Constitutional and Legislative Considerations in Retroactive Lawmaking Constitutional and Legislative Considerations in Retroactive Lawmaking W. David Slawson* T-HE PROBLEM of determining the constitutional limits of retroactive leg- lislation has always been approached with the implicit assumption that "retroactivity" is a distinct legal phenomenon with its own, almost unique, set of constitutional difficulties.' The thesis of this Article is that questions of retroactive law are essentially questions of substantive due process, and that any attempt to treat retroactivity as a special category to which special rules are to be applied is wasted effort. In the first section the meanings of retroactivity are discussed. The second will examine some decisions of the Supreme Court, in order tor dis- cover the basic factors usually involved in determining the constitutionality of those laws commonly regarded as retroactive. These factors will then be used to explain and justify a few patterns that have emerged from the Court's long involvement with this sort of legislation. The last two sections, necessarily brief because based more on speculation than on examination of judicial experience, will deal with two rather special types of retroactive law. I THE TWO MEANINGS OF "RETROACTIVE" Probably the major source of confusion in discussions of retroactive law is that one word, "retroactive," is used in two different senses. The term is used both (1) to describe a particular basis of selection for the direct imposition of legal effects and (2) as a description of particular kinds of effects which may occur when a new law is imposed on society. Clear analysis dictates that the two senses be kept distinct, and in order to do this an attempt will be made to define the different uses of "retroactive." * Member, Colorado Bar. "Method Retroactivity" Perhaps the first definition that comes to mind is that a retroactive law is one that imposes, in terms, rights and duties on the occurrence of past events. As can readily be seen, however, this definition is of little use be- cause it permits laws with the same effect to be retroactive or nonretroactive depending on how they are phrased.2 This conclusion is not surprising, since a moment's reflection shows that rights and duties can only exist in the present; speaking of imposing them on past occurrences is merely a short- hand way of stating present rights and duties are imposed so as to achieve a situation equivalent to what would have existed had certain other rights and duties existed in the past. Thus a tentative definition, not dependent on phrasing, may be, "All laws that make present rights and duties depend on past events." This is the definition used by Bryant Smith, a leading writer in the field. 3 The phrase, "depends on past events," can give trouble. For example, does it go so far as to include a law the effect of which depends on an exist- ing legal relation that was created by a past event? No one has as yet analyzed the exact form of dependence on past events that will render a law "retroactive," but it is at least reasonably certain that most who have used the above definition of retroactive did not intend to give the quoted phrase the all-inclusive meaning just suggested, for they have failed to discuss many of the kinds of laws that this broad interpretation would include, for example, laws that change the legal consequences of being a "fiduciary" or "employee," or laws that tax or regulate the use of property. And Smith expressly rejected the definition, "All laws that extinguish or impair rights acquired under past law," as too broad.' The phrase, "depends on past events," will not be explored any further, since the problem is not important for the purposes of this Article. Enough has already been said to show that the concept of retroactivity has not been precisely analyzed in the literature to date and to suggest, perhaps, that the concept is not capable of precise analysis. "Method-retroactivity" will here- inafter refer only to laws that make rights or duties depend on past events in the narrow sense of dependence on events that have occurred and ter- minated before the laws were enacted. "Vested Rights Retroactivity" "Retroactive" is also used to describe an effect which occurs when a new law is imposed on society. If the effect of a law is substantially to disturb patterns of conduct that represent substantial investments in labor or prop- erty or to remove valuable rights, rights of action or even liberties,5 then the law is "retroactive" in this second sense.6 Perhaps the most quoted passage in the field uses the term in this manner. Justice Story, in Society for the Propagationof the Gospel v. Wheeler,7 stated that "retroactive" embraced not only laws that were "enacted to take effect from a time an- terior to their passage," but also covered "all statutes, which, though oper- ating only from their passage, affect vested rights and past transactions . *", 8 Courts and legal writers, when thinking of retroactivity of this sort, often speak of "affecting vested rights." Since it provides a convenient shorthand, "vested rights retroactivity" will be used throughout this Article in contrast to method retroactivity. References to "retroactive" that do not state which of its two senses is intended will mean method retroactivity. Whether a law is vested-rights retroactive is a question of fact which can only be answered after examining the interaction between the law and the society upon which it is imposed. The interaction is sometimes easy to fore- see, however. It can confidently be predicted that a law delaying the collec- tion of debts for one year will have a substantial impact on a commercial society such as ours. On the other hand, it was early held in response to the enactment of allegedly "retroactive" divorce laws that marriage contracts were "not the kind of contract" covered by the contract clause.0 Even a law imposing general rules of conduct, applicable only to the future, may be strongly vested-rights retroactive if, in the society in which the law will be effective, certain classes of individuals have made substan- tial commitments of property or labor in anticipation of engaging in the proscribed conduct. The effect of the eighteenth amendment on those who had invested in a liquor business illustrates this fact, as do other more com- mon examples of laws that render illegal conduct which a party to a con- tract is under a duty to perform.10 5 See, e.g., FHA v. The Relation Between the Two Meanings It is commonly assumed that there is a close connection between the two senses of retroactivity. An analysis of the case law will be bypassed for the moment in order to paraphrase the kind of reasoning that leads to this conclusion:" (1) Individuals commonly act so as to achieve advantageous results. (2) Retroactive laws change the legal results of acts after these acts have been performed. (3) Therefore retroactive laws defeat reason- able expectations and are undesirable. The weakness in the chain is that it oversimplifies. First of all, a great deal of activity which has or may have substantial legal consequences is undertaken regardless of these conse- quences. 2 For example, the vast majority of persons undoubtedly earn as much money as they can without regard to how much income tax they will be required to pay. And nearly everyone would drive reasonably carefully whether or not the local law permits the defense of contributory negligence. A more basic fallacy in the argument, however, is its implicit 13 asser- tion that method-retroactive laws are more likely than others to defeat expectations.

