The Town of Russell has a vacant Town Board Supervisor position and is seeking an individual to serve the remainder of a term that expires April 18, 2016.

Joint Town Board – Plan Commission Meeting – May 12, 2015 Posted May 4, 2015 at noon at the Town Garage, Buffalo Bay Store, Peterson's Foods and Red Cliff Tribal Administration Center and Town website. Approximately 4 Town Electors and members of the public were present.

The meeting was called to order by Chairman Paul “Rocky” Tribovich at 6:00 p.m. at the Town of Russell Community Center. Roll call was taken as follows; present Supervisors Jeff Benton, Larry Meierotto, Don Sullivan, and Clerk/Treasurer David L. Good.

Plan Commission Chairman, Larry Meierotto, did not call the Plan Commission to order due to the lack of a quorum.

The Pledge of Allegiance was recited by those present.

Discussion with Rob Schierman, Bayfield County Planning & Zoning, regarding any and all aspects of the Town of Russell Zoning Overlay District; with emphasis on criteria requiring an Alternative Development Plan, creating lots with existing structures requiring an Alternative Development and potential impacts on other Zoning Ordinances of changes to acreage thresholds requiring an Alternative Development – Discussion followed on the following items: 1. Publics lack of understanding regarding the Alternative Development and specifically the “process”. Even so, the results to those parties seeking an Alternative Development have been successful. 2. Zoning supports the end result because a Certified Survey Map is created, lot lines/set backs are defined, open space is delineated, developable areas delineated, clearly defines areas for future development. 3. There have been instances when property is to be subdivided and distributed to heirs. 4. Decreasing acreage limit from 20-acreas to 9.5-acreas before an Alternative Development is required. 5. Schierman suggested changing the process from a Class B Special Use to a Class A Special Use which leaves decision making at the Town level instead of the County Zoning Committee. This would be a reduction in costs to an applicant of $75. 6. How to split off an existing structure was discussed if the lot created would require an Alternative Development. 7. F-2 and A-2 classification need to stay at 35-acres. 8. Commercial and Industrial at 5-acres is somewhat high. Since this is a 5 ft. set-back 5-acres is very large. 9. Discussion followed on acreages 9.5-acres verses ¼ of a qtr. qtr. It was agreed to go to 9.5-acres. 10. Creation of substandard parcels was discussed. If this happens, and the owner wants to develop the parcel, they need to do an Alternative Development. 11. Adding Municipal to the Town table of Zoning Districts. 12. How to proceed with modifications was discussed. Costs is $225 to the Town. 13. Other changes were discussed such as percent of open space requirements, possibly reducing them. Developable verses non developable lands were reviewed. Set these as minimum and maximum numbers. 14. Set-backs will be the same as defined in the current zoning ordinance. 15. Existing approved Alternative Developments remain in force. 16. Existing ownership of Open Space was discussed but no changes were recommended. 17. Schierman agreed to draft proposed changes to the existing language for the Town to bring forward to our attorney.

Discussion regarding Bayfield County Zoning actions for Bolder Pointe LLC request and Town Board and Plan Commission recommendations – Discussion followed about the approval process. Schierman explained the history of NR-135 and the Zoning Ordinance along with grand fathered pits with no end date for operation. The Zoning Committee has been consistent in its recent approval process and length of time they are approved to operate. Discussion followed on what and why the Zoning Committee made the decision they did and the potential negative effect on local parties needing gravel. There is no language in the Zoning Ordinance prohibiting a 25 year pit licensure. It was noted that no requests to extend pit licenses for existing permits have been denied at this time. Discussion followed about how to ensure extension of pit licenses in the future. It was agreed to send a letter to the Zoning Committee requesting they develop Zoning Ordinance language to ensure existing licensed pits can be renewed or extended if there are no violations.

The Town Board recessed at 6:44 p.m.

The meeting reconvened at 7 p.m.

Approximately 4 Town Electors and members of the public were present.

PUBLIC INPUT – Tribovich asked the public if input should be held now or at the end of the meeting. A show of hands was taken. Public input was at the beginning of the meeting. Mark Wendling spoke on the Town letter to Bayfield County Board regarding endorsing a candidate to replace Beth Meyers. He felt this was very inappropriate. He spoke in favor of his wife being appointed and did not want the Town to take any action and let the County Board handle the matter. He also spoke about the North Pikes Creek project and did state it was started at the Town Plan Commission and he reviewed this history as he perceived it.

APPROVAL OF MINUTES

A motion was made by Sullivan and seconded by Meierotto to approve the minutes of the Regular Town Board Meeting of April 14, 2015. The motion carried.

COMMITTEE REPORTS

Roads Committee Report by Roads Chairman – No report.

FLAP Grant for Little Sand Bay Road Improvements – Mark Wendling stated that no information has been received to date on our Phase 2 2015 Grant Application.

