BE IT FURTHER RESOLVED thut the Board directs TCC to pursue these claims to confirm the jurisdictional boundaries, taxation, und powers of the tribal government of \he Yukon Flats.

BE IT FURTHER RESOLVED that the 1002 area of the Arctic National Wildlife Refuge be made Wilderness to achieve this end; and ~

PROTECT PORCUPINE CARIBOU HERD. ITS ECOSYSTEM AND THE GWICH'IN WAY OF LIFE

WHEREAS, for thousands of years the Gwich 'in Athabascan Indians of northeast Alaska and northv.,est Canada have relied on caribou for subsistence and continue todav to subsist on the Porcupine Caribou herd, \Vhich is essential to meet the nutritiOnal, cultural and spiritual needs of their people, and;

WHEREAS, the health and prciductivity of the Porcupine Caribou herd and the ecosystem an which it depends, including the purity of the water and other wildlife, are threatened by proposed oil development in the ~aribou calving and post-calving grounds in the Arctic National \Vildlife Refuge - Coastal Plain, and;

WHEREAS, oil development in the calving grounds violate our -culture and endanger the very future of the Gwich'in people, and;

WHEREAS, the Gwich 'in have the inherent right to continue their own way of life; and that this right is recognized and affirmed by civilized nations in Article 1 of both the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights which reads, in part:

"... in no case may a people be deprived of its own means of subsistence."; and

WHEREAS, the entire Gwich'in Nation was called together by their Chiefs in Arctic Village June 5.10, 1988 to carefully address this issue and to seek the advice of the elders, and;

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors urges the U.S. Congress and President to recognize the rights of the Gwitch'in people to continue to live their way of life by prohibiting development in the calving and post•calving grounds of the Porcupine Caribou herd, and;

BE IT FURTHER RESOLVED that the 1002 area of the Arctic National Wildlife Refuge be made Wilderness to achieve this end.

BE IT FURTHER RESOLVED that the Tanana Chiefs Conference Executives take immediate action to inform appropriate committees and members of Congress, as well as the press, of this position; and take other action as needed to aid the Gwich'in in their fight.

WHEREAS, airplane hunting has led to abuses against wildlife in the Yukon Flats; and

WHEREAS, these abuses violate Native cultural values and give subsistence hunting and trnpping: a bad name; and

WHEREAS, anti-hunting and trapping groups use these abuses to further their case against subsistence hunting and trapping.

A RESOLUTION FOR TCC TO CONDUCT A FEASIBILITY STUDY TOWARDS ESTABLISHING A TRIBAL COURT SYSTEM \\1THIN THE YUKON FLATS SUBREGION

WHEREAS, the need for a viable and workable Tribal Court system is of the highest importance. and

WHEREAS, most of the villages do not receive law enforcement on a timely basis from the State; and

WHEREAS, the need for enforcement of the law in areas of alcohol and drug abuse. the Child Welfare Act, Domestic Assault, and local village ordinances is lax or nonexistent in most villages; and

\VHEREAS, the Village Council and TCC must see to finding a solution to these and other srn:inl problems.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs the TCC to conduct a feasibility study towards establishing a triha! court system that wil! include all villages in the Yukon Flats as soon as possible; and

BE IT FURTHER RESOLVED that should all villages ratify this proposal, TCC's Legal Departmeht assist the Chiefs of each village in establishing a Tribal Court system !'or the Yukon Flats.

WHEREAS. the population of the Yukon Flats region is increasing in age; and

WHEREAS, the Elderly of the Yukon Flats region are currently forced to leave relatives and friends to obtain care in facilities far from home; and

\VHEREAS, this causes extreme hardship on the Elderly and their community which thereby looses the benefit of their presenc·e and knowledge.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs the TCC to conduct a survey of the Yukon Flats region to determine the need for an Elder Care Facility.

WHEREAS, the Yukon Flats Health Center is the only health facility whith offers mi.::

WHEREAS, the YFHC does not have an adequate back-up generator for emergency power during a power outage at the YFHC; and

WHEREAS, this may create a life and death situation should a power failure occur.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Dire..:tnrs directs the TCC to make funds available to obtain and install a back up generator at the Yukon Flats Health Center.

