SUSSEX COUNTY COUNCIL-GEORGETOWN,DELAWARE-J1JNE 6, 1972 Call to The regular meeting of the Sussex County Council was held Order on Tuesday, June 6, 1972, at 10:00 a.m., with the follow ing members present: Richard L. Timmons, President William B. Chandler, Jr., Vice President John L. Briggs, Councilman The meeting was opened with the Pledge of Allegiance and the repeating of the Lord's Prayer. Richard Haarde Bay View Park 1 year term Nanticoke The Council stated that the County will not assume any River cost or accept any responsibility for damage to property through the spoil disposal being pumped on land owners when the Nanticoke River is dredged. Frankford The Council agreed on the date scheduled for a public Dagsboro hearing regarding the proposed Frankford-Dagsboro Sanitary W/S Public Sewer System-June 28, 1972, 8:00 p.m. at the Indian River , Hearing High School. ( 79) June 6, 1972 Page 3 Long Neck Mr. Henry's office was given permission to proceed with Sewer the preparation of a contract for Phase II of the pro posed Long Neck Sewage Facilities. M 189 72 Airport Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to authorize Mr. Henry, County Engineer, to adver tise for bids for the paving of the Sussex County Airport fueling area. M 190 72 Airpark Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously Phase II carried to authorize Delaware Associated Engineers to proceed with final design and specifications for Phase II of the Sussex County Industrial Airpark. Fire Call Walt Sherwin, Civil Defense Director gave the Fire Call Report Report for the month of May and is as follows: Fires 71 Wash Down 1 Ambulance 305 Fire Marshall 57 Rescue 7 Miscellaneous 87 Red Cross 7 Control Help Line Burning 21 Total 561 M 191 72 Civil Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously Defens e carried to authorize the Director of Finance to issue a check in the amount of $232.36, payable to Preston Truck- ~ ing Company to cover freightcharges for three generators for Civil Defense use. This money will be reimbursed. M 192 72 Holiday Motion by Mr. Briggs, se c onded by Mr. Chandler, unanimously carried thBt July 3rd and 4th be considered a holiday and that the Sussex County Courthouse be closed on both days. M 193 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimosuly carried that the Council recess for lunch. The Council reconvened at 1:15 p.m. PUBLIC HEARINGS C/Z #71 -From AR to C-1 in Broad Creek Hundred, being lands of Horace Jones. M 194 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. (80) June 6, 1972 Page 4 C/Z #72-An application to amend the zoning map by chang ing from AR to MR in Dagsboro Hundred, on the south side of Rte. 336A, west side of Rte. 336, northeast of the Town of Dagsboro and including Vernon Timmons Develop ment, and other lands of Vernon Timmons containing 35 acres more or less. M 195 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of thePlanning and Zoning Commission and grant approval of this application. C/Z #73-An application to amend the zoning map by chang ing from AR to C-1 in Indian River Hundred, being lots 25, 30, 35, 36, 43, 44, 45, 46, 55, 56, 57, 58, 67, 68, 69 and 70 of Bookhammer's Addition to Oak Orchard being lands of Eugene Bookhammer. M 196 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. C/Z #74-An application to amend the zoning map by chang ing from AR to MR in Indian River Hundred, on the east side of RTe. 285, north and east of Rte. 286 being lands of Salvatore J. Gallo and containing 97.250 acres. M 197 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of Planning and Zoning Commission and grant approval of this application. C/Z #75-An application to amend the zoning map by changing from AR to C-1 in Indian River Hundred on the north side of RTe. 277A north of Rte. 279, being land of Thaddeus E. and Janet E. Nowakowski and containing 5.6 acres more or less. M 198 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of Planning and Zoning Commission and grant approval of this application. (81) June 6, 1972 Page 5 C/U #61-An application from Trustees of Sussex Chapter No. 7, Order of the Eastern Star to consider the Con ditional Use of land in an AR District in accordance with Article 10, Section 2, Paragraph 16 for an East ern Star Lodge Hall located in Seaford Hundred, on the east side of Pine Street, Extended, 200 feet north of Road 20. M 199 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. C/U #62-An application from George Knox to consider the Conditional Use of land in an MR District in accordance with Article 10, Section 2, Paragraph 26 for a beauty shop in Baltimore Hundred on the east side of Rte. 14 south of Bethany Beach on lands of Summer, Place Motel. M 200 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. Vote by roll call: Mr. Briggs, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea. C/U #63-An application from Cozy Cove, Inc. to consider the Conditional Use of land in· an AR District in accord ance with Article 10, Section 2, Paragraph 24 for a mobile home park in Indian River Hundred on the north side of Rte. 22, west of Massey's Landing, a tract of land known as the "Warrington Farm" and containing 135 acres. The decision on this application was reserved by the Council until a recommendation is made by the Planning and Zoning Commission. C/U #64-An application from Jennings E. Williams to con sider the Conditional Use of land in an AR District in accordance with Article 10, Section 2, Paragraph 26 for a cabinet shop and material storage in Broad Creek Hundred on the northwest side of Rte. 28, 2.2 miles northeast of Rte. 13 and containing 1.75 acres, more or less.