General Town Garage and Road Maintenance Issue – Barningham reported that roads are being graded. We had the delivery of our new stainless steel sander and it has been installed on the truck. All spring yard clean-up is completed. Road weight restrictions were lifted at noon on May 11, 2015. Northwoods Paving has promised to complete blacktop patching on 2 culvert crossings on Old County K within two weeks. This does not include the Turner Road patch. Page 3 of 13

Plan Commission report by Committee Chairman – Meierotto reported on the meeting held May 5, 2015. He reviewed suggested recommendations regarding Adopt-A-Road program as follows. The Commission agreed to follow the WI DOT “Adopt-A-Highway” program with the following suggested changes. The program will be called “Adopt-A-Road”. The WI DOT Application form will be utilized with all references to “WI-DOT” changed to “Town of Russell”. Participants will provide documentation that they watched the “Safety Video” available from the WI DOT. The Town Chairman will be the approval authority and the “Permit Number” and “Group Number” will be eliminated. The following changes were recommended regarding the WI DOT Program Terms and Conditions located on the back of the application: a. Change all references of “WI DOT” to “Town”. b. Eliminate WI DOT number 4 relating to interstates and work plans. c. Number 5. Change trash pick-ups to a minimum of two times (preferably spring and fall). d. Number 9. Change minimum age to participate in a pick-up to 11 years or 6th grade. e. Number 15. Reference that the Town will provide supplies (safety vests, bags, signs). f. Number 18. Eliminate completing Form and state the group will “inform the Town” when a pick-up is completed. g. Eliminate number 19. Regarding transportation and where to park personal vehicles. h. Number 20 changed to “Recyclables are to be collected in separate bags and may be kept by the group”. i. Add that if a sign recognizing the group is requested, the Town will purchase and install the sign(s) and the group will be responsible for the costs.

A motion was made by Sullivan and seconded by Benton to approve the program as recommended and that the Clerk draft a resolution for adoption at the June Board Meeting. The motion carried.

Monuments of Recognition – Meierotto read the following recommendation.

Guidelines for Public Memorials in the Town of Russell

The Town of Russell recognizes the need for memorials to be established to recognize individuals, groups, or organizations that have made a significant contribution to the culture or history of the Town of Russell. Individuals and families that have a desire to establish a memorial should follow these guidelines that provide a process for establishing such memorials.

1. A written Request for Memorial shall be submitted in writing to the Town and explain who is being memorialized, their contribution to the Town of Russell, and what is being proposed for a memorial. If requested, the Town will provide the requester with a selection of suggested items and images of available recognition items.

2. Memorials will consist of a standard bench or table, selected by the Town Board, or a sign, to be placed on Town-owned land. If requesting a memorial sign, a scaled drawing must be submitted with the request form.

3. The Town Board, may, from time to time, add other items to the list of approved memorials as they see fit.

4. The Town Plan Commission will review the request and forward a recommendation to the Town Board with a list of where a bench or table could be placed on Town land.

5. The request will be reviewed by the Town Board who will determine a. whether the person has “made a significant contribution to the culture or history of the Town of Russell,” b. whether there is a current need in the Town for a bench or table, or other memorial item, and c. the approved location for the placement of the memorial item.

6. All signs will be displayed at the Community Center in the “sign garden”.

7. If approved, the Town will notify the requestor and will coordinate the completion of the recognition process.

8. All costs associated with the purchase of memorial, including shipping, will be borne by the donor.

9. The item will be installed by Town employees, Board members, or volunteers with town employee or Board member supervision.

10. Memorial items will remain on Town grounds until they become unsafe, or unacceptable from an aesthetic standpoint. If an item falls into disrepair due to age, wear, vandalism, storm damage, etc., the donor will be informed, and the donor may choose to repair or replace the item, otherwise the Town will remove the item.

11. The Town reserves the right to move or remove a memorial item.

Discussion followed about the Town being over 100 years old.

A motion was made by Benton and seconded Sullivan to recommendation adoption of the guidelines. The motion carried.

Update on Little Sand Bay Recreation Activities – No report.

NEW BUSINESS

Town Board Supervisor vacancy – Discussion followed about seeking persons interested in the position. It was agreed to post the notice and place it on the Town website. Interested individuals will be asked to submit letters of interest.

Tractor-mower proposals and mower only proposals – Cost estimates were presented by Barningham. Discussion followed. No action will be taken until future operating scenarios are discussed with the Tribe and opportunities to consolidate some functions collaboratively.

Contracting for a dumpster at the Town Garage – Discussion followed on the estimated costs from Waste Management and Eagle Waste. A motion was made by Tribovich and seconded by Meierotto to approve the contract with Waste Management. After lengthy discussion, the Board agreed to not secure a dumpster at this time and to get an agreement in place with BRB Recycle to allow us access during their non-business hours. Page 6 of 13

Tribovich withdrew his motion and Meierotto withdrew his second. Tribovich made a motion and Meierotto a second to table to the June Board Meeting. The motion carried.

Ordinance to Establish Procedures and Criteria for Allowing Alternative Forms of Sworn Testimony at Board of Review (BOR) Hearings

Whereas, sec. 70.47(8), Wis. Stat. authorizes the board of review to consider requests from a property owner or the property owner's representative to appear before the board under oath by telephone or to submit written statements under oath to the board of review;

Now Therefore the Town Board of Russell, Bayfield County does ordain as follows:

1. PROCEDURE: In order for a property owner or property owner's representative to submit a request to testify by phone or submit a sworn written statement, he or she must first comply with the following procedures: a) the legal requirement to provide notice of intent to appear at BOR must be satisfied; and b) an Objection Form for Real Property Assessment (PA-115A) must be completed and submitted to the BOR as required by law. After the two requirements outlined above have been met, a Request to Testify by Telephone or Submit a Sworn Written Statement at Board of Review (Form PA-814) may be submitted to the town clerk. Such requests must be submitted in time to be considered by the board at the first meeting of the BOR.

