fisheries Department, Dated: 31.07.84)

VI. The licensee shall not fish Gourami, if any such fish is accidentally caught, it shall be immediately returned alive into the water.

VII. A licensee or his authorised persons found in possession of fish in the licensed area or within two hundred metres of the said area shall be liable to prove to the satisfaction of the Officers of the Fisheries Department as to how he came into possession of the fish failing which the fish shall be forfeited to the Government.

VIII. The licences issued are not transferrable and shall be shown on demand to any office of the Fisheries, Forest, Revenue, Police or Public Works Department or any person authorised in this behalf by the Director of Fisheries.

IX. The licence is not transferrable but in the event of the death of licensee (owner) or in case he becomes incapable or physically disqualified for fishing, it can be made over in the name of his legal heir on application to the Inspector of Fisheries, .

X. Licences for items (1) and (2) in condition II shall be issued for a financial year and the full licence fees shall be recovered , irrespective of the date of issue.

XI. Application for renewal of the licence for items (1) and (2) in condition II shall Be made to the Inspector of Fisheries, Mettur Dam, within a month before the date of expiry of the licence. Licensees who do not renew their licences in time shall not be allowed the concession of the payment of licence fees in two instalments. They will be liable to pay a penalty fees of 10 percent of the licence fees if the licence is not renewed within 15 days from the date of which the licence expired.

XII. If a licence is lost and cannot be recovered, a duplicate licence will be issued on payment of penalty fee of Rs. One.

XIII. The Inspector of Fisheries, Mettur Dam may refuse to grant a licence or cancel any licence already a granted if a person fails to conform to any of the conditions prescribed in this licence or poaches in the conserved area or abets poaching. When a licence is so cancelled, the licensee shall not be entitled to the refund of any portion of the fee he has paid for such licence. In the event of the cancellation of a licence which is paid in part, the balance amount due towards the licence fees shall not be recovered. The Assistant Director of Fisheries concerned may at any time revoke the cancellation order and validate the licence under special circumstance.

XIV. The licensee shall also confirm to the regulation relating to all or any of the following matters which will be notified in the notice board of the Government Fisheries Station, Mettur Dam and by wide publicity, as and when necessary by the Assistant Director of Fisheries concerned:----

(1) The kind, number dimensions and mesh of nets to be used for fishing and the mode of operations. (2) The kind, size and quanatity of the species of fish that may be caught.

(3) Close seasons for any species of fish

(4) The centres and timings of fishing including “no fishing” days.

(5) The maintenance and surrender of the licence.

(6) The landing of fish at specified centres for inspection and weighment and the calculation of

dryage.

(7) The collection of statistic.

(8) The form of certificates to be issued for disposal of fish otherwise than to the department.

XV. The conditions of this licence are liable to alteration during the period of its currency.

CONDITIONS OF LICENCE

1. The licence is granted subject to the following conditions:--- 2. No fishing shall be permitted in the waters given below except under a licence to be obtained from the inspector of Fisheries, Lower Anicut, Inspector of Fisheries, . 3. A licence granted for a quarter ending 31st March/30th June/30th September/31st December will be valid for that quarter only irrespective of the date of issue. First quarter commencing from 1st January to 31st March.

Second quarter commencing from 1st April to 30th June

Third quarter commencing from 1st July to 30th September.

Fouth quarter commencing from 1st October to 31st December.

4. The following fees shall be charged for licences:--

Licensee shall on demand show their catches to any of the Officers or persons referred to in condition 6 above for inspection. 8. The licence ; shall not fish within 200 meters of any masonry work, jetty and the like nor shall he display his catches near such works after fishing. 9. Fishing of Hila is prohibited in the coleroon river below the Lower Anicut Regulator upto a distance of 1,000 meters during the period from 1st July to 30th September every year. 10. The Inspector of Fisheries may refuse to grant a licence to any person and may cancel any licence already granted for the reasons mentioned in clause II. If the licensee shall not be entitled to the refund of any fee he has paid for such licence. 11. In granting or cancelling any licence under clause 2 the Inspector of Fisheries have regard to the following matters namely:---

1. The Number of licences already granted in a particular locality

2. The availability of fish in any particular locality.

3. The Demand for fish.

4. The necessity to protect breeders during the breeding seasons.

5. The necessity to prevent the depletion of the fishery.

1. Fishing shall be permitted in the Poondi Reservoir, the Nagari and Kortallayar river below the Vellar anicut only under a licence obtainable for the Sub- Inspector of Fisheries, Poondi on prepayment of the fees prescribed below:-

(ii) Kannivalai (drift net) not to exceed 500 metres and 100 metres when the water level falls below 100 feet Rs.10 a month or Rs.100 a year.

