(See end of Document for details) Legislation (Wales) Act 2019 2019 anaw 4 PART 4 GENERAL 41 Consequential amendments and repeals Schedule 2 contains consequential amendments and repeals. 42 Power to make additional provision to give full effect to this Act (1) If the Welsh Ministers consider it necessary or expedient for the purpose of giving full effect to any provision in this Act, or in consequence of any such provision, they may by regulations make— (a) supplementary, incidental or consequential provision; (b) transitory, transitional or saving provision. (2) Regulations under subsection (1) may amend, repeal, revoke or otherwise modify any enactment (including a provision in this Act). 43 Regulations made under this Act (1) A power to make regulations under this Act— (a) is exercisable by statutory instrument; (b) includes power to make different provision for different purposes. (See end of Document for details) Legislation (Wales) Act 2019 2019 anaw 4 PART 2 INTERPRETATION AND OPERATION OF WELSH LEGISLATION Application and effect of Part 3 Legislation to which this Part applies (1) This Part applies to— (a) this Act; (b) [F1Acts of Senedd Cymru] that receive Royal Assent on or after [F21 January 2020]; (c) Welsh subordinate instruments that are made on or after [F31 January 2020]. (2) “Welsh subordinate instrument” means an instrument (whether or not that instrument is a statutory instrument) containing only one or both of the following— (a) subordinate legislation that is made under an [F4Act of Senedd Cymru] or an Assembly Measure, whether by the Welsh Ministers or by any other person; (b) subordinate legislation that— (i) is made under an Act of the Parliament of the United Kingdom or retained direct EU legislation, (ii) is made only by the Welsh Ministers or any other devolved Welsh authority (within the meaning given by section 157A of the Government of Wales Act 2006 (c. 32)), and (iii) applies only in relation to Wales.     LEGISLATIVE CONSENT MEMORANDUM HEALTH AND CARE BILL 1. This legislative consent memorandum is laid under Standing Order (“SO”) 29.2. SO29 prescribes that a legislative consent memorandum must be laid, and a legislative consent motion may be tabled, before Senedd Cymru if a UK Parliamentary Bill makes provision in relation to Wales for any purpose within, or which modifies the legislative competence of Senedd Cymru. 2. The Health and Care Bill (“the Bill”) was introduced in the House of Commons on 6 July 2021. The Bill as introduced can be found at: https://bills.parliament.uk/bills/3022. Policy Objective(s) 3. The UK Government’s stated objective is to enact policies set out in the NHS’s recommendations for legislative reform, following the NHS Long Term Plan, and the White Paper, Integration and Innovation: working together to improve health and social care for all. The UK Government says that the Bill builds on the NHS’s own proposals for reform, aiming to make it less bureaucratic, more accountable, and more integrated, and to incorporate lessons learnt from the pandemic. Summary of the Bill 4. The Bill is sponsored by the Department of Health and Social Care. 5. The key provisions of the Bill cover a number of areas, set out briefly below. a) Addressing of concerns raised by NHS England, such as establishing existing Integrated Care Systems (ICSs) on a statutory footing, formally merging NHS England and NHS Improvement, and making changes to procurement and competition rules relating to health services. The Bill also includes proposals to give the Secretary of State for Health and Social Care powers to direct NHS England and to decide how some other health services are organised.

In accordance with paragraph 8F(1) of Schedule 7 to that Act(2), a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament. Citation, commencement and extent 1.—(1) These Regulations may be cited as the Fertilisers and Ammonium Nitrate Material (Amendment) (EU Exit) Regulations 2021 and come into force on the day after the day on which they are made.     APSE Briefing 21-11 February 2021 Local Government and Elections (Wales) Act 2021 1. Introduction The Local Government and Elections (Wales Act) 2021 received Royal Assent and came into force on 20 January 2021 though many provisions have later commencement dates. This briefing provides a summary of the Act but provides a specific focus on the General Power of Competence. 2. Summary of the main provisions of the Act The Act contains a number of provisions long discussed within Wales, and indeed across local government throughout the UK. Whilst some of the matters reflect existing provisions within England, Scotland and Northern Ireland the new Act encompasses some ‘firsts’ for local government; not least the extension of voting rights to 16 and 17-year-olds. In brief the Act introduces the following: - • Reforms to improve electoral arrangements for local government, which includes extending the vote to 16 and 17-year-olds. It also extends voting rights to foreign citizens who are legally resident in Wales. There are further measures to improve voter registration and a new enabling power for Principal Councils to choose between the ‘first past the post’ voting system or to introduce the ‘single transferable vote’ voting system. • Reforms to increase public participation in local democracy, and improve transparency such access to meeting and online participation • Provision relating to the leadership of principal councils, including encouraging greater diversity amongst executive members and establishing a statutory position of chief executive
