We are forced to play watch- dog at both the local and state levels. As the current president of the WSGVAR, I along with Tom Berge Jr, the legislative chairman recently spoke at the Monterey Park City Council meeting where the City Council is to be commended for their vote to eliminate the Residential Property Report (RPR). The RPR is a city inspection that is required when a home is being sold. The city found that the benefit was minimal while the cost to the property owners was substantial and increased red tape and frequently delayed the close of escrow, some- times causing a buyer to lose a mortgage rate lock. I recently sold a property in Monterey Park in which there were no permits on record at City Hall for the origi- nal construction. The home was built in 1908, preceding the city’s incorporation. Fortunately, the county had suf- ficient evidence of the structure, but the burden of proof fell entirely on the seller. Of the homes I have sold in Monterey Park, sellers spent between $2,500 and $5,500 to comply with the city’s requirements. Some sellers have had to spend more than $15,000 to comply, often on homes where the buyer intends to re- model or even rebuild. The two most outrageous com- plaints I have heard were 1. The city made a seller re- move an addition because they had no record of it being built, only to have the sellers later find the permits; 2. The city’s requirement of the seller to make extensive re- pairs on items that had passed the city’s inspection when the seller had purchased the home. In Sacramento, a legislative session doesn’t pass with- out numerous bills that affect property owners. Recently CAR was successful in blocking an attempt to overturn the “Cost-Hawkins law” which exempts newer construc- tion from rent control. In addition, CAR defeated a docu- ment transfer tax that would have cost buyers and sellers an average of $225 per sale. The anticipated fight in Sacramento for 2014 is whether to change Prop 13. Long considered untouch- able, the dynamics of the super majorities in both the Assembly and the Senate have many REALTORS© con- cerned. We’ll keep fighting, and I’ll keep you posted.
