Statement from the Chair Hon Speaker made the following statement to the House - “Honourable Members, allow me to begin by congratulating the team that presided over the last sitting on 26th November. Let me announce them by their titles and perhaps you may find a little humour to prevail for just a short while. Firstly, the Deputy Speaker, the Honourable Dominic Tabuna, Member for Yaren, sat in this very Chair. On a serious note, I think this is a milestone achievement in itself, saying to us all, the parliament is functioning with improved efficiency and going all out to improve in the other aspects of its Parliamentary work.     REPUBLIC OF NAURU Government Information Office MEDIA RELEASE For Immediate Release 1 November, 2010 Nauru Parliamentary deadlock ends Nauru’s 20 th Parliament is at last up and running following the election of a new Speaker and the re-election of Marcus Stephen as President. The breakthrough brings to an end the deadlock which has plagued the parliament of Nauru since early in the year when three former government members sided with the Opposition and attempted a no-confidence motion against the Stephen government. Two general elections followed, - in April and June - with both resulting in equal numbers on both sides being returned. The government has functioned under State of Emergency provisions since June 11. This morning, the “grandfather” and 30-year veteran of the parliament, former president Ludwig Scotty accepted the sole nomination for the Speaker’s position having been nominated by Marcus Stephen and seconded by Opposition member Godfrey Thoma. The new Speaker took the early opportunity to encourage all Members to work together for the benefit of Nauru, pointing out that the disruptions of the past months have not been productive for the country, its people or the House. He encouraged his colleagues to talk about issues and resolve them in parliament rather than lash out in the media or turn to the Courts to resolve issues. The Supreme Court two weeks ago ruled in favour of the President and his government after a challenge had been mounted which questioned the legality of the State of Emergency and the various Orders issued by the President. Mr Scotty said this had produced bad publicity for Nauru and had cost a great deal of money for lawyers for a Court ruling that still left some Members dissatisfied.

A quorum not being present, the Hon Godfrey Thoma (Speaker of Parliament) adjourned the House until Thursday 9 May 2013 at 10.00am after making the following statement: First of all I would like to convey a message to the public regarding statements I have delivered through this House since I took up the chair; you can obtain hardcopies from the Clerk. Secondly, for those who would like to see me personally for matters that are not clear please put your request in writing to the Clerk so that we can arrange a time and date for an appointment. I would also like to summarise the sittings since the second dissolution letter from the President was received. You are aware that the first dissolution letter was withdrawn and a second letter was issued. On Monday 15th April, Speaker received a letter by hand from the President to dissolve the 20th Parliament. On the 16th April Parliament sat but due to no quorum there was no meeting. On the 18th April Parliament was reconvened and former Speaker, Hon. Ludwig Scotty, read the letter of advice to dissolve the House and then resigned. Henceforth the Deputy Speaker, Hon Landon Deireragea, took the chair for nomination of a new Speaker. On Tuesday 23rd April there was no nomination for a new Speaker.

The House met at 10:30am in accordance to its resolution made on Tuesday 20th December, 2011. 2. Hon. Ludwig Scotty M.P., Speaker of Parliament took the Chair and read Prayers. 3. Statement from the Chair The Chair made a statement to the House which read as follows: “Honourable Members, You will have noticed that we have lost one from amongst us in this august House who had always sat with dignity and pride at the centre point of the Clerk’s table in front of me. I am sure you will join me in noting with sadness the untimely passing of our long time Clerk of Parliament, Frederick Valentine Cain who was better known as Freddy or Fred to those close around him. He was given the nickname of ‘ngait ibaka’ by the first Clerk of Parliament the late Patrick Cook of which title Fred had been very fond of and of which he was playfully called by his jolly friends. Fred was also known as ‘hopalong’ to his family of which I was led to believe was due to the famous exploits of the film idol, Hopalong Cassidy. Freddy Cain had joined the Nauru Parliament in 1977 and had served up to the position of full Clerk, for a combined total of 34 years and 5 months, non- stop, until the day he passed away in Brisbane on the 23rd of January of this year.

    Votes and Proceedings of the 20th Parliament No 38 Tenth sitting of the Twentieth meeting 16 May 2013 10.00am 1 Meeting of House A quorum not being present, Hon Godfrey Thoma (Speaker of Parliament), read prayers and then read out a letter from the Speaker to the President dated 16 May 2013: Your Excellency It has become apparent that you no longer intend to proceed with the proposed constitutional reference to the Supreme Court under Article 55. This is a great disappointment, because the current position of Parliament cannot be resolved until Parliament achieves a quorum, and the Court’s answers to the questions you were going to pose in your constitutional reference may have helped to achieve that. I would therefore respectfully urge you to reconsider your position and also to be honest about your intentions. If you no longer intend to proceed with the constitutional reference, then you should publicly withdraw your publicised promise to do so. If it is also your intention to continue to not turn up to Parliament sittings, then you should also withdraw your advice to dissolve Parliament, given that the dissolution cannot occur due to the absence of you and 8 other members from Parliament sittings. Alternatively, you should bring this impasse to an end by turning up to Parliament with your Cabinet colleagues so that debate can finally proceed and the dissolution can finally occur. If quorum is obtained when the Parliament sitting resumes this afternoon, and debate on your advice to dissolve proceeds, then Parliament would be dissolved next Thursday, 23 May, and the general election could be held 4 weeks later on 22 June.