2. CRITERIA TO BE CONSIDERED The board may consider any or all of the following factors when deciding whether to grant or deny the request: a. The requester's stated reason(s) for the request as indicated on the PA-814 b. Fairness to the parties c. Ability of the requester to procure in person oral testimony and any due diligence exhibited by the requester in procuring such testimony d. Ability to cross examine the person providing the testimony e. The BOR's technical capacity to honor the request f. Any other factors that the board deems pertinent to deciding the request

NOW, THEREFORE, BE IT RESOLVED by the Board of the Town of Russell, at a Meeting held this 12th day of May, 2015, that the Town Board is officially adopting said resolution.

A motion was made by Sullivan and seconded by Meierotto to approve. The motion carried with Tribovich abstaining due to the contractor being related by marriage.

Request by CORE to use Community Center monthly in support of a grant to offer cooking classes – Clerk Good reviewed the request. A motion was made by Meierotto and seconded by Benton to approve. The motion carried.

Schedule to revise the Town Comprehensive Plan – Clerk Good said no action is required at this time.

Request to use Town Garage restrooms and well for water during Bike Tour – Discussion of past use was discussed and the condition of the well spigot. A motion was made by Sullivan and seconded by Meierotto to provide water from the facet on the Town Garage and not allow the use of the Town Garage restrooms. The motion carried.

Red Cliff ECC request to use LSB picnic gazebo/area for pony rides June 19 & 26, 2015 – This is the same request we received in past years. A motion was made by Meierotto and seconded by Sullivan to approve. The motion carried.

OLD BUSINESS

Bayfield County appointment to fill District 1 vacant County Board seat – Tribovich reported the County Board is acting on this on May 26, 2015.

Schedule meeting with property owner to discuss turn-a-round on Beaver Road – Clerk Good stated the property owners were sent a certified letter and we have received confirmation that they received it but we have not heard from them at this time. Tribovich asked that this be removed from future agendas.

Xcel Energy natural gas extension proposal to service Town Garage and others in the vicinity – The Board agreed to drop this item from the agenda at this time.

Possibly hire a consultant to timber cruse Town land by the Pit/Community Center – Discussion was held regarding the WI DNR cutting plan and a list of foresters was provided by the WI DNR. Clerk Good sent out 47 RFP’s and we have received 2 inquiries. A motion was made by Sullivan and seconded by Meierotto to table to the June Town Board Meeting. The motion carried.

Experience Works Program update – Clerk Good stated the potential candidate may be available to start in July 2015. The Experience Works Coordinator will keep us informed.

Clerk Good reported that Notice of Board of Review was posted on April 29, 2015 at the Town Garage, Buffalo Bay Store, Peterson Foods and the Tribal Administration Building and the doors to the Town Garage as well as the Town website. The notice was published in the Ashland Daily Press on April 29, 2015. Clerk Good reported that the Board of Review Training Affidavit was filed with the Wisconsin Department of Revenue electronically on February 19, 2015 that Jeff Benton, Don Sullivan, Larry Meierotto and Paul “Rocky” Tribovich are trained and received such training on May 22, 2014. The Clerk received the sworn and signed Assessment Roll from Assessor Martin and a summary of “arms- length” sales within the Town during the prior twelve months. The Assessor confirmed that notices of change in assessment were mail on April 8, 2015 by First Class U.S. Mail at Chippewa Falls, WI.

On behalf of the Town of Russell; Bayfield County, Wisconsin, I am pleased to provide this letter in support of the TIGER grant application being submitted by the Red Cliff Band of Lake Superior Chippewa (Red Cliff Band). We work closely in partnership with the tribal nation and share in the need for, and benefits of the Red Cliff Band Transportation Center (RCTC).

The Town of Russell will be affected by this project in significant ways. A large portion of the Red Cliff Reservation lies within the Town of Russell. The center of our town is on the shores of Lake Superior and is a gateway area to the Apostle Islands National Lakeshore. The RCTC will aid in maintaining our roadways, providing transit options for our residents, and help our community grow as a recreational business center for tourism.

We urge you to fund the RCTC. This project will greatly aid the town in quality of life, safety, and economic development.

You hnd asked about having the Dept. of Natural Resources look at the Town of Russell property in Sec. 5, T51N R4W, at Valley View Road.

DNR forestel' Bill Volavka wrote a plan for that property in 1991. Volavka's plan called for a shelterwood harvest ill 1997, and an overstory removal in 2008, in the oak areas in the eastern half of the property. The forest has not changed much since Volavk.a's plan was written.

I was able to walk the property todJiy. On the eastern half of the property, there is a very good crop of oak saplings between one inch and four inches diameter at breast height. These saplings would benefit from removal of the inature aspen and most of the mature oak in the overstory. This kind of release harvest would have to be done carefully so as not to damage the established saplings. The goal of this harvest would be to make the established saplings grow much more quickly.

On the western half of the property there is a mix of more maple and basswood that could potentially be managed as an uneven-aged hardwood forest, or could be encouraged to regenerate oak, depending on how that harvest is done. A more aggressive harvest, say removing half the trees while scuffing up the soil, would encourage oak seedlings to become established if done in a good acorn year. A couple years after the first harvest, you would do a second harvest to release those new oak seedlings.

A less aggressive harvest may remove Y4 to 1/3 of the trees, to encourage basswood and maple seedlings and saplings.