WHEREAS, there is a need for a place for them to share their successes and support nn another as a group.

TCC REGION SPRING DUCK HUNT

WHEREAS, the Native people of the TCC Region since time immemorial has depended on the spring duck hunt for food; and

WHEREAS, at a recent meeting of the Interior Fish and Game Advisory Board meeting in Beaver, the residents were notified by the Refuge Manager that there wiH be no more spring duck hunts.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors in assembly support the people of the TCC Region in its sovereign states to continue to hunt ducks and geese in the spring; and

BE IT FURTHER RESOLVED that the TCC Region is Indian Country and management of fish and game within the exterior boundaries of the TCC Region is the responsibility of the Athabascan nation.

WHEREAS, there was introduced in the U.S. Congress by Don Young, an amendment to A...'J\J"CSA to repeal the reversionary clause of the Beaver Airport DOT Patent: and

WHEREAS, the removal of the reversionary clause would be detrimental to tbe people nf Beaver for future village expansion and-access 'to traditional harvesting areas.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby opposes the repeal of the reversionary clause of the Beaver Airpnrt DOT Patent; and

BE IT FURTHER RESOLVED that a letter be sent to the Secretary, who is supposed to protect Indians, and copies to our delegation ill protest of this act of further taking away of freedom from the Indians.

BEA VER FIRE PROTECTION

WHEREAS. the Beaver Tribal Council is the governing body of the Native Vil!ag('. of Beaver; and

WHEREAS. Beaver is located within the boundaries of the Tanana Chiefs Conference in the Yukon Flats; and

WHEREAS. Beaver Village is without adequate fire protection; and

WHEREAS, there are numerous home fires in the winter and brush fires in the summer.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors support the Beaver Village Council in acquiring firefighting equipment, such as a fire truck, a storage area, and fire extinguishers for homes.

VILLAGE AIRPORT LIGHTS - VENETIE

WHEREAS. the Village of Venetie is increasing. We have five (5) air services which comes in daily except on weekend, also fuel plane comes twice a month for our school and village fuel; and

WHEREAS, we have longest periods of darkness during winter, sometimes we have emergency charter at night, when this happens we use snow-machine lighls or cloth diesel to burn; and

WHEREAS, the only transportation is by air. We eagerly in need of lights on our air strip, due to nighttime emergency or aircraft accident.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs TCC to seek federal funding for airport upgrading to install lights and maintenance money for the Venetie Airport.

TOK SUBREGION ELDERS HOME

WHEREAS, the Upper Tanana villages of Dot L_ake, Tanacross, Tetlin. N"orthway, E:igk. and Mentasta do not have an Elders' Home located within its region: and

WHEREAS, the nearest Elders' Home is located within Fairbanks which is between lri0- 250 miles from our villages; and

WHEREAS, the elders are saddened by having to move so far away from family and friends to obtain professional care; and

WHEREAS. the town of Tok is an ideal central location since it is located within a !"il"l\ mile radius of the majority of our villages; and

WHEREAS, Tok has other beneficial facilities to assist the elders, which supports its ideal location for a home; and

WHEREAS, a Elders' Home in Tok would allow family and friends to visit more frequently; and

·~. WHEREAS, our elders, whom we love and respect, should be able to receive professional care when needed, without having to move hundreds of miles from their home and village; and

WHEREAS. resolutions submitted from villages in the past years have surport~d putting an Elders' Home within the subregions of our state; and

WHEREAS. our villages do not have the resources or funds to pursue such a project

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs administration to work with the Upper Tanana Development Corporation (Tok), United Crow Band (Tok), the Upper Tanana Village Councils and any other organizations to plan and set up the most timely and efficient way to make an Elders Home in Tok possible; and

BE IT FURTHER RESOLVED that all the above named organizations contact our district legislatures by correspondence to support and request funding for the Tok Subregion Elders Center; and

BE IT FURTHER RESOLVED that additional funding be also sought through and available sti1tc of federal grants that pertain to this subject area.