(iii) Dragnet not to exceed 25 metres encircling net (Manivalai) not to exceed 25 metres Rs.25 a month.

(iv) hand-Picking – Fish by hand Rs.1 a month or Rs.10 a year.

4. the nets used for fishing shall have a minimum mesh of 1.9 cms square or 1 cm bar from knot to knot when the nets is wet.

5. In the Poondi Reservoir fishing shall be regulated as follows:-

(i) the Centres and timings of fishing shall be decided upon by the Sub-Inspector of Fisheries of Poondi.

(ii) The catches consisting of large sized fish comprising of Catla, Rohu, Mrigal, Labeo, Fimbriatus, Common Carp, Silver carp and Murrels, bigger sized Tilapia and cat fishes should be shared between the incense and the Government in the ratio of 1:2. The catches consisting of small sized Tilpia, less than 0.15.0 centimetre in length and other miscellaneous small sized fishes, should be shared between the lecensee and the Government in the ratio of 1:1 (G.O.Ms.No.403, F&F dt.12.4.85) (iii) When the Water level in the reservoir is reduced is reduced below 36.59 metres M.S.L mesh regulation of nets shall not apply, provided the incense surrenders to the Department alive the fingerlings of Catla, Labeo, Cirrma, Cirrhosa, Chanos, etroplus, Mullets and Mirror Carp.

6. the licences issued are not transferable and shall be whown on demand to any Officer of the Fisheries, forests, Revenue, Police or Public Works Department or to any person authorized in this behalf by the Director of Fisheries, Madras.

RULES

1. No person shall fish in the watersspecified in schedule. A with any drift net (nachu Valai) whose mesh is below 3.8 cms. from knot to knot.

2. No person shall fish in the waters specified in the schedule A during the period when fishing is permitted in these waters except under and in accordance with a licence granted by the Government which shall be obtained from the Assistant Director of Fisheries, Tuticorin, or any Officer duly authorised by him.

If the licence is lost a duplicate of the licence may be obtained from the issuing officer on payment of a penal fee of Rs.1/-(Rupees one only)by the licensee provided that the issuing officer is satisfied that it cannot be recovered.

3. The fee for the grant of licences shall be in accordance with the scale of fees specified below:-

i. Mani Valai (Cast net)- Rs.15 per annumor Rs.7.50 for half year. ii. Nachu Valai (Drift net) not exceeding 40 fathoms in length-Rs.10 per annum or Rs.5 for half year. iii. 4. Not withstanding anything contained in these rules, fishing may be conducted departmentally at any time or by any tackle under the order of the Director of Fisheries.

5. Who ever commits a breach of rule 1,2,4 or 4 shall be punishable with fine which may extend to one hundred rupees and when the breach is a continuing one. with a further fine which may extend to ten rupees for every day after the date of first conviction, during which the breach is proved to have been persisted in.

6. A magistrate may, while convicting any person for the breach of any of the provisonsof rules 1 to 4. Order the seizure, forfeiture and removal of the net. basket or other fixed engine used incontravention of any such rule and also order the forfeiture o fany fish taken by means of any such net, basket trap or fixed engine.

7. A licence granted under these rules shall include the conditions specified in schedule – B.

1. Kadamba tank of in the tirunelveli district.

2. The South main channel taking off from the Srivaikuntam anicut on its right and ending in the kadamba tank including the head sluices of kadamba,Authoor in Kadayhanodai.

III. Every coracle licenced for fishing shall bear on its four sides a distinguishable mark in bold white figures. The marking will be made and renewed as and when necessary by the Fisheries Department free of charge. IV. The Licence shall not ply his coracle of fish within 200 meters of the Dam, masonry works, jetty, etc. nor shall unload his catches near such works after fishing.

V. The license shall sell his entire catches to the Fisheries Department or to persons authorised by the department at prices fixed by the Director of Fisheries, Madras. The Department reserves the right to refuse the purchase of a part or the entire catches of a license, and shall permit the licensee to dispose his catches otherwise.

VI Al licenseeor any person employed by himfound in possession of fish in the licesedearea or wihti 200 meters of athe said area shall beliable to prove to the satisfaction of the Officers of the fisheries Department as to how he came into possession of the fish, failing which the fish shall beforfeited to the government.