As we discussed on the phone, I am not available at this time to set up a harvest for the Town. I faxed you a list of consulting foresters who work in the County, who could help you out establishing and administering a timber sale on this property.

I do highly encourage you to consider this harvest. Especially in.the eastern half of the stand, the oak saplings are ready to be l'eleased so they can grow into mature trees.

RE: RFP- Forest Management, Town Property, Pit/Shooting Range

This proposal is in response to Request for Proposal from Town of Russell via email dated April 24,2015. Proposals where requested to be provided for the June 9,2015 board meeting.

Background on Groeschl Forestrv Consulting, Inc. Our firm has been in business since 1986 and incorporated since 1995. We currently employ 3 professional foresters, Jeffrey Groeschl, Andrew Tuttle, and Tom Leahy. Our client base is very diverse from Federal Government, Sate Government, County & Town Government, forest industry, logging industry, and many small private landowners. Our services typically include, forest reconnaissance and mapping, timber sale set-up and administration, and forest tax law assistance.

Specifics on the Pit-Shooting Range Tract Jeffrey Groeschl conducted a field review of this specific tract on May 13 1h 'vvith the DNR recommendations in-hand. This tract is quite variable, but appears to lend itself to placement in three forest classifications. The western portion of the tract is primarily red oak with lesser amounts of soft maple. The northern portion of the tract is quite unique with hemlock, hard maple, and red oak. The eastern portion of the tract has had some type of disturbance activity several decades ago that created conditions suitable for establishment of red oak. There is a very healthy component of young red oak dispersed through this portion of the property.

Recommended Management We recommend management that responds to the unique character of the property. The western portion dominated by red oak should be thinned to remove the larger mature red oak with heavy forks or multiple trunks, and also remove trees that are diseased, defective, or deformed and present little opportunity to improve in value. This will maintain a very healthy mid-sized oak stand on the Town land as a significant financial investment going forward. The northern portion of the tract should be thinned to favor red oak, hemlock, sugar maple, yellow birch, and any other species that is healthy and has potential to improve in both size and value. The same removal criteria as previously described will be applied, but creation of canopy gaps would be applied to stimulate regeneration of hard maple or red oak. This area will most likely continue to progress toward a more northern hardwood type forest with the presence of sugar maple. The eastern portion of the property would be marked to favor the healthy young red oak saplings and small poles. The larger trees have many defect indicators and would be removed in favor of the young red oak and sugar maple saplings and poles. This type of management will continue to favor the red oak as well as a complex of other species present. Proposal Groeschl Forestry Consulting, Inc. will conduct all timber sale preparation services and all timber sale administration services to accomplish all recommended management. Timber sale preparation includes individual tree marking, timber cruising, mapping, preparation of advertisement documents, timber sale bidding, preparation of a timber sale contract. Timber sale administration includes: pre-work meeting, site inspections, volume accounting, and stumpage collection. Overall timber sale administration focuses on successful performance of the contract and its clauses.

Groeschl Forestry Consulting Inc. performs services on a time/materials basis. We charge at the following rates: labor @ $55/hour; mileage @ $0.65/mile; tree marking paint @ $18/gallon. Invoicing occurs twice during the project, when the sale has been prepared and offered for logger bids and at the end of the timber sale for administration of the timber sale contract.

Based on my evaluation of the pit-range property, we anticipate a timber sale as prepared as recommended may generate approximately $25,000 of stumpage income to the Town. The costs for us to handle the project from start to finish will be between $4,000 and $5,000. These are estimates and would be refined as the scope of the project is refined and approved by the Town. The stumpage income estimate is also based on a sealed bidding process with no restrictions who can bid on the project.

Retention of Services The Town may retain our services through signature of this proposal. A signed copy will be returned to Groeschl Forestry with the original retained by the Town of Russell.

WHEREAS, Wisconsin Statutes §59.69 (5) authorizes the County Board to adopt a zoning ordinance; and

WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to amend an ordinance; and

WHEREAS, Section 13-1-104 Code of Ordinances, Bayfield County, Wisconsin authorizes the County Board to make amendments to Title 13, Chapter 1 of the Code of Ordinances, Bayfield County, Wisconsin pursuant to Wisconsin Statutes §59.69; and

WHEREAS, it is deemed in the best interest of the County of Bayfield to amend the definitions set forth in Section 13-1-4(a) Code of Ordinances, Bayfield County, Wisconsin to include definitions for the following terms: brewerylmegabrewery; brewpub; farm winery; mircrobrewery; micro-distillery; micro-winery; and winery; and

WHEREAS, it is deemed in _the best interest of the County of Bayfield to amend shoreland fee schedule set forth in Section 13-1-21(e)(1)kk. Code of Ordinances, Bayfield County, Wisconsin to include grading in the explanation of the fees required for shore/and permits; and

WHEREAS, it is deemed in the best interest of the County of Bayfield to create subsection (4) in Section 13-1-22(b) Code of Ordinances to provide structural setbacks from cul-de-sacs; and

WHEREAS, it is deemed in the best interest of the County of Bayfield to make a change to the height restrictions language under Section 13-1-22(h) Code of Ordinances, Bayfield County, Wisconsin to remove the requirement of a conditional land use permit for all structures exceeding (35) feet in height in the shore/and area; and