WHEREAS, the City of Nulato received legislative grants in the amounts of$ l.OUO.(H)li and $1,200,000 during 1983 and 1986, respectively; and

WHEREAS, these monies were utilized to complete Phase I. Feasibility Study and PrnJ1._'ct Design of a three-Phase water/sewer system; and

WHEREAS, these monies were utilized to partiat!y complete Phase II, Construction 1J( ( he Sewer System; and

WHEREAS, Phase III, Construction of a Water System has not been initiated; and

WHEREAS, legislative funds have been denied the City of Nulato since 1987; and

WHEREAS, completion of Phase II and III has been on hold since 1987; and

WHEREAS, there is not a single home in Nulato connected to and benefiting from :1 water/sewer system; and

WHEREAS, every home in Nulato still uses a water haul and honey bucket disros:il -~~-- system: and

WHEREAS, a water/sewer system is one of the greatest contributing factor of a healthy home environment.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of DireCLors supports the continuation and completion of a water/sewer system in Nulato, Alaska, and directs TCC to seek federal funding to complete Phases II & rn of the Nulato water/sewer system.

WHEREAS, the preventive health care services needs, such as immunizations for chiidrcn. tuberculosis screening, prenatal screening, family planning and health promotion and education are not being met; and

WHEREAS, the communities within the Yukon-Koyukuk Subregion are desirous nr having these services accessible and available.

WHEREAS, the villages have a clear expectation and understanding of the role of those social services employees; and

WHEREAS, a!l but one position has been vacant since 1990 and they are as yet unfilled.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directms urges the Alaska Division of Family & Youth Services to retain nm\ residentially fill all Galena-based Soc_ial Services positions as soon as possible.

WHEREAS, the McGrath Native Village Council is recognized as a governing entity to receive funds assigned to Alaska Natives and American Indians by the L).S. Department and Urban Development; and

WHEREAS, the 1980 Census count for McGrath was 355 as compared to the 1990 city count of 533, and new members are enrolled ta the MNVC as per lhc Constitution and Bylaw; and

WHEREAS, the new members of the MNVC and others are in dire need of homes to help stabilize their living conditions due to the high cost of paying rent and

WHEREAS, the McGrath Native Village Council requests enough funds to build 10 new HUD Housing units and eight Elders units.

WHEREAS, subsistence salmon also need to be enhanced, because subsistence fishing on the Innoko River always have been poor or marginal at best. ~

WHEREAS, the State Fish and Game regulations no longer have a rural subsistence priority and the federal regulations have a rural subsistence priority; and

WHEREAS, subsection 304(f) of ANILCA allows ANCSA corporations to enter int[) agreements which can shift ANCSA lands to be subject to the federal regulations.

EQUALIZATION OF COMMERCIAL ALLOCATIONS AND SUSTAINED YIELD

WHEREAS, commercial fishing on the Yukon River and related fisheries is controlled hv limited entry commercial fisheries, and allo'cation between these fisheries i:~ grossly unequal; and

WHEREAS, the State of Alaska has failed to manage these fisheries on a sustained yield basis as required by law resulting in declines in Yukon River salmon population; and

WHEREAS, the Board of Fisheries has historically failed lo address these problems and is resulting in institutional economic hardship on the TCC region.

~OW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board o[ Directors directs staff to bring suit against the State of Alaska to force the State Board of Fisheries to equalize allocations of commercial fish harvest between the Yukon and Kuskokwim Rivers and area in Cape Fisheries and to set total harvestable allocations based upon sustained yield.

WHEREAS, Child Support enforcement regulations are creating financial hardships: are resulting in liens against Native allotments and corporate srock: ::ire preventing parents from applying for AFDC and other programs for children truly in need; and

WHEREAS, a lack of access to legal representation creates an artificial appearnnce that parents with resources are failing to support their children when actually parents lack the resources to make child support payments but cannot afford an attorney to have court-ordered child support reduced; and

WHEREAS, if a custodial parent applies for AFDC, the money received is then billed against the non-custodial parent and becomes a lien against any money ht.! or she subsequently earns and against any property he o.r she owns: and

WHEREAS, interest is charged and compounded resulting in huge amounts owed: and

WHEREAS, this situation hurts children of existing families.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs TCC staff to use all means at its disposal to change current child support regulations and enforcement actions to alleviate problems that arl; affecting a disproportionate number of village families who have scant access to cash economies.

