Call to The regular meeting of the Sussex County Council was held Order on Tuesday, June 6, 1972, at 10:00 a.m., with the follow­ ing members present:

The meeting was opened with the Pledge of Allegiance and the repeating of the Lord's Prayer.

Nanticoke The Council stated that the County will not assume any River cost or accept any responsibility for damage to property through the spoil disposal being pumped on land owners when the Nanticoke River is dredged.

Frankford­ The Council agreed on the date scheduled for a public Dagsboro hearing regarding the proposed Frankford-Dagsboro Sanitary W/S Public Sewer System-June 28, 1972, 8:00 p.m. at the Indian River , Hearing High School.

Long Neck Mr. Henry's office was given permission to proceed with Sewer the preparation of a contract for Phase II of the pro­ posed Long Neck Sewage Facilities. M 189 72 Airport Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to authorize Mr. Henry, County Engineer, to adver­ tise for bids for the paving of the Sussex County Airport fueling area. M 190 72 Airpark Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously Phase II carried to authorize Delaware Associated Engineers to proceed with final design and specifications for Phase II of the Sussex County Industrial Airpark.

Fire Call Walt Sherwin, Civil Defense Director gave the Fire Call Report Report for the month of May and is as follows:

This money will be reimbursed. M 192 72 Holiday Motion by Mr. Briggs, se c onded by Mr. Chandler, unanimously carried thBt July 3rd and 4th be considered a holiday and that the Sussex County Courthouse be closed on both days.

C/U #63-An application from Cozy Cove, Inc. to consider the Conditional Use of land in· an AR District in accord­ ance with Article 10, Section 2, Paragraph 24 for a mobile home park in Indian River Hundred on the north side of Rte. 22, west of Massey's Landing, a tract of land known as the "Warrington Farm" and containing 135 acres.

The decision on this application was reserved by the Council until a recommendation is made by the Planning and Zoning Commission.

C/U #64-An application from Jennings E. Williams to con­ sider the Conditional Use of land in an AR District in accordance with Article 10, Section 2, Paragraph 26 for a cabinet shop and material storage in Broad Creek Hundred on the northwest side of Rte. 28, 2.2 miles northeast of Rte. 13 and containing 1.75 acres, more or less.

M 201 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the Planning and Zoning Commission and grant approval of this application.

M 202 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried that an extension be granted for a Conditional Use permit on Fowles Delight Trailer Park with the stip­ ulation that the plot plan be submitted to the Planning and Zoning Commission within 60 days and work started within 90 days of the approval of these plans and the project be completed within 12 months of the starting date.