These decisions are influenced by personal characteristics of the young mother and by her living arrangements and activities before the conception. We use data from the 1979-1992 waves of the National Longitudinal Survey of Youth (NLSY) to examine the distributions of living arrangements and the economic wellbeing of young women after a birth that results from a premarital pregnancy. Our findings show that approximately 37 percent of the young women who have such births live with their husbands in the year following the birth, while 1/3 live with their parents, 12 percent cohabit, and 18 percent are on their own and unmarried.

Institutions, ideas and power structures appear to become entrenched over time, and may become ineffective or obsolete, even if they once played a legitimate or useful role. In this paper I argue that there is a common set of problems underlying the occurrence of resistance to change in individuals, social structures and the development of knowledge. Resistance to change is not always irrational or problematic; it is also necessary to allow stable personal identities and social structures to survive in a constantly changing world. I offer a historical and theoretical framework for the question of inertia. Finally, I argue that philosophy has often seen its task to be the critique of ossified, inert or obsolete ideas and social structures, but that it has neglected the positive dimension of resistance to change. This extended concept is used to show and discuss how IT systems can either enforce change or be a source of inertia preventing change in organisations, and such planned or inadvertent effects of imple- menting IT systems are discussed as a significant source of user resistance.

We investigate this tendency in probability- updating tasks. Study 1 shows that, whenever decision inertia conflicts with normatively optimal behavior (Bayesian updating), error rates are larger and decisions are slower. This is consistent with a dual-process view of decision inertia as an automatic process conflicting with a more rational, controlled one. Wefind evidence of decision inertia in both required and autonomous decisions, but the effect of inertia is more clear in the latter. Study 2 considers more complex decision situations where further conflict arises due to reinforcement processes. We find the same effects of decision inertia when reinforcement is aligned with Bayesian updating, but if the two latter processes conflict, the effects are limited to autonomous choices. Additionally, both studies show that the tendency to rely on decision inertia is positively associated with preference for consistency. Signature of Student ii Acknowledgements This dissertation has had a long gestation and its undertaking involved many friends and colleagues. My family has probably had to endure the hardest of times as I cloistered myself away for the duration of my studies. Friends also had to adjust to this under-researched phenomenon, the doctoral distance, and I am glad they all took this in their stride and for the most part with good humour. Beyond the isolation zone of my cloister was the secluded garden of discipline and practice where the hard work of research transformation took shape. From the outside this garden looks foreboding, from the inside this façade drops away and I have had good fortune in the help and shepherding I have received from many people in the progress of my research. I was fortunate to have a greater number of co-supervisors than would normally be involved in the course of doctoral studies.
