[London Breed], The Sunshine Ordinance Task Force in 19108 Anonymous v. Herrera, et al. ruled unanimously on Feb 5 that the City Attorney violated SF Admin Code 67.29-5 by not recording places of and (if not otherwise publicly recorded) general statement of issues discussed at meetings in his calendar.

A few weeks back, we audited approximately 40 agencies' heads' calendar and email public records compliance, including your agency. In light of 19108, we allege that you as the responsible official violated the Sunshine Ordinance, SF Admin Code 67.29-5, because you did not keep or cause to be kept a daily calendar with: [(if not otherwise publicly recorded) a general statement of issues discussed at each meeting.]. Alternatively, you did record the detailed information in your calendar and it has been withheld from us for unknown reasons constituting an incomplete response, SFAC 67 .21.

We intend to bring SOTF complaints to enforce all 16 allegedly non-compliant agency heads' compliance with SFAC 67.29-5. As per the ruling in 19108, the respondent is the official and not the agency as a whole or their staff, as the official is personally responsible under SFAC 67.29-5 but can delegate that work however they want.

However, in lieu of a complaint, hearings, and eventual Order from SOTF for this issue, we would also accept the attached consent letter signed by you on official letterhead. If you are amenable to the consent letter approach, please review with your attorneys and let us know before close of business Feb 12, 2020. If you would like altered verbiage, that may be negotiated as well. If a letter amenable to us is signed and published, and the forthcoming Prop G calendar entries satisfy us, we will drop the complaint. Our goal is complete Sunshine compliance going forward throughout the entire City, which we can achieve through SOTF Orders or your voluntary binding compliance.

Notes: [ Examples of alleged violations from your Prop G calendars are attached. They do not have the required detail pursuant to 67.29-5. Meetings with your staff or other mayors etc. does not tell the public what issues were discussed. Given that these meetings are not recorded, they probably have the most interesting topics. The deliberative process privilege is banned in SF, so the public has a right to know what you discussed in private in _c:ill meetings. ] ·

This is in response to your request below sent during non-business hours and received by the Office of the Mayor on November 4, 2019.

Please see attached, responsive to Item 1, entries for the Mayor's Prop G calendar for October 28 and October 29, 2019. Pursuant to Admin Code 67.29-5 the "Prop G" calendar shall be made available to the requestor "three business days subsequent to the calendar entry date". Accordingly, given the time of your request and the dates requested, the days provided are the available Prop G calendar entries.

Please note that future entries for the Mayor's Prop G calendar by definition do not yet exist. Please also note that future entries for the Mayor's "non-Prop G" calendar, as previously noted, are exempt from disclosure, at least pursuant to Cal. Gov. Code 6254(f) for security reasons.

We will provide a separate response for the additional records requested in Item 1.

2. Other agencies release calendars as well, and they include Elsbernd as attendees in various meetings which I am now cross-checking. I want to confirm something before I file a complaint: Does the Mayor's Office still take the position that meeting items for Elsbernd and Bruss (not Breed) that are in the future as of the date of request (and recurrence entries for Elsbernd and Bruss (not Breed) that would show future meetings as of the date of request) are exempt pursuant to Gov Code 6254(f) and Times Mirror?

For example: A. On Nov. 27, you stated "See the attached records from Sean Elsbernd's calendar responsive to your request below. Please note that certain recurrence patterns have been redacted per the previously cited security exemptions, including CPRA 6254(f) and the Times Mirror case, re future entries. " B. On Dec. 5, in "AB Oct to Nov_Redacted, 11 you withheld, without justification, on pages 7, 9, 12, 15 (and others) certain recurrence patterns. To be clear, these recurrences were in fact entered in by a human being and are thus "writings" (which frankly you already conceded in "A").

I want to confirm you stand by exemptions of future meetings of Elsbernd/Bruss before we file a separate complaint. Unlike 19103, these people are not the Mayor and its highly unlikely they have round-the-clock SFPD protection detail, therefore, even if we lose 19103, we would still pursue a separate case regarding Elsbernd/Bruss.

The SOTF have started to conduct remote meetings via videoconference and are working to establish procedures to resume all operations including the processing of complaints. While the Sunshine Ordinance requires that certain actions be taken within 45 days, the Covid-19 emergency has forced delays and immense new backlogs for complaint hearings. We write today to ask if you are willing to waive the 45 day rule for your complaint. The SOTF intends to resume hearing complaints on a limited basis and complaints will be queued to be heard in the near future. Below are new Immediate Disclosure Requests {SF Admin Code 67.25(a)) directed to your agency and the above named persons. Your response is required by Feb 11, 2020. Rolling records responses are requested (SFAC67.25(d)) if you are unable to immediately produce records. Exact copies of every responsive record are requested (Gov Code 6253(b)) - do not: provide mere URLs, ·print and scan electronic records, convert native files to PDFs, or provide black and white versions of any color record. Provide only copies of records not requiring fees and in-person inspection of all other records {GC 6253). Emails are requested in the easily-generated EML or MSG formats (SFAC 67.21(1)).

I am now auditing how the City appears to unlawfully withhold the BCC recipients of emails when they print out emails in certain formats. The identity of BCC recipients is not exempt. BCC is not an information security record that reveals vulnerabilities or increases chance of an attack. The BCC names was typed in by a human being and are not metadata. You must provide BCC just like you provide To or CC recipients. There is no legal authority to keep secret the identities of persons communicating with government officials, unless they are specifically confidential informants and such. If you withhold the BCC names, I will file complaints, separate and apart from email metadata complaints.

Your non-exhaustive obligations: All withholding of any information must be justified in writing (SFAC 67.27). All withholdings by masking or deletion (aka redactions) must be keyed by footnote or other clear reference to the specific justification for that redaction, and only the minimal exempt portion of any record may be withheld (SFAC 67 .26). You must respond to emailed requests (SFAC 67.21(b)). You must notify us of whether or not responsive records exist and/or were withheld for each below request (Gov Code 6253(c), 6255(b)). You must state the name and title of each person responsible for withholding any information (Gov Code 6253(d)). Do not impose any end-user restrictions upon me (Santa Clara Co. vs Superior Ct, 170 Cal.App 4th 1301); so if you use a third-party website to publish records, please make them completely public without any login or sign-in.

Thanks for the update. In cases 20040, 20041, 20042, 20044, the allegation description is "failing to maintain a Prop G calendar" (the section is correct).

And for everyone else's information: in each case the sole defendant is, in fact, just the elected official or dept head, and not the office or staff members, pursuant to ruling in SOTF 19108 Anonymous v. Herrera.

Dear SOTF Petitioners, Respondents and other Stakeholders:

As you most likely know SOTF operations have been delayed over the last few months due to the Covid-19 emergency. The SOTF have started to conduct remote meetings via videoconference and are working to establish procedures to resume all operations including the processing of complaints.

PS9 While the Sunshine Ordinance requires that certain actions be taken within 45 days, the Covid-19 emergency has forced delays and immense new backlogs for complaint hearings. We write today to ask if you are willing to waive the 45 day rule for your complaint.

The SOTF intends to resume hearing complaints on a limited basis and complaints will be queued to be heard in the near future. We continue to work to address technical issues posed by remote meetings. We are aware of the time sensitivity of your records requests. Please be assured that the SOTF appreciates the urgency of your matters and the importance of handling them in a timely manner.