WHEREAS, it has been the practice of the Fairbanks State Court system to release village people charged, but not convicted of domestic violence with a stipulation that they cannot return to their village until their trial date, which is often a period of two to three weeks; and

WHEREAS, this practice is discrimination in fact against Native people; and

WHEREAS, the practice causes great harm to relationships as well as tn the indiYidual charged and is, in fact, a punishment to the individual even beforl.! the individual has been found guilty or innocent.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Din:ctors direct Tanana Chiefs Conference staff to work to protect the civil rights of village people who are being harmed by discriminating court procedures.

WHEREAS. by the end of this year, 47% of all Natives will be those referred to as "m-:w Natives; and

WHEREAS, most of today's youth are denied the benefits of membership in village and regional Native corporations: and

WHEREAS, as the Native population progresses, the youth are becoming more well voiced on issues that effect them and have a lot to offer in terms of leadership; and

WHEREAS, all Natives have a right to be a part of ANCSA, regardless of their date of birth; and

WHEREAS, The issuance of stock to new Natives will conjure up stronger unity within our Native society.

WHEREAS, most Village Councils do not have an economic base which is needed in order to provide the required services to their tribal members; and

WHEREAS, a governing body requires a !and base in order to establish an economic base: and

WHEREAS, the language of any culture is essential to the continued strength of that culture: and ~

WHEREAS, the number of people to whom the Athabascan language is their first language is dwindling and the number of people who understand but do not speak the language are mostly in their late 40's; and

WHEREAS, we are soon to have two generations who neither speak nor understand the Athabascanlanguage;and

WHEREAS, unless this is quickly reversed, the language will no longer' be a living language.

:'fOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs TCC staff to work with Alaska State legislators to make the teaching of Alaska Native Languages mandatory in all Alaska Public School systems whose enrollment is primarily Alaska Native.

WHEREAS, a large number of parents in the Interior are voluntarily sending thdr children to Mt. Edgecumbe, which, although it is geographically distant from the Interior, it has proven to be an academically superior educational facility: and

WHEREAS, the Native people of the TCC region feel strongly that there should be viable alternative educational programs created for Interior Native students that takes into account the vast distance children must cover in order Jo attend Mt. Edgecumbe, the only alternative high school open for Native students.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors strongly support plans to develop an Interior campus regionally based high school boarding program which offer a greater offering of Vocational Education classes, and maintains the same high academic standards as Mt. Edgecumbe. This campus should be built to accommodate 100 to 150 rural students and located in the Shageluk area.

WHEREAS, the Chief Andrew Isaac Health Center was initiaUy constructed hy the Fairbanks Memorial Hospital in 1971 under a twenty year agreement with the Indian Health Services, and expanded in 1978; and

WHEREAS, the agreements between Indian Health Service and the Fairbanks ).fcmmial Hospital for CA.lHC expire in 1993; and

WHEREAS, the size of the current health center is no longer adequate to meet the increased medical services needs of the increasing Native population of the Tanana Chiefs region; and

WHEREAS, the Tanana Chiefs Conference and the Fairbanks Memorial Hospital ha\'lc: developed a proposal to expand the Chief Andrew Isaac Health Center to 38.000 square feet to meet the health services needs for the next twenty year period.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors urges the lndian Health Service and the United States Congress to proceed with obtaining the agreements and financing necessary to replace and expand the Chief Andrew Isaac Health Center in Fairbanks by 1993.

