Cotter This Article argues that some recent copyright-infringement cases illustrate how courts sometimes fail to take seriously the needs of religious believers to reproduce and distribute their religion's core texts for pur- poses of their religious practice. More specifically, although the Establishment Clause poses no obstacle to the government's conferral of a copyright "subsidy" upon the authors of religious texts, a variety of copy- right doctrines, including rules relating to authorship, copyright estoppel, and merger, suggest that some otherwise copyrightable religious texts may lack copyright protection due to the religion's attributionof the text to su- pernaturalorigin or to the needs of the faithful to access the precise words of the text. In addition, although the Free Exercise Clause does not require the government to exempt religious believersfrom general compliance with the Copyright Act, the fair-use doctrine should in some instances shield believers from liability, particularly when the copyright owner has sought to use copyright as a tool for suppressing the practice of a breakaway sect. If the law knows no heresy, then copyright law should not serve as a tool for repressing religious dissent. INTRODUCTION When the itinerant tinkerer Johannes Gensfleich Gutenberg intro- duced his moveable-type printing press to Germany sometime in the mid- fifteenth century,' he had little reason to foresee the remote consequences of his invention-notably the Protestant Reformation and the advent of I. Inventors in Korea, China, Japan, and perhaps in other places as well, had discovered a variety of printing techniques long before their appearance in the West. Prior to Gutenberg, however, there is no evidence of the invention of a moveable-type printing press, which enabled the publication of printed material on a much more efficient scale compared to any prior method. See BECHTEL, supra, at 86; KAPR, supra, at 114, 119-20, 132. There is also no conclusive evidence that Gutenberg was influenced by Eastern printing techniques, although some academics have speculated regarding that possibility. The first made possible the mass distribution of books and pamphlets expressing views that dissented from the religious orthodoxy of the day, much to the chagrin of the Roman Catholic Church and, later, of the established Protestant churches. 2 It also made possible the mass distri- bution of vernacular translations of The Bible,3 the laity's reading of which many Catholic leaders at that time discouraged.4 Not surprisingly, both church and state, Catholics and Protestants, frequently reacted by attempt- ing to restrict the dissemination of the dangerous new ideas.5 A second, and not unrelated, effect of the invention of printing was the development of copyright law.6 Prior to the invention of the printing press, authors necessarily relied upon manual copyists to reproduce their works, and this technological limitation had two consequences. First, man- ual copying substantially limited the number of copies that could be made 2.     Ancient and Modern: What the History of Religion Teaches Us About Contemporary Global Trends Philip Jenkins Edwin Erle Sparks Professor of Humanities at Pennsylvania State University Distinguished Senior Fellow at Baylor University’s Institute for Studies of Religion ARDA GUIDING PAPER Ancient and Modern: What the History of Religion Teaches Us About Contemporary Global Trends Religious developments in the contemporary world attract a great deal of scholarship drawing on a wide range of methodologies — ethnographic, economic, and sociological — but the historical component is still not as prominent as it should be. Certainly modern scholars have traced the historical origins of modern conditions, for example in terms of the Christian missions that created the flourishing churches of Africa and Asia, or the contemporary rise of Islamic fundamentalism. Having said this, surprisingly little work on contemporary conditions draws on the vast and flourishing scholarly literature concerning religion in earlier centuries, in the ancient, medieval and early modern worlds. Historians dwell in one academic world while scholars of contemporary religion inhabit another, and the two sides have little contact.1 Yet such a separation is unfortunate, in that the earlier history contains a vast amount of information and case-studies that are highly relevant to contemporary conditions. More important, perhaps, these studies tell us repeatedly that contemporary trends that we believe to be modern and unprecedented are in fact no such thing, and that they have often appeared in earlier eras. It is futile, then, to try and explain these supposed novelties in terms of strictly modern developments. Moreover, contemporary scholarship often describes processes that assume a historical trajectory, but often, the historical pattern is assumed rather than demonstrated.

In a bid to escape exile in Crete, Icarus uses wings made from wax and feathers made by his father, the Athenian master craftsman Daedalus. But the sin of hubris causes him to pay no heed to his father’s warnings. He fl ies too close to the sun, so burning his wings, and falls into the Tsea and drowns. The parable is often used to highlight the perils of pride and the reckless, impulsive behaviour that it fosters. The frontier nature of celebrity culture perpetuates and enlarges narcissistic characteristics in stars and stargazers. Impulsive behaviour and recklessness are commonplace. They fi gure prominently in the entertainment pages and gossip columns of newspapers and magazines, prompting commentators to conjecture about the contagious effects of celebrity culture upon personal health and the social fabric. Do celebrities sometimes get too big for their boots and get involved in social and political issues that are beyond their competence? Can one posit an Icarus complex in some types of celebrity behaviour? This chapter addresses these questions by examining celanthropy and its discontents (notably Madonna’s controversial adoption of two Malawi children); celebrity health advice (Tom Cruise and Scientology); and celebrity pranks (the Sachsgate phone calls involving Russell Brand and Jonathan Ross).

    1 The Other Camp of the Saints: Comparing Christian and Muslim Narratives of Global Expansion in the Modern Era Philip Jenkins 2011 2 The Other Camp of the Saints: Comparing Christian and Muslim Narratives of Global Expansion in the Modern Era My title demands some explanation. In 1973, Jean Raspail published the book The Camp of the Saints, a futuristic fantasy that has subsequently become a cult classic for the far Right on both sides of the Atlantic. Raspail imagines how the Third World's black and brown people invade and overwhelm the White North, which has been rendered defenseless by the rise of gutless Western liberalism. Obviously, I am drawing nothing from the book’s politics, but its underlying ideas do look startling in retrospect. For one thing, it is incredible now to think that a book published so relatively recently would fail to present its apocalyptic thesis in the religious terms that we now find so familiar. In recent years, the book has been quoted ever more widely as Europe’s growing Muslim populations have become more visible, but that Muslim element is nowhere in its pages. The Asian masses of Camp of the Saints are explicitly fighting to erase Europe's failed God, and passages from the biblical book of Revelation are scattered throughout the work; but they have no alternative of their own, and are not fighting for Allah or Krishna. They are waging race war, not jihad. In different ways, the narrative of a West being overwhelmed by the religion of what we would now call the Global South (a term coined in 1980) has subsequently become familiar among both Christians and Muslims.

GREENLEE∗ Introduction In July 1999, the government of the People’s Republic of China (PRC) and the Chinese Communist Party (CCP) began an official crackdown against the qigong cultivation1 group known as Falun Gong.2 Intended to quickly contain and eliminate what the PRC considers an evil or heretical cult (xiejiao), the suppression has instead created the longest sustained and, since the Tiananmen Square protests of June 1989, most widely known human rights protest conducted in the PRC.