CONDITIONS

1. No fishing shall be permitted in the pulicat Back waters under and in accordance with a licence obtainable form the Sub Inspector of Fisheries , Pulicat, on prepayment of the prescribed fees. 2. The following fees shall be charges for licenses:- (i) Drag nets of the following description : Rs.5.00/- (Rupees five only) for one net per mensem.

a) Kondavalai :0.95 centimeters to 1.60 cm from knot to knot when the net is wet and the net shall not be more than 19.50 m. in length. Each net shall not be operated by more than 2 persons. b) Nethilivalai No mesh regulation. It should not be more than 15.25m. in length. c) Kalluvalai 2.0.cm. to 2.5 cms from knot to knot when the net is wet. d) Kattimethikulamvalai 2.0 cm ti 2.5cm. from knot to knot when the net is wet. ii) Encirculing not of the following description Rs.5.00 (Rupees Five ) per mensem for one net. a) Pendavali :2 com. knot to knot when the net is wet. b) Periavalai :2.5 cm. to 3 cm. knot to knot when the net Is wet. c) Siruvalai :2 cm. from knot to knot when the net is wet. d) Suthuvalai :2 cm. to 2.5 cm. from knot to knot when the net is wet. e) Padaguvalai :3 cm. to 4.5 cm. from knot to knot. when the net is wet. iii. Cast net (Manivalai) : Rs.2 (Rupees two only) per mensem for one net. No mesh regulations. iv. Nandulatchavalai :Rs.5 /-(Rupees five only) per mensem for 20 katchas (made of diverse size 400 cms to 500 cms.) the number should not exceed 20 katchas per licence. v. Rod and line :Rs.1/- (Rupees one only) per mensem per rod. vi. Boovalai or Oyior Thattuvalai :Rs.5/- (Rupees five only) per mensem for one net 2cm. to 2.5 cm. from knot to knot when the net is wet. vii. Hand picking :Rs. 0.50 (fifty paise only) per mensem by one person without any contrivance including cloth.

3. The mesh of the nets used in the pulicat back waters should be as shown against each:

i. Kondavalai should be from 0.95 cms. to 1.60 cms knot to knot when the net is wet (it should not be more than 19.50 meters long and should not be operated by more than two persons per not) ii. Nethilivalai should not be more than 15.25 metres long (No restriction of mesh)

iii. Pendavalai and Siruvalai should not be less than 2.0 cms. from knot to knot when the net is wet, It should not be more than 30.50 metres long and should not be operated by more than 4 persons pet net. iv. Periavalai 2.5 to 3.00 cos. from knot to knot when the net is wet. It should not be more than 45.70 meters in length and operated y more than 12 persons per net. v. Manivalai – No restriction of mesh. vi. Oyi valai-Tattu Valai- The mesh of the net should be 2.01 cms to 2.5 ms knot to knot when the net is wet and the length of the net should not be more than 45.70 meters. It should not be operated by more than 10 persons per net. It should be operated only between 4 am AND 7 pm.

vii. Bodi valai is totally prohibited.

4. The licensee should hand over to the Fisheries Dept. the fingerlings of all fish below 7.40 cms. if required, or release them, alive into the water.

5. Removal of Juvenile prawns and gravid prawns, green crab (Scyila serrata) both young and gravid once is prohibited. If caught, they should be released back alive.

6. This licence does not give right to the licenses to remove dead or alive mutty shells or edible Oysters (Oysters Madras senses) live or dead shells.

7. The licensee shall, on demand, show his catches to the Officers of the Fisheries Department for inspection.

8. The licences issued are not transferable and shall be shown on demand, to any officers of the Fisheries. Forest, Revenue, Police or Public Works Depts. or any person authorised in this behalf by the Director of Fisheries.

9. The Sub Inspector of Fisheries, Pulicat, may refuse to grant a licence or cancel any licence already granted if a person fails to confirm to any to the conditions prescribed in his licence or poaches in the conserved area of abets poaching. When a licence is so cancelled, the licence shall not be entitled to the refund of any portion of the fee he has paid for such licence. The Asst. Director of Fisheries concerned may at any time, revoke the cancellation Order and validate the licence under special circumstance.

10. If a licence is lost and cannot be recovered a duplicate licence will be issued on payment of penalty fee of rupee one.

11. The licensee shall also conform to the regulations relating to all or any of the following matters which will be notified in the notice board of the Government Fisheries Station, Pulicat and by wide publicity as and when necessary by the Asst Director of Fisheries concerned:-

1. The kind, number, dimensions and mesh of net to be used for fishing and the mode of operations.

2. The kind, size and quality of the species of fish that may be caught.

3. Closed seasons for any species of fish;

4. The centres and timings of fishing including ‘No fishing days’

5. The maintenance and surrender of the licence.

6. he landing of fish at specified centres for inspection and weightment.

7. The collection of statistics.

12. The conditions of this licence are liable to alteration during the period of its currency.