WHEREAS, the prevention of cancer among Alaska Natives in the TCC region is a high priority of the TCC Health program, the Indian Health St':rvice, and the State of Alaska; and

WHEREAS, the prevention and early detection of breast cancer is of significant concern, as nationally one woman out of ten \\ill develop breast cancer in their lifetime; and

WHEREAS, the availability of mammogram screening services ts the most important element in the detection and treatment process; and

WHEREAS, the Alaska State Legislature is considering House Bill 45, which addresses increased coverage by insurance and medical assistance for mammogrnm services; and

WHEREAS, the Tanana Chiefs Conference recognizes that HB 45 will result in improved access to bteast cancer detection services statewide.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby urges the Alaska State Legislature to enact House Bill 45, to extend insurance and medical assistance coverage for mammograms for breast cnncer detection.

SUPPORTING REPLACEMENT OF THE ALASKA NATIVE MEDICAL CENTER IN ANCHORAGE

WHEREAS, the Alaska Native Medical Center in Anchorage serves as a referr::il hospital for all Alaska Native in Alaska; and

WHEREAS, the Alaska Native Medical Center is an aging facility that is not sufficient to meet state-of-the-art standards of modern medical care, and is at risk f{)r serious damage in the event of another large earthquake in Anchorage: and

WHEREAS, in conjunction with the Alaska Native Health Board and other N".itive organizations, the Alaska Area Native Health Service has acquired the land and utilities to construct a new Alaska Native Medical Center:·and

WHEREAS, the project is ready for the final design and construction to proceed; and

WHEREAS, the project will require a total of $150 million in Federal appropriations over the next four years.

:'iOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby supports the replacement of the Alaska Native Medical Center . .i.nd urges the United States Congress to provide the $27 million appropriat"ion necessary in Fiscal Year 1992 to initiate the construction project.

ESTABLISH AN ALASKA PHYSICIAN ASSISTANT TRAINING PROGRAM

WHEREAS, the role of the physician assistant has increased in providing health services to residents of rural Alaska over the past ten years; and

WHEREAS, the Tanana Chiefs Conference, fnc. desires to provide for an im:n::iscd number of Alaska Natives trained as physician assistants over the next ten years; and

WHEREAS. at present the only accredited training programs for physician assistants are located outside of the State of Alaska; and

WHEREAS, there is adequate documentation of the viability of starting an .Alaska-based physician assistant training program in Anchorage.

'.\'OW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby supports the establishment of a physician assistant training program based in Alaska, and urges the State of Alaska and Alaska academic institutions to cooperate in the creation of such a program.

WHEREAS. health care for Indian people is an entitlement through the trust ohligations assumed by the federal government in its dealings with Indian Tribes; and

WHEREAS, Indian people are entitled to health care without regard to their personal. individual, financial status; and

WHEREAS, Contract Health funds require that Indian people sign up for Medicaid and other social welfare programs that are demeaning to individual Indian people; and

WHEREAS. AANHS has recently issued a directive addressing the individual financial of Alaska Natives with the implication that personal funds should be used in place of services provided by Indian Health Service; and

WHEREAS. this directive would alter the trust relationship between the rcdernl go_vernment and Indian tribes.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs the Alaska Area Native Health Service to rescind its directive and to omit any reference to personal resources of indlvidual Alaska Natives: ond

BE IT FURTHER RESOLVED that TCC Board of Directors directs TCC administration to vigorously work to change the congressional requirement that forces Indian people to sign up for social welfare programs such as Medicaid to get bask medical care services through Contract Health Care funding and to continue to assert the right of Indian people to health care as a result of the trust relationship between the federal government and Indian people.

OUTREACH FOR VILLAGE ELDERS

WHEREAS, Elderly people from villages are often referred to Fairbanks for specialized medical care and outpatient procedures; and

WHEREAS, many village elders feel unsure or uneasy about the transportation, the location of physician's office; the time of appointments and in genera! getting from place to place; and

WHEREAS, there is no system in place to meet the planes of village elders and escort them to appointments which means that volunteers have to be found to travel with elders from their villages and to stay with them while they are receiving outpatient care; and it is often very difficult to find anyone to act as an escort.

\!OW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors directs TCC administration to put into place a system of outreach workers to meet village elders at the airport and to escort them to the appointments and to assist them with their stay in Fairbanks in whatever way is required.