WHEREAS, it is deemed in the best interest of the County of Bayfield to amend Section 13-1-24(b), 13-1-24(d) and 13-1-24(d)(2) to provide that a land use permit, and not a Class A special use permit, is required for certain excavating, grading or filing on Lake Superior and for grading in areas with certain slopes or along the shoreline of certain navigable waters; and WHEREAS, it is deemed in the best interest of the County of Bayfield to amend the table listed under Section 13-1-62(a) Code of Ordinances, Bayfield County, Wisconsin to remove as a permissible use the word vineyard and to include among permissible uses the terms brewery, megabrewery, microbrewery, micro-distillery, micro-winery, farm winery, and winery and further to provide that said permissible uses shall be conditional uses in r-rb, ag-1 and commercial zones; and

WHEREAS, it is deemed in the best interest of the County of Bayfield to amend the table listed under Section 13-1-62(a). Code of Ordinances, Bayfield County, Wisconsin to remove the special use (class a) shore/and grading in the r-1, r-2, r-3, r-4 r-rb, commercial, industrial, municipal, ag-1, ag-2, f-1, f-2 and w (conservancy) columns; and replace with permitted use (p); and

Except as provided in subsections (b) and (c), a Class A special land use permit shall be required for the grading or filling of one thousand (1,000) square feet or more within a strip paralleling the shoreline of a navigable water and extending inland three hundred (300) feet from the ordinary high water mark.

(2) A Class A special land use permit shall be required for any grading in areas on slopes greater than twenty percent (20%).

Section 8. Except as specifically modified and amended by this ordinance, the Bayfield County Code of Ordinance shall remain in force and effect exactly as originally adopted and previously amended. All ordinances or parts of ordinances inconsistent with or in contravention of the provisions of this ordinance are hereby repealed. Section 9. SEVERABILITY. If a court of competent jurisdiction adjudges any section, clause, provision, or portion of this ordinance unconstitutional or invalid, the remainder of this ordinance shall not be affected thereby.

Section 10. EFFECTIVE DATE. This ordinance shall take effect and be in full force from and after its passage.

(i) Compliance with the minimum average width requirements shall be determined whenever feasible as demonstrated by the following example. In applying the example, the side of the rectangle equivalent to the required minimum average width shall be aligned with the side of the lot fronting a road, or, if there is no road frontage, with the side of the lot to which access is provided. If, due to a lot’s configuration, it is not feasible to determine the minimum average width as demonstrated by the example, such determination shall be made as reasonably determined by the Planning and Zoning Administrator. (1) The Unincorporated Village Overlay District is created to accommodate the land use patterns of those established unincorporated villages where, in order to insure development consistent with the intent of this Chapter, special provisions shall be applied.

(2) The Unincorporated Village Overlay District shall encompass the lands contained in the Villages of Drummond, Cornucopia, Iron River, Herbster, Grand View, and Port Wing as these boundaries are delineated on the orders creating these respective sanitary districts created under the provisions of Ch. 60.3, Wis. Stats, and on file at the Register of Deeds Office.

(3) This District shall also include the property included within the Cable Sanitary District service area in Section 18-43-7, in the Town of Cable, as shown on the map of said section showing proposed zoning district changes for the Cable Sanitary District prepared by the Bayfield County Land Records Department and filed with the Bayfield County Planning and Zoning Department on April 20, 2005. (a) Applicability. The Town of Russell Overlay District shall apply to and include all lands within the Town of Russell. (©8/30/2005)

(b) Intent of Town of Russell Overlay District. The intent of this overlay district is to promote the public health, safety, convenience and general welfare; to encourage planned and orderly land use development; to protect property values and the property tax base; to permit the careful planning and efficient maintenance of roadways; to ensure adequate highway, utility, health, educational and recreational facilities; to recognize the needs of agriculture, forestry, industry and business in future growth; to encourage uses of land and other natural resources which are in accordance with their character and adaptability; to encourage the protection of old-growth forests; to preserve wetlands; to conserve soil, water and forest resources; to protect the beauty and amenities of landscape and man-made developments; to provide healthy surroundings for family life; and to promote the efficient and economical use of public funds. (c) Definitions. All terms contained herein shall be as defined in Sec. 13-1-4 unless otherwise defined within this section. (©8/30/2005)

(1) Alternative Development. A development or land division in which dwellings and other buildings are located on only a portion of a development, in contrast to conventional practice, which distributes development evenly across the entirety of a parcel, in order to accomplish either of the following: (©8/30/2005)

a. Preserve by deed restriction, including conservation easement, restrictive covenant and development rights transfers, the majority of the land division parcel for present or future agricultural use or conservation; (©8/30/2005)

b. Create, maintain or expand protective barriers contiguous with roadways, lakes, wetlands and other natural resources in the Town of Russell. (©8/30/2005)

(2) Certified Forester. A person meeting the requirements of Section NR 1.21(2)(e) of the Wisconsin Administrative Code. (©8/30/2005)

(3) Conservation Easement. As provided in §700.40, Wis. Stats., a holder's non-possessory interest in real property imposing any limitation or affirmative obligation, the purpose of which includes retaining or protecting natural, scenic or open space values of real property, assuring the availability of real property for agricultural, forest, recreational or open space use, protecting natural resources, maintaining or enhancing air or water quality, preserving a burial site, as defined in §157.70(1)(b), Wis. Stats. or preserving the historical, architectural, archaeological or cultural aspects of real property. (©8/30/2005)

