PARLIAMENT OF NAURU DRAFT HANSARD Seventeenth Parliament First Sitting of the First Meeting Tuesday, 28th August 2007 Mr Speaker, Hon. , M.P., took the Chair at 10.00 a.m. and read Prayers.

The Chairman of the House, Mr. Frederick Cain, took the Chair and read Prayers.

Mr. Chairman: Good morning Members and welcome to this inaugural sitting of the Seventeenth Parliament. Let me first of all congratulate you all on your recent election as Members of this august House and I trust that most of you have recovered from your week-end celebrations and ready to tackle the tasks ahead of you. We will now commence our business in accordance with our programme and I shall commence first with the Proclamation of the Speaker which reads as follows, and I quote - ‘Whereas the Sixteenth Parliament of the Republic of Nauru was dissolved at the end of the 26th day of July 2007; And Whereas by a Writ issued by the Speaker by and with the advice of the President and dated the 20th day of July 2007, the Speaker appointed the twenty-fifth day of August 2007 for the holding of a General Election of Members of Parliament in accordance with the advice of the President; And Whereas I have received the Return of the said Writ notifying me that the said General Election was duly held and of the names of the persons elected thereat; I, Valdon Dowiyogo, in accordance with the advice of the President do appoint and proclaim that the Seventeenth shall meet at Parliament House at the hour of ten o’clock on the morning of Tuesday, 28th August 2007 and shall proceed to transact the following business, namely – First, the election of a Member of Parliament to be Speaker of Parliament; Secondly, the election of a Member of Parliament to be Deputy Speaker of Parliament; And in that order before the transaction of any other business; Parliament must at its first sitting thereafter elect a Member of Parliament to be President of the Republic. God save the Republic! Unfortunately, the Chief Justice is unable to be with us on this occasion and has authorised the Resident Magistrate, Mr. Eperama Rokoiko to administer the Oath to Members. Honourable Members, I now lay on the Table of the House the Return of the Writ which reads as under, and I quote – “The Honourable Speaker, Republic of Nauru, The Honourable Speaker, this is to advise you in declaration that in obedience to your Writ of 27th day of July 2007, I have caused a parliamentary election on the date appointed by your, to wit, twenty fifty day of August 2007. I hereby return the said Writ attaching herewith the declaration of the result of election in the Constituency elected to be the Members of the Seventeenth Parliamentary Election on the Republic. The results of the election is as under – For the Constituency of Aiwo – Dantes Tsitsi and Rene Reynaldo Harris; For the Constituency of Anabar/Ijuw/Anibare – Ludwig Scotty and Riddel Akua; For the Constituency of Boe – Baron Divavesi Waqa and Mathew Batsiua, For the Constituency of Buada – Shadlog Bernicke and Roland Kun, For the Constituency of Ewa/Anetan – Cyril Buraman and , For the Constituency of Meneng – Sprent Jared Dabwido and Rykers Solomon, For the Constituency of Ubenide – , Frederick Pitcher, Valdon Dowiyogo and Fabian Ribauw, and For the Constituency of Yaren – Dominic Joselito Tabuna and . Our next order of business is for the swearing in of Members, and I will ask the Resident Magistrate to enter the Chamber for this purpose.