WHEREAS, the health system in most villages is already at a critical level that seriously impacts the health and well-being of rural people.

COMMISSION TO ELIMINATE ALCOHOL, TOBACCO AND ILLEGAL DRUGS

WHEREAS, our Athabascan people have survived through the greatest of adversities throughout history; and

WHEREAS. our Native people have proven strong endurance to overcome the worst of problems; and

WHEREAS, it is proven that Drug Abuse and their related problems is destroying our peop!e and our heritage; and

WHEREAS, statistics show that amongst the Alaska Natives:

1. There are increasing drug arrests and incarcerations.

2. Recent study of Alaska Native suicides said the rate among young, single men is more than twice the average for the same group nationwide.

3. Director of community health services for Alaska Area Health Service states that we are vulnerable to depression and substance abuse.

4. Accidental deaths are five times the U.S. rate, with increased violence, and traffic deaths.

NOW THEREFORE BE IT RESOLVED that our Native leaders. Native Organizations, Administrations and individuals take all steps necessary to eliminate illegal drug abuse, and

BE IT FURTHER RESOLVED that with the combined efforts of the Tanana Chiefs Conference, Fairbanks Native Association, Doyon, Ltd., villages and individuals, in order to stamp out the most critical problem of drug abuse, do hereby form an AREAWIDE COMMISSION with the goal to eliminate alcohol, tobacco and illegal drugs in our region.

TRIBAL AUTHORITY

WHEREAS, the governing bodies of the other sovereign Native villages and tribes in that part of the Interior of Alaska, known as the Doyon region; chartered and formed an Indian organization under the corporate rules of the State of Alaska called Tanana Chiefs Conference, Inc., for the purpose of contracting under the provisions of P.L. 93-638 and acting as a vehicle for the consolidated provision of health and social services for the Alaska Native members of the Native Villages and Tribes in the region; and

WHEREAS. TCC is neither an Indian Tribe nor is it the duly elected governing body of a '.\'ntive village or an Indian Tribe; and

WHEREAS. TCC and various employees of TCC have at certain times and on certain documents represented that TCC is an Indian Tribe in an illegal assumption of tribal authority.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directdrs and their employees cease every and all actions that directly or indirectly represent that TCC is an Indian tribe or an authorized tribal governing body.

WHEREAS, Tanana Chiefs Conference, Inc. is an Indian organization chartered by a group of tribes through the authorities of their duly elected trihal governments for the primary purpose of consolidating services fur those tribes under the provisions of P.L. 93-638 and various other federal and state acts; and

WHEREAS. the authority contract on behalf of member tribes derives from those trihcs and does not exit independently of that delegared to Tanana Chiels Conference by those tribes; and

WHEREAS, Tanana Chiefs Conference staff have ignored tribal resolutions against various contract proposals and have attempted to circumvent the Self­ Determination Act process by pursuing said contracts through other than P.L. 93-638 contracting authority.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors reaffirms the authority of member tribes and directs administration and staff not to pursue contracts for services to tribes unless those tribes specifically delegate such authority to Tanana Chiefs Conference, Inc.; and

BE IT FURTHER RESOLVED that federal acts such as the BUY INDIAN ACT shall not be used by Tanana Chiefs Conference, Inc. for the purpose of circumventing the authority of member tribes.

WHEREAS. the TCC has for several years declared war on alcohol and drug atiuse in the region; and

WHEREAS, some Alaska Native organizations have recently prohibited any use of akohtil or drugs by any employee on travel status; and

WHEREAS. such a policy within the TCC would strengthen the efforts on the war on drugs and alcohol.

WHEREAS. youth delegates, along with those participants sponsored by their respective organizations, of the Tanana Chiefs Youth Convention, need exposure to the resolution process; and

WHEREAS, an extra day of orientation would allow direct participation in the decision making process, giving youth the opportunity to practice parliamcnt:1ry procedure; and

WHEREAS, though the current youth convention includes observance of Tanana Chiefs in action, an extra day of orientation would enable the youth to reach the goal or accomplishing more through working together. The youth would feel mors..: part of the convention; and

WHEREAS, the preparation of joint youth resolutions would voice the concerns and views of all youth participants.