(4) Deed restriction. A restriction on the use of a property set forth in a deed or other instrument of conveyance, including, but not limited to, a restrictive covenant, conservation easement, transfer of development rights or any restriction placed on undeveloped land as a condition for the division or development of the undeveloped land. (5) Historic Site Overlay. An area designated by the Bayfield County Board that possesses a contiguous or nearly contiguous historic site(s), building(s), structure(s) or objects united historically and/or aesthetically by a common theme or a set of common characteristics that are historically or architecturally significant to the Town of Russell, the state or the nation. (6) Historic Site. Any parcel of land whose historic significance is due to a substantial value in tracing the history or prehistory of, humanity, or upon which a historic event has occurred and which has been designated as a historic site under this section, or an improvement parcel, or part thereof, on which is situated a historic structure and any abutting improvement parcel, or part thereof, used as, and constituting part of, the premises on which the historic structure is situated. (7) Historic Structure/Building. Any improvement which has a special character or special historic interest or value as part of the development, heritage or cultural characteristics of the Town of Russell, the state or the nation and which has been designated as a historic structure pursuant to the provisions of this section. (8) Old-Growth Forest. A forest that includes at least eight 100-year old trees per acre; is at least five acres in size. (©8/30/2005)

(d) Zoning District Dimensional Requirements and Classification. Except as provided in subsections (e) and (f) below, the following dimensional requirements shall apply to all parcels located within the Town of Russell Overlay District: (©8/30/2005)

(e) Alternative Developments. In order to further the goals and policies of the Town of Russell Land Use Plan, the Bayfield County Planning and Zoning Committee will favor plans for land divisions that provide for an alternative development. At the discretion of the Bayfield County Planning and Zoning Committee, deed restrictions, including restrictive covenants, or conservation easements, or both, may be required for such plans. (1) Minimal Lot Area. The minimal lot area as stated in subsection (d) above shall apply unless the developer submits an application and plan for an alternative development that includes a plan as to how the minimal open space will be maintained. Upon consideration of the recommendation by the Town of Russell and the approval by the Bayfield County Planning and Zoning Committee of a plan for an alternative development, the minimal lot requirements of Section 13-1-60 of the Bayfield County Zoning Ordinance shall apply to that portion of the development not required to meet the open space requirements. (2) Minimal Open Space. A plan for an alternative development shall include minimal open space as set forth in the table below. (©8/30/2005)

Each unit created under this section may own an equal amount of the required minimum open space, or an unequal amount of open space if that was the wishes of the owner as long as the minimum requirement was met. (e.g. If there is 18 acres of open space required, for four units, each unit must have at least 4.5 acres of the open space.) A deed restriction shall be recorded describing the open space and buildable space, restricting the entire lot from being subdivided and prohibiting any structure; any change in the use of the land requiring a permit within the open space or (©12/15/2009

d. A Class B Special Use permit shall be required prior to any subdivision under this section. (©12/15/2009)

(4) Uses of Open Space. Space that is dedicated to be open shall be maintained in a natural, undisturbed condition, which shall include the farming of crops. Limited access may be allowed for passive or active recreation. (©8/30/2005)

(5) Additional Plan Requirements. A plan for an alternative development shall meet all of the requirements of the Bayfield County Zoning Ordinance and shall include the following: (©8/30/2005)

a. The location of all improvements and minimal open space and a plan as to how the minimal open space will be maintained. (©8/30/2005)

b. A plan that as to how the minimal open space will be used and maintained; (©8/30/2005)

c. Existing zoning on and adjacent to the proposed development; (©8/30/2005)

d. Any proposed lake and stream access with a small drawing clearly indicating the location for the proposed development in relation to the access; (©8/30/2005)

e. Any proposed lake and stream improvements or relocation; (©8/30/2005)

f. All Department of Natural Resources designated wetlands, and any field verified wetlands designated by a public agency. (©8/30/2005)

g. The County Planning and Zoning Committee shall require submission of a draft of protective covenants, where a covenant is proposed and whereby the land divider intends to regulate land use in the proposed development. The covenants may be subject to the review and approval of the Bayfield County Corporation Counsel as to form; (©8/30/2005); (A)7/30/2013)

h. Easements shall be shown and shall be limited to utility easements, drainage easements, conservation easements, access easements and service easements; (©8/30/2005)

m. A plan for an alternative development shall and shall assure proper use, construction and maintenance of open space facilities and shall result in a development superior to conventional development in terms of its benefits to future owners of the development, surrounding residents and the general public. The County Planning and Zoning Committee may place whatever additional conditions or restrictions it may deem necessary to insure development and maintenance of the desired character, including plans for disposition or re-use of property if the open space use is not maintained in the manner agreed upon or is abandoned by the owners. (f) Nonconforming Parcels...Notwithstanding Sec. 13-1-26(d), any parcel of land with dimensions not conforming to the zoning district dimensions of this section that was created by a county-approved certified survey map or plat prior to the adoption of this section on the 30th day of August 2005, shall not be subject to the dimensional requirements of this section. Further subdivision of such parcels and all other parcels shall be governed by this section. (©8/30/2005)

