Public Authority The Public Information Officer O/o the Assistant Elementary Education officer, Madanoor Vellore District. * * * * * 1. The petitioner had asked for information on 10.07.2008. She was given a reply on 28.08.2008. Not being happy with it, she appealed on 17.09.2008 and not finding any reply, she appealed to the Commission on 05.01.2009. She also sent another petition to the Public Information Officer, Forensic Science Department on 22.07.2009. Meanwhile, the Commission sent on 08.07.2009 a direction in case No.89/timebound/U1/09 to the Public Information Officer to supply the information asked for or to appear before the Commission with the explanation why it has not been supplied. The Public Information Officer sent a reply both to the Commission and to the petitioner stating that the Service Register she had asked for as the R.T.I. query has been given to her and acknowledged by her as stated by the aided School where she was working. The petitioner contends that the information supplied is incorrect and contested that in another petition under RTI, which was sent on 22.07.2009, saying that the authenticity of the signature has to be verified and she has not received the Service Register and by non supply of the Service Register, she has been put to a total loss of almost Rs.1,793/- per month by non fixation of her pay properly. These facts were averred to at the enquiry today by the petitioner and the Public Authority stated that they had to access the information only from the aided School where she was working and they had done so and supplied the information as given to them by the aided School. 2. Going into the papers submitted by the petitioner to the Commission at various times and the acknowledgement photocopy which has been produced, it is seen that there is some visible discrepancies between the two signatures. The Public Authority has asked the information from the school which becomes the 'transferred Public Information Officer' and being an aided school is fully under the purview of the Right To Information Act, 2005. 3. The Assistant Elementary Education Officer who is the public authority is therefore directed to (a) refer the signature to the Forensic Department for verification and if found to be incorrect take action against the school under his powers as the Supervisory Authority of the School. (b) take steps to reconstruct the Service Register from the other available records and rework the salary which is alleged to have been not fixed properly. ( c ) submit a report on this within six weeks of this order to the Commission and take all steps necessary to ensure that it is set right without any further harassment to the petitioner.