WHEREAS, the_ Interior Education Council (IEC) met in a regularly scheduled meeting in Fairbanks. on January 24, 1991; and

WHEREAS. the members of the IEC discussed indepth the importance of specific proposals that may require legislative consideration in the current session; and

WHEREAS. five legislative proposals were subsequently selected and then prioritized by the IEC members in the foilowing order of importance and need:

1. Interior Campus FY'1992 Increments (1-4), 2. Interior Economic and Education Development Resource Center, 3. Athabascan Language Center/Tok 4. Vocational Education/Coordinator, 5. Developmenta! Tuition.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors request support and technical assistance from the staff of the TCC and the Interior Campus to ensure that al! possible efforts are made to have these legislative proposals written and monitored; and

BE IT FURTHER RESOLVED that the Tanana Chiefs Conference requests support on the five legislative proposals from the Rural College Council of the College of Rural Alaska.

SEWAGE DISPOSAL SYSTEM. BIRCH CREEK

WHEREAS, the Birch Creek Village Council is the governing body of Birch Creek Village; and

WHEREAS, the Birch Creek Village Council has notified Tanana Chiefs in the past about the village's problems with its landfill and sewage disposal systems; and

WHEREAS, Birch Creek Village often experiences flooding of its landfill which causes pollution of the surrounding area and to the Birch Creek River; and

WHEREAS, future flooding of the landfill could ruin the landfill entirely and cause major pollution; and

WHEREAS, Birch Creek Village has no adequate sewage disposal system to service for either the village's school or village residents.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby support funding to replace the landfill and install a sewage lagoon at Birch Creek Village as soon as possible; and

,-~- BE IT FURTIIER RESOLVED that the Tanana Chiefs Conference staff make every effort to remedy these problems.

WHEREAS, lhe Alaska National Inte_rest Lands Conservation Act provides for a rural subsistence priority for fish and wildlife resources; and

WHEREAS. the rural subsistence priority is necessary to continue the way of life of the Alaska Native people of the TCC region.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors hereby declares it to be the policy of Tanana Chiefs Conference, Inc to oppose any amendment to Title VIII of ANILCA

REAPPORTIONMENT BOARD

WHEREAS, the Alaska State Legislature is being reapportioned based upon the 1990 Census; and

WHEREAS, the predominant culture and linguistic character of the Tanana Chiefs Conference region is Alaska Native; and

WHEREAS, the Reapportionment Board has many options available to the representation of Alaska Native voters in the district; and

WHEREAS. the Federal Voters Rights Act prohibits the dilution of minority voting strength in State Legislative apportionment; and

WHEREAS, in the past, Legislative Districts within the TCC region have reflected Native voting strength.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors calls upon the Reapportionment Board to draw Legislative District lines to reflect the cultural and linguistic character of the Tanana Chiefs Conference regions and avoid dilution of Native voting strength within the region; and

BE IT FURTHER RESOLVED that the Board of Directors directs the Administration to take all necessary action to implement this resolution.

INVESTIGATION OF RURAL FUEL RETAILERS

WHEREAS, it is believed that the price of petroleum in the State of Alaska is extreme\v overpriced; and ·

WHEREAS, in the view of the facts that:

a. Crude oil is obtained in Alaska. b. Crude delivery costs in Alaska are obviously the lowest in the nation. c. Alaska State Motor Fuel Tax is among the lowest in the USA; and

WHEREAS, M.A.PCO, TESORO, and PETROSTAR produce petroleum products for the Alaska market: and

WHEREAS. because of their excessive and monopolistic prices the people of Alaska are paying the highest price for petroleum products in the USA and this is bringing a hardship upon many Alaskans.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors support the petition calling for the Attorney General's Office to investigate the pricing of motor fuel and heating oil sold in the State of Alaska.

NOW THEREFORE BE IT RESOLVED that the Tanana Chiefs Conference Board of Directors requests the TCC to obtain funds to operate the Subsistence Task Force.