(g) Historic Site Overlay District. It is hereby declared a matter of public policy that the protection, enhancement, perpetuation and use of improvements or sites of special character or special architectural, archeological or historic interest or value is a public necessity and is required in the interest of the health, prosperity, safety and welfare of the people. (1) The purpose of this section is to: (©8/30/2005)

a. Effect and accomplish the protection, enhancement and preservation of such improvements, sites and districts which represent or reflect elements of the Town of Russell’s cultural, social, economic, political, artistic and architectural history; (©8/30/2005)

b. Safeguard the Town of Russell’s historic, prehistoric and cultural heritage, as embodied and reflected in such historic structures, sites and districts; (©8/30/2005)

c. Foster civic pride in the notable accomplishments of the past; (©8/30/2005)

d. Stabilize and improve property values and enhance the visual and aesthetic character of the Town of Russell; (©8/30/2005)

(2) Applicability. The Historic Site Overlay District shall apply to and include historic sites and/or historic structures placed therein pursuant to the provisions of paragraph (3) below. (©8/30/2005)

(3) Classification Procedure and Criteria (©8/30/2005)

a. Addition and Removal of Historic sites – Procedure (©8/30/2005)

1. Historic sites and historic structures may be added to, or removed from, the Historic Site Overlay District upon a petition by either the landowner or Town of Russell Board. (©8/30/2005)

2. Before adding or removing any site or structure to or from the Historic Site Overlay District, the Bayfield County Planning and Zoning Committee shall review the recommendation of the Town of Russell. (©8/30/2005); (A)7/30/2013)

3. The committee shall then vote to add or remove the site or structure to or from the Historic Site Overlay District based upon the recommendation of the Town of Russell and the criteria in paragraph b. below. The final decision shall be made by the Bayfield County Board. (©8/30/2005);

b. Criteria for Addition and Removal of Historic sites – For purposes of this section, a locally designated historic structure, historic site or historic district designation may be placed on any site, natural or improved, including any building, improvement or structure located thereon, or any area of particular historic, architectural, archeological or cultural significance to the Town of Russell, the state or the nation, which: (©8/30/2005)

1. Exemplifies or reflects the broad cultural, political, economic or social history of the nation, state or community; or (©8/30/2005)

2. Is identified with historic personages or with important events in national, state or local history; or (©8/30/2005)

3, Embodies the distinguishing characteristics of an architectural type or specimen inherently valuable for a study of a period, style, method of construction, or of indigenous

materials or craftsmanship, or that represents a significant and distinguishable entity whose components lack individual distinction; or (©8/30/2005)

5. Has yielded, or may be likely to yield, information important to prehistory or history. (©8/30/2005)

(4) Management and Maintenance – Ordinary maintenance and repairs may be undertaken, provided that the work involves repairs to existing features of a historic structure or site, or the replacement of elements of a structure with pieces identical in appearance, and provided that the work does not change the exterior appearance of the structure or site and does not require the issuance of a building permit. (5) Permitted Uses – All uses permitted within the underlying zoning district, by right or by special exception, shall be permitted unless specifically prohibited below. In all cases, the more restrictive requirement(s) shall apply. (©8/30/2005)

(6) Prohibited Uses – The following shall not be permitted within a historic district prior to the issuance of a special use permit. (©8/30/2005)

a. The construction or reconstruction, alteration or demolition of all of or any part of the property. (©8/30/2005)

b. Improvements made to any site or structure beyond the typical maintenance that will not change the appearance or character of the site or structure. (©8/30/2005)

c. The construction, building or maintenance of any road path or thoroughfare for the passage of motor vehicles. (©8/30/2005)

(7) The Town Board shall recommend and the county shall issue a special use or permit unless: (©8/30/2005)

a. In the case of a historic structure or historic site, the proposed work would detrimentally change, destroy or adversely affect any exterior feature of the improvement or site upon which said work is to be done; (©8/30/2005)

b. In the case of the construction of a new improvement upon a historic site, or within a historic district, the exterior of such improvement would adversely affect, or not be compatible with, the external appearance of other neighboring improvements on such site or within the district; (©8/30/2005)

c. In the case of any property located in a historic district, the proposed construction, reconstruction, exterior alteration or demolition does not conform to the purpose and intent of this section and to the objectives and design criteria of the historic preservation plan for said district; (©8/30/2005)

d. In the case of a request for the demolition of a deteriorated building or structure, any economic hardship or difficulty claimed by the owner is self-created or is the result of any failure to maintain the property in good repair; (©8/30/2005)

e. The building or structure is of such local architectural or historical significance that its demolition would be detrimental to the public interest and contrary to the general welfare of the people of the city and state; (©8/30/2005)

f. In the case of a request for a demolition permit, the denial of the demolition permit would result in the loss of reasonable and beneficial use of, or return from, the property. (©8/30/2005)

(h) Old-Growth Overlay District (©8/30/2005)

(1) Purpose. The purpose of the Old-Growth Overlay District is to: (©8/30/2005)

a. Discourage development and disturbance to the natural environment in areas with old-growth/virgin timber. (©8/30/2005)

b. Provide areas where native flora and fauna may prosper in a natural habitat. (©8/30/2005)

The intent of this overlay district is to promote the public health, safety, convenience and general welfare; to encourage planned and orderly land use development; to protect property values and the property tax base; to permit the careful planning and efficient maintenance of roadways; to ensure adequate highway, utility, health, educational and recreational facilities; to recognize the needs of agriculture, forestry, industry and business in future growth; to encourage uses of land and other natural resources which are in accordance with their character and adaptability; to encourage the protection of old-growth forests; to preserve wetlands; to conserve soil, water and forest resources; to protect the beauty and amenities of landscape and man-made developments; to provide healthy surroundings for family life; and to promote the efficient and economical use of public funds. (c) Sign Regulation Purpose. The purposes of this ordinance are to protect the natural scenic beauty and rural character of the Town of Bayfield, promote traffic safety and provide important information to the traveling public. These purposes shall be achieved by restricting the number, size, location, maintenance, and spacing of outdoor advertising signs through the administration of this ordinance. (©3/11/2008)