Mr. Chairman: Honourable Members, the next business before us is the election of the Speaker, and according to Article 34, Parliament shall, before it proceeds to the despatch of any other business, elect one of its Members to be Speaker. Mr. Speaker and Honourable colleagues, I am pleased to announce to this august House that over the course of our short break I have appointed my Cabinet Ministers and therefore in exercise of the powers in that behalf vested in the President under Article 23 of the , I, Hon. Ludwig Scotty, M.P., President of the Republic of Nauru do hereby assign to the Ministers of the Cabinet of Nauru the responsibilities for the business of government as described herein:- Ministers of Cabinet – Hon. Ludwig Scotty, that is myself, as Minister for the Public Service for the Chief Secretary’s Department, Cabinet Secretariat and Directorate of Audit; and also as Minister for Police consisting of the Nauru Police Force – emergency services and protective services. Also I am holding the Ministry of Home Affairs consisting of Lands & Survey, Lands Committee, Women’s Affairs, Media and Culture. Next is the Hon. David Adeang, M.P. – Minister assisting the President, Minister for Foreign Affairs & Trade, Minister for Finance & Economic Planning - Department of Finance consisting of Treasury, Bureau of Statistics, Development Planning, Banking and Insurance; and also the Hon. Adeang is holding the Ministry of Utilities consisting of fuel, power and Water. Next is the Hon. Dr. Kieren Keke, M.P. as Minister for Transport and Telecommunications. The Department of Transport consists of Ports & Shipping, Public Transport and Directorate of Civil Aviation. He is also in charge of Nauru Air Corporation and RONTEL. He is also holding on to the portfolios of Ministry of Health and Ministry of Sports. Next is the Hon. , M.P. – Minister for Education looking after the Department of Education consisting of Education, Youth Affairs and Vocational Training. Next is the Hon. Frederick Pitcher, M.P. – Minister for Commerce, Industry and Resources. The Department of Commerce, Industry and Resources consist of Tourism, Agriculture, Commerce and Business Development and also looking after Eigigu Holdings Corporation. He is also in charge of foreign investments in offshore registry – Nauru Agency Corporation. He is also in charge of the industry which consists of Republic of Nauru Phosphate (RONPHOS) and Nauru Rehabilitation Corporation. Last but not least is the Hon. Roland Kun, M.P. as Minister for Justice and Border Control, consisting of Customs & Immigration, Passports and Quarantine. Mr. Speaker and Honourable colleagues, this government prior to the General Elections on 23rd October acknowledged that there were many Nauruans overseas for study, health work or other reasons who would like to cast their vote and exercise their democratic voice in the elections. Therefore, the Electoral (Proxy Voting) Regulations 2004 was approved by Cabinet on October 15, 2004 and was implemented during the 2004 Parliamentary General Elections. Part III, First Schedule outlines the officers of the Republic of Nauru defined as a witness for the purposes of the Electoral (Proxy Voting) Regulations 2004. On 20th July 2007, Cabinet approved the amendment to the Electoral (Proxy Voting) Regulations to reflect the changes in Nauru’s overseas missions. The new office in Taipei was included, the new Consul General office in Brisbane and the Vice Consul in Bangkok also are included. In order to grant the right to vote to Nauruan electors in Kiribati and the Republic of the Marshall Islands, Cabinet Decision of 1st August 2007 approved a further amendment to the First Schedule to include appointments of representatives of the Chief Secretary in Kiribati and the Marshall Islands to be witnesses for the purpose of these regulations. In response to continued demand for proxy voting by Nauruan electors in jurisdictions not covered under the current legislation Cabinet approved on the 23rd of August 2007 a final amendment to the Electoral (Proxy Voting) Regulations to include ‘any person or persons in a country other than Nauru appointed by the Chief Secretary by notice in the Gazette to be a witness for the purpose of these regulations.’ In compliance to the above regulations, the Chief Secretary appointed witnesses for the purpose of proxy voting in Samoa, Kosrae, Honiara – Solomon Islands and Tuvalu. Rene Harris. I wish to inform the House that immediately after the suspension of the House this morning the said Member assaulted one journalist, Mr. Sean Dorney, Pacific correspondent for Network Broadcasting, or ABC, within the parliamentary precincts. I also wish to inform that the said journalist was discharging his duties when he was assaulted by the Member. Mr. Speaker and Honourable Members, in a parliamentary democracy the behaviour of Members of Parliament should be such as to enhance the dignity of Parliament and its Members in general. The Parliament has powers to punish its Members for their misconduct either inside or outside the House. The standard of conduct that Members of Parliament are expected to observe is to maintain the highest tradition of parliamentary life. The normal procedure to be followed in this regard is that the matter, on a motion, be referred to the Committee of Privileges to inquire into the alleged misconduct and whether such conduct was derogatory to the dignity of the House and inconsistent with the high standards expected of a Member. In this case, the Honourable Member has committed a breach of privilege and contempt of the House and I therefore move that this matter be referred to the Committee of Privileges to look into the above incident of misconduct by Hon. Harris and report back to the House with suitable recommendations in this regard. Thank you.
