Town of York Site Plan and Subdivision Regulations:

SECTION 6.3. Physical environment of property; 3.A 4. vegetation in general, specifically noting any trees larger than 24” in diameter in breast height;

As part of the subdivision plan review process, we are requesting a waiver to locate any trees greater than 24” at breast height that are located within any proposed open space.

This would be a large undertaking on a parcel of this size and the intent of the cluster subdivision is to leave a large portion of the property in its natural state. This will be turned over to the land trust to manage which should insure vegetative cover is properly managed.

An extremely large portion of the property will be left untouched maintaining any large growth in those areas.

SECTION 7.1.3 D New slopes established by re-grading a site shall not exceed 20%, except for the allowed 33% slope along proposed .

To minimize disturbance, roadway ledge cuts occurring outside the required roadway right of way may have slopes up to a vertical face.a vertical face

SECTION 9.5.8 Developments containing fifteen (15) residential units or more, or which generates average daily of 150 trips per day or more, shall have at least two connections either with existing public , or with streets on an approved Subdivision Plan for which a performance guarantee has been filed and accepted. The reason for this policy is to ensure the volume of traffic passing in front of any house on the street remains at a low, neighborhood-friendly level.

A. Alternatively, a residential street network may be designed with a central Collector street with Minor or Alternative Minor streets accessing the Collector street. No house shall have access onto the collector street. Not more than 14 residential units shall be permitted on each Minor street. Not more than 9 residential units shall be permitted on each Alternative Minor street. With this design option, a dead-end collector street shall not be longer than 2,000’, and not more than 50 residential units shall be accommodated on a dead-end collector street. 9.5.9

Site Plan and Subdivision Regulation Section 6.3.13.4 Waiver Request. 1780 US Route 1, York, ME

As part of the subdivision plan review process, we are requesting waivers of this section of the ordinance to: 1. Allow 3 shared private roads with a combined 11 lots direct access onto the collector . These roads have less restrictive geometric standards than Alternative Minor roads. This will allow access to residential units with much less impact than installing another minor street. It is the intent that the driveways are a one way loop which will reduce the conflict entry points onto the collector road.Figures that require waivers are width of ROW from 50 t 40 feet, curve radius down to 50 feet and design speed of 15 MPH. 2. Allow access to 52 residential units in a development utilizing a 2000 foot collector road. The site has ample density to add additional residential units however requiring another collector road for additional lots would require additional entrances onto Route 1. Granting the waiver will keep a single main entrance onto Route 1. 3. Allow 15 residential units on minor streets. Logic for this is the same as for waivers 1 and 2.

Section 7.18.6 Proper and complete monumentation shall be installed prior to final approval of the application. The applicant’s surveyor shall certify in writing that all monuments have been installed according to the submitted plan, using the form entitled “Certificate of Monument Installation.” This form must be submitted to the Board prior to the receipt of final approval of the application. Waiver requested for monuments to be set for a specific property prior to the transfer of that property. Certification of monumentation set shall be provided prior to acceptance of roadways by the town.

Drilled stone or reinforced with inset galvanized steel posts shall be set. Waiver requested to provide ¾ inch rebar with metal caps be allowed in place of granite bounds. Due to the proximity of ledge at the site granite bounds will be difficult to install and will be unstable. The rebar can be driven to 40 inches if conditions allow, or can be installed in drill holes in the underlying rock providing more permanent witness to the property lines..