The Town of Russell (the “Town”) and the volunteer group (the “Group”) named on this application, recognize the value and the desirability of litter-free roads. ADOPT-A-ROAD PROGRAM TERMS AND CONDITIONS

1. The Group and its members are to be considered as volunteers and not as officers, employees, or agents to the Town of Russell. Any injuries, claims, liabilities, suits or costs arising from Group or Group members’ activities relating to this permit shall be the sole responsibility of the Group or its individual members. 2. The Group agrees to indemnify and hold harmless the Town of Russell from any injury, cost, suit, liability or award arising from the issuance or exercise of this permit, or because of any adverse effect upon any person or property attributed to the works of the Group. 3. Participants in the Group agree to obey and abide by all laws and regulations relating to safety and such terms and conditions as may be required by the Town for special conditions that may exist on a particular adopted section. 4. The Group agrees to provide a document signed by each volunteer stating that they have viewed the WisDOT Adopt-A-Highway Safety Video which is now available on the Internet! Adopt-A-Highway Safety Video. 5. The Group shall pick up litter a minimum of two times a year between April 1 and November 1 (preferably spring and fall). The Group shall not work beyond its section limits. 6. The Group shall not pick up litter on medians, bridges, around other structures that would pose a danger. 7. The Group shall supply one adult supervisor for every 5 to 6 workers. 8. The Group leader shall review the safety rules with all participants before proceeding to the road segment. 9. All participants shall be at least 11 years of age or in the 6th grade. No other persons shall be present at the work site. 10. The Group shall work only during daylight hours and in good weather. 11. Both traffic safety signs shall be displayed properly during litter pickup. Groups shall work on only one side of the road at a time. 12. All participants shall wear safety vests. 13. When the Group encounters closed containers or items suspected to be hazardous, these items shall not be touched. Items of serious concern should be noted and reported to the Town Road Foreman.

14. The Group shall place filled trash bags at designated pickup site(s) and shall recycle trash as required by the Town. 15. The Group shall be provide required supplies and materials from the Town (safety vests, bags, signs). 16. The Group shall not collect litter during the following holiday periods, Memorial Day extended weekend, July 3–5 and Labor Day extended weekend. 17. Within 24 hours of a collection, the Group shall notify the Town Road Foreman. 18. The Group may keep any recyclable materials. 19. Partisan political groups (groups of people with common political opinions and purposes organized for gaining political influence, governmental control and for directing government policies) shall not be permitted to participate. 20. The Group shall notify the Town of abandonment of their segment. This permit is valid until such time the Group notifies the Town of abandonment or the Town terminates the agreement for non-performance of compliance with the agreement.

The Town agrees to as follows: 1. Provide safety vests, trash bags, traffic safety signs and a safety training video (WI DOT via internet). 2. Remove the filled trash bags as soon as possible after the pickup. 3. The Town reserves the right to refuse or revise acronyms of Group names when preparing signs.

Resolution to Establish Procedures and Criteria for Monuments of Recognition and Public Memorials

Whereas; the Town Board receives requests to honor various persons, events, or organizations within the Town. The Town Plan Commission recommended and Town Board adopted the following guidelines to be used when such a request is received. This resolution codifies those guidelines as follows:

Guidelines for Public Memorials in the Town of Russell

The Town of Russell recognizes the need for memorials to be established to recognize individuals, groups, or organizations that have made a significant contribution to the culture or history of the Town of Russell. Individuals and families that have a desire to establish a memorial should follow these guidelines that provide a process for establishing such memorials.

A written Request for Memorial shall be submitted in writing to the Town and explain who is being memorialized, their contribution to the Town of Russell, and what is being proposed for a memorial. If requested, the Town will provide the requester with a selection of suggested items and images of available recognition items.

Memorials will consist of a standard bench or table, selected by the Town Board, or a sign, to be placed on Town-owned land. If requesting a memorial sign, a scaled drawing must be submitted with the request form.

The Town Board, may, from time to time, add other items to the list of approved memorials as they see fit.

The Town Plan Commission will review the request and forward a recommendation to the Town Board with a list of where a bench or table could be placed on Town land.

The request will be reviewed by the Town Board who will determine whether the person has “made a significant contribution to the culture or history of the Town of Russell,” whether there is a current need in the Town for a bench or table, or other memorial item, and the approved location for the placement of the memorial item.

All signs will be displayed at the Community Center in the “sign garden”.

If approved, the Town will notify the requestor and will coordinate the completion of the recognition process.

All costs associated with the purchase of memorial, including shipping, will be borne by the donor.

The item will be installed by Town employees, Board members, or volunteers with Town employee or Board member supervision.

Memorial items will remain on Town grounds until they become unsafe, or unacceptable from an aesthetic standpoint. If an item falls into disrepair due to age, wear, vandalism, storm damage, etc., the donor will be informed, and the donor may choose to repair or replace the item, otherwise the Town will remove the item.

The Town reserves the right to move or remove a memorial item.

BRB is allowing RUSSELL's Employees, Jim Barningham and Kim Halvorson to enter the BRB facility after regularly scheduled hours.
